PO Box 398 Atlantic Beach, NC 28512 Subject: REQUEST FOR RECORDED DEED RESTRICTIONS Kingsbridge Stormwater Project No. SW8 890414 Onslow, County Dear Mr. Youngblood: Alan W. Klimek, P.E. Director Division of Water Quality On June 19, 1989, you were issued a Certification of Compliance with Stormwater Regulations, No. 890414 for the subject project. As stated in the Stormwater Rules, 2H.1003(g)(9): Deed restrictions and protective covenants are used to ensure that subdivisions maintain development consistent with the plans and specifications approved by the Division and will include the State as a beneficiary. A review of our files indicates that a copy of the recorded deed restrictions has not been received. If the deed restrictions have been recorded, please submit a copy of the recorded document to this Office by September 21, 2006, which includes the three (3) italic statements below. If the deed restrictions have not been recorded, you must notify all the lot owners of this requirement, they must all sign an amendment to the deed restrictions, and you must record the amendment and send a copy to the Division. Per your signed letter to Mark Hawes dated May 19, 1989, copy attached, the following statements must be recorded: "These covenants are intended to insure continued compliance with stormwater runoff rules adopted by the State of North Carolina and therefore, benefits may be enforced by the State of North Carolina. " "No more than 2,500 square feet of any lot shall be covered by structures and/or paved surfaces, including walkways or patios of brick, stone, slate or similar materials. " "No structures and /or paved surfaces, including walkways or patios shall be placed within 30 feet of the mean high water line of SA waters. " Failure, to record the required deed restrictions is considered to be a violation of the above referenced Stormwater Rules, and subject to enforcement action. A copy of the recorded deed restrictions, including the'allowable built -upon area per lot, must be received no later than September 21, 2006 in order to avoid possible penalties. Listed below are steps that I recommend you take to bring the subject site into compliance. 1) State Stormwater Permit SW8 890414 - The stormwater pipe installed between Lots 4 and 5 was not approved by DWQ. It is the understanding of this office that the pipe was installed more than 10 years ago. Either remove the pipe or request a modification of the SW Permit to include the pipe. If you decide to try to modify the SW Permit, justification for the pipe should be included. Some considerations may be the reason the pipe was installed, the length of time it has been in place, adjacent property owner concerns, lack of an easement, note that agreement to record deed restrictions did not include restrictions on pipe installation (in 1989), pictures of vegetated grass swales discharging into inlet of pipe (no curb outlets), distance of pipe outlet from Queen's Creek,etc. 2) In addition, it appears that some of the lots have built upon area (BUA) in excess of the allowed built upon area permitted under SW8 890414. As part of that permit, you agreed to record deed restrictions limiting the BUA to 2500 square feet per lot. After reviewing the file, it appears that you may be able to modify the SW Permit and allocate more built upon area to all or some of the lots provided that the total wetland area within the project site is not in excess of 25%. Currently, the total impervious surface proposed for the entire project including roads is approximately 14% but 25% is allowed under the current regulations(note no impervious allocation was given to common areas and this must also be calculated in). Modifying the BUA involves modifying the SW Permit ($420 fee plus two copies app, calcs, and plans) and amending the existing deed restrictions. For the lots that you no longer own within Kingsbridge II, owners' signatures on the amended restrictions may be required. 3) The plans that DWQ and DLR have do not include a 404 wetland delineation. Please contact Brad Shaver of the USACE at 910-251-4611 and make arrangements to obtain a current Jurisdictional Determination for the project site and provide a copy of the site plans with the new JD with the SW Permit modification package and to Janet Russell of DLR. As previously noted The Wilmington Regional Office approved your submittal for 25% low density development for Kingsbridge Properties II lots numbered 1 through 104 on June 19, 1989. This approval excluded the western portion of the initial plans submitted February 14. 1986. It is our understanding that the ponds sized for two 100 year back to back storms have been filled. This office requests that you clarify your intentions for the western portion of the plot. If you do not have an intention of building any impervious surfaces on this area in the near future and are not selling lots, then a letter stating as such would satisfy this request. This information should be received by this office no later than May 4, 1990.
