Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 980634 Modification dated August 23, 1999, for the construction of Eagle Point Golf Club. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supercede any other agency permit that may be required. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adj udicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. This permit covers the construction of 709,953 square feet of built -upon area. 2. The overall tract built -upon area percentage for the project must be maintained at 25%, as required by Section 1005 of the stormwater rules. 3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 5. No piping is allowed except that amount as shown on the approved plans. 6. The built -upon area within the 575' AEC must be maintained at 25%. Currently,187,233 square feet of buildings and parking is proposed within the AEC. State Stormwater Management Systems Permit No. SW8 980634 Modification II. SCHEDULE OF COMPLIANCE Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 4. Prior to the sale of this project, in whole or in part, the following deed restrictions must be recorded with the Office of the Register of Deeds and submitted to DWQ: a. "The built -upon area is limited to 709,953 square feet. Construction of additional built -upon area will require a permit modification." b. "Construction of additional impervious areas such that low density requirements are no longer met must be submitted to DWQ and a permit modification must be issued prior to construction. An engineered system will be required, if allowed, to collect and treat the runoff from all built -upon area associated with the project, including that area permitted under the low density option. If an engineered. system cannot be permitted, the additional built -upon area cannot be allowed." C. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this development, except as shown on the approved plan, is strictly prohibited by any persons." d. "A minimum of 30' of vegetated buffer area shall be provided between surface waters and all impervious surfaces." Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the permitted development, except for average driveway crossings, is strictly prohibited by any persons. 6. Projects within CAMA's Area of Environmental Concern (AEC) are subject to a reduction of the permitted amount of built -upon area due to CAMA jurisdiction within the AEC. 7. A copy of the recorded restrictions must be received by this Office within 30 days of the date of sale. The permittee will also provide the name, mailing address and telephone number of the purchaser within 30 days of the sale. 8. The following items will require a modification to the permit. Revised plans, specifications and calculations must be permitted prior to the penmittee beginning construction on the modification: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision or sale of the project area, in whole or in part. f. Filling in, altering or piping any vegetative conveyance shown on the approved plan. 9. The Director may determine that other revisions to the project should require a modification to the permit. 10. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational fortheir intended use prior to the construction of any built -upon surface. 11 During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 13. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. 14. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. M. GENERAL CONDITIONS Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. 2. . The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. 6. The permittee grants permission to DENR Staff to enter the property for the purpose of inspecting all components of the stormwater management facility. 7. The permittee shall notify DWQ of any mailing address changes within 30 days of such change. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which have jurisdiction. Deed Restriction Requirements The following statements must be recorded for all low density projects and for all projects that involve the subdivision and selling of lots or outparcels: 1. No more than_ square feet of any lot, including thatportion of the right-of-way between the edge ofpavement and the front lot line, shall be covered by impervious structures, including asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or the surface ofswimming pools. This covenant is intended to insure continued compliance with the stormwater permit issued by the State of North Carolina. The covenant may not be changed or deleted without the consent of the State. 2. No one may fill in, pipe, or alter any roadside swale except as necessary to provide a minimum driveway crossing. NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot number, size, and the allowable built -upon area for each lot. For commercial projects that have outparcels or future development the following statements must also be recorded. 3. The connection from the outparcel or future area into the stormwater system must be made into the forebay such that short -circulating of the system does not occur. 4. All built -upon area from the outparcel or future development must be directed into the permitted stormwater control system. 5. Built -upon area in excess of the permitted amount will require a permit modification prior to construction. For curb outlet systems, the following statement in addition to items 1 and 2 above must be recorded: 6. The intention of this letter is to furnish such information. The following points correspond respectively to the requests set forth is the above referenced review letter: 1. Existing and proposed grading for clubhouse and villa sites are indicated on the revised site plan 2. A) As per your phone conversation on 6/22/99 with Elizabeth Swinson from this office, the following items have been delineated on the plans: Dimensions of second parking lot next to club house, parking stalls and Isle width, Dimensions of circle drive in front of club house, and parking in front of all villas. B) The road width is held constant throughout. Several additional indicators were denoted on the plans to clarify this dimension. A preliminary review of that information 1'has determined that the application is not complete. The following information is needed to continue the St0mWater reviacxr• Please provide the existing and proposed grading for the clubhouse and villa sites. 2. Please provide the dimensions for the roads, parking areas, and clubhouse. