DEVELOPER AGREEMENT
1. DEVELOPMENT AGREEMENT WILL BE REQUESTED FOR THOROUGHFARE ROADWAY IMPROVEMENTS TO
GREEN LEVEL CHURCH ROAD ASSOCIATED WITH IMPROVEMENTS BEYOND THE TRANSPORTATION PLAN
REQUIREMENTS.
CARY COMMUNITY PLAN REQUIRED TRANSPORTATION IMPROVEMENTS
1. GREEN LEVEL CHURCH ROAD - PERFORM FRONTAGE WIDENING ON THE WEST SIDE OF GREEN LEVEL CHURCH
ROAD CONSISTENT WITH THE TOWN OF CARY THOROUGHFARE PLAN TO PROVIDE AN ADDITIONAL SOUTH
BOND THROUGH LANE AND A 10-FOOT STREET SIDE TRAIL.
2. FEE -IN -LIEU PAYMENT FOR HALF THE MEDIAN OF THE ULTIMATE ROADWAY SECTION.
COMMITTED TRANSPORTATION IMPROVEMENTS
1. REFER TO THE OFFSITE ROADWAY PLANS FROM KIMLEY-HORN
THE FOLLOWING MINOR MODIFICATIONS TO THE TOWN'S DEVELOPMENT STANDARDS HAVE BEEN APPROVED IN ACCORDANCE WITH SECTION 3.19 AND
OTHER APPLICABLE SECTIONS TO THE LDO.
1. GRADING WITHIN GREEN LEVEL CHURCH ROAD 50 FOOT STREETSCAPE
JUSTIFICATION -AS A RESULT OF WIDENING GREEN LEVEL CHURCH ROAD FOR OF 4-LANE TYPICAL SECTION WITH A 1O' STREET SIDE TRAIL,
APPROXIMATELY 50% OF THE STREETSCAPE ALONG GREEN LEVEL CHURCH ROAD WILL BE PARTIALLY DISTURBED TO CONSTRUCTION THE REQUIRED
TRANSPORTATION IMPROVEMENTS. DISTURBED AREAS WILL BE REVEGETATED TO COMPLY WITH STANDARDS FOR A 50' WIDE TYPE A STREETSCAPE.
2. CHAMPION TREE REMOVAL (1 TIER 1 TREE)
JUSTIFICATION - SPACING REQUIREMENTS FOR THE PROPOSED SITE ACCESS ON GREEN LEVEL CHURCH ROAD IS RECOMMENDED TO BE AT LEAST
600-FEET FROM THE INTERSECTION WITH FUSSELL AVENUE. THE PROPOSED SITE ACCESS IS LOCATED 700-FEET FROM FUSSELL AVENUE AND CANNOT
BE SHIFTED TO AVOID DISTURBANCE OF THE CHAMPION TREE'S CRITICAL ROOT ZONE. LDO SECTION 7.2.5(4) PROVIDES INCENTIVES AND DESIGN
FLEXIBILITY FOR PRESERVING EXISTING HEALTHY TREES AND FOREST STANDS LOCATED OUTSIDE OF BUFFERS, STREETSCAPES, AND FLOODPLAINS.
AN APPROX. 250' X 50' FOREST STAND ON -SITE SHALL BE PRESERVED AS PRIVATE PERMANENT OPEN SPACE INCLUDING A 22" RED OAK 25" WHITE OAK
20" RED OAK„ AND 26" WHITE OAK IN EXCHANGE FOR THE FLEXIBILITY TO REMOVE THE CHAMPION TREE.
3. STREET CONNECTIVITY
JUSTIFICATION TO NOT STUB CHIPLEY DRIVE TO EXISTING SEAHORSE COURT TO THE SOUTH AND EAST -WEST BETWEEN ALSTON LANDING WAY AND
CHIPLEY DRIVE:
• AT THE TIME THE PROPERTY WAS REZONED, THE APPLICANT NOTED THAT IT INTENDED TO REQUEST A CONNECTIVITIY WAIVER BASED ON THE
IMPACT TO THE STREAM AND WETLANDS REQUIRED BY A ROADWAY EXTENSION. THE REQUEST WAS SUPPORTED BY WATERFORD ESTATES
RESIDENTS IN PUBLIC TESTIMONY BEFORE THE PLANNING BOARD AND TOWN COUNCIL.
