Sullins Governor director May 20, 2011 MEMORANDUM TO: Chuck Waklid, MO Matthews FROM: Jay Sau e , Eric Flee Dee Freeman Secretary SUBJECT: Environmental Sciences Section (ESS) Review of 316(a) and 316(b) Documents This Memorandum serves to detail three specific changes in how the ESS reviews and tracks these documents Existing conditions and their corresponding changes are detailed below 1) Traditionally, permittees interact with at least two NCDWQ sections during the servicing of permits with Biological Monitoring Requirements ESS and the Complex Permitting Unit Specifically, the permittee submits biological monitoring reports and proposed biological study plans to the ESS for review ESS comments are then sent directly to the permittee with appropriate copies to the DWQ permitting staff. When dealing with specifics about the permit, the permittee coordinates directly with the Complex Permitting Unit However, based on several interactions between Biological Assessment Unit (BAU) staff and permittees, it has become obvious that this multi -contact approach for the maintenance of these permits has caused confusion and frustration for the regulated community Permittees are unsure where correspondence should be addressed and who to contact if they have questions. Therefore, ESS is recommending that the permittee should address all correspondence directly to the Complex Permitting Unit, including, but not limited to biological monitoring reports and proposed biological study plans. The Complex Permitting Unit can then forward these documents to the ESS for review The ESS will then provide consultation back to the Complex Permitting Unit In essence, ESS will act as technical consultants to the Complex Permitting Unit. This will eliminate confusion among the permit holders and will provide them with a more predictable and user-friendly regulatory environment. The Complex Permitting Unit can thea incorporate recommendations from the ESS with reviews from other agencies including EPA oversight comments 2) Traditionally, ESS reviews of biological monitoring reports and proposed monitoring plans were not systematically managed ESS reviews of biological monitoring reports and proposed biological study plans will be henceforth executed following a standardized methodology (attached). If you should have any questions regarding this document or the associated attachments please feel free to contact Eric Reek Cc. ,;eff Poupart Xo,mAelnick-= Sergei Chernikov Review Document for Environmental Sciences Section Evaluations of 316(a) Balanced and Indigenous Populations Reports (BIP) Introduction Study plans constructed for the evaluation of biological communities associated with facilities requiring a 316(a) thermal variance will be reviewed by the North Carolina Division of Water Quality (NCDWQ) based in part upon the definitions below (1-2) These definitions are pursuant to the requirements of 40 CFR Part 125 Based on these requirements, study plans and the subsequent monitoring reports submitted to the NCDWQ must contain the monitoring components (for lakes and rivers) detailed in the benthos and fish community methodology sections Variation on these monitoring components will be considered on a case-by-case basis Inquires regarding modification of these components must be directed to Jay H. Incorporating uplake, downlake, and near discharge sampling stations will allow the NCDWQ to accurately evaluate the possible effects of the thermal discharge on the benthic macroinvertebrate community and will allow a more effective e,,aluawn of any unacceptable damage done to these communities or populations or the recovery of perturbed ones, and which may be the result of unacceptable environmental stress. 2) Benthic macroinvertebrate monitoring shall be annual. Annual sampling will provide the NCnta WQ with da of sufficient ieniporal resolution to assess benthic macroinvertebrate corrin-waity structure and trends 3) Benthic macroinvertebrate samples should be collected in the same month as previous collections to preserve year-to-year data comparability. 4) At each station, if the burrowing mayflies of the genus Hexagenia spp or Ephemera spp are present, quantitative assessments of the bottom substrate shall be made. Sediment from each of the three ponar replicates per station shall be composited and passed through a USA Standard Testing Sieve (or equivalent manufacturer) with percentages (by weight) of each sediment fraction retained on each respective sieve reported The following sieve sizes (micrometers) are required 4, 6, 8, 12, 16, 20, 30, 40, 60, 80,100, 120, 140, 200, and 270. Hexagenia spp and Ephemera spp are sensitive to particle size and low dissolved oxygen Quantitatively measuring the sediment size will help rule out possible confounding factors associated with particle size and will allow NCDWQ to more accurately assess any possible effects the thermal discharge is having on these communities. 5) A minimum of three ponar replicates per sampling station shall be collected A minimum of three ponar replicates will provide sufficient sampling resolution to comprise a representative sample of the benthic community at each sampling station 6) All taxa shall be identified to the lowest practical taxonomic level. Specifically, 0-2 specimens are recorded as RARE, 3-9 specimens are recorded as COMMON and 10 or more specimens are recorded as ABUNDANT Enumerating benthic macroinvertebrate taxa by these methods will provide the NCDWQ with fine and coarse -scale relative abundance data of the pollution tolerant and pollution intolerant taxa within the invertebrate community, 7) All samples in streams and rivers shall require a habitat assessment (NCDWQ 2006).
