REQUIRED ITEMS:
1. This completed application form (with original signature)
2. Legal documentation of transfer of ownership (such as relevant pages of a deed or a bill of sale) is
required for an ownership change request. Articles of incorporation are not sufficient for an
ownership change but can be provided for a name change.
3. Information to document facility, industrial activities, stormwater discharges, or outfall changes
as noted in item IV above (if appropriate)
Why is this information needed?
Regulations in 40 CFR §122.63 allow for minor modifications to NPDES permits for a change of
ownership or operational control of a facility, provided that information supports that no other change
in the permit are necessary.
Why does this form need to be mailed in?
Permittees and applicants must fulfill signatory requirements in the NPDES federal
regulations in 40 CFR §122.22 (please see those regulations for guidance). Until NCDEQ's
electronic submission process meets Cross -Media Electronic Reporting (CROMERR)
requirements, this original signed (not digital signature) form must be mailed to the
address below. The uploaded copy is stored as part of the permit record in the Division's
digital repository.

GENERAL WARRANTY DEED

THIS GENERAL WARRANTY DEED (this "Deed") is made effective as of
March 9 , 2021, by and between Cargill, Incorporated, a Delaware corporation, with a
mailing address of 15407 McGinty Road West, Wayzata, Minnesota 55391 (hereinafter
"Grantor"), and Legacy Feeds, LLC, a North Carolina limited liability company, with a principal
mailing address of 604 Benton Pond Place, Fremont, North Carolina 27830 (hereinafter
"Grantee").
Grantor, in consideration of the sum of One and no/100 Dollar ($1.00) and other good and
valuable consideration, to it paid by Grantee, the receipt of which is hereby acknowledged,
conveys, confirms and warrants to Grantee, its successors and assigns, in fee simple the following
described real estate in Wilson County, North Carolina, more particularly described in Exhibit A
(attached hereto and made a part hereof) (the "Property"), together with all hereditaments and
appurtenances belonging thereto and all improvements and buildings thereon, subject to those
exceptions set forth in Exhibit B (attached hereto and made a part hereof) and to the extent they
lawfully affect the Property (the "Permitted Exceptions').
The Property having been previously conveyed to Grantor by instruments recorded in
Book 1360, Page 96 of the Wilson County Recorder's Office, Book 992, Page 588 of the Wilson
County Record's Office, and Book 994, Page 271 of the Wilson County Recorder's Office.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and
appurtenances thereto belonging to the Grantee in fