Reference has been updated. 5.Expand on this more. What are some examples of "stabilization and dispersal techniques" that EBX intends to utilize? Also, since the issues regarding erosion and active/unstable banks wasn't addressed in the viability letter since it was expected to be addressed as part of the stream restoration plan, DWR needs EBX to make an effort at showing on Figure 4 where the problem areas are anticipated needing to be addressed with these "stabilization and implementation of dispersal techniques". From our site visit, I remember quite a bit of bank erosion and active sediment loss issues. This statement has been updated to “Bank stabilization techniques will include minorgrading and livestake planting in areas where surface flows have become concentrated to minimize the chances of non-diffuse flow.” The use of the term “dispersal techniques” was used in error and has been removed. Additionally Figure 4 was updated to show where the problem areas are located. 6.Add more details to Section 4.4 Other Activities Some additional language was added to this section: “Most of this work will be near the culverts that will be removed at the existing culvert and just downstream of this area. As this is an active cattle farm, the exact locations are always in flux and final locations will be determined prior to construction activities. 7.Add a statement committing to mixing stems prior to planting to maximize diversity of the planted stems. Language has been added to Section 4.5 that states “Prior to planting, stems will bemixed to maximize diversity within the planted community.” res.us 8. Recommend this language or something similar to replace what is currently here: Within 30 calendar days after completing the establishment of the buffer mitigation and nutrient offset areas, the Sponsor will submit written notification to NCDWR documenting that all buffer mitigation and nutrient offset activities have been completed. Failure to submit written notification within 30 days may result in a modified credit release schedule or a delay in the issuance of credit releases. Section 4.7 has been updated to include this recommended language. 9. Why isn't the area adjacent to BS2 proposed as Preservation? I believe it meets all the qualifications/criteria, but it appears to have been missed in the site viability letter. Am i missing or forgetting something? The table has been updated to include preservation credit zones from 20-29 ft and >30 ft. This increased the overall credit amount by 626.091. Language to describe the Preservation Activities was added to Section 4.3. 10. Figure 1: Edit legend. Figure 1 legend and title has been edited to include “For Buffer Mitigation Credits”. 11. Buffer Viability & Stream Determination Appendix B – Conservation Easement Template Appendix C – Agency Correspondence Appendix D – Limited Phase I Environmental Site Assessment Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 3 February 2023 1 INTRODUCTION Environmental Banc & Exchange, LLC (EBX), a wholly owned subsidiary of Resource Environmental Solutions (RES), is pleased to provide this Bank Parcel Development Package (BPDP) for the Bobs Branch Riparian Buffer Mitigation Project (Project) under the proposed RES Bobs Branch Mitigation Banking Instrument in the Randleman Lake Watershed for Riparian Buffer Mitigation Credits that is being made between the Bank Sponsor, EBX, and the NC Division of Water Resources (DWR). The Project (DWR: 2020- 1384v1) is designed to provide riparian buffer mitigation credits for unavoidable impacts due to development within the Randleman Lake Watershed of the Cape Fear River Basin, United States Geological Survey (USGS) 8-digit Hydrologic Unit Code (HUC – 03030003) (Figure 1).The Project is proposing to provide riparian buffer mitigation through the NC Division of Water Resources (DWR) Randleman Lake Riparian Buffer Mitigation program. This Plan is in accordance with the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 and the Randleman Lake Water Supply Watershed Buffer Rule 15A NCAC 02B .0724 and the proposed RES Bobs Branch Mitigation Banking Instrument. 1.1 Parcel Location The Bobs Branch Project is within Cape Fear River Basin within the 8-digit USGS HUC 03030003, 14-digit HUC 03030003010060, and DWR Sub-basin Number 03-06-08. The Project is located in Randolph County approximately two miles northwest of New Market, North Carolina (Figure 1). To access the Project from the town of New Market, NC, travel north approximately one mile on State Road 1009. Turn left on Marlboro Church Road and continue for 0.5 mile. Then turn right onto Old Edgar Road and continue for 0.6 mile to the access road of the project on the right (Figure 2). The latitude and longitude of the access road to the Project is 35.84275°N and -79.8953°W. 1.2 Project Overview The Project consists of one continuous conservation easement that will total approximately 11.52 acres and includes Bobs Branch, a direct tributary to Randleman Lake, and two unnamed tributaries (BS1 and BS2) that drain into Bobs Branch (Figure 3). The Project has a total drainage area of 218 acres (Figure 3) and is located within a semi urban area, and land use within the project area is currently comprised of primarily open pasture with a few pockets of forested area, mostly acting as a living fence line. Historic land disturbance principally includes conventional agricultural practices such as channel manipulation and livestock access. Water quality stressors currently affecting the Project include livestock access and lack of forested riparian buffer areas (Figure 4). The goal of the Project is to restore ecological function to the existing streams and their associated riparian areas by establishing appropriate plant communities while minimizing temporal and land disturbing impacts and permanently protecting the newly restored areas in perpetuity through a conservation easement. Buffer improvements and the removal of livestock will help filter runoff from agricultural fields, thereby reducing nutrient and sediment loads to Project channels and the overall watershed. Immediate water quality benefits and pollutant removal within the vicinity of the Project will include the exclusion of livestock access to streams and reduction in nutrient loads from agricultural land-uses. This Project is Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 4 February 2023 consistent with the management strategy for maintaining and protecting riparian areas in the Randleman Lake watershed. The Project