Declarant desires for Phase Two, Sections One and Two, Brewster Place, to be subject to the Declaration, and WHEREAS, Developer and Owner are the owners of all of the lots in Phase Two, Sections One and Two, and desire to amend the Declaration to comply with the conditions of the stormwater permit for Phase Two NOW, THEREFORE, the Declarant hereby declares that all of the property within Phase Two, Sections One and Two, Brewster Place, as described above, and all future RETURNED TD J sections within Phase Two, shall be held, sold and conveyed subject to the Declaration, as hereby amended, which Declaration shall run with the land and be binding on all parties having any right, title or interest in the described property or any part thereof, their heirs, successors or assigns, and shall inure to the benefit of each owner thereof Article VI I, Section 1 of the Declaration is supplemented by adding the following language The stormwater requirements for Phase Two are as follows a The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8990732, as issued by the Division of Water Quality under NCAC 2H 1000 b The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the stormwater management permit c These covenants are to run with the land and be binding on all persons and parties claiming under them d The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality e Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the Division of Water Quality f The maximum allowable built -upon area per lot is 4,000 square feet This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools g All runoff from the built -upon areas on the lot must dram into the permitted system This may be accomplished through providing roof dram gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales to collect lot runoff and directing them into the stormwater system or into the street Lots that will naturally drain into the system are not required to provide these additional measures -3- IN TESTIMONY WHEREOF, Declarant and Owner have caused this Instrument to be signed in Its corporate name by Its president
