SUBMITTAL REQUIREMENTS Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ). A complete package includes all of the items listed below. A detailed application instruction sheet and BMP checklists are available from hn://Rortal.ncdenr.org/web/-ffA/ws/su/statesw/forms does. The complete application package should be submitted to the appropriate DWQ Office. (The appropriate office may be found by locating project on the interactive online map at hgp_//Rortal.ncdenr.org web/wq/ws/su/maps.) Please indicate that the following required information have been provided by initialing in the space provided for each item. All original documents MUST be signed and initialed in blue ink. Original and one copy of the Stormwater Management Permit Application Form. CIB 2. Original and one copy of the signed and notarized Deed Restrictions & Protective Covenants_ Form. Tf the receiving stream is reported as class SA or the receiving stream drains to class SA waters within Y2 mile of the site boundary, include the Y2 mile radius on the map. 7. In the instances where the applicant is different than the property owner, it is the responsibility of the property owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring that the deed restrictions are recorded. By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and protective covenants for this project, if required, shall include all the items required in the permit and listed on the forms available on the website, that the covenants will be binding on all parties and persons claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted without concurrence from the NC DWQ, and that they will be recorded prior to the sale of any lot. I think the cleanest course of action is to permit the 2 new buildings in Southbridge Multifamily LLC (under the current permit) so they can begin moving forward with construction. Then we will submit a package to NCDENR as previously discussed to spilt the permit accordingly. My recommendation would be to think about who the current permittee is now and who you want the permittee to be when you split them eventually. If you don't need to change the permittee, then you can leave it in the current permittee's name. If you want to go ahead and change it now you can. Just put some thought into how you want the transfer process to proceed (as in my 10/10/13 email under "paperwork".) I am not sure what your specific goals or limitations are to provide more specific detail. But, if this does not make sense please let me know. Here are a couple of items to consider: 1.) Compliance: From the file, it looks like you all have worked with Steve Pusey to get things finalized from a compliance perspective. I haven't gone through that carefully, but assuming that the site is in compliance any upcoming transfers to the HOAs should be pretty easy. 2.) Paperwork: My recommendation would be to think of this as a two step process. You will need to have the current permittee submit for a modification to split the permit into three pieces as the first action. Then, as a second action have the current permittee transfer the permits to the HOAs. Both actions can be submitted in a single submittal, but I would encourage you to think about this as a two-step process in order to keep track of "who signs what". I would also recommend that you submit for both the mod and the transfer in a single submittal because the reviewer will know the details of the situation, and this is usually the fastest route to a permit (as opposed to getting a modification issued and then coming back in for a transfer after the mod is issued). The current permittee needs to submit: a. Three applications: The current permittee would sign each document as the applicant. If he/she wants the permit number to stay with one of the three pieces in particular, please tell us that up front. It doesn't matter to us which one keeps the old number. All three permits will stay under current rule (assuming that all you do is a split and there are no other big changes), but sometimes people have a preference as to who keeps the old number when they split permits. The other two pieces will get new numbers. b. Supporting Documents: Then, you would also submit any of the supporting forms that change signed by the permit applicant/current permittee (supplements, 0&M, deed restrictions, or any other forms that would have "new" info as a result of the permit split). If a form isn't changing, then we shouldn't need a new form to be submitted. c. Transfer Forms: The outgoing person is the current permittee and the incoming person is the new HOA. The soils of the site consist of silty sands. The site is moderately wooded with grades ranging from 1 % to 20%. The proposed modification is to the current State Stormwater Permit No. SW8 090903 Modification. The current permit contains a total of ten (10) BMP's; of which seven (7) are sand filters and three (3) are wet detention ponds. These BMP's treat various types of development within this project, which includes single family residential, commercial, and multi -family. Approximately 1.76 additional acres will be disturbed / graded for the construction of Southbridge Multifamily Phase 3. The Phase I and Phase III Residential construction is complete. All sand filters for drainage areas 1-613 are complete. Pond 7-12 is complete and certifications have been previously provided to NC DENR. Pond #14 (multi -family pond) construction is complete and certification has been provided to NC DENR. Construction of Phase I and Phase II (Building 6) is