easement can be accessed from Old Edgar Rd off State Road 1009 (Figure 2). The Project area is comprised of riparian areas adjacent to one perennial stream (Bob Branch), two intermittent streams (BS1 and BS2), and an ephemeral channel (upper portion of BS2). Bobs Branch flows west to east. BS1 flows northeast to Bob Branch and BS2 flows north to drain into Bob Branch. All streams have been straightened and incised. Three stream reaches (BS1, BS2 and Bobs Branch) were determined to be subject to the Randleman Lake Watershed buffer protection rules (“Subject”), whereas the upstream section of BS2 was determined to be ephemeral and therefore not subject to the Randleman Lake Watershed buffer protection rules (“Non-subject”). Stream determinations were verified by the DWR during a site visit on rd December 3, 2020. Correspondence regarding this determination is in Appendix A. The Project will provide critical ecological uplift to aquatic and riparian corridors that would otherwise be even further degraded by agricultural uses and continued livestock access. Buffer mitigation efforts along the Project streams will be accomplished through the planting, establishment, and protection of a hardwood forest community. Buffer restoration activities will include fencing and protection through a conservation easement. The result will be a riparian buffer that functions to mitigate nutrient and sediment inputs from the surrounding uplands. The buffer mitigation plan proposed is being submitted for review under the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295. In addition to traditional riparian restoration, the Project will also incorporate the alternative buffer mitigation option: Mitigation on ephemeral channels, as outlined in 15A NCAC 02B .0295 (o) (7). DWR staff performed an onsite viability assessment for buffer mitigation on December 3, 2020. This correspondence is provided in Appendix A. Of the total 11.52 acres in conservation easement, the Bobs Branch Riparian Buffer Project presents the opportunity to provide 433,597.198 riparian buffer mitigation credits. These will be derived from restoration and preservation of the riparian buffer and adjacent riparian areas surrounding the streams and ephemeral channels of the Project and protecting buffers in perpetuity with a conservation easement. For stream channels and ephemeral channels, buffers and other riparian areas will have a minimum width of 30 feet and a maximum of 200 feet from the edge of the channels. There are some small sections where the riparian buffer included in the Project is less than 30 feet due to landowner parcels (Figure 5). These widths are measured from the start of top of bank and extend perpendicularly landward from the top of bank. The new plant community will be established in conjunction with the treatment of any existing exotic or undesirable plant species. Figure 5 shows the Conceptual Design for Riparian Buffer Map and Section 4 provides details of the mitigation determination on the Bobs Branch Riparian Buffer Mitigation Project. 1.2.1 Parcel Ownership The land required for the construction, management, and stewardship of this mitigation project includes portions of the parcels listed in Table 1 EBX, LLC has obtained a legal option to develop the mitigation project and establish a permanent conservation easement on the necessary area on the subject parcels. Once recorded, the secured easements will allow EBX to proceed with the Project development and protect the mitigation assets in perpetuity. The Mitigation Banking Conservation Easement Template for Buffer & Nutrient Offset Sites (provided by DWR with slight modifications) will be utilized to draft the site protection Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 5 February 2023 instrument. Once recorded, the secured easements will allow EBX to proceed with the Project development and protect the mitigation assets in perpetuity. Spencer & Gina Rae Spencer 7736536035 Randolph 2 EXISTING CONDITIONS 2.1.1Surface Water Classification The Project area includes unnamed tributaries to Bob Branch, which eventually drains to the Deep River (now the Randleman Lake) by way of Bob Branch. The current State classifications for Bob Branch is Water Supply IV (WS-IV) and Class C. Classification WS-IV refers to waters that are used for consumption, culinary or food processing purposes. These waters are generally in moderately to highly developed watersheds or Protected Areas. Class C waters have protections supporting “secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological integrity, and agriculture. Secondary recreation includes wading, boating, and other uses involving human body contact with water where such activities take place in an infrequent, unorganized, or incidental manner” (NCDEQ, 2020). 2.1.2 Physiography and Soils The site is located in the Southern Outer Piedmont level IV ecoregion within the Piedmont level III ecoregion. With lower elevations and less relief compared to other areas of the Piedmont, the landforms of this ecoregion consist of irregular, rolling plains. The geologic composition of the region is red, clayey subsoils underlain by deep saprolite and gneiss, schist, and granite bedrock. Interspersed throughout the region are also areas of diabase, diorite, or gabbro bedrock that form alkaline soils. Natural vegetation communities consist of mixed oak forests, while historic land use trends have promoted the establishment of loblolly and shortleaf pine forests (USEPA). The Natural Resource Conservation Service (NRCS) depicts three soil mapping units across the Project (Figure 6). The map units and soil characteristics are summarized in Table 2. The map units are Chewacla and Wehadkee soils, 0 to 2 percent slopes, frequently flooded, Mecklenburg loam, 8 to 15 percent slopes, Mecklenburg clay loam, 2 to 8 percent slopes, moderately eroded and Mecklenburg clay loam, 8 to 15 percent slopes, moderately eroded. The mapped soil data presented here are for reference only. Additional work will be conducted as needed to support the project. (Figure 4). 