Mike Toler Chrysler Dodge Jeep Ram High Density Stormwater Project Carteret County Dear Mr. Toler: Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this permit now references DEMLR as the Division responsible for issuance of the permit. On July 10, 2014, the Wilmington Regional Office received a request to transfer the stormwater permit to the new owner. The permit was transferred effective July 11, 2014. The Wilmington Regional Office then received a complete modified Stormwater Management Permit Application for Mike Toler Chrysler Dodge Jeep Ram on July 22, 2014. Staff review of the submitted plans and specifications has determined that the modified project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding the transferred and modified Permit No. SW8 040205 dated July 25, 2014, for the construction, operation and maintenance of the permitted built - upon areas and BMP's associated with the subject project. The modifications included in this permit are: 1. A complete redesign of the site and the pond. 2. An increase in the amount of built -upon area which constitutes a major modification under SL 2008-211, the coastal stormwater rules. The site has been redesigned.to meet the larger design storm required by SL 2008-211. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit, which expired on February 13, 2014, shall now be effective from the date of issuance until February 13, 2018, and the permittee shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), certification of the BMP's, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to certify the BMP's, to transfer the permit, or to renew the permit, will result in future compliance problems. This permit shall be effective from the date of issuance until February 13, 2018, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The proposed wet detention pond has been designed to handle the runoff from 158,585 square feet of impervious area. 3. The pond's drainage area will be limited to the amount of built -upon area indicated in Sections 1.2 and 1.6 of this permit, and per the approved plans. There is no allocation for future built -upon area. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. A permit modification must be submitted and approved prior to the construction of additional built -upon area from outside of the approved drainage area. SCHEDULE OF COMPLIANCE 1. The proposed stormwater management system must be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon area associated with the modification. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide and perform the necessary operation and maintenance at the scheduled intervals, to assure that the permitted stormwater system functions at optimum efficiency, in accordance with the signed and approved Operation and Maintenance Plan, which is attached to and an enforceable part of this permit. 4. Access to the outlet structure must be available at all times. 5. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEMLR. The records will indicate the date, activity, name of person performing the work and what actions were taken. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 040205 Decorative spray fountains will be allowed in the permitted stormwater treatment system, subject to the following criteria: a. The fountain draws its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in the permitted pond is 1/6 horsepower. 8. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 9. If the stormwater system is used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, changes in the grading, repositioning of the built -upon areas, etc. b. Redesign of or addition to the approved amount of built -upon area or to the permitted drainage area. C. Further subdivision or sale of all or part of the permitted project area. d. Additions to the permitted project area. e. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. f. Construction of any future BUA accounted for on the permit application. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 12. The permittee shall ensure that the maximum built -upon area limit is not exceeded at any time, and shall ensure that the site is graded such that runoff from all the built -upon is directed into the permitted system. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part; b. Bankruptcy; c. Foreclosure; d. Dissolution of the partnership or corporate entity; e. A name change of the current permittee; f. A name change of the project; g. A mailing address change of the permittee; Page 5 of 8 State Stormwater Management Systems Permit No. SW8 040205 2. Any individual or entity found to be in noncompliance with the terms and conditions of this permit or the requirements of the stormwater rules is subject to enforcement procedures in accordance with G.S. 143, Article 21. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily or fail to meet the permit requirements, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall submit a permit renewal application to the Director at least 180 days prior to the expiration date of this permit. The renewal request must include the completed renewal application, fee and all supporting documents. Permit modified and reissued this the 25t" day of July 2014. You are using an outdated application form SWU-101. Please visit the Division's website and download the most recent version, dated October 31, 2013, The latest SWU-101 application has been completed and is included in this submittal. 