Wayne County Dear B&B Partnership: On October 19, 2022, the Division received your response to the Division's request for additional information related to your permit renewal request. In your email conveying the submission to the Division you indicated that the entirety of the 500 plus page submission was to be considered confidential but provided no basis for the confidentiality claim. North Carolina General Statute § 143-215.3C provides that information received by the Division shall be available to the public except on a showing that the information is entitled to trade secret protection under N.C. General Statute § 132-1.2. Since we received your submission, we have reached out to your counsel multiple times to ascertain which parts of the submission you are claiming are confidential and the basis for that claim of confidentiality. To date, we have received no response to those inquiries. Within thirty days of receipt of this letter, please submit a confidential version and a publicly viewable version of your response to the additional information request in the following format: 1. A confidential version with no redactions and clear labels of which information is confidential and the statutory/legal basis for asserting confidentiality. 2. A publicly viewable version with only the confidential information redacted.