2.1.4 Landscape Communities A. Existing Vegetation Communities Currently, the land use in the vicinity of the Project is primarily actively grazed pasture and forested pasture. The pasture is dominated by pasture grasses with the presence of other herbaceous species like fescue grass (Festuca sp.), dogfennel (Eupatorium capifollium), and common rush (Juncus effuses). Very few trees are on-site except for scattered Eastern red cedar (Juniperus virginiana), sweet gum (Liquidambar styraciflua), and American elm (Ulmus americana). Some herbaceous plants have established themselves in many parts of the stream channels and banks on-site, including an identified species of Persicaria, and very few occurrences of a Rumex species. Invasive species are also present throughout, including Chinese privet (Ligustrum sinense) and Japanese stiltgrass (Microstegium vimineum). The site viability letter from DWR in Appendix A provides details on land-uses within the Project riparian areas. Current conditions demonstrate significant habitat degradation because of impacts from agriculture, livestock in particular, and historic land uses (Figure 7). The area within the Project has been used as cattle pasture since at least 1980. There are forested areas located to the west and northeast of the Project area. At some point, between the years of 1993 and 2006, a CAFO (Concentrated Animal Feeding Operation) was constructed adjacent to the Project area. B. Riparian Vegetation In general, the stream features within the Project abut grazed pasture and forested pasture that have little to no existing riparian buffer and do not function to their full potential. Current conditions Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 7 February 2023 demonstrate significant habitat and water quality degradation with a loss of stabilizing vegetation because of impacts from active pastureland. BS1 is a short reach that runs through a pasture and eventually flows into BB1. Generally, the reach lacks a riparian buffer and the stream banks of BS1 contain short, herbaceous vegetation and no woody vegetation. BS2 runs northward through pasture that lacks a riparian buffer, barring a few mature trees along the banks throughout the reach and eventually flows into BB1. Some understory native and invasive species are also present in this area around the base of the trees. Generally, the stream banks contain short, herbaceous vegetation with some areas containing woody vegetation. Most tree species present on this reach are sweet gum and Eastern red cedar. BB1 is a named stream that runs eastward through pasture along the landowner parcel line. The reach lacks riparian buffer, with a few mature trees along the bank throughout. Some understory and invasive species are present including Chinese privet along the reach around the base of the trees. In addition, The Bald eagle (Haliaeetus leucocephalus) is protected under the Bald and Golden Eagle Protection Act (BGPA) and prohibits take of bald and golden eagles (Table 3). In addition to the USFWS database, the North Carolina Natural Heritage Program (NCNHP, 2020) GIS database was consulted to determine whether previously cataloged occurrences of protected species were mapped within one mile of the project. Results from NHP indicate that there is one known occurrence of state threatened or endangered species within a one-mile radius of the project area (NHP, 2020). This occurrence is for the Schweinitz’s sunflower, a species of the Aster family. No protected species or potential habitat for protected species was observed during preliminary site evaluations. A survey conducted for the Schweinitz’s sunflower on October 12, 2021 confirmed there are no individuals on site. Based on initial Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 9 February 2023 site investigations, no impacts to state protected species are anticipated as a result of the proposed project. A letter from the USFWS dated April 14, 2021 indicated that minimal adverse impacts to fish and wildlife resources are expected as part of the project. Documentation is included in Appendix C. RES has evaluated the Parcel’s existing and future conditions of cultural resources to determine potential project impacts. A review of the North Carolina State Historic Preservation Office (SHPO) website was reviewed to determine if any listed or potentially eligible historic or archeological resources in the proposed Bobs Branch Site existed. This search did not reveal any occurrence within the project area. In addition, the search did not reveal any registered occurrence of any possible historic or archeological resources within a mile of the proposed project area. A letter from SHPO dated April 6, 2021 stated that no known historic resources would be affected by the project. Documentation is included in Appendix C. 3.3 Federal Emergency Management Agency (FEMA) Floodplain/Hydrologic Trespass The project is not within a FEMA regulatory floodway (Figure 4) and therefore no FEMA permitting will be required for this project as currently designed. Hydrologic trespass is not anticipated for the project and will not be permitted to adjacent properties upstream or downstream of the Project. 3.4 Clean Water Act - Section 401/404 Due to the nature of this Project, there will be no 401/404 permit required. 3.5 Additional Environmental Considerations A limited Phase I Environmental Site Assessment was completed for the Parcel by acquiring an Environmental Date Resources (EDR) report in July 2022. The report can be found in Appendix D. Neither the target property nor the adjacent properties were listed in any of the Federal, State, or Tribal environmental databases searched by EDR. There are no known or potentially hazardous waste sites identified within or immediately adjacent to the project area. 4 R IPARIAN RESTORATION AND PRESERVATION IMPLEMENTATION PLAN Riparian restoration and preservation areas adjacent to streams and ephemeral channels are shown in Figure 5 and mitigation types were determined by the DWR in the Site Viability Letter dated February 16, 2021 (Appendix A). Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 10 February 2023 4.1 ParcelPreparation Preparation at the Project will involve spraying undesired fescue grass and exotic invasive species; contoured ripping, seeding, and planting. Specifically, a vigorous invasives species treatment for privet will occur along Bobs Branch. Livestock will be excluded from the entire easement area by installing a permanent fence. Bank stabilization techniques will include minor grading and livestake planting in areas where surface flows have become concentrated to minimize the chances of non-diffuse flow. A seed mix will be chosen to maximize successful herbaceous growth in all riparian areas while also incorporating valuable pollinator species (Table 5). All riparian planting areas will be seeded using a no-till drill prior to tree planting or broadcast seeded depending on the season of planting. Temporary and permanent riparian seeding, and bare root plantings will be planted according to the planting plan (Section 4.5). The limits of the riparian restoration areas will be surveyed post-planting and seeding, and information will be provided in the As-Built report. 