now complete. Plans have been included for Southbridge Multifamily Phase 3 that propose the construction of two (2) new apartment buildings with paved parking and access. This proposed modification of 58,007 Sf will reduce the previously permitted future allocation. The remaining portion of the multi -family site will remain undeveloped. Based on the current design, a future allocation of 87,882 SF of impervious surface has been provided for future development of the remaining site area. EROSION CONTROL MEASURES: The attached plans and specifications outline the requirements for erosion control measures. The detention pond/silt basin will be constructed immediately after that portion of the site is cleared, and outlet structure with protection will be installed. Disturbed areas will be landscaped or seeded upon completion. EROSION CONTROL NOTES AND MAINTENANCE PLAN All erosion and sediment control measures will be checked for stability and operation following every runoff -producing rainfall, but in no case, less than once every week and within, 24 hours of every half -inch rainfall. 2. All points of egress will have construction entrances that will be periodically top - dressed with an additional 2 inches of #4 stone to maintain proper depth. They will be maintained in a condition to prevent mud or sediment from leaving the site. Immediately remove objectionable material spilled washed or tracked onto the construction entrance or roadways. 3. Sediment will be removed from hardware cloth and gravel inlet protection, block and gravel inlet protection, rock doughnut inlet protection and rock pipe inlet protection when the designed storage capacity has been half filled with sediment. Refer to new NPDES rules regarding basin outlet structures and skimmers shall withdraw water from the surface. SECTION 02920 SOIL EROSION AND SEDIMENTATION CONTROL 1. GENERAL 1.1 Contractor shall take every reasonable precaution throughout construction to prevent the erosion of soil and the sedimentation of streams, lakes, reservoirs, other water impoundments, ground surfaces, or other property as required by State and Local regulations. 1.2 The Contractor shall install all required silt fences, and construction entrances at the initiation of work, and have these measures reviewed and approved by the local permit authority prior to clearing and grading operations. 1.3 The Contractor shall, within 21 days of suspension or completion of land disturbing activities, provide permanent protective covering for disturbed areas. Temporary and permanent erosion control measures shall be coordinated to assure economical, effective, and continuous erosion and siltation control throughout the construction and post -construction period. Use the specified seed for both temporary and permanent seeding. 2. PRODUCTS 2.1 Asphalt for anchoring mulch shall be Type SS-1 Emulsion. 2.2 Fertilizer shall be 10-10-10 grade or equivalent. 2.3 Lime shall be dolomitic agricultural ground limestone containing not less than 10 percent magnesium oxide. 2.4 Mulch shall be small grain straw, hay, wood chips, asphalt emulsion, jute or other suitable material free of undesirable weed seed. 2.5 Phosphate shall be 20 percent superphosphate or equivalent. 2.6 Seed shall be 20% carpet grass, 24% Bermuda, 20% turf Fescue, 10% Creeping Red Fescue, and 24% Annual Rye grain. Bermuda seed shall be hulled for warm weather planting and unhulled for cool weather planting. Purity of seed shall be a minimum of 98 percent and germination shall be a minimum of 85 percent. 2.7 Silt fence shall consist of NCDOT Class A fabric supported by metal posts spaced not more than 6 feet on center. The bottom of the fabric shall be buried a minimum of 6 inches. 2.8 Gravel for check dams shall be #57 washed stone. 2.9 Aggregate for construction entrance shall be #4 washed stone. 2.10 Stone rip rap for check dams and erosion control shall be NCDOT Class A or B as shown. 3. EXECUTION 3.1 General: Take every practicable measure during construction or suspension to work to minimize erosion and siltation. Measures should include good construction practices, temporary physical barriers to sediment travel, settling basins for new ditches, and establishment of vegetative cover. 3.2 Construction Practices 3.2.1 Avoid dumping soil or sediment into any wetland or watercourse. 3.2.2 Maintain an undisturbed vegetative buffer where possible between a natural watercourse and trenching and grading operations. 3.2.3 Avoid equipment crossings of streams, creeks, and ditches where practicable. 3.2.4 Grade all cut, fill and ditch slopes to minimum slope of 3:1, unless otherwise shown or directed. 3.3 Temporary Physical Barriers are required where sedimentation on offsite property or excessive erosion is a problem. 3.3.1 Mulch shall be used for temporary stabilization of areas subject to excessive erosion and for protection of seedbeds after planting where required. 1. Apply grain straw and hay at a rate of 75 to 100 pounds per 1,000 square feet and wood chips at a rate of 500 pounds per 1,000 square feet. Jute and mesh should be installed as per manufacturer's instructions. 2. Asphalt emulsion for slope stabilization should be applied at a rate of 1,000 gallons per acre. Asphalt emulsion used for anchoring straw should be applied at a rate of 150 gallons per ton of straw. 3.3.2 Silt Fences shall be used at the base of slopes to restrict movement of sediment from the site. Clean silt fence of accumulated sediment after each rainfall event or when it exceeds a depth of 0.5 feet above natural grade. 