That, Grantors for and in consideration of the sum of Ten Dollars ($10.00) and other valuable
considerations to them in hand paid by the Grantee, the receipt of which is hereby acknowledged, have

Township, Pitt County, North Carolina, and being more particularly
described as follows:
BEING all of Lot 30 as shown on the plat entitled "Fire Tower Commercial
Park — Lot 30" prepared by Baldwin Design Consultants, PA and recorded
at Plat Book 89, Page 50, Pitt County Register of Deeds.

1. Before commencing the construction or alteration of any
buildings, enclosures, fences, loading docks, parking facilities, signs, light
poles, or any other structures on or modifications to the land described above
(the "Land"), the Grantee shall first submit to Shenandoah Investment
Group, LLC, or its assignee (collectively, "Shenandoahas applicable, by
registered mail, the following, as applicable, depending upon the nature of
the work being performed by Grantee: site plans, landscaping plans, and/or
building plans and specifications (the "Plans"). Shenandoah shall have a
one-time right to review the Plans for a period of five (5) business days (the
"Approval Period") and approve the Plans to confirm that the improvements
or modifications to the Land depicted in the Plans are aesthetically appealing
such that the Land, and the improvements located thereon, or to be located
thereon, remain or will be reasonably consistent with the overall nature,
aesthetically, of the surrounding properties at the time the Plans are
submitted to Shenandoah taking into consideration the nature of the
improvements originally constructed by Grantee on the Land. Shenandoah
shall not unreasonably withhold, delay or condition its approval of the Plans
the Approval Period, it shall be conclusively presumed that Shenandoah has
approved the Plans. If Shenandoah rejects the Plans, it shall provide Grantee
with a detailed written statement of the reasons for rejection, shall suggest
revisions that meet Shenandoah's requirements and shall otherwise make
reasonable efforts to aid Grantee in altering the Plans to be acceptable to
Shenandoah. Shenandoah's approval of the Plans shall be final and may not
be rescinded thereafter, provided the improvements are constructed and
maintained in substantial conformity with the approved Plans; provided,
however, Shenandoah acknowledges local governmental authorities may
require Grantee to make certain changes to the Plans as a condition to
Grantee's receipt of such governmental approval and in such instance
Shenandoah shall not have the right to re -review the Plans.

2. Grantee shall at all times keep the premises, buildings,
improvements, and appurtenances on or about the Land in a clean, attractive
condition. Grantee shall remove at their own expense any trash, garbage or
rubbish of any character whatsoever which may accumulate on the Land;
shall replace any dead or diseased plants or other vegetation; and shall
repair and maintain any damage or normal wear and tear adversely
affecting the appearance of the Land.
3. The property herein conveyed may not be used for any ®f the
following purposes:
a® bingo parlor;
® tattoo parlor;
C. new or used automobile sales;
® mobile, modular or manufactured home sales;
e® any adult entertainment business, specifically including
but not limited to, the production, sales, distribution or use of pornographic
materials.
4. No structure of a temporary nature, including but not limited
to a trailer, mobile home, tent, shack, garage, barn or other outbuilding may
days; provided, however, that a trailer or other temporary structure may be
used as an office during the initial construction of improvements on the
property.
5. The rights hereby granted, the restrictions hereby imposed,
and the agreements herein contained, shall be restrictions and covenants
running with the Land; shall inure to the benefit of, and 1• binding upon,
parties hereto and their respective heirs, successors, and assigns; and shall
expire fifteen (15) years from the date hereof.
6. Ilothing in these restrictions shall be construed to prohibit the
construction on the Land or use of the Land as a mini -storage or self -storage
racility.
