Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 081222 dated January 19, 2012, for the construction of the subject project. This permit shall be effective from the date of issuance until February 27, 2019, and shall be subject to the conditions.and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. Please replace plan sheets C-0.0, C-1.2 and the cover sheet with the new enclosed plan set. This permit shall be effective from the date of issuance until February 27, 2019, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 3,675 square feet of impervious area. The system must be operated with a 50' vegetated filter. 4. The tract will be limited to a total of 10,049 square feet of built -upon area. Of this total, 6,374 is existing, pre-1988 built -upon area that is not being collected or treated. The remaining 3,675 square feet of built -upon area is being collected and treated in the proposed sand filter, as indicated in Section 1.8 on page 3 of this permit, and the approved plans. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. Page 2 of 8 State Stormwater Management Systems Permit No. SW8 081222 6. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. 7. The post-1988 proposed built -upon areas associated with this project shall be located at least 50 feet landward of all perennial and intermittent streams. 8. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 5. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 6. Records of maintenance activities must be kept for each permitted BMP. The records will indicate the date, activity, name of person performing the work and what actions were taken. 7. The permittee shall submit to the Division of Water Quality an annual summary report of the maintenance and inspection records for each BMP. The report shall summarize the inspection dates, results of the inspections, and the maintenance work performed at each inspection. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 081222 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form to the Division of Water Quality, signed by both parties, and accompanied by the supporting documentation as listed on page 2 of the form. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2008- 211, Title 15A NCAC 21-1.1000, and NCGS 143-215.1 et.al. The permittee shall notify the Division in writing of any name, ownership or mailing address changes at least 30 days prior to making such changes. 12. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Permit issued this the 19th day of January, 2012. SUBMITTAL REQUIREMENTS Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ). A complete package includes all of the items listed below. A detailed application instruction sheet and BMP checklists are available from http:///portal.ncdenr.org/web/wq/ws/su/statesw/forms dots. The complete application package should be submitted to the appropriate DWQ Office. (The appropriate office may be found by locating project on the interactive online map at h� //12ortal.ncdenr.org/web/wq/ws/su/maps.) This data is based on soils investigations conducted at the site to identify seasonal high water table (SHWT) and infiltration rate. The measures designed in this report have adequate capacity to control and treat runoff from the impervious surfaces required upon completion of this project. 2.0 PROJECT NARRATIVE a) Project Description Pump Station 35 is located on Oleander Drive at Bradley Creek and is currently contained on two neighboring properties. This pump station is one of the Cape Fear Public Utility Authority's largest pump stations and this project will provide greater capacity and reliability. The majority of this project will be internal including but not limited to pump, screening and electrical upgrades to give greater capacity. The only impervious surface that will be added to the site will be a new generator and a larger generator fuel tank to supply the station with enough fuel to operate for five days during a power outage until fuel will need to be replenished. This will include a total of 894 sgft of additional impervious surface. All other work associated with this project will be within existing structures. The stormwater runoff from this additional impervious surface along with impervious surface from two existing buildings will be managed by a sand filter of buried trench design due to site constraints. A vicinity map showing the location of the project is included in Appendix A and on the drawings. b) Existing Site Pump Station 35 was constructed in components between 1981 and 1985 on one piece of property. The property deed and copies of record drawings indicating construction date are included in Appendix B. In 2007, the adjacent property was purchased that had two existing buildings, a large gravel driveway/parking area and a billboard. Research indicates that the existing building closest to Oleander Drive was constructed in 1955 and that the other building was constructed in 1994. The driveway/parking area was installed in 1955 with that building and was expanded for use in constructing Pump Station 35 from 1981 through 1985. The property deed and copies of tax records indicating structure construction dates is included in Appendix C. Based on existing conditions and the proposed project, the Wilmington Regional Office of the Division of Water Quality indicated that this project would require a permit and would be considered high density. c) Stormwater Design Information The information presented in this section describes the specific design data used in the design of the stormwater measures. i) Rainfall Data The pre- and post -development peak runoff rates and the volume of runoff generated by the I -year, 24-hour storm were modeled using Hydraflow 2004. The program uses the Rational runoff method and rainfall data for the specific site. The precipitation data is for this design came from NOAA. The 24-hour rainfall depth for the 1-year storm is 3.81 inches and the intensity is 0.27 inches/hour. ii) Survey Information A detailed land survey is provided by McKim and Creed. Vertical data based on NAVD 88. iii) Offsite Runoff Due to site and surrounding topography, no offsite runoff will flow onto this site. iv) Soils Investigation ECS Carolinas, LLP, performed a soil investigation on July I, 2008. At this time, ECS conducted a subsurface soil and groundwater exploration at two requested locations. Based on findings the soil appeared to fill to the depths reached in the boring locations where