Skvarla, III Secretary On October 1, 2014, staff from the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) inspected Riverside Development in New Hanover County to determine status of compliance with Stormwater Management Permit Number SW8 081209, last issued on January 5, 2009. DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter. As the new owner of this property, Clearly Development, Inc. must immediately request a transfer of the original permit into their name for this project site before moving forward with any additional construction on the property. This law, under certain circumstances, allows a permit transfer without the written consent of the current permit holder. Since the property was in foreclosure, we believe the law will be useful in this case. The transfer of the permit requires that certain conditions be met. These items are listed on the Name/Ownership change form. In addition to the requirement to transfer the permit, we have enclosed the "Compliance Inspection Report" from October 1, 2014, which summarizes the findings of the recent inspection. In summary, the following deficiencies must be resolved: 1. A Name/Ownership Change form must be submitted 2. A signed engineer's certification needs to be submitted for the stormwater system. 3. A copy of the recorded deed restrictions needs to be submitted. 4. Erosion control measures need to be installed and erosion repaired as needed. Furthermore, there are a couple lots just north of Wrightsboro Plaza that need treatment of their stormwater runoff; more specifically, the Advance Auto Parts store and the lot behind it. These lots are owned by Mr. Ronald Hughes. Without treatment of the runoff, Mr. Hughes is in violation for not having a stormwater permit for Advance Auto, which is built. The other lot is still vacant. Please contact Mr. Hughes to discuss and resolve this issue by designing the pond(s) in Riverside Development to handle the runoff from these 2 lots. There is also another undeveloped, wooded lot behind these 2 lots, owned by Wrightsboro Plaza, which may be worth your consideration for inclusion in Riverside Development's pond(s), as it is not covered by a permit either. Therefore on August 30, 2012, the DWQ inspected Riverside Subdivision off of Castle Hayne Rd. Road, in New Hanover County to determine the status of compliance with Stormwater Management Permit Number SW8 081209 issued to you on January 25, 2009. DWQ's file review and site inspection revealed that the stormwater controls have not been installed and built upon area (BUA) has not been constructed on the site. Corrective Actions Needed: Silt fence still needs to be installed along the south side of the roadway as per the approved plan. Additional silt fence needs to be installed around the wetlands pocket in the area of lot 4. Construction entrance needs to be top dressed with #4 stone as per approved plan to prevent dirt from being tracked off -site. Stockpiles were observed on site in the open space behind lot 166. These stockpiles were not shown on the approved plan. Stockpiles need to be sloped a maximum on 2:1 and stabilized within 21 calendar days of cease of any phase of activity. Bypass swale needs additional stabilization. Grass has not yet germinated and the excelsior mat will begin to deteriorate shortly. Bypass swale must be stabilized. A portion of pond 42 was dug at the time of the site inspection. Water was being directed into the dug portion of the pond. This water was turbid and does not appear to be below 50 NTU's and therefore is not allowed to be discharged from the site. A small pipe was installed allowing the pond to outlet into the bypass swale. '['his pipe is not shown on the approved plan and must be removed. 'rile pond can only be discharged by the outlet structure utilizing a floating skimmer as per the approved plan and if the water is below 50 NTU's. Clearing activities were observer on an adjacent lot being performed by the contractor and the material from this lot was being brought onto the site. The contractor as ran over the silt fence along the perimeter of the site to reach the adjacent lot. This area is outside the limits of disturbance and no erosion control has been designed or installed for the clearing of the lot. A revised plan will need to be submitted to this office showing the additional cleared area within 20 working days. A Notice of Violation will be issued.