4.2 Methods Vegetation within riparian areas can vary depending on disturbance regime and adjacent community types, so the protected buffer easement will be planted with appropriate native species observed in the surrounding forest and species known to occur in similar environments (Section 4.5). 4.3 Riparian Restoration and PreservationActivities For stream and ephemeral channels, the Project will provide buffer mitigation through riparian restoration activities in accordance with the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 (n) and incorporate the alternative buffer mitigation option: Mitigation on ephemeral channels, as outlined in 15A NCAC 02B .0295 (o) (7). Riparian restoration activities will include the planting of bare root plantings as described in Section 4.5. All restoration activities will begin from the tops of the stream or ephemeral channel banks and extend a minimum of 30 feet from the stream outward to a maximum of 200 feet perpendicular and landward to the stream channel (Figure 8). The proposed conservation easement includes riparian areas adjacent to streams and the ephemeral channel. Restoration will occur where non- forested pasture is currently present (Figure 5). Preservation will take place in limited forested areas within the Project where existing tree growth was determined adequate, and in in accordance with the alternative mitigation option of Consolidated Buffer Mitigation Rules 15A NCAC 02B .0295 (o)(4) and (5) and the DWR buffer viability assessment (Appendix A). Specifically, the ephemeral portion of Reach BS2 contain forested areas that will be preserved (Figure 4). Furthermore, restoration and preservation will entail the permanent protection of the riparian area from cutting, clearing, filling, grading, and similar activities that would affect the functioning of the riparian areas through a conservation easement that will have clearly visible easement markers and signs (see Section 4.5 for further description of the easement boundaries). The upper portion of one of the stream features, BS2, is an ephemeral channel. As per the rule, ephemeral channels are natural channels with discernable banks observable within crenulations on a USGS 7.5-minute topographic map (Figure 3). Moreover, the entire area proposed for buffer mitigation credit along the upper portion of BS2 is located within the contributing drainage area to the ephemeral channel and is Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 11 February 2023 directly connected to an intermittent reach downstream (Figure 3, Figure 4, and Figure 5). The channel will be contiguously contained within the conservation easement areas of the Project. 4.4 Other Activities Other activities involved with the Project include minor bank stabilization effortsalong reach BS2, including grading and live staking where stream bank stability is compromised, such as erosional rills and side cuts. Most of this work will be near the culverts that will be removed at the existing culvert crossing at the Ephemeral/Intermittent transition point on BS2 and just downstream of this area. As this is an active cattle farm, the exact locations are always in flux and final locations will be determined prior to construction activities. An additional culvert will be removed along BS1, and stabilization and grading will occur where this removal occurred. 4.5 Planting Plan All riparian restoration areas will be planted from top of bank back at least 30-feet from the tops of stream banks with bare root tree seedlings on nine by six-foot spacing to achieve an initial density of 800 trees per acre. Prior to planting, stems will be mixed to maximize diversity within the planted community. Bare root plantings and live stakes shall be planted according to the planting plan. Live stakes will be planted in areas on BS2 where grading will occur. Planting of the Project where riparian buffer restoration is being performed will meet the performance standards outlined in the Rule 15A NCAC 02B .0295. The vegetation data will be collected no earlier than late August of each year. This includes treating invasive species and planting at least four species of native hardwood bare root trees. A Piedmont Alluvial Forest will be the target community type and will be used for all areas within the project. The community is defined by Schafale (2012). The initial planting of bare root trees will occur after construction is complete before Spring 2023. Wherever possible, mature vegetation will be preserved and incorporated into the buffer. Tree species specified for planting on the Bobs Branch Project are shown in Table 4. Please note that the real compositions of planted trees may differ from this proposed list due to availability; however, the procured trees will ideally be comprised of species from the list. With that said, the minimum number of unique species to be planted in each planting zone across the Project will be seven. Wherever possible, mature vegetation will be preserved and incorporated into the buffer. Some areas adjacent to the forested areas may require maintenance due to the rapid regeneration of some species, such as red maple (Acer rubrum) and sweetgum (Liquidambar styraciflua). The live stake plantings mentioned above will consist of black willow (Salix nigra) and silky dogwood (Cornus amomum). Table 4. Boundaries may be identified by cattle fence, marker, bollard, post, tree-blazing, or other means as allowed by site conditions and/or conservation easement. Boundaries will be marked with signs identifying the property as a mitigation site and will include the name of the long-term steward and a contact number. These boundary markers will be installed prior to the DWR as-built site visit in order to satisfy the Task 2 milestone. Boundary markers disturbed, damaged, or destroyed will be repaired and/or replaced on an as needed basis. The easement boundary will be checked annually as part of monitoring activities and the conditions as well as any maintenance performed will be reported in the annual monitoring reports to DWR. 4.7 Post-Establishment Notification Within 30 calendar days after completing the establishment of the buffer mitigation and nutrient offset areas, the Sponsor will submit written notification to NCDWR documenting that all buffer mitigation and nutrient offset activities have been completed. Failure to submit written notification within 30 days may result in a modified credit release schedule or a delay in the issuance of credit releases. This will be in accordance with the RES Bobs Branch Mitigation Banking Instrument. Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 13 February 2023 5 MONITORING AND MAINTENANCE PLAN 5.1 Monitoring Protocol and Success Criteria Riparian vegetation monitoringwhere buffer mitigation credits are being generated will be based on the “CVS-EEP Protocol for Recording Vegetation: Level 2 Plot Sampling Only Version 4.2”. Annual vegetation monitoring will occur each year for a minimum of five (5) years and will be conducted during the fall season with the first year occurring at least 6 months from initial planting. Monitoring plots will be installed a 2 minimum of 100 min size and will cover at least two percent of the planted mitigation area. The planted area is 10.77 acres, and there will be 9 fixed vegetation plots measuring riparian buffer mitigation success. These plots will be randomly placed throughout the planted riparian area and will be representative of the riparian community (Figure 9). The following data will be recorded for all trees in the plots: species, common name, height, planting date (or volunteer), and grid location. All stems in plots will be flagged with flagging tape. The measures of vegetative success for the Project will be the survival of at least four native hardwood tree species, where no one species is greater than 50 percent of stems, at a density of at least 260 stems per acre at the end of Year 5. Desirable native volunteer species may be included to meet the performance standards upon approval by DWR. Invasive and noxious species will be monitored and treated so that none become dominant or alter the desired community structure of the site. Photos will be taken from all photo points each monitoring year and provided in the annual reports. Visual inspections and photos will be taken to ensure that restoration and preservation areas are being maintained and compliant. A visual assessment of the cattle exclusion areas within the conservation easement will also be performed each year to confirm: Fencing is in good condition throughout the site; no cattle access within the conservation easement area; no encroachment has occurred; diffuse flow is being maintained in the conservation easement area; and there has not been any cutting, clearing, filling, grading, or similar activities that would negatively affect the functioning of the buffer. A summary of Project monitoring and maintenance activities can be found in Table 6. Table 6. Boundaries may be identified by fence, marker, bollard, post, tree-blazing, or other means as allowed by Project conditions and/or conservation easement. Boundary markers disturbed, damaged, or destroyed will be repaired and/or replaced on an as- needed basis. Easement monitoring and staking/ signage maintenance will continue in perpetuity as a stewardship activity. 5.2 Adaptive Management Plan and Parcel Maintenance Adaptive measures will be developed, or appropriate remedial actions taken if in the event that the site, or a specific component of the site, fails to achieve the defined success criteria. Remedial actions will be designed to achieve the success criteria specified in this Plan, and will include identification of the causes of failure, remedial design approach, work schedule, and monitoring criteria that will take into account physical and climatic conditions. Initial plant maintenance may include a one-time mowing, prior to initial planting to remove undesirable species. If mowing is deemed necessary by EBX during the monitoring period, EBX must receive approval by the DWR prior to any mowing activities to ensure that no buffer violations have been performed. Failure to receive approval to mow within the Randleman Lake buffer, as defined in 15A NCAC 02B .0233, by the DWR could result in Randleman Lake buffer violations and violations of the conservation easement. If necessary, RES will develop a species-specific control plan. 6 LONG TERM MANAGEMENT PLAN EBX, acting as the Bank Sponsor, will record a Conservation Easement with the Randolph County Register of Deeds Office for this site. The Conservation Easement is intended to be assigned to North Carolina Wildlife Habitat Foundation (NCWHF). All monitoring activities, including periodic inspections of the site to ensure that restrictions required in the Conservation Easement are upheld, are the responsibility of EBX until the Project is transferred to NCWHF. Endowment funds required to uphold the Bobs Branch Bank Parcel conservation easement in perpetuity shall be negotiated prior to site transfer to NCWHF. Bobs Branch Buffer Mitigation Plan Riparian Buffer Project 15 February 2023 The Bank Sponsor will ensure that the Conservation Easement has allowed for the implementation of an initial monitoring phase, which will be developed during the design phase and conducted by the Bank Sponsor. The Conservation Easement will allow for yearly monitoring and, if necessary, maintenance of the Parcel during the initial monitoring phase. These activities will be conducted in accordance with the terms and conditions of the RES Bobs Branch Riparian Buffer MBI made and entered into by EBX and DWR. 7 FINANCIAL ASSURANCE The Sponsor will provide financial assurances in the form of Performance Bonds sufficient to assure one hundred percent (100%) completion of all mitigation work, required reporting and monitoring, and any remedial work required. Financial assurances will be payable at the direction of the DWR to its designee or to a standby trust. Financial assurances structured to provide funds to the DWR in the event of default by the Bank Sponsor are not acceptable. The initial performance bond will be in the amount of at least $150,000 and shall be able to cover 100% of the costs associated with construction of the riparian restoration areas. The monitoring bond shall be in the amount of at least $100,000 and shall be able to cover 100% of the costs associated with the monitoring and maintenance of the riparian restoration areas for five years. Performance bonds for monitoring shall be renewed to cover the next years monitoring period, with confirmation of renewal provided to DWR with each annual monitoring report when applicable. DWR reserves the right to alter the credit release schedule if monitoring reports are submitted without proof of bond renewals when applicable. 