The revisions include the expansion of the driveway at the intersection of Carl Street and Racine Drive to accommodate longer turn lanes and a proposed traffic signal. A total of 1,672 ft2 of built -upon area is proposed while 2,214 ft of existing built -upon area has been converted to landscape area, for a net BUA reduction of 542 ft2. It has been determined that a formal permit modification is not required for the proposed changes. We are forwarding you an approved copy of the plans for your files. Please add these approved plan sheets to the previously approved set. Please be aware that all terms and conditions of the permit issued on June 15, 2000, remain in full force and effect. Please also understand that the approval of this revision to the approved plans for the subject State Stormwater Permit is done on a case -by - case basis. Based on the fact that the Kohl's Store has to open in February or they walk away from the deal, you and Rick agreed to expedite the State Stormwater Review process to the best of your ability so we can attempt to meet our permit approval target date which would be July 9, 2003. We are requesting coverage under the existing stormwater permit based the fact that when we submit for review and approval the current Permittee, Smith Creek Station, LLC, will be the owner of the subject property. Outparcel 2 and outparcel 5 which is beside the Texas Roadhouse. I am getting ready to submit a Soho Japanese Steakhouse on outparcel 5 next to the Texas Roadhouse for your review. When the shopping center was originally permitted by me the two outparcels noted above had a 50' right of way between them that was a part of the shopping center. The permit for Smith Creek Station Shopping Center SW8 970105 and the deed restrictions that go with the permit list the outparcels at 90% impervious coverage non inclusive of the 50' right of way between them. The 50' right of way was included in the shopping center impervious area. Somewhere along the way the owners put a new map on record for the shopping center removing the 50' right of way, selling 25' to each adjacent outparcel (outparcel 2 & 5). Therefore outparcel 2 & 5 and the deed restrictions are not correct in permit SW8 970105 as it currently exists. This will hold up the approval of the SOHO Japanese Steakhouse. I am hoping that the Smith Creek Station Permit can be administratively rewritten with the approval of the SOHO Japanese Steakhouse. To do this I would submit a letter signed by the current Smith Creek Station Permittee requesting that the permit be administratively rewritten, a copy of the current record property map for the shopping center and outparcels as they currently exist along with revised deed restrictions for the outparcels. The total impervious areas listed in permit SW8 970105 for each pond would remain the same. The impervious areas for outparcel 2 & 5 would increase slightly due to each acquiring an additional 25' of property from the 50' right of way. The impervious area for the remaining shopping center, which is not built out, would decrease slightly due to the removal of the 50' right of way. However, as stated above the total impervious areas listed in permit SW8 970105 for each pond would remain the same. The above is similar to what we agreed to do at Junction Creek Business Park. I am hoping we can do the same for Smith Creek Station. I have faxed you a copy of this e-mail with copies of the old and new record map for your review.
