On April 11, 2006, the Wilmington Regional Office received a plan revision for Stormwater
Management Permit Number SW8 971223. The revisions include the development of 4,510 ft2
of built -upon area within the area between the marina bulkhead and Keelson Row. This area
was previously permitted for a total maximum of 15 337 ft2 of built -upon area to drain to the
detention pond. The development includes 1,210 ft� for a Bathhouse and covered kiosks,
1,800 ftZ for a Sailing Club Complex, and 1,500 ft2 for a Moon/Star Unit with storage, leaving a
total of 10,827 ft2 availabe for future development in that area.. It has been determined that a
formal permit modification is not required for the proposed changes. We are forwarding you a
copy of the approved additional plans for your files. Please add these approved plan sheets to
the previously permitted set to form the new approved plan set.
Please be aware that all terms and conditions of the permit issued on June 2, 1998, remain
in full force and effect. Please also understand that the approval of this revision to the
approved plans for the subject State Stormwater Permit is done on a case -by -case basis.
Any other changes to this project must be approved through this Office prior to
construction. The issuance of this plan revision does not preclude the permittee from
complying with all other applicable statutes, rules, regulations or ordinances which may
have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction.

Hi Linda,
With the 1.5' roof overhang, we come up with 988 sf of roofline for the marina bath house.
There is an additional 22 sq ft of sidewalk/pavers that is not part of the Keelson Row sidewalk, bringing the BUA
up to 1010 sq ft.
There is a pretty substantial wood deck/handicap ramp, but that is all above grade/gaps between the boards.
Over the marina electrical panels, we also have 2 roofed "Kiosks" of probably 6'x8' each, (sort of like the sign
board that Scott Greer did for his Eagle Project just outside of St. Marks. I was his project advisor, so somehow
he was influenced by the pictures of the Bald Head Island panel cover "kiosks". We are installing the new
A -dock slips this week, will probably need another kiosks to cover those panels also. The big slips are 3
phase, plus we have the single phase meters, so to be safe lets call it another 200 sf of roofed area for all 3.
You can take that of the allowable 15,xxx sf.

In looking at the permit, I'm really having a hard time figuring out where it
states that the "postage stamp" lots are limited to 100% of their area as
impervious. The only 100% impervious lots that I see were 4 lots that were owned by
BHI, Lots 1, 3, 8 and 15. These lots were allotted 100% of their area as BUA in
order to not have to provide deed restrictions on those 4 lots. Those 4
developer -owned lots are cross -hatched and labeled on the 1996 approved plans,
while the postage stamp lots are only hatched, indicating that buildings will be
going up there, according to the plan legend. Not all of the postage stamp area is
hatched, there are open areas, so that is why I don't understand how they could be
considered at 100% impervious. The permit does not even refer to them as "lots",
only "buildings".
The area in-between the Marina bulkhead and Keelson Row was included in the
drainage area of the pond. My spreadsheet that I used to check the pond
calculations shows 15,337 sq. ft. of "buildings" other than the portion of the BUA
of 27 lots and all of the BUA from 4 lots, that is permitted as part of this
project. When you count the lots shown on the approved plans, the 31 lots that are
permitted do not include the "postage stamp" lots, and there are no other existing
buildings on the 1998 approved site plan, so I can only assume that the 15,337 sq
ft. of "buildings" is available as BUA for the postage stamp lot area.
That being said, the currently proposed total BUA for the Moon/Star unit & storage
and the Sailing Club unit is 3,300 square feet. In December, 2000, another building
was permitted by LAMA under a refinement to 191-86, called the "Bathhouse",
however, no BUA amount is set forth on those plans. The site plan was created by
the BHI Planning Department. Do you have any information regarding how much BUA was
used up for the Bathhouse? If not, can you estimate the BUA by scaling the plans?
The bathhouse appears to be located across from "The Lightkeeper" (a gift shop) and
an ice cream store.

Thanks for your reply to my questions.
For your tomorrow express review, the "postge stamp" nominal 20'x20'
square lots along the marina have a 2' setback from the original marina
wall per the Bald Head Island Harbour "urban code type II lot". This
setback is a bulkhead easement (i.e. the marinaplatincludes the water
plus the 2' land side easement band). Due to the marina wall not being
perfectly parallel to Keelson Row, and due to the 2' band inside of the
original bulkhead line, the lot depths are slightly less than 191, and
decrease very slightly (about .01' per 20' lot width) in depth as you
go south towards Eb & Flo's. The intent of the buildings/roofs on the
two site plans that I submitted is to honor the 2' band".
There is also a 5' side setback requirement, but that is only where
"postage lot" properties under different ownership adjoin. As these are
all owned by Bald Head Island Limited, the 5' side setback is not a
requirement. As I read the shaded zones on the Klein & Associates
drawing, the impervious "buildings" were calculated as contiguous,
without side setbacks between each lot.
We will gutter the marina side of these roofs to channel rainwater
water back to its Keelson Row collection and thence to the pond.
on my question on the duplexes. The two lots in question that these
duplexes are proposed on are on lots 41 & #3, both having 100%
impervious allotment. Since these 2 lots are by percentage, (which we
won't exceed 100% on) I think that we can handle it all locally with the
building inspector and Village CAMA person to stay within that amount.
I won't submit any furthe for your files on this.
I am availlable by phone or in person if you have further questions on
your review. I'll be at Bald Head Island on Tuesday, but can be at
Cardinal Drive in about 1 hr 45 minutes of leaving on a ferry at half
past any hour.