8 PROJECTS CREDIT POTENTIAL 2 This Project has the potential to generate approximately 10.47 acres (33597.198 ft) of riparian buffer 2 restoration credits on existing non-forested cattle pasture and 0.08 acres (3,268 ft) of riparian buffer preservation credits on existing forested areas. The riparian buffer mitigation credits generated will service the Randleman Lake Watershed buffer impacts. The Sponsor will maintain one credit ledger for Buffer Restoration. All mitigation credit assets shall be shown on the credit ledger. The total potential mitigation credits that the Bobs Branch Riparian Buffer Mitigation Project will generate are summarized in Table 7; Figure 5. The site visit was to determine the potential for riparian buffer mitigation within a proposed Easement Boundary, which is more accurately shown in the attached map labeled “Bob’s Branch Overview” (Figure 1). On December 3, 2020, Ms. Merritt performed a site assessment of the subject site. Staff with EBX were also present. This site is also being proposed as a stream or wetland project. ARTICLEII. PROHIBITED AND RESTRICTED ACTIVITIES Any activity on, or use of, the Conservation Easement Area inconsistent with the purpose of this Conservation Easement is prohibited. The Conservation Easement Area shall be preserved in its natural condition and restricted from any development that would impair or interfere with the conservation values of the Conservation Easement Area. Without limiting the generality of the foregoing, the following activities and uses are expressly prohibited, restricted or reserved as indicated hereunder: A. Disturbance of Natural Features. Any change disturbance, alterationor impairment of the natural features of the Conservation Easement Area or any introduction of non-native plants and/or animal species is prohibited. B. Construction. There shall be no constructing orplacing of any building, mobile home, asphalt or concrete pavement, billboard or other advertising display, antenna, utility pole, tower, conduit, line, pier, landing, dock or any other temporary or permanent structure or facility on or above the Conservation Easement Area. C. Industrial, Commercial and Residential Use. Industrial, residential and/or commercial activities, including any rights of passage for such purposes are prohibited. D. Agricultural, Grazing and Horticultural Use. Agricultural, grazing, animal husbandry, and horticultural use of the Conservation Easement Area are prohibited. E. Vegetation. There shall be no removal, burning, destruction, harming, cutting or mowing oftrees, shrubs, or other vegetation in the Conservation Easement Area except as provided in the BPDP. Mowing of invasive and herbaceous vegetation for purposes of enhancing planted or volunteer trees and shrubs approved in the BPDP is allowable once a year for no more than five consecutive years from the date on page 1 of this Conservation Easement, except where mowing will negatively impact vegetation or disturb soils. Mowing activities shall only be performed by the Bank Sponsor and shall not violate any part of Item L of Article II. F. Roads and Trails. There shall be no construction of roads, trails or walkways on the Conservation Easement Area; nor enlargement or modification to existing roads, trailsor walkways. G. Signage.No signs shall be permitted on or over the Conservation Easement Area, except the posting of no trespassing signs, signs identifying the conservation values of the Conservation Easement Area, signs giving directions or proscribing rules and regulations for the useof the ConservationEasementArea and/or signs identifying theGrantorasowneroftheConservationEasementArea. H. Dumping or Storage. Dumping or storage of soil, trash, ashes, garbage, waste, abandoned vehicles, appliances, machinery or hazardous substances, or toxic or hazardous waste, or any placement of underground or aboveground storage tanks or other materialson the Conservation EasementAreais prohibited. I. Excavation, Dredging or Mineral Use.There shall be no grading, filling, excavation, dredging, mining or drilling; no removal of topsoil, sand, gravel, rock, peat, minerals or other materials, and no change in the topography of the land in any manner on the Conservation Easement Area, exceptto restore natural topography or drainage patterns. . J. Water Quality and Drainage Pattern.There shall be no diking, draining, dredging, channeling, filling, leveling, pumping, impounding or related activities, or altering or tampering with water control structures or devices, or disruption or alteration of the restored, enhanced, or created drainage patterns. In addition, diverting or causing or permitting the diversionof surface or underground water into, within or out of the easement area by any means, removal of wetlands, polluting or discharging into waters, springs, seeps, or wetlands, or use of pesticide or biocides is prohibited. K. Development Rights. No development rights that havebeen encumbered or extinguished by this Conservation Easement shall be transferred pursuant to a transferable development rights scheme or cluster development arrangement or otherwise. L. Vehicles. The operation of mechanized vehicles, including, but not limited to, motorcycles, dirt bikes, all-terrain vehicles, cars and trucks is prohibited other than for temporary or occasional access by the Enter Sponsor Name, the Grantee, its employees and agents, successors, assigns,and the NCDWR for purposes of constructing, maintaining and monitoring the restoration, enhancement and preservation of streams, wetlands and riparian areas within the Conservation EasementArea.. M. Other Prohibitions. Any other use of, or activity on, the Conservation Easement Area which is or may become inconsistent with the purposes of this grant, the preservation of the Conservation Easement Area substantially in its natural condition, or the protection of its environmental systems, is prohibited. ARTICLE III GRANTOR’S RESEVERED RIGHTS The Grantor expressly reserves for himself, his personal representatives, heirs, successors or assigns, the right to continue the use of the Conservation Easement Area for all purposes not inconsistent with this Conservation Easement, including, but not limited to, the right to quiet enjoyment of the Conservation Easement Area, the rights of ingress and egress, the right to hunt, fish, and hike on the Conservation Easement Area, the right to sell, transfer, gift or otherwise convey the Conservation