THE WAIVER WILL NOT ADVERSELY IMPACT PUBLIC SAFETY OR INFRASTRUCTURE.
• BOTH WATERFORD ESTATES AND ALSTON LANDING HAVE THE REQUIRED NUMBER OF ACCESS POINTS TO COMPLY WITH SECTION 7.10.3(B)(2) OF
THE LDO. THEREFORE, THE REQUESTED WAIVER WILL NOT HAVE AN IMPACT ON PUBLIC SAFETY.
• BY ELIMINATING THE ROAD CONNECTION BETWEEN CHIPLEY DRIVE AND SEAHORSE COURT, THE PHYSICAL SITE CONSTRAINTS OF THE EXISTING
SHALLOW SANITARY SEWER WILL NOT BE IMPACTED. THEREFORE, THE REQUESTED WAIVER WILL NOT HAVE AN IMPACT ON PUBLIC
INFRASTRUCTURE
THE WAIVER WILL MAINTAIN THE INTENT AND PURPOSE OF THE LDO.
• THE ENVIRONMENTAL IMPACTS TO THE WETLANDS BETWEEN CHIPLEY DRIVE AND BOTH SEAHORSE COURT AND ALSTON LANDING WAY IDENTIFIED
ON THE USACE JURISDICTIONAL DETERMINATION DATED 9/18/20 ARE ELIMINATED.
• SIGNIFICANT TREE PRESERVATION OUTSIDE REQUIRED RIPARIAN BUFFER AREAS IS POSSIBLE WITHOUT THE DISTURBANCE THAT WOULD BE
REQUIRED FOR THE STREET CONNECTIONS.
• A PEDESTRIAN CONNECTION IS PROVIDED WITH A 6-FOOT WIDE ASPHALT TRAIL BETWEEN THE TWO COMMUNITIES WHICH WILL ALLOW RESIDENTS
FROM WATERFORD ESTATES TO WALK TO ALSTON RIDGE ELEMENTARY SCHOOL LOCATED TO THE NORTHEAST ON FUSSELL AVENUE.
4. MINIMUM DRIVEWAY SEPARATION
JUSTIFICATION REDUCE THE MINIMUM DRIVEWAY SEPARATION OF 3.5-FEET TO 1.5-FEET FOR PROPOSED FRONT LOADED TOWNHOMES TO THE PROPERTY
LINE TO ALLOW FOR DRIVEWAY ACCESS TO THE PROPOSED 1-CAR GARAGE UNITS:
• AT A MINIMUM, THE DRIVEWAYS AND GARAGES WILL BE ADEQUATE FOR MEETING THE LDO OFF-STREET PARKING REQUIREMENTS FOR TOWNHOMES
WITH 2-BEDROOMS.
• DRIVEWAYS WILL BEGIN TO TAPER FROM A 15-FEET WIDTH THAT IS THE SAME SIZE AS THE GARAGE OPENINGS AT 16-FEET FROM THE MINIMUM
20-FOOT BUILDING SETBACK TO A WIDTH OF 13.5 FEET AT THE FIGHT -OF -WAY TO MAINTAIN A DISTANCE OF 7-FEET FOR STORAGE OF A 2.5' X 2.5'
GARBAGE AND RECYCLING CONTAINERS WITH 2-FEET SPACING BETWEEN.
• IN ALL CASES, DRIVEWAYS SHALL BE 1.5-FEET FROM THE LOT LINE. IT SHOULD BE NOTED THAT GARBAGE AND RECYCLING CONTAINERS SHALL BE
PLACED ON THE EXTERIOR SIDE OF THE DRIVEWAYS FOR END UNITS.