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to July 14, 1999, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces associated with this project prior to receipt of the stormwater permit is considered a violation of NCGS 143-215.1, and is subject to enforcement action. The enclosed application is requesting approval for 7.52 % and 10 % respectively. The method of conveyance and treatment is remaining relatively unchanged. The modification which you will note on the plans is described below and includes; Golf Hole alignment revisions, relocation/shifting of irrigation pond, modified parking layout (same count, less dense shape), adjusted pipe discharge outlet locations. The concept of having a lined irrigation pond is consistent with previous plans although the size and shape of the pond has been modified to promote littoral shelving and greater storage. The overflow stream leads to a small lined pond where recirculated water will be pumped back to the irrigation pond. Created marshes and littoral shelves are designed throughout the course, with the aid of Rob Moul's office, to promote water quality"polishing" and benefiting discharge to the natural drainage channel through the middle portion of the site. The manmade pond just prior to release of runoff after major rain events, near #5 green, has been enlarged to promote greater attenuation. Care has been taken not to network required pipes and to minimize the number of inlets. We have also received plans from Henry Johnston, Architect, that better defines the intended design for the Clubhouse and Villas. These plans have been incorporated onto the Stormwater masterplan and enlarged on another plan for your review. Impervious surface area density has only slightly increased by 1.22% over the entire tract and .07% within the AEC. This is due to the current level of detailed design and the project is still well under allowable percentages. GENERAL The project site is located adjacent to Porter's Neck Plantation at the intersection of Porter's Neck Road and Bald Eagle Lane and within New Hanover County, North Carolina. The project site is 216.81 acres. Sedimentation and Erosion control measures are to be in accordance with DEM requirements. The intent of this project is to develop an eighteen (18) hole golf course and practice areas with a clubhouse and 4 single family villas. 2. EXISTING SITE The existing site is essentially a large abandoned field and woodland. Damage and debris from recent hurricanes is evident. There are also existing water bodies on -site (man made ponds) connected by a wet weather drainage way. The existing ponds are delineated wetlands that will be protected and incorporated into final design. Design parameters for stormwater considerations shall dictate that the project remain a low density development. Vegetation consists primarily of grasses, scrub growth, and young trees. Subsurface soils in upland areas are primarily well drained. Heavy spring rains indicate the existing drainage has maintained groundwater levels at a reasonable depth so as not to preclude or interfere with proposed developments. Subsurface soils in freshwater ponds and wetlands are primarily poorly drained sands which may support seasonally high water tables within 12 inches of ground surface. 3. PROPOSED IMPROVEMENTS Proposed grading for the site will dramatically alter the overall site appearance while maintaining overall drainage patterns. At the property perimeter, fill piles will create a screening effect from adjoining landowners. The new ridge lines will also ensure that stormwater runoff is retained on the interior of the site and any discharge from the site will occur through one of two existing outfalls. The interior of the site will also be reshaped to provide topographic relief from tee to green on the golf course and also to screen adjacent holes from one another. The three existing ponds will remain while the wet weather drainage way connecting, them will be expanded to an open water surface, effectively creating a single body of water. In addition, two additional landscape ponds are to be created on -site as golf course amenities and irrigation ponds. Drainage will be designed that infiltration is promoted wherever possible on the golf course. Minor piping is necessary only to provide positive relief for the low or isolated areas of the golf course (such as sand bunkers). A result of the low density design is that post construction discharges are typically minimized and may be further reduced by landscaping and drainage improvements. 4. DRAINAGE CALCULATION CONSIDERATIONS A complete set of calculations for pipe sizing, outlet protection, catch basin rim and invert elevations, water quality swale velocities, and pond and road culvert sizing is attached. Any deviation from the approved plans must be noted on the Certification. 4. The Director may notify the` permittee"when the permitted site does not meet one or more of the minimum requirements of the permit Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The maximum built -upon area is 64.88"acres square feet, inclusive `of that portion of the right-of-way between the front lot line and the edge of pavement, stiuctures, pavement, walkways of brick, stone, slate, but not including wood decking. 6. This permit covers the construction of 18.11 acresg88_,$43 square feet) of impervious area. Construction of additional impervious area will require a permit modification. 7. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons. Projects within CAMA`s Area of Environmental Concern (AEC) are subject to a reduction of the permitted amount of built -upon area due to CAMA jurisdiction within the AEC. 9. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational -for their intended use prior to the construction of any built -upon surface except roads. 10 During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 11. The following items will require a modification to the permit. Revised plans, specifications and calculations must be permitted prior to the permittee-beginning construction -on the modification: a. Any revision to the approved plans, regardless of size. b. - -Projecf Bame change: y C. Transfer -of ownership. - d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering or piping any vegetative conveyance shown on the approved plan. 12. The Director may determine that other revisions to the project should require a modification to the permit. 13. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 14. The permittee shall submit the Engineer/Owner/DesignerlPermittee Certification within 30 days of completion of the project. 15. The permittee shall submit all information. requested by the Director or his representative within the time frame specified in the written information request. I]T. GENERAL CONDITIONS 1 • Failure to abide by the conditions and limitations contained in this permit may subject the permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. 1 7 The permit issued shall continue in force and effect until revoked or terminated. 4 State Stormwater Management Systems Pit No W8 9RQ5.334 I The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or -may not be approved. 6. The permittee grants permission to DENR Staff to enter the property for the purpose of inspecting all components of the stormwater management facility. 7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which have Jurisdiction.