Easement Area, in whole or in part, provided such sale, transfer or gift conveyance is subject to the terms of, and shall specifically reference, this Conservation Easement. Notwithstanding the foregoing Restrictions, Grantor reserves for Grantor, its successors and assigns, including acting as the Bank Sponsor, the right to construct and perform activities related to the restoration, enhancement, and preservation of riparian areas within the Conservation Easement Areain accordance with the approved _ BPDP, and the UMBI describedin the Recitals of this Conservation Easement. ARTICLE IV. GRANTEE’S RIGHTS The Granteeor its authorized representatives, successors and assigns and NCDWR, shall have the right to enter the Property and Conservation Easement Area at all reasonable times for the purpose of inspecting the Conservation Easement Area to determine if the Grantor, or his personal representatives, heirs, successors, or assigns, is complying with the terms, conditions, restrictions, and purposes of this Conservation Easement. The Grantee, Enter Sponsor Name, and its authorized representatives, successors and assignsand NCDWR shall also have the right to enter and go upon the Conservation Easement Area for purposes of making scientific or educational observations and studies, and taking samples. The easement rights granted herein do not include public access rights. ARTICLE V ENFORCEMENT AND REMEDIES A. To accomplish the purposes of this Easement, Grantee, and NCDWR are allowed to prevent any activity on or use of the Conservation Easement Area that is inconsistent with the purposes of this Easement and to require the restoration of such areas or features of the Conservation Easement Area thatmay be damaged by such activity or use. Upon any breach of the terms of this Conservation Easement by Grantor that comes to the attention of the Grantee, the Grantee shall notify the Grantor in writing of such breach. The Grantor shall have 30 days after receipt of such notice to correct the conditions constituting such breach. If the breach remains uncured after 30 days, the Grantee may enforce this Conservation Easement by appropriate legal proceedings including damages, injunctive and other relief. Notwithstanding the foregoing, the Grantee reserves the immediate right, without notice, to obtain a temporary restraining order, injunctive or other appropriate relief if the breach of the terms of this Conservation Easement is or would irreversibly or otherwise materially impair the benefits to be derived from this Conservation Easement. The Grantor and Grantee acknowledge that under such circumstances damage to the Grantee would be irreparable and remedies at law will be inadequate. The rights and remedies of the Grantee provided hereunder shall be in addition to, and not in lieu of, all other rights and remedies available to Grantee in connection with this Conservation Easement. The costs of a breach, correction or restoration, including the Grantee’s expenses, court costs, and attorneys’ fees, shall be paid by Grantor, provided Grantor is determined to be responsible for the breach. The NCDWR shall have the same rights and privileges as the said Grantee to enforce the terms and conditions of this Conservation easement.. B. No failure on the part of the Grantee to enforce any covenant or provision hereof shall discharge or invalidate such covenant or any other covenant, condition, or provision hereof or affect the right to Grantee to enforce the same in the event of a subsequent breach or default. C. Nothing contained in this Conservation Easement shall be construed to entitle Grantee to bring any action against Grantor for any injury or change in the Conservation Easement Area resulting from causes beyond the Grantor’s control, including, without limitation, fire, flood, storm, war, acts ofGod or third parties, except Grantor’s lessees or invitees; or from any prudent action taken ingood faith by Grantor under emergency conditions to prevent, abate, or mitigate significant injury to life, damage to property or harm to the Conservation Easement Area resulting from such causes. ARTICLE VI MISCELLANEOUS A. Warranty. Grantor warrants, covenants and represents that it owns the Property in fee simple, and that Grantor either owns all interests in the Property which may be impaired by the granting of this Conservation Easement or that there are no outstanding mortgages, tax liens, encumbrances, or other interests in the Property which have not been expressly subordinated to this Conservation Easement. Grantor further warrants that Grantee shall have the use of and enjoy all the benefits derived from and arising out of this Conservation Easement, and that Grantor will warrant and defend title to the Property against the claims of all persons. B. Subsequent Transfers. The Grantor agrees to incorporate the terms of this Conservation Easement in any deed or other legal instrument that transfers any interest in all or a portion of the Conservation Easement Area. The Grantor agrees to provide written notice of such transfer at least sixty (60) days prior to the date of the transfer. The Grantor and Grantee agree that thetermsof this Conservation Easement shall survive any merger of the fee and easement interests in the Conservation Easement Area or any portion thereof and shall not be amended, modified or terminated without the prior written consent and approval of the NCDWR. C. Assignment. The parties recognize and agree that the benefits of this Conservation Easement are in gross and assignable provided, however that the Grantee hereby covenants and agrees, that in the event it transfers or assigns this Conservation Easement, the organization receiving the interest will be a qualified § 501 (c)(3) holder pursuant to 33CFR 332.7 (a)(1), N.C. Gen. Stat. § 121-34 et seq. and and § 170 (h) of the Internal Revenue Code, and the Grantee further covenants and agrees that the terms of the transfer or assignment will be such that the transferee or assignee will be required to continue in perpetuity the conservation purposes described in this document. D. Entire Agreement and Severability. The combined Mitigation Banking Instruments: MBI with corresponding Mitigation Plan, and MBI with corresponding BPDP, and this Conservation Easement sets forth the entire agreement of the parties with respect to the Conservation Easement and supersedes all prior discussions, negotiations, understandings or agreements relating to the Conservation Easement. If any provisionis found to be void