• ALL REAR LOADED TOWNHOMES WILL MAINTAIN A 3.5-FOOT CLEARANCE BETWEEN THE 15-FOOT WIDE DRIVEWAYS AND LOT LINES. IT SHOULD BE
NOTED THAT GARBAGE AND RECYCLING CONTAINERS SHALL BE PLACED ON EACH SIDE OF THE INTERIOR UNIT DRIVEWAYS.
THE WAIVER WILL NOT ADVERSELY IMPACT PUBLIC SAFETY OR INFRASTRUCTURE.
• THE DRIVEWAYS WERE DESIGNED TO MAINTAIN VEHICULAR AND PEDESTRIAN SAFETY WITH A STRAIGHT PATH TO THE GARAGE.
• DRIVEWAY WIDTHS HAVE BEEN REDUCED FROM 17-FEET TO 15-FEET FOR LESS OVERLAP OF THE SIDEWALK TO ENHANCE PEDESTRIAN SAFETY.
• THE DRIVEWAY DESIGN AVOIDS CONFLICTS WITH WATER METERS AND SEWER CLEANOUTS IN THE DRIVEWAY.
THE WAIVER WILL MAINTAIN THE INTENT AND PURPOSE OF THE LDO.
• IN ORDER TO CREATE A STRONG PRESENCE ALONG THE PUBLIC STREETS, THE FRONT -LOADED UNITS ARE DESIGNED WITH A PROMINENT ENTRY TO
OFFSET THE WIDTH OF THE GARAGE AND THE STREETSCAPE WILL MEET THE CURRENT LDO REQUIREMENTS.
• GRASS WILL BE PLANTED BETWEEN ALL DRIVEWAYS. THE HOMEOWNERS ASSOCIATION (HOA) WILL BE RESPONSIBLE FOR MAINTENANCE OF THESE
GRASS AREAS AND THE FRONT YARDS.
• ADEQUATE PARKING IS PROVIDED FOR EACH TOWNHOME IN THE DRIVEWAY AND GARAGE WITH ADDITIONAL VISITOR PARKING DISTRIBUTED EVENLY

1. UNLESS EXPLICITLY SPECIFIED IN THE NOTES ON THIS DEVELOPMENT PLAN, THE DEVELOPMENT OF THIS PROJECT, INCLUDING ANY SUBSEQUENT
DEVELOPMENT PLANS, SHALL COMPLY WITH THE CARY LAND DEVELOPMENT ORDINANCE (LDO) AND ALL OTHER APPLICABLE REGULATIONS AND
GUIDELINES. IN THE EVENT OF A DISCREPANCY BETWEEN THIS APPROVED DEVELOPMENT PLAN AND THE APPLICABLE REGULATIONS OR
GUIDELINES, AND ABSENT PLAN OR OTHER RELATED APPROVAL, THE APPLICABLE REGULATIONS OR GUIDELINE SHALL APPLY.
2. NO CHANGES TO ANY ASPECT OF THIS DEVELOPMENT PLAN, INCLUDING BUT NOT LIMITED TO, LANDSCAPING, GRADING, ARCHITECTURAL DESIGN
(ESPECIALLY COLORS), LIGHTING, OR UTILITIES SHALL BE MADE WITHOUT THE APPROVAL OF THE DEVELOPMENT REVIEW COMMITTEE OF THE TOWN
OF CARY.
3. THE ESTABLISHMENT OF PERMANENT GROUND COVER WILL BE ESTABLISHED IN 15 WORKING DAYS OR 90 CALENDAR DAYS, WHICH EVER IS FIRST.
4. THE DEVELOPER WILL BE RESPONSIBLE FOR ALL INSTALLATION COSTS ASSOCIATED WITH STREET LIGHTING ALONG PROPOSED STREETS,
ADJACENT STREETS AND THOROUGHFARES AS REQUIRED PER TOWN OF CARY POLICY STATEMENT NO.13. THE DEVELOPER SHALL CONTACT DUKE
ENERGY -PROGRESS AFTER PLAN APPROVAL AND PRIOR TO CONSTRUCTION IN ORDER TO DEVELOP A STREET LIGHTING PLAN FOR THE
SITE/SUBDIVISION PLANS.