refusal was not immediate. On the one boring that reached deep enough, the Seasonal High Water Table (SH WT) was estimated to be 40" below the surface. The ECS investigation report is included in Appendix D. As this would place the SH WT in fill, only a properly designed buried trench sand filter will meet DWQ State Stormwater requirements for control and treatment of runoff for this project. As this is a rigid enclosed system, Mr. Vincent Lewis, state soils scientist for the North Carolina Department of Environment and Natural Resources, was not asked to visit the site for verification of the findings. The bottom of the designed sand filter will be below the SH WT but will be designed to counter flotation and the system will have no other interaction with the SHWT. v) Design of the Buried Trench Sand Filter System The buried trench sand filter system proposed for this project will utilize pre -cast concrete sections connected on -site into a water tight strurcture. Run-off from the drainage area being treated will be conveyed to the sand filter by surface Flow and will enter the sand filter through grates over the sedimentation chamber portion of the sand filter. vi) Site Characteristics The total site area including both properties and all drainage area is 0.55 acres. The site has been subdivided into three drainage areas based on treatment requirements. See the Chart 2.1 for project drainage area information. Drainage Areas I & 2 will not be controlled and treated as the impervious surface in those areas was constructed prior to 1988. All of the run-off from Drainage Area I will be managed by a pre -cast concrete buried sand filter. vii) Pre and Post Development Rate In order to meet the requirements for Structural Stonnwater Controls, the required storage volume must be discharged at a rate equal to or less than the predevelopment discharge rate for a one-year, 24-hour storm. To determine the pre and post development flow rates, the Rational Method was used along with the modeling program I lydraflow. The run-off coefficients used were as follows: C for impervious area = 95 C for grassed area = 35 Using the above C values 35 was used for pre -development now even though existing impervious area as we assumed no development. The Hydraflow model calculated a composite C value of 72 for the post development flow based on 38% of the area at a C of 35 and 62% of the drainage area at a C of 95. Based on these C values, the model indicated the peak flows calculated by the model are as follows: Pre -development peak flow = 0.28 cuft/s Post -development peak flow = 0.58 cuft/s See appendix E for Fydraflow model hydrographs. These flows are so low it is impractical to restrict the Post -development flow to the Pre -development flow rate as this will have negative impacts on the treatment quality of the sand filter. viii) State Stormwater Requirements The site is located within'/2 miles of and draining to SC classification waters. State stormwater requirements are that the system must contain and treat the entire 1.5" storm volume. Based on using a buried trench sand filter the key values calculated are as follows: Rv = 0.613 Volume of 1.5" Storm = 424 cult Water Quality Volume = 289.47 cult Minimum Sedimentation Basin Surface Area = 19.14 sqft Minimum Sand Filter Bed Surface Area = 37.37 sqn The sand filter designed for this project has the following criteria: Volume of storage above sand filter media = 455 cuff Sedimentation Basin Surface Area = 144 sqft Sand Filter Bed Surface Area = 144 sqft 'therefore all design criteria are met. For review of the calculations of the above values see Appendix F. ix) City of Wilmington Stormwater Requirements This project does not fall within the threshold of the City of Wilmington's stormwater requirements. x) Underdrain and Outlet Discussion The sand filter will have an underdrain that conveys the treated run-off to the discharge chamber. The calculated required underdrain for this project was a minimum of 2 — 6" perforated pipes at a slope of 0.5%. For a 1.5 safety factor this design includes 3 — 6" underdrain perforated pipes. The total maximum effluent flow of the sand filter based on combining the max flow through the filter and the filter overflow is 12.87 cuft/s. This is the max flow that the filter will allow to pass and anything above this flow will not enter the sand filter. Based on this effluent flow, the minimum diameter of the effluent pipe was calculated as 7 inches. Due to a desired safety factor of 1.5 the pipe outlet used for this sand filter is 12 inches. Stormwater rules require a level spreader length of 65 If per 1 cuft/s with a 50' buffer strip between the level spreader and the wetland. Due to the nature of this project, DWQ agreed that we could install a level spreader with sufficient length to reduce the velocity to less than 2 ft/s. Therefore we propose the installation of 15 If of level spreader at the sand filter discharge. The Hydraflow model indicates that the peak flow for a 100-year storm will be 1.2 cuft/s. Assuming this peak flow is passed through the sand filter with no attenuation and using the weir equation, the velocity of flow over 15 If of weir is 0.92 ft/s. This letter, with attachments, is the report of our estimation. Field Testing On July 1, 2008 ECS conducted an exploration of the subsurface soil and ground water conditions at two requested location shown on the attached Site Diagram. ECS met with W. Paul Shivers with Highfill in order to locate the borings. The purpose of this exploration was to obtain subsurface information of the in -place soils for the proposed storm water treatment areas. We explored the subsurface soil and ground water conditions by advancing hand auger borings into the existing ground surface at the requested boring locations. We visually classified the subsurface soils and obtained representative samples of each soil type encountered. We also recorded the ground water level observed at the time of each hand auger boring. The attached SHWL sheet provides a summary of the subsurface conditions encountered at each hand auger boring location. The ground water level and the seasonal high ground water level (SHWL) were estimated at each boring location below the existing grade elevation. Below is a summary of each boring location. This maintenance record will be kept in a log in a known set location. Any deficient BMP elements noted in the inspection will be corrected, repaired or replaced immediately.