or unenforceable by a court of competent jurisdiction, the remainder shall continue in full force and effect. E. Obligations of Ownership. Grantor is responsible for any real estate taxes, assessments, fees, or charges levied upon the Property. Grantor shall keep the Property free of any liens or other encumbrances for obligations incurred by Grantor. Grantee shall not be responsible for any costs or liability of any kind related to the ownership, operation, insurance, upkeep, or maintenance of the Property, except as expressly provided herein. Nothing hereinshallrelieve the Grantor oftheobligation to comply with federal, state or local laws, regulations and permits that may apply to the exerciseof the ReservedRights. F. Long-Term Management. If livestock operations will be maintained on the property, Grantor is responsible for all long-term management activities associated with fencing to ensure livestock do not have access to the Protected Property. These activities include the maintenance and/or replacement of fence structures, asdeemed necessary by the Grantee, to ensure the aquatic resource functions within the boundaries of the Protected Property are sustained. G. Extinguishment. In the event that changed conditions render impossible the continued use of the Conservation Easement Area for the conservation purposes, this Conservation Easement may only be extinguished, in whole or in part, by judicial proceeding. H. Eminent Domain. Wheneverall or part of the Conservation Easement Area is taken in the exercise of eminent domain so as to substantially abrogate the Restrictions imposed by this Conservation Easement, Grantor and Grantee shall join in appropriate actions at the time of such taking to recover the full value of the taking, and all incidental and direct damages due to the taking. I. Proceeds. This Conservation Easement constitutes a real property interest immediately vested in Grantee. In the event that all or a portion of the Conservation Easement Area is sold, exchanged, or involuntarily converted following an extinguishment or the exercise of eminent domain, Grantee shall be entitled to the fair market value of this Conservation Easement as determined at the time of the extinguishment or condemnation. J. Notification. The wetlands, scenic, resource, environmental, and other natural characteristics of the Conservation Easement Area, and its current use and state of improvement, are described in Section f theBPDP, prepared by Bank Sponsor and acknowledged by the Grantor and o Grantee to be complete and accurate as of the date hereof. Both Grantor and Grantee have copies of this report. Sincerely, Pete Benjamin, for Field Supervisor cc:NMFS, Beaufort, NC EPA, Atlanta, GA WRC, Raleigh RE: Helianthus schweinitzii Survey at Bobs Branch Mitigation Site, Randolph County, NC A plant survey for the federally listed Schweinitz’s sunflower, Helianthus schweinitzii (Fed E, State E | S2 G3), was conducted on October 12, 2021 at the Bobs Branch Stream, Wetland, and Riparian Buffer Mitigation Project (a Federal-Aid project (FHWA lead agency) administered by the North Carolina Division of Mitigation Services), located near Sophia, NC in Randolph County. H. schweinitzii is endemic to the Piedmont regions of North and South Carolina, historically being centered around Charlotte, NC and Rock Hill, SC. Suitable habitat for H. schweinitzii includes disturbed areas with full-partial sun exposure such as roadsides and powerline cuts; historically, it has occurred in dry, open woodlands and Piedmont prairies. In North Carolina, the known distributions of H. schweinitzii occur in Surry, Stokes, Catawba, Gaston, Rowan, Davidson, Randolph, Mecklenburg, Cabarrus, Stanly, Montgomery, Union, Anson, and Richmond counties. This species faces threats including alteration of native habitat, fire suppression, roadside/utility right-of- way maintenance, invasive species encroachment and other anthropogenic impacts. The current land conditions within the Bobs Branch site include a small portion of forested riparian area along Bob Branch, while the rest of the site is active cattle pasture, lacking a well-developed understory and shrub strata. The riparian areas most closely resemble a disturbed dry basic oak forest, including eastern red cedar (Juniperus virginiana), post oak (Quercus stellata), willow oak (Quercus phellos), winged elm (Ulmus alata), sweet gum (Liquidambar styraciflua), red maple (Acer rubrum), persimmon (Diospyros virginiana) and green ash (Fraxinus pennsylvanica). The pasture is dominated by dogfennel (Eupatorium capillifolium), panicled aster (Symphyotrichum lanceolatum), fescue grass (Festuca sp.), pokeweed (Phytolacca americana), and common rush (Juncus effusus). The survey team including Emily Ulman and Hannah Gadai, visited a reference population for H. schweinitzii on October 12, 2021 at a roadside population of roughly 35 stems near Sophia, NC, about two miles west of the project site; coordinates are 35.841785, -79.900592. The surveying team had reviewed elemental occurrence data provided by the NC Natural Heritage Program (NHP) and had a dichotomous key for the genus Helianthus, adapted from Schilling (2006) and Weakley (2008). The survey team has performed rare plant surveys in the past for threatened and endangered plant species throughout North Carolina. At the Bobs Branch site, the surveying team walked along the boundary and within the easement recording species present and any occurrences of potential suitable habitat. Because this site was mainly dominated by pasture grass and active cattle grazing, there was minimal likelihood that H. schweinitzii would be alive and present. Most of the herbaceous layer had either been eaten or trampled. After a thorough examination of the area and an assessment of the habitat present, no suitable habitat was located and therefore, no populations were found at this project site. In conclusion, after conducting a more thorough evaluation of the habitat present at the Bobs Branch Mitigation Site and surveying for H. schweinitzii specifically, we have determined that there is no suitable habitat present, therefore, we are changing the conclusion on the species conclusion table on the self-certification letter from may affect to no effect on any H. schweinitzii populations. Moving forward, as the habitat is improved and restored to mimic the natural conditions of the original landscape, there is potential to create and foster suitable habitat for H. schweinitzii throughout the Bobs Branch Mitigation Site.
