Annual Homeowners Association Meeting
August 22, 2021
Robi Bennett, President, called meeting to order. Proxies counted and
also headcount done. We had enough homeowners to meet our
quorum. Our first order of business was George going over the budget.
We have had several large expenditures over the last couple of years
that has depleted our bank account. There has not been a large
increase in eight years but felt like for right now we needed an
increase to build our account back up for any emergencies down the
road.
We voted on the increase and we only had one "NO" vote. So starting
immediately our dues is $250 quarterly.
Mark Bammert brought up the issues of our sidewalks and expressed
concerns over a lawsuit if someone should fail on our property. We
have had the sidewalks worked on before but as long as our oak trees
continue to grow we will have these issues. Dana Barnes told us about
another neighborhood that had these issues and the city fixed them.
What a wealth of information this was! Thank you so much Dana. The
next morning I called the city and spoke with a Construction
Supervisor who met with me that same morning. He walked the
property with me and explained the city was responsible for our
sidewalks and we were going onto the work order to take case of this.
Also, we can't be sued if someone should trip and fall. It's the city who
will be at fault.
Neat, Mark Bammert was concerned about the retention ponds out
front. He notice that we don't have as many frogs in the ponds as
previous years and he was worried about any chemicals they were
using. I have seen a lot of turtles there and we have a Blue Heron that
likes fishing for frogs so I think we are safe. Also, he brought up home
much we are paying annually to RPS. They were coming out !��! ��
every month to inspect the pond but after we had the f 1011
installed it's every other month. Mark was concerned o ajoiu
about a law suit if a child should fall into the retention pond. If we see
children fishing or hanging out we ask them to leave. I don't know
what else we can do but be vigilant when we see kids hanging out
around the pond.
Mark brought up the light houses out front needed repaired and
painted. That will also be addressed at a later date. Thank you to Sue
and Jeff for power washing them! They are only here four times a
year yet their yard and house always looks beautiful.
While we are on this subject of houses and yards please take time to
clean up the front of your home before winter sets in. One house
looking shabby can change the whole neighborhood.We all moved
here because it was a beautiful street but some people are letting
their property go and not keeping it up to our standards.
One of our newest homeowners Stevie Mitchell brought up trees that
need to be taken down back in the wooded area. It looks like that
won't be addressed until our neat annual meeting. Stevie also
volunteered to take care of timer on retention pond and our sprinkler
system out front. Thank you so much Stevie.
Mark has taken on our lighting out front. Thank you once again Mark
for all that you do here on our street.
There was a lot of yelling around the room until Bobby Barnes
suggested we put these issues on the table and meet again in three
months. I'm hoping that we have resolved some of these issues. The
question was brought up concerning the election of new officers for
our HOA. No one was interested and everyone thanked us for a job
well done.

As shown on the 2020-21 cash flow report, the HOA met its 2020-21 expenses by taking
$9395.93 from the HOA's fund balance.
Assuming expenses in 2021-22 will continue without substantial change from the past year,
and assuming a reasonable fund balance should be 15%of annual expense or $4,350,
then quarterly dues would need to be $250, an increase of $50/quarter..

Maintenance Agreement
This Agreement is entered into by and between RPS Environmental, LLC ("Eaviro") and
Southern Oaks HOA ("Customer") for the below described services to be performed no less
than 6 times per year beginning August 2020 and ending 30 days after written notice of either
party to terminate the Agreement. Any additional changes to the Agreement must be made in
writing and signed by the parties. After the initial year of service, this agreement shall continue
on a month to month basis.
1. Enviro will inspect no less than 6 times per year the Stormwater Control Measures (SCMs)
which are located off: Woodland Forest Court, (2 ponds) for compliance with applicable
regulations as well as for any additional recommended maintenance or repair that Enviro feels is
necessary for the SCMs to perform as designed. Any deficiencies, issues and non -compliant
areas discovered by Enviro will be noted in the inspection report provided to the customer.
Enviro will provide a scope of work along with pricing to address any such area upon the request
of the customer.
2. Enviro is not responsible for mowing SCM areas. Unless stated otherwise, SCM areas include
the basin, slopes, spillways, and outfalls.
3. Enviro will pick up and dispose of trash and debris in the SCMs including the pond basins,
outfall structures, and emergency spillways. This does not include flushing pipes or removal of
any debris in a closed area such as a catch basin.
4. Er viro will treat aquatic vegetation and algae in wet basins on an as needed basis no more
than 6 times per year if needed. (Months to treat bond — April, May, June, July, August and
September). This may include the use of EPA approved herbicides and algaecides. Bacteria and
Dye and Avast treatments will be billed separately if needed. Enviro strictly follows all label
restrictions. Controlling aquatic vegetation is a process and acceptable results may take longer
than desired. The customer should contact Enviro with any questions or concerns with the
condition of the water. Customer is to notify Enviro if any area treated with herbicides and/or
and landscam.
5. Enviro will prepare inspection reports each visit to include pictures. Each inspection report
will identify noncompliant aspects of the stormwater system as well as any additional
recommended maintenance or repair that Enviro feels is necessary for the stormwater system to
perform as designed.
6. Enviro will provide consultation regarding applicable regulations, permit reppo
stormwater system performance and compliance. Should the customer desire for 1
interact with a regulatory agency or engineer additional charges may occur.

