We find the plan to be acceptable and hereby issue this Letter of Approval with Modifications. This approval shall become null and void if you have not made progress on the site within six months after the date of approval. A one-time six-month extension can be granted for good cause shown upon receiving a written request from you before the expiration of the approved plan. This letter of approval is being issued prior to the issuance of the stormwater permit due to concurrent reviews, but any land disturbing activity associated with this project shall not begin prior to issuance off all required permits including the stormwater permit and the land disturbing permit. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction General Permit. After the form is reviewed and found to be complete, you will receive a link with payment instructions for the $100 annual permit fee. After the fee is processed, you will receive the COC via email. As the Financially Responsible Party shown on the FRO form submitted for this project, you MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form may be accessed atdeq.nc.gov/NCGO1. Please direct questions about the eNOI form to the Stormwater Program staff in the Raleigh central office. If the owner/operator of this project changes in the future, the new responsible party must obtain a new COC. Title 15A NCAC 413 .0118(a) and the NCGO1 permit require that the following documentation be kept on file at the job site: 1. The approved E&SC plan as well as any approved deviation. 2. The NCGO1 permit and the COC, once it is received. 3. Records of inspections made during the previous 12 months. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to ensure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. In addition, it would be helpful if you notify this office of the proposed starting date for this project. Please notify us if you plan to have a preconstruction conference. No construction activity can occur within the Clarks Chapel Road right of way until NCDOT Driveway Permit has been approved and received by this office. 2. No construction activity can occur within or in proximity to unnamed tributary to Flat Creek until 401/404 permits has been approved by NCDENR and USACE and received by this office. 3. Please resubmit a new Financially Responsibility of Ownership form without markups for our records. This is a legal document and must not be altered after notarization has taken place. This must be completed prior to issuance of the land disturbing permit. 4. Per the Erosion Control Ordinance, please maintain a 10' undisturbed vegetative buffer between stormwater discharge and the property line at the proposed discharge point for construction runoff. 5. Contractor to ensure that any import or export material be from a permitted site. 6. Erosion control measures must be installed in accordance with the approved engineering plans and maintained at all times. Alternate measures must first be approved with the engineer of record and regulatory site inspector prior to installation. 7. Clearing limits for grading must be clearly delineated in the field as shown on the approved engineering plans. Any additional clearing or land disturbing activity that disturbs the ground surface outside of those limits will constitute a violation of the County's Ordinance and will be subject to penalties. 8. Any deviations in the original approved construction plans or design changes to land clearing to the overall site must first be submitted for review to this regulatory office and approved prior to continuation of construction. Failure to resubmit could result in possible issuance of stop work orders, holding of any building inspections, or issuance of certificates of occupancy. 9. Erosion control measures must be in good working condition and in place at the completion of construction each day and on holidays to prevent possible offsite sedimentation associated with changing weather events. 10. Additional measure may be required if site dictates change due to construction activities. 11. NCGO10000 Construction General Permit and Buncombe County Stormwater Management Permit must be obtained prior to beginning construction and issuance of Buncombe County Land Disturbance Permit. 12. An onsite pre -construction meeting must be scheduled with this office prior to any land disturbing activities including tree removal.