This is with reference to your request to modify State Permit #191-86, which was renewed on 9/2/05 and expires
on 8/31/07. The action proposed in your submittal is the construction of the "Moon/Star Unit", adjacent to the
east side of the Bald Head Island Marina Basin. The proposed project was included as impervious area in the
existing stormwater plan (#SW8 971223) that was approved by the NC Division of Water Quality. The submitted
drawing depicts the final dimensions and detail of the proposed construction. The project is located between A
and B docks, on the east side of the Bald Head Island marina basin, adjacent to the Cape Fear River, Brunswick
County.
Upon reviewing the submittal and conferring with Doug Huggett. Major Permits Section, I have determined
that the proposed action is consistent with existing State rules and regulations and is in keeping with the
original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the
modification of State Permit # 191-86, as described in your letter and plans dated 3/15/06, and received in
our office on 3/17/06. The applicant shall obtain any authorization required by the NC Division of Water
Quality, Stormwater Section prior to initiating work under this permit refinement. By copy of this letter we
are also notifying the U. S. Army Corps of Engineers of our action.

Dear Mr. Brooks:
Enclosed, please find five copies of drawing C1 for a proposed "Sailing Club Complex" on previously
Permitted impervious area adjacent to the east side of the Bald Head Island Marina Basin along
Keelson Row. I have included a scanned portion of the original Klein Engineering approved
stormwater drawing showing the site area on my drawing. That 1998 drawing indicated a clubhouse
at approx 85' from our new south bulkhead wall. We have shifted our proposed building about 20'
north to allow for a handicap ramps. Note that the original plan had an extensive wood deck for the
areas not covered by impervious surfaces (rooflines). Todays plan has less decking and less
impervious, as shown. Site drainage is to Keelson Row, and through catch basins/storm piping to the
pond at the Tent Site.
Immediately north of the south marina wall we are showing a small 15'x25' building (459 sf roofline) in
an area that is approved impervious for sailing gear storage and/or sailing center classroom/gothering
space. As we go north, there is an approximate 13'x70' main building (1143 sf roofline), similar in
design to the marina bath house, which will house the sailing director and instructor(s), two handicap
bathrooms, more sailing gear storage, and an open top shower. The site area for design purposes is
180 sf x 20'+/- = 3600 sf. Subtracting out the original wood decking, actual permitted impervious
allotment is in excess of 50% of the 180' length "Complex". For round numbers, we are calling our site
as 50% impervious = 1800 sf. Existing high density stormwater permit #SW8-971223 allowed for 38 of
these "postage stamp" lots at 100% impervious plus the club building along the 1130 ft east bulkhead.
Our current design has less impervious than the original.
This project is similar to the one approved by Letter of Refinement to Permit 191-86 dated December
27, 2000 for the Marina Bath House.

is the reconfiguration of the floating docks in Bald Head Island Marina. The slip previously assigned to the
"D" dock T-head has been relocated to "A" dock. "No docking" signs are posted at the T-head and the
mooring cleats have been removed. The "A" dock slip arrangement has been slightly modified to include the
additional slip. The revised docks plan for the marina shall not exceed the number of boat slips that are
currently permitted. The project is located in Bald Head Island marina, adjacent to the Cape Fear River, in

lam. The layout was last approved based on drawing by a Letter of Refinement dated T� ►J
16-03. There is one remaining section of A -Dock t at is slated for construction this spring. With this
drawing I am showing the as -built conditions and slip count of B, C, E, & F-Docks, and the portion of A -
Dock by the Marina Both House that was installed last year. There was a pinch point in the marina
fairway near the D-Dock tee -head, and by marina and yacht club decree/deed, this position was
taken out of the dockage scheme. The cleats were removed, and it is posted on the tee -head "No
Docking". I have updated to the enclosed layout, with D-Dock reduced 1 slip to 23 slips, and A -Dock
increased that 1 slip to 52 slips.

On June 2, 1998, the Division of Water Quality issued a Stormwater Management Permit to Bald Head
Island, Ltd., for the construction of a wet detention pond to serve the high density development at Harbour
Village. The permit allocated 48,000 square feet for future development. The current proposal is for a temporary
tent site with parking. Based on the drawings submitted, the proposed built -upon area is 20,540 square feet, well
below the allotted amount.
Construction of the temporary tent site is approved as long as the runoff from all built -upon area will be
directed into the permitted wet detention pond. A total of 27,460 square feet remain for additional future
development. All other terms and conditions of the original June 2, 1998, permit remain in full force and effect.

This is with reference to your request to modify State Permit #191-86, which was renewed on 8/11/99
and expires on 8/31/2001. The action proposed in your submittal is the construction of a bathhouse,
adjacent to the east side of the Bald Head Island Marina Basin. The proposed building was included as
impervious area in the existing stormwater plan (#SW8 971223) which was approved by the NC Division
of Water Quality. The submitted drawing depicts the final dimensions and detail of the proposed
construction.
The project is located on the east side of the Bald Head Island marina basin, adjacent to the Cape Fear
River. Upon reviewing the submittal, I have determined that the proposed action is consistent with
existing State rules and regulations and is in keeping with the original purpose and intent of the permit.
I hereby submit this Letter of Refinement authorizing the modification of State Permit # 191-86, as
described in your letter and plans dated and received in our office on 12/12/00 and 12/13/00. Additional
plat copies received on 12/22/00. By copy of this letter we are also notifying the U. S. Army Corps of
Engineers of our action. If you have any questions concerning the above or if I can be of any other
assistance, please advise.

the Bald Head Island Marina.

CAMA Major Development Permit #191-86 shows the area contemplated for

current Stormwater Permit #SW8 971223 as 100% impervious.