Retention Pond Maintenance
An unkept retention pond is destined to fail. If the local government does
not own it, it becomes the association's responsibility to keep the pond in
working order, and they are also responsible for any expenses incurred.
This includes regular inspections, especially after severe storms or heavy
rain, to identify and repair areas of erosion, gullies, and other damage;
removing sediment and debris from the pond before they reach the outlets;
and beautifying the surrounding banks with grass, shrubs, and other
vegetation.
HOA Liability
Forget swimming pools —while necessary in many communities, retention
ponds can easily be considered an HOA's greatest liability and expense.
Not only do they pose a constant drowning hazard for residents, but they
also require continuous maintenance and planning. Because of the high
cost of the initial installation,monthly maintenance and periodic removal of
sediment buildup, it is recommended that associations set aside 12% of
their yearly budget for a small retention pond, and up to 35% for a larger
pond.
What is a Retention Pond?
While it may look like a regular water feature, a retention pond serves a
much greater purpose. Growing communities are at increased risk of
flooding and erosion damage from excess stormwater runoff. Retention
ponds are permanent structures designed to hold water flow for a short
period of time, similar to a dam. In response to a storm, the pond's water
level fluctuates, reducing risk and saving the community from potential
flood damage and costly repairs.

The Wilmington Regional Office received and accepted a State Stormwater Management Permit Renewal
Application for the subject project on September 13, 2021. A preliminary in-depth review of that information has
determined that the application is not complete and that additional information is needed. To continue the review,
please provide the following additional information in a single, hard copy submittal package:
1. 15A NCAC 02H.1040(l)(a) and . ] 042(2)(b)(ii) : The application was signed by Robi Bennett; however
the provided documentation from the NC Secretary of State does not identify Ms. Bennett as a president
or vice-president of this HOA. In the case of a limited liability corporation (LLC), the application must
be signed by a manager or company official as defined in GS 57D. Please:
a. Provide official documentation showing that Ms. Bennett is a president and authorized to sign for
the HOA
Please remember to confirm that any revised information is presented consistently throughout the application
documents. Please also remember to provide a hard copy of any updated documents per 15A NCAC
02H.1045(3).
The requested information should be received in this Office by October 14, 2021, or the application will be
returned as incomplete. If additional time is needed to submit the requested information, please email your
extension request prior to this due date to the email address provided below with a justification and a date of when
the requested information will be submitted, which shall be no later than 15 days past the original due date. Please
note that only two letters requesting additional information is allowed in the State Stormwater Program for a
total of 30 days to submit the requested additional information. If the information is not satisfactorily provided
after either the second request or 30 days, the project will be returned. If the project is returned and you wish to
re -submit later, you will need to resubmit all required items at that time, including the application fee.

State Stormwater Management Permit #SW8 040723 for the subject project expired on August 23, 2018. This is
a reminder that permit renewal applications are due 180 days prior to their expiration per 15A NCAC 2H.1045(3).
North Carolina General Statutes and the Coastal Stormwater rules require that this property be covered under a
stormwater permit Failure to maintain a permit subjects the owner to assessment of civil penalties.
Please submit a complete permit renewal form along with a $505.00 fee and other submittal requirements within
30 days. The permit renewal form can be found on our website at: https://deq.nc.aov/about/divisions/energv-
m ineral-and-land-resources/storm water/storm water-program/post-construction-2.
A review of the North Carolina Secretary of State corporation's database revealed that this corporation may have