3.3.3 Stone Check Dams, placed at the discharges of creeks, ditches, and swales, shall consist of Class A or Class B erosion control stone at minimum two feet high and three feet thick across the watercourse, with a one foot thick layer of gravel on upstream side. Remove sediment if accumulated to a depth of 1.0 feet at upstream face. 3.4 Vegetative Cover: Establish and maintain permanent vegetative cover on all unpaved areas disturbed by the work. 3.4.1 Preparation of Seedbed: Areas to be seeded shall be scarified to a depth of 4 inches and until a firm, well pulverized, uniform seedbed is prepared. Lime, phosphorous and fertilizer shall be applied during the scarification process in accordance with the following rates: Lime: 45 pounds per 1000 square feet Phosphorous: 20 pounds per 1,000 square feet Fertilizer: 17 pounds per 1000 square feet 3.4.2 Seeding: Disturbed areas shall be seeded with 2 to 3 pounds per 1000 square feet of the specified seed mixture. Seed shall be worked into the bed to a depth of 1/4 inch. Regrade and seed eroded areas immediately 3.4.3 Mulch all areas immediately after seeding. Mulch shall be applied and anchored as specified hereinbefore. Reapply as necessary to retain cover until grass is established. 3.5 Construction Entrance: Provide an aggregate drive, 20 feet wide by 50 feet long by 6 inches thick at each entrance to the site used by construction vehicles, until such time as the permanent roadway is constructed. Remove soil if accumulated to a depth greater than 0.5 inches. 3.6 Maintenance: The Owner and Contractor shall be responsible for maintaining all temporary and permanent erosion control measures. Temporary structures shall be maintained until such time as vegetation is firmly established in the area protected by the structure. Here are a couple of items to consider: 1.) Compliance: From the file, it looks like you all have worked with Steve Pusey to get things finalized from a compliance perspective. I haven't gone through that carefully, but assuming that the site is in compliance any upcoming transfers to the HOAs should be pretty easy. 2.) Paperwork: My recommendation would be to think of this as a two step process. You will need to have the current permittee submit for a modification to split the permit into three pieces as the first action. Then, as a second action have the current permittee transfer the permits to the HOAs. Both actions can be submitted in a single submittal, but I would encourage you to think about this as a two-step process in order to keep track of "who signs what". I would also recommend that you submit for both the mod and the transfer in a single submittal because the reviewer will know the details of the situation, and this is usually the fastest route to a permit (as opposed to getting a modification issued and then coming back in for a transfer after the mod is issued). The current permittee needs to submit: a. Three applications: The current permittee would sign each document as the applicant. If he/she wants the permit number to stay with one of the three pieces in particular, please tell us that up front. It doesn't matter to us which one keeps the old number. All three permits will stay under current rule (assuming that all you do is a split and there are no other big changes), but sometimes people have a preference as to who keeps the old number when they split permits. The other two pieces will get new numbers. b. Supporting Documents: Then, you would also submit any of the supporting forms that change signed by the permit applicant/current permittee (supplements, O&M, deed restrictions, or any other forms that would have "new" info as a result of the permit split). If a form isn't changing, then we shouldn't need a new form to be submitted. c. Transfer Forms: The outgoing person is the current permittee and the incoming person is the new HOA. Please also submit the data requested by the transfer form such as the deed to show that the new owner owns the land. d. Plans: We need two sets of plans for each of the three permits (6 sets total). We will keep one for each of our files and mail one to each of the new permittees. e. Three $505 fees for the three modifications. There are three transfers, too, but since each of them are a first transfer to each of the three respective permits, the $40 fee doesn't apply. (Additional transfers after the first one are $40.) f. Other: I would recommend taking some extra time to think through the "who signs what" and "what is changing" issues. That is easy to get mixed up, and it commonly does. For instance, sometimes people will intend to follow this process but they will have each HOA sign the application form. That doesn't quite work because the current permittee is the one who is doing the modification. Then, it becomes a huge issue because there are so many people involved and everyone is confused about why forms have to be resigned by different people. Or, sometimes the lot numbers will change in one of the "pieces" and that doesn't get carried over to the deed restrictions. Or, any number of small details can be omitted inadvertently. Like I said, this isn't "hard", it is just a lot to keep track of. 3.) Permitted Land: All of the land previously permitted will have to continue to be permitted. For instance, that area that is sort of a triangle and not colored in the middle of the pink, blue, and green will have to be covered if it was already covered before. Also, if the "pink" area is covered by the current permit then that will have to be addressed, too. (Maybe that is why we were talking about a master permit before? I don't remember.) 