A complete Stormwater Management Permit Renewal Application was received for Ocean Harbour Estates on January 4, 2012. The Division is hereby notifying you that permit SW8 931204 has been modified to add the option for permeable pavement and renewed on January 4, 2012, and shall be effective until May 31, 2022. The plans previously approved on May 31, 2002, in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995, remain in full force and effect. Please attach this cover letter and enclosed new pages 2 and 3 of the permit to the original permit issued on May 31, 2002.This site was inspected on September 12, 2011. All deficiencies noted in the inspection report have been addressed and the site is currently in compliance with the terms and conditions of this renewed state stormwater permit. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. The permit is hereby renewed subject to the following addendums, clarifications,. conditions and limitations: 2. The original permit conditions contained in the permit issued on May 31, 2002 remain in full force and effect, except as amended herein. (An additional copy of this original permit can be obtained from the Division of Water Quality, Wilmington Regional Office.) 3. This permit shall be effective from the date of issuance until May 31, 2022. 4. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. The renewal request must include the applicable documentation and the processing fee. 5. Permeable Pavement is allowed for this project and is subject to the following conditions: a. The permittee shall designate a point of contact to all lot owners wishing to install a permeable pavement on their lot. b. The necessary rules, requirements and forms for the installation of permeable pavement are available to the permittee on the Division's website. The permittee shall supply all lot owners, wishing to install a permeable pavement on their lot, with the necessary forms or direct such lot owners to the Division's website to download the forms directly. 2 Ocean Harbour Estates SW8 931204 c. The permittee shall review for completeness and accuracy, all such permeable pavement applications within the permitted project, for compliance with the permeable pavement design, inspection and maintenance requirements listed in the latest version of the NC DWQ Best Management Practices Manual. A complete permeable pavement application includes a scaled lot layout and grading plan with the proposed permeable pavement clearly marked, the completed and signed permeable pavement supplement, calculations, a soils report prepared by a knowledgeable and appropriate professional and a signed Inspection and Maintenance Agreement from each lot owner wishing to install a permeable pavement on their lot. d. The permittee shall approve or reject each permeable pavement application by checking the appropriate box on the supplement form, signing the form and returning the original to the lot owner. The permittee shall reject all applications for lots that do not meet the minimum soil hydraulic conductivity rate and the minimum water table separation requirements, or which propose a permeable pavement that does not meet the minimum design requirements. e. The permittee shall keep a copy of all permeable pavement applications on file for the life of the Stormwater Management permit. At the end of every quarter (March, June, September, and December), the permittee shall submit a copy of the permeable pavement approval package, including lot layout plan, supplement form, calculations, soils report, and the signed Operation and Maintenance Agreement to the Division for any and all lots within the permitted project, which were approved to install a permeable pavement in that quarter. The permittee shall ensure that each owner of a lot having permeable pavement, provides the necessary maintenance as outlined in the signed Inspection and Maintenance Agreement, by whatever reasonable and legal means necessary. The permittee must outline the financial arrangements for performing the maintenance. Options include at his own expense, or via individual assessments to those lot owners having permeable pavement, or via the homeowner's association dues. Whatever method is decided upon must be approved by the HOA and placed into the recorded deed restrictions. g. Prior to the sale or ownership transfer of any lot where a permeable pavement has been installed, the permittee shall provide a copy of the previously approved calculation sheet and shall require the new owner to sign an Inspection and Maintenance Agreement prior to closing. h. The permittee shall cause the following statements to be added to the recorded covenants and restrictions for the project: i. If credit for a permeable pavement within the lot boundary is desired, the lot owner must submit a request along with supporting documentation, to the permittee or his designated representative and receive approval prior to construction of the permeable pavement. ii. The financial responsibility for maintaining the permeable pavement has been assigned to the individual lot owner. Here is the certification showing that the trenches were constructed properly and the plans show a cross-section of a trench. I also talked to the inspector who did the inspection in September and he remembers trenches. Perhaps the swales that drain water to the trench look like basins? The two features would look similar, but a swale would take water to an area where there would be an inlet to an underground trench? Is it possible that all this time the permit has read incorrectly and does not match the plans? I would be happy to talk with you. Upon review of the package I have two follow up questions: 1. Operation and Maintenance (0&M) Agreement: An infiltration basin 0&M agreement was received with the package, however there are infiltration trenches treating your stormwater. Please submit the 0&M agreement for infiltration trenches which is available on our website, htto://aortal. ncdenr.ora/web/wo/ws/su/bmp-ch l 6. 