II, Regal Hill & Tinley Estates at Carolina Plantations High Density Subdivision Wet Detention Pond / Constructed Wetland Onslow County Dear Mr. Sydes: Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this modified permit references DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete, modified State Stormwater Management Permit Application for Great Neck Section IIA and IIB, Regal Hill and Tinley Estates at Carolina Plantations on September 24, 2014, with final information received on January 7, 2015. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 21-1.1000. We are forwarding modified Permit No. SW8 100714 dated February 5, 2015, for the construction of the built -upon areas and BMP's associated with the subject project. The modifications covered by and incorporated into this permit are: 1. Development plans for Tinley Estates, the previously designed "Future Multi -family Section", are added to the approved plan set. 2. The project name has been changed to remove "Future Multi -family Section" and add "Tinley Estates". 3. The multi -family area is now 23 single family lots. 4. In Pond #1, the future BUA allocation has been reduced by a total of 9,512 sf for the addition of sidewalks. The future BUA allocation available for Pond #1 is now 5,488 sf. 5. In Pond #2, the future BUA allocation has been reduced by a total of 156,069 sf for the development of Tinley Estates and the addition of sidewalk. The future BUA allocation available for Pond #2 is now 115,931 sf. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of up to four (4) years extension. Accordingly, this permit, which was set to expire on October 13, 2020, shall now be effective from the date of issuance until December 31 '2021, which includes all available extensions. The permittee and the project shall be subject tot a con rtions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, certification of the BMP's, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to certify the BMP's, to transfer the permit, or to renew the permit, will result in future compliance problems. This permit shall be effective from the date of issuance until December 31, 2021 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Sections 1.7 and 1.8 of this permit. The subdivision is permitted for 141 lots, each limited to a maximum amount of built -upon area as indicated in Section 11.20 (f) of this permit. There are 90 lots in Great Neck Section II; 28 lots in Regal Hill; and 23 lots in Tinley Estates. The stormwater controls designated as Pond 1, Pond 2, and Wetland 3, have been designed to treat the runoff from 310,600, 670,170, and 35,750 square feet of built -upon area, respectively. 3. The tract will be limited to the amount of built -upon area indicated in Sections 1.2 and 1.7 of this permit, and per approved plans. The built -upon area for the future development within the drainage areas of Pond 1 and Pond 2 is limited to 5,488 and 115,931 square feet, respectively. This permit does not provide any allocation of built -upon area for future development within the drainage area of Wetland 3. 4. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control systems. A 50' wide vegetative buffer must be provided and maintained adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the banks of each side of streams and rivers and the mean high water line of tidal waters. The wet detention pond(s) may not be located within the buffer and no built -upon area is allowed within the buffer. 6. All runoff being directed into wetlands shall flow into and through those wetlands at a non -erosive velocity. 7. SCHEDULE OF COMPLIANCE No homeowner/lot owner/developer shall alter the approved stormwater management system, or fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a modification or revision to the permit and receiving approval from the Division. 2. The permittee is responsible for routine monitoring of the project's built -upon area and verifying that the built -upon area for the entire project and for each lot does not exceed the maximum allowed by this permit. Once the lot transfer is complete, the lot owner may not increase the built -upon area above the permitted maximum for that lot without approval from both the permittee and the Division. The permittee shall not approve any requests for additional built -upon area over and above the permitted maximum on any lot without first submitting for and receiving a permit modification from the Division. The permittee must maintain compliance with the overall BUA limit for the project established by this permit, the permit documents and the recorded deed restrictions. If any lot is found to have exceeded the permitted BUA limit for that lot without the approval of the Division and the permittee, the permittee shall notify the lot owner in writing and require resolution. 4. The permittee shall review all proposed new and modified lot plans for compliance with the BUA limit. The plans reviewed must include all proposed built -upon area. The permittee shall not approve any plans that exceed the maximum allowed BUA limit. Any approvals given by the Permittee do not relieve the permittee or the lot owner of the responsibility to maintain compliance with the BUA limit established by the permit and in the recorded deed restrictions. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 6. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 7. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further development, subdivision, acquisition, or sale of any, all or part of the project area. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. e. The construction of any future BUA allocation listed on the application. 8. The Director may determine that other revisions to the project should require a modification to the permit. 9. Access to the approved stormwater management system for inspection and maintenance must be provided. All stormwater collection and treatment systems must be located in a right-of-way, a dedicated common area or a recorded easement. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. 10. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 11. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 13. The permittee shall at all times provide and perform the operation and maintenance items as specified in the signed Operation and Maintenance agreements, to assure that all components of the permitted stormwater system function at optimum efficiency. The approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals. 14. Records of maintenance activities must be kept by the permittee. The records will indicate the date, activity, name of person performing the work and what actions were taken. 15. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 16. Prior to transfer of the permit, the stormwater facilities must be inspected by DEMLR personnel. The project and the stormwater facility must be in compliance with all permit conditions. Any items not in compliance must be repaired, replaced or restored to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 17. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away frorr the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in Pond and 2 is 1/3 and 3/4 HP, respectively. 18. If permeable pavement credit is desired, the permittee must submit a request to modify the permit to incorporate such language as required by the Division of Water Quality. The request to modify must include a soils report identifying the type of soil, the Seasonal High Water Table elevation and the infiltration rate. Upon the successful completion of a permit modification, the individual lot owners that request to utilize permeable pavements shall submit the necessary forms and documentation to the permittee, or a designated agent, and receive approval prior to construction of the permeable pavement. Page 7 of 11 State Stormwater Management Systems Permit No. SW8 100714 19. Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 100714, as modified and reissued by the Division of Energy, Mineral and Land Resources under NCAC 02H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. f. The maximum built upon area per lot is as follows: 90 lots - Lots 142-231 Great Neck Section II @4,500 sf; 28 lots - Lots 247-274 Regal Hill @3,500 sf; 23 lots - Lots 1-23 Tinley Estates @4,500 sf This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters, which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. h. Built -upon area in excess of the permitted amount will require a permit modification. 20. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves a request to transfer the permit. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement procedures as set forth in North Carolina General Statute 143, Article 21. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. The application form, supplement forms, and approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The permittee shall maintain a copy of the approved plans and specifications on file at all times. 11. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006- 246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 12. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Permit modified and reissued this the 5ch day of February 2015. Regarding the application, I need to find out if a mailing address change has occurred as well as a project name change. The previous permit was sent to PO Box 7122, but the modified permit application only provides a street address with no indication of a different mailing address. Is the PO Box mailing address no longer being used? If so, the Name/Ownership Change form should also reflect that change. The narrative states that Great Neck 11 and Regal Hill are built -out, and the wetland that treats the runoff from some of those lots in DA #3 will be finished soon. If the permitted wetland BMP is not completed yet, then how is the runoff from those completed high density lots treated? I also have concerns with the deed restrictions. The Master Declaration was recorded on January 25, 2011. This document provides a list of definitions for terms which are used throughout the document, including Article I, Subsection 1.25 for "Permit". This definition indicates that the stormwater permit number is SW8 100510, when in fact the correct permit number is SW8 100714. It appears that SW8 100510 is the permit number for the adjacent development, Great Neck Section I, Crown Park, Bentley Place and The Burroughs, and that the restrictions for SW8 100714 were simply copied over from that previously prepared document, but failed to change the permit number. The permittee will need to file an amendment to the Master to correct the referenced permit number. In addition, you will need to add ALL the other deed restriction statements as listed in the previous permit in Section 11.20 (note that the modified permit will list these requirements in Sec. 11.19) . Alternatively, while you are amending the "Permit' definition in the master to correct the permit number, you could include a reference to the specific section number in the permit that contains the missing deed restriction statements and then record a copy of the full modified permit as an attachment to that amendment. Limiting BUA is just one piece of the overall compliance puzzle. All the other deed restriction statements listed in the permit need to be included as an amendment or included as a reference in the Definitions section of the master declaration. The modified permit cannot be issued until we are assured that the required deed restrictions are corrected and recorded. All three phases encompass 63.79 acres, and are located in the Northeast section of the Carolina Plantations development (East of the wastewater treatment plant). Also, an unnamed tributary draining to Half Moon Creek (C; NSW) serves as part of the South property line dividing Great Neck Section I from Section 11. Since the time the permit was issued, Great Neck Section II and Regal Hill have been built out completely, and 2 out of the 3 stonmwater BMPs have been constructed and certified (the stormwater wetlands to be finished soon). The 9.91 acre remaining section for future multi -family