Date Received: April 8`h 2022 Plan Type: New Dear Mr. Hagedorn: This office has reviewed the subject erosion and sedimentation control plan. We find the plan to be acceptable with modifications and herby issue this Letter of Approval with Modifications. Modifications must be received in this office no later than two weeks prior to the project start date. Failure to submit modified plans can result in a violation and fine under the Iredell County Land Development Code. The Modifications required for Approval are listed on the attached page. The Certificate of Approval issued by Iredell County must be posted at the job site. This plan approval shall expire three (3) years following the date of this approval as is required by Title 15A NCAC 4B.0129 and Appendix H of the Iredell County Land Development Code. Title 15A NCAC 4B 0118(a) and Appendix H of the Iredell County Land Development Code requires that a copy of the approved erosion control plan be on file at the job site. Any amendments and/or revisions to the approved plan must be reviewed and approved prior to implementation in order for the site to remain in compliance. Failure to submit plans for approval may result in administrative actions and/or penalties as indicated in the Iredell County Land Development Code. Also, this letter gives notice as required by G.S. I I3A-61.1(a) and Appendix H of the Iredell County Land Development Code, of our right of periodic inspection to insure compliance with the approved plan. Iredell County's Sedimentation Pollution Control Program is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the Letter of Approval with Modifications NC Park 40/77 April 13"' 2022 Page 2 of 4 commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Iredell County Land Development Code and the Sedimentation Pollution Control Act of 1973, (North Carolina General Statute 113A-S 1 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act and Code. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval. It is the responsibility of the applicant to obtain all other required permits or approvals. As of May 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deq.nc.gov/NCG0L Please direct questions about the NOI form to Annette Lucas at Annette.lucas@ncdenr.gov or Paul Clark at Paul.clark@ncdenr.gov. ncdenr.gov. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. As of May 1, 2019, a $100 fee will be charged annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. In addition, it is required that this office to be notified of the proposed starting date for this project. Failure to notify this office of the starting date may result in a Notice of Violation and civil penalty. As required in the approved plan construction sequencing, please schedule a preconstruction conference with our staff prior to land disturbing activity. Your cooperation is appreciated. Suggested changes are designated as "SC" for improvement of the plan. 1. Provide a copy of all updated deeds or proof of sale of all properties within the limits of disturbance showing NP BGO NC Park Statesville, LLC prior to any land disturbing activity. —RC 2. Close off stream crossings with silt fence when not in use. —RC 3. In the Construction Sequence Phase 1 Step 1, remove Gaston County and include language to schedule a preconstruction meeting with the City of Statesville and Iredell County Erosion Control prior to land disturbing activity. —RC 4. Ensure all basin baffles are extended to the basin sidewalls. RC 5. Ensure there are 3 baffles between the diversion entry point and the skimmer. —RC 6. Install diversions or berms to ensure as much of the drainage area as possible drains to the back end of the basin opposite of the skimmer so that minimal sheet flow occurs to the skimmer side. —RC 7. Turn up silt fencing at the basin outlets so treated water can discharge from the limits of construction unobstructed. —RC 8. Leave baffles in the basins in phase 2 until the majority of the drainage area is stabilized and permission is given from erosion control to convert to BMPs. -RC 9. Mark slope drain locations on the plans. —RC 10. Correct the disturbed acreage in the erosion control section of the stormwater report from 44.5 acres to 43.5 acres. -RC 11. Have uniform labeling of the erosion control blankets. Labeled as "EC" in the key but some locations are labeled as "EB" on the plans. —RC 12. Ensure the limits of disturbance do not encroach on City of Statesville stream buffer requirements unless permitted to do so by the City. —RC 13. Provide a seasonal seeding detail. —RC 14. Label the sediment basin number on the calculation sheets in the stormwater report. —RC 15. Adjust Basin 4 skimmer orifice size to 4 inches to dewater the required volume of 68,598ft3 in as close to 3 days' time (2.87 days) possible. —RC 16.