5. THE GRADING PERMIT WILL NOT BE ISSUED UNTIL THE TOWN OF CARY HAS RECEIVED NOTIFICATION FROM THE ECOSYSTEM ENHANCEMENT
PROGRAM OR AN APPROVED NUTRIENT OFFSET BANK THAT A RECEIPT HAS BEEN ISSUED TO THE DEVELOPER AND THE LOCAL GOVERNMENT
STATING THE NITROGEN BUY -DOWN HAS BEEN COMPLETED IF REQUIRED.
6. ALL STRUCTURES WITHIN THE BOUNDARIES OF THE SITE REQUIRE INDIVIDUAL PERMITS FROM THE TOWN OF CARY INSPECTIONS AND PERMITS
DEPARTMENT. THIS WOULD INCLUDE RETAINING WALLS, BOARDWALKS, MAIL KIOSKS, AND ENTRY SIGNS.
7. ALL PROPOSED LANDSCAPING SHOULD BE PLANTED OUTSIDE THE SIGHT DISTANCE EASEMENTS SHOWN ON THE PLAN SHEETS IN SUCH A WAY THAT
SHRUBS/TREES DO NOT ENCROACH INTO THE SIGHT DISTANCE EASEMENTS SHOWN. ANY PLANTING THAT GROWS INTO THE SIGHT DISTANCE
EASEMENT SHOULD BE MAINTAINED WELL UNDER 3.5' TO ENSURE SAFE INTERSECTION SIGHT DISTANCE PER AASHTO IS PROVIDED AT ALL TIMES.
8. THE APPLICANT HEREBY OFFERS AND CONSENTS TO INCLUSION OF ALL IMPROVEMENTS AND COMMITMENTS SHOWN ON THIS DEVELOPMENT PLAN.
9. SIGN PERMITTING IS A SEPARATE APPROVAL PROCESS AND HAS NOT BEEN REVIEWED OR APPROVED WITH THIS DEVELOPMENT PLAN.
10. THE PROPERTY OWNER SHALL BE REQUIRED TO REPLACE, IN ACCORDANCE WITH SECTION 7.2.5(E) OF THE LAND DEVELOPMENT ORDINANCE, ANY
CHAMPION TREE RETAINED IN THIS PLAN THAT DIES WITHIN ONE YEAR OF THE COMPLETION OF DEVELOPMENT ACTIVITY ON THE PROPERTY.
11. TREES IDENTIFIED AS REPLACEMENTS FOR CHAMPION TREES TO BE REMOVED FROM THE SITE SHALL BE, PER SECTION 7.2.5(E) OF THE LDO,
MAINTAINED THROUGH AN ESTABLISHMENT PERIOD OF AT LEAST THREE YEARS, EXCEPT THAT REPLACEMENT TREES LOCATED ON INDIVIDUAL
DETACHED DWELLING LOTS SHALL BE MAINTAINED THROUGH AN ESTABLISHMENT PERIOD OF ONE YEAR. REPLACEMENT TREES THAT DO NOT
SURVIVE THE ESTABLISHMENT PERIOD SHALL BE REPLACED BY THE DEVELOPER.
12. THE DEVELOPER WILL BE RESPONSIBLE FOR ALL INSTALLATION COSTS ASSOCIATED WITH STREET LIGHTING ALONG THE PROPOSED STREETS,

13. FIRE PROTECTION DURING CONSTRUCTION: THE FIRE PROTECTION WATER SUPPLY SYSTEM, INCLUDING FIRE HYDRANTS, SHALL BE INSTALLED AND
BE IN AT LEAST THE FUNCTIONAL STATUS PRIOR TO PLACING COMBUSTIBLE MATERIALS ON THE PROJECT SITE. IF PHASED CONSTRUCTION IS
PLANNED, COORDINATED INSTALLATION OF THE FIRE PROTECTION WATER SUPPLY SYSTEM IS PERMITTED. COORDINATION OF THE WATER SYSTEM
