At our meeting on February 24th, we got an update on the treatability study, and discussed the issue in detail providing each of our perspectives on the how to address the treatment of contaminated stormwater. I think we laid out that there is significant concern from citizens redirecting any additional contaminated wastewaters to Badin Lake (i.e. Outfall 012). DWR is also concerned that an SOC would be viewed yet another extension to permit limits Badin Business Park has been obligated to meet for some time. DWR staff is interested in reviewing and discussing solutions to noncompliance with NPDES permit limits. If BBP must run some trial tests or a pilot study to assess what treatment is suited at Outfall 005, no permission is needed from DWR. If BBP needs to separate 005 waste streams to assess what treatment is suited at Outfall 005, DWR is interested in hearing a proposal that splits the waste streams as necessary but still directs the discharges to the 005-receiving stream. Action on such a study would require a written permit modification. Please note, DWR does not see a reason to remove BBP's responsibility for meeting permit limits during these studies. Any treatment, temporary or permanent, should improve the quality of discharge to the unknown tributary. It is BBP's responsibility to present such an option(s) to DWR that move towards a final solution as quickly as possible. We look forward to meeting when we can discuss a solution that meets the above criteria. If a permit modification is needed to proceed to a solution, DWR will act on that written modification request as quickly as possible. Richard Richard E.