2. Please check the stage/storage table provided in the calculations for the Temporary Pool Volume. The surface areas used in that table are much larger than the surface areas reported on the supplement at those same elevations, resulting in a falsely large provided volume. The stage/storage table has been reviewed and reflect the size of the pond and are included on the supplement as such. 3. There is not enough volume provided at the temporary pool elevation of 18:55. Please check and revise as needed. The storage volume at elevation 18.55 has been reviewed and has been raised to 18.65 resulting in a volume of 19,873 W. 4. The calculations appear to base the average head for determining the orifice size on a temporary storage elevation of 18.50. Please revise the average head and orifice calculation to use the reported temporary pool elevation of 18.55. Since the storage volume elevation was raised to 18.65 as noted in item 3 above this elevation has been used to determine average head and orifice sizing, which remained as previously proposed. 5. The project is proposed on a 6.8 acre tract. The site was permitted for a modification (SW8 040205) in 2012 to construct an automobile dealership. The previously approved high density plan allowed for the construction of a, commercial building and associated parking and drives for an automobile dealership. The plan being submitted is modifying the footprint of the building, adding additional parking and modifying the pond to include retained side slopes. II. Stormwater Information The project is located within the White Oak River basin and currently drains northerly to Hull Swamp, Class C, 21-15, a tributary of the Newport River. This project is being submitted as a high density commercial project under the current Coastal Stormwater Rules modifying the permit from 2004. NCDENR-DWQ "Stormwater Management" rules and regulations (NCAC 15-2H-.1000) were used as guidelines in making this evaluation. New and revised NCDENR-DWQ coastal stormwater rules became effective October 1, 2008 and are more rigorous than previous rules. This is a general evaluation that consisted of transects across the tract, free -style soils mapping and shallow borings within accessible areas, qualitative estimates of the land and soil properties, and review of existing maps or information on these areas. The SW portions of the tract have historically existing impervious surfaces or disturbances, thus evaluations were not completed within this area. No quantitative on -site or specific testing was completed as part of this evaluation that can be required for NCDWQ stormwater permitting. According to NCDENR-DWQ rules, coastal stormwater may be treated by infiltrative devices, detention treatment basins, or an equivalent aftemative method when the proposed project is greater than 1. acre in size, has >12% residential impervious surfaces, >10,000 sqft non-residential impervious surfaces, and are within Yz mile of Class S.A. Waters or their unclassified tributaries. Coastal lands that are >% mile from Class S.A. Waters or their unclassified tributaries allow up to 24% residential impervious surface for low -density development, or 10,000 sgft non-residential impervious surfaces, before requiring engineered stormwater treatment systems. This tract is >1/2 mile from S.A. Waters, and appears to drain towards the NW to an unnamed tributary of Hull Swamp which is classified as Class-C Waters (see topo and DWQ map). It appears a high density project within these tracts would require prescriptive engineered stormwater treatment methods and design if the lands exceed 24% impervious surface. Infiltration methods or infiltrative 'best management practices' (BMP) are utilized for stormwater treatment on coastal high density projects to preserve space or due to inadequate drainage outlets. Detention stormwater treatment ponds may also be used if they do not directly discharge to S.A. waters through 'effective infiltration' methods. Low density projects (<12% to <24% residential impervious surface or <10,000 sqft non-residential impervious surface) should not require engineered stormwater treatment systems. Historically existing impervious surfaces should be exempted from stormwater density calculations, and then new development should comply with current NCDWQ stormwater requirements as much as practicable. This tract is located on a typical coastal plain geomorphic setting, consisting very gently sloping to level, flatwoods with 0 - 2% slopes. General elevations are —15 — 20 ft, based upon general USGS topographic maps. The tract consists of deep, fine to medium, sand to loamy sand sediments, with spodic (hardpan) horizons at variable depths pending location. The following is a brief description of the land and soil types found, and potentials for stormwater treatment usage: The "Yellow" Areas (see map) are somewhat poorly drained, deep uniform fine to medium sand to loamy sand textures and with incipient spodic (soft hardpan) horizons. The estimated seasonal high water static water table is +18 - <24 inches from the present surface, pending location and based upon soil wetness indicators and general elevations. Estimated permeability is 30 — 90 minfin or 0.6 — 2 in/hr to +50 inch depths from present surface, based upon soil texture and structure. Soil types found are similar to Mandarin and Leon -dry phase soil series. These soil areas should be usable for stormwater infiltration with basin bottoms +0.5 - 1 ft above the present surface (pending location) to maintain a 2 ft separation from seasonal high water table. We recommend a long-term loading rate for stormwater infiltration that is 1/ or less the average estimated soil hydraulic conductivity, or --0.6 — 1.0 in/hr for these moderate to moderately slow hydraulic conductivity rates and gradients. Detention ponds would have to maintain the permanent pool elevation between 12 - 30 inches from the present ground surface.
