Sullins, Director Division of Water Quality August 20, 2007 Jeff Mack, Director of Golf Operations County Club of Landfall 2210 Deer Island Drive Wilmington, NC 28405 Subject: Exemption from Stormwater Management Permit Regulations Landfall Dye Course Improvements Stormwater Project No. SW8 070512 New Hanover County Dear Mr. Mack: The Wilmington Regional Office received a copy of the Sedimentation and Erosion Control application for the subject project. Staff of the Wilmington Regional Office has reviewed the application for the applicability of the Stormwater Management rules to the proposed activity at this project. Based on our review, you do not appear to be proposing a development activity on this site at this point in time that would be subject to the stormwater requirements as provided for in 15A NCAC 2H.1000. Please be advised that other regulations will potentially apply to your proposed activities. If your project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. This exemption applies only to the Coastal Stormwater Management Permit for the currently proposed grading activity. If at any time, construction on or development of any part of this site is planned, as defined in NCAC 2H.1000, including, but not limited to subdivision, sale of the property in whole or in part, or if the proposed activities differ in any manner from what is shown on the plans on file with the Division, then you must submit the project for review of the applicability of the stormwater management rules prior to said construction or development.