2. Permeable Pavement: How would you like to handle maintenance for the permeable pavement? It can either be done by the individual lot owners that become approved to have permeable pavement on their lots, or it can be done for all applicable lots by the HOA. If it is done by individual homeowners, then the homeowner will submit an 0&M agreement to the HOA as a part of the approval process. Then, the HOA will forward that signed 0&M agreement to the Division quarterly. If the HOA oversees maintenance, then you can submit an 0&M agreement as a part of this modification process and the permit will direct the HOA to perform maintenance. Check for $505 Thank you for your assistance with the transfer and renewal of this Storm Water Permit. We have discussed this several times on the phone. We finally were able to obtain a signature on the Transfer Form from one of the surviving members of the original Development Company that held the permit. We are requesting transferring the permit into the Homeowners Association, renewing the permit for another 10 years and adding the pervious language to the permit. I have already met with your representative, David on site and he inspected the system and suggested that it had all the engineering certifications on file and he approved of the condition of the system. As we discussed on the phone, we would also like to amend the permit to include the new pervious solutions language into the renewed permit. During our conversation you suggested that you would be willing to do this at no additional cost after you had researched the soil conditions in our neighborhood. I think you will find in your records that the sandy soils in this neighborhood are ideal for pervious solutions. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. Per SW8 931204, each lot in Section Ocean Harbour Estates is limited to a maximum of 5,300 square feet of built -upon area (BUA). 2. Deed restrictions for SW8 931204, were recorded on March 16, 1994 in Deed Book 973 at Page 356 of the Brunswick County Register of Deeds office. 3. This permit covers the construction of a total of 5,300 square feet of built -upon area, which includes 5,299 square feet of proposed BUA and 1 square foot of future BUA as summarized below. Total Impervious Area Allocated: 5,299 ft2 Buildings 4,846 ft2 Parking Area, Total Surface Area 692 ft2 Parking Area, 60% Area Credited for Permeable Pavement 415 ft2 Parking Area, 40% Resulting Effective Impervious Area 277 ft2 Other Non -Permeable Pavement 176 ft2 Total Impervious Area for Future Use: 1 ft2 Page 2 of 5 State Stormwater Management Systems Permit No.SW8 111002 4. This permeable pavement on this lot will be constructed with a 6" washed stone gravel base, which is assigned a 60% managed grass credit. 5. The soils under the permeable pavement must maintain a minimum hydraulic conductivity of 0.52" per hour, and the Seasonal High Water table must be a minimum of 2 feet below the bottom of 6" washed stone layer. 6. The slope of the completed permeable pavement must be 0.5% or less. 7. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 8. The lot must maintain a minimum 30-foot-wide vegetated buffer between impervious areas and surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers, and the mean high water line of tidal waters. No built -upon area may be located within the buffer. 9. All runoff directed into and through the vegetative buffer must flow through the buffer in a diffuse manner. 10. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 11. All roof drains must terminate at the edge of the 30' buffer and must flow through the buffer in a diffuse manner. II. SCHEDULE OF COMPLIANCE 1. The permeable pavement must be protected during construction such that no sediment -laden runoff is directed across the permeable pavement surface. 2. No direct or concentrated runoff from roof gutters or other surfaces is allowed to be discharged onto the permeable pavement. 3. To achieve the 60% managed grass credit, a minimum 6" washed aggregate base must be provided under the permeable pavement. 4. No more than 100 axles per day (50 cars) shall be allowed on the permeable pavement surface. 5. Trees overhanging the permeable pavement should be avoided. 6. Special care must be taken to avoid compaction of the underlying subgrade soils during installation of the permeable pavement. 7. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface. 8. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated areas or conveyances will be repaired immediately. 9. The permittee shall at all times provide and perform the necessary operation and maintenance procedures as specified in the signed Operation and Maintenance Agreement, such that the permeable pavement system functions as designed and permitted. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any of the items shown on the approved plans, including the stormwater management system, design concept, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area .or to the drainage area. C. Further subdivision, acquisition, or selling of the project area. d. Filling in, altering or piping any vegetative conveyance shown on the approved plan. 11. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 12. No piping shall be allowed except that minimum amount necessary to direct runoff beneath an impervious surface such as a road and that minimum amount needed under driveways to provide access to lots. 13. The permittee is responsible for verifying that the lot's proposed built -upon area does not exceed the allowable built -upon area. The maximum allocated built -upon area for the lot may not be revised without approval from the Division of Water Quality. If the allocated maximum built -upon area on the lot is exceeded without approval of the permittee and the Division, the lot owner is subject to enforcement action by the Division of Water Quality. 14. Within 30 days of completion of the project, the permittee must certify in writing that the permeable pavement has been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. 15. This lot is subject to the deed restrictions which have been previously recorded for permit number SW8 931204, in Deed Book 973 at Page 356 of the Brunswick County Register of Deeds office. 16. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until. modified, revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. Page 4 of 5 State Stormwater Management Systems Permit No.SW8 111002 5. The permit is not transferable to any person or entity except after notice to and approval by the Director. The Director may require modification or revocation and re - issuance of the permit to change the name and incorporate such other requirements as may be necessary. At least 30 days prior to a change of ownership, or a name change of the permittee or of the project, or a mailing address change, the permittee shall submit a completed and signed Name/Ownership Change Form to the Division of Water Quality accompanied by the supporting documentation as listed on the form. The approval of this request will be considered on its merits, and may or may not be approved. 6. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the permit transfer request. Neither the sale of the project nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state and federal), which have jurisdiction. If any of those permits result in revisions to the plans, a permit modification must be submitted. 8. The permittee grants permission to DENR Staff to enter the property during business hours for the purposes of inspecting the stormwater management system and its components. 9. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. This permit does not take the place of a review and approval with the subdivision's established Architectural Standards by the Rivers Edge HOA/POA. When a CAMA Major application for a lot in a subdivision is preceded by a LAMA Minor application for the associated upland development, the Division must verify that the built -upon area does not exceed the maximum BUA limits assigned by the Master Stormwater permit for that subdivision. In this case, our review has revealed a potential problem with the amount of built -upon area proposed for this lot. This lot is part of the subdivision Ocean Harbour Estates, which is covered by stormwater permit number SW8 931204. This permit allowed for each of the 38 lots in the subdivision to have a maximum of 5,300 square feet of built -upon area. I pulled the lot plan you provided with the March 2011, CAMA Minor application, and after scaling off the house alone, there appears to be approximately 5,272 square feet, leaving only 28 square feet for the back porch, the pool deck, the walkways and the driveway. The lot plan does not indicate what type of material comprises the back porch, the pool deck or the walkways. The water surface of the pool and raised, uncovered, open -slat decking is not considered a built -upon surface, however, the driveway is denoted as pervious concrete. Pervious concrete with a 6" gravel base receives a 60% managed grass credit, meaning that only 40% of the total driveway area is counted as built -upon area. However, even this appears to put the lot over the 5,300 sf maximum when combined with the home's built -upon area. The current permit for Ocean Harbour Estates does not contain the necessary permit language for the permittee to approve the use of permeable pavements in this subdivision. Until the permit is modified to allow for the use of permeable pavement and until the HOA assumes the responsibility of implementing the permit conditions, all permeable pavement installations on a lot in a permitted subdivision must come to the Division of Water Quality for approval. The Division has no record of approving either the design or the installation of this driveway. Dear Alan, Land Management Group, Inc. evaluated the lot for the purpose of providing site data to the engineer for his submittal of the proposed storm water retention plan for the proposed residence. The purpose of the evaluation was to describe the soil profile, quantify the depth to the seasonal high water table, estimate permeability and to inform the project engineer of any potential limitations of this project within the proposed stormwater retention areas The soils at this site are mapped as Wando in the Soil Survey of Brunswick County (USDA, 1986). Soil borings 1 thru 2 confirmed the soils are Wando. The soil boring locations are shown in Appendix A and the soil profile descriptions are shown in Appendix B. The seasonal high water table is normally evident by observation of redoximorphic features suggesting past conditions of saturation and reduction. In the same way, there can be modern drainage features such as canals or ditches that have altered the hydrologic profile. Often, observed redoximorphic features are relicts of previous hydrologic conditions but not current ones. The degree of expression, or in this case, the lack of it is evidence that SHWT occur at depths greater than seven feet. There is no evidence of redoximorphic features 84" from the soil surface in the two locations. Soil permeability is estimated based on soil physical properties. The following are estimates of the soils at each location. Boring one has an estimated permeability of 8 once-cs ,cr 110ure Boring two leas an estirriated permeability of 6 -10 inches n ,r hoti!%. In summary, this site has multiple areas that are proposed for stormwater infiltration system placement. These areas have soils that have seasonal high water tables that are deeper than 84" from the soil surface in the two locations. If the proposed Permanent Pool Elevation is more than 6° below the seasonal high water table elevation, then additional testing and analysis may be required to quantify any affect on adjacent wetlands, surface waters, and/or buffers where applicable. ("Association"), which I copied to you. In that letter I offered, on behalf of W.M. Stanaland Estates, Inc. ("Corporation"), to have the storm water system inspected by the North Carolina Department of Environment and Natural Resources ("NCDENR") to insure that It complies with all state regulations. 1 Informed ivir. Mr. Gore responded in a letter dated March 16, 2004, (see attached) in which he stated that this issue would be discussed at the annual membership meeting on April 17, 2004, with a response to follow shortly thereafter. As of the date of this letter I have not received any further correspondence from Mr. Gore. Therefore, I assume the Association has no further issues with the storm water system and is willing to assume the permits. Please contact Mr. Brooks Gore and issue the storm water permits to the Association.