townhomes has also been changed to be single family residential homes. This new section called "Tinley Estates" will consist of 23 lots, and is now designed and ready for construction. The purpose of this modification is to add Tinley Estates to the existing permit. The project area for Tinley Estates is currently undeveloped land that has been timbered. The existing topography is very flat (< 12" change across property). The project will be located within an area consisting mostly of Lynchburg fine sandy loam according to the Onslow County Soil Survey. Tinley Estates will connect to the existing drainage network from Regal Hill and Great Neck Section II that drain into Wet Detention Basin 42. This stormwater BMP is located near the WWTP, and was designed for full build out of Regal Hill, a portion of Great Neck - Section 11, and the former multi -family section that is now Tinley Estates (See Overall Stormwater Exhibit Map). This future area has been planned as part of the Carolina Plantations Development, and is located between the Regal Hill and Great Neck Section 11 subdivisions. A large area of404 wetlands is also located immediately West of the project boundary. The ditch network for this area is proposed as a temporary measure to lower the water table and ease operations for potential construction in the winter / early spring. A comparison with Wet Detention Basin #2 (Pond #2) in the Great Neck Section 11 subdivision verifies that the proposed ditch network will not cause potential impacts to wetlands. Pond #2 is located in Great Neck Section 11, and is designed to treat stormwater from part of Great Neck 11 and all of Regal Hill and the future multi -family area (includes full build out). All stormwater information pertaining to these areas is referenced in DWQ Stormwater Permit No. SW8 100714 approved October 13, 2010. Because of the pond's proximity to nearby wetlands, we were required to evaluate if it would cause impacts due to dewatering. Our soil scientist used the Skaggs Method to determine how far Pond #2 needed to be from the wetlands before it negatively impacted (drained) the wetlands. This horizontal distance was based on factors pertaining to the type of soils in conjunction with the difference in elevation of the wetlands and the pond's permanent pool elevation. Since the centerline of the ditch is the wetlands boundary, this is the elevation used for the model to assure the wetlands will not be impacted. If the pond does not affect the conditions at the center of the wetlands ditch, the wetlands will not be affected. Final results concluded that as long as the permanent pool elevation (44.50) for Pond #2 was 32.9 ft. away from the existing ditch centerline, the wetlands would not be affected. As shown on the Grading, Drainage, and Erosion and Sedimentation Control Plan for the Future Multi -Family Section, the existing Pond #2 permanent pool is located 90 LF from the outfall ofthe proposed ditch network. Because of similar soil conditions and proximity to Pond #2, it is a safe assumption that the ditch network parameters are comparable to those of Pond #2 to evaluate wetland impacts. All elevations of the entire ditch network are above the pond's permanent pool elevation. Also, 1595 LF out of the 1600 LF ditch network is greater than 32.9' horizontally from the wetlands. The remaining 5 LF is a result of having to tie the ditch outfall into the existing drainage network. Even so, the 5 LF is still 0.3' higher than the permanent pool elevation of 44.50, and is only 29' fi-om the wetlands. McDaniel, PE FUTURE MULTI -FAMILY SECTION ✓U� i at CAROLINA PLANTATIONS Erosion and Sediment Control Narrative At Carolina Plantations in Onslow County, there is an undeveloped section located in the Northeast corner of the project. This 10.06 acre tract is located immediately North of Great Neck Section 11 (ONSLO-201 1 -009) off of Oldtowne Street, West of Regal Hill (ONSLO-201 1- 007) off Sonoma Road, and East of a large area of 404 wetlands (See USGS map). This area' will eventually be developed for residential use and during the winter and spring months it experiences high water table conditions. To accommodate future construction and grading operations (not planned at this time), our client would like to use an open ditch drainage system to lower the groundwater within the property. When this area is designed in the future, we will submit a modified erosion control plan with associated fee for the additional disturbance. The site has long been cleared of timber, and the existing topography is very level (does not change 0.5' across entire property). This phase of the project will involve an area of land disturbance totaling 3.69 acres and according to the Onslow County Soil Survey, the limits of disturbance will be located within an area consisting entirely of Lynchburg fine sandy loam. As described in the Soil Survey, the proposed ditch network will help reduce wetness conditions that put limitations on construction operations. All the ditches are interconnected and will ultimately discharge to an existing 36" RCP stubbed out from a yard inlet that drains to wet detention basin 42 located in Great Neck, Section I1. To prevent the transport of sediment off -site from land disturbing activities, several erosion control measures will be used. The existing silt fence installed during construction for Regal Hill will accommodate this phase of disturbance to prevent impacts to offsite wetlands. The existing wire mesh and gravel inlet protection on all of the existing yard inlets will prevent any sediment from entering the existing stormwater pipe network. Both points of access (off Sonoma Road and Oldtowne Street) will have stabilized construction entrances to prevent sediment from leaving the site via truck traffic. The ditch network will incorporate two sediment traps with rock check dams to allow suspended sediment in runoff flows to settle before clean flows are slowly discharged to the existing wet detention basin. Also, the flat topography of this area greatly reduces any threat of erosion control issues.