1 4.) BMP Boundaries: We need to make sure that the BMP drainage area lines fall neatly within each HOA's new boundary lines. From a quick look, it looks like they do. If they do not, then we will have one HOA's piece partially offsite-ing to another HOA's piece. So, if the DA lines cross the future permit boundary lines then we need to talk some more and I can send you an example of what we will need to do. You can still do the split, it will just be more paperwork and the permit will be longer. 5.) Overall Low Density: I don't think that this is the case for this project, but there is place in the permit text that references low density requirements (Section 116g). That may be in there in error. If it is overall low, then let's talk about that, too. Hopefully that clears things up. N&T initially started design on this Phase but never completed design or permitting. I am not sure as to its status. 2. The remaining areas Red (SB PHI Residential), Blue (SB Commercial), & Green (SB Multifamily) are currently permitted under SW8 090903. Each of these distinct areas have their own individual POA/ HOA set up to maintain BMPs etc within their "boundary" Our client wishes to proceed forward with splitting the original permit into 3 permits with each covering their respective areas (Red, Blue, & Green). They will be set up independently and individually be responsible for maintenance of their respective BMPs. Construction in the Red (SB PHI Residential) area is complete and i believe that they either have completed or are in the process of turning over common areas & BMPs to HOA (the permit split may be the last piece of the puzzle for the attorneys). Nevertheless our client have asked us for a fee to provide services for permit split and we just wanted to verify with NCDENR that 1. It's acceptable & 2. Any issues you can foresee with moving forward with this process. I know all BMPs are built & have been certified with NCDENR except for Pond 13 which resides in the Blue (SB Commercial) area. Remember, before transferring the permit, you must provide legal documentation showing that the common areas have been conveyed to the HOA, and that the declarant has conveyed at least 50% of the lots to owners other than the declarant. I am going to go out there soon, along with our Land Quality representative, to take a look at the site. Land Quality is responsible for any erosion issues with lots that are under construction. They haven't closed their project out yet. I am not aware of any handouts DENR has for homeowners other than the permit itself. This paperwork is taken care of in the transfer process. Based on the letter, ° Bill says ... as best I can tell, and what I would suggest you do is to allow the recent repairs an opportunity to take hold. The rip rap should hold and prevent additional erosion on the downside of the fence. (Outside the property owners' yard) Hopefully the turf that was added will help as well once it starts to root." We've been working diligently for the past two years (plus) to wrap this project up and get it to a point where all were comfortable for turnover to the property owners association. I feel like we are there. Any handouts DENR has for homeowners explaining their continual responsibilities relating to erosion control/stormwater would be greatly appreciated by us and our Property Management Company. I can't believe it's already Jan. 17! Anyway, it looks like there's only one remaining problem to take care of, the erosion behind Lot 9. If the runoff from the roof is causing the problem, then I agree with the Rainstorm Solutions. The best solution could be to add gutters to the house and pipe the runoff underground via trunk lines under the fence to the swale that leads to the yard inlet (located just behind the intersections of Lots 8 & 9). Maybe they could do the same for Lot 10 as well, if they have this problem. This would require a plan revision and calculations to show that it would work without causing erosion at the outlet. The trunk lines from the houses would probably feed to a common header which discharges into the swale. Let me know ASAP what you all decide. Chris, as best I can tell, and what I would suggest to be done next ...Is let what repairs and preventive actions that were recently installed take hold and see how it works. What I did see that would cause me some concern as a storm water/runoff/erosion problem is the area directly beneath the drip line of the house's roof line. (On the side of the house where the HVAC is) This is the area that has caused the problem to date and the amount of runoff going towards the fence and eroding the ground, both inside the fence and beyond the fence. The yard is still going to erode, and as I mentioned to you the HVAC pad is being compromised by the washout beneath it. This problem will only continue. We tend to see it in areas of sharp grade changes and no gutters, just as here. The water flow is so great for just turf, If they are lucky enough to get turf established they might be able to sustain it, but still may see under washing around the pad itself. Getting some type of shrub established and ground cover in place might hold up better in the long run to keep the soil in place. If the problem persist and the above measures are not an option or for some reason don't work, I would suggest adding gutters to the house and piping that water under ground via trunk lines beyond the fence.
