The initial permit was issued for a proposed Phase I project that included the construction, operation, and maintenance of a Cultec infiltration chamber/trench system for stormwater management. Staff review of the plans and specifications has determined that the subject protect, as proposed for a modification to the initial permit, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H 1000. We are forwarding Permit No. SW8 050409 Modification dated July 18, 2005, for the construction of the subject project that includes stormwater management of larger drainage and impervious areas, a temporary drainage basin during construction, and the application of 3 sand filters instead of the previously permitted Cultec infiltration system for stormwater control. This permit shall be effective from the date of issuance until July 18, 2015, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within sixty (60) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 1508 of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. G.S. 113A-54.1(a) requires that this office approve or disapprove a submitted revised plan within 15 days of receipt of such plan. Failure to act by this office within this time period shall be deemed approval of the revised plan. Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to the approval of an erosion and sediment control plan is a violation of the Act. The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal and State water quality laws, regulations and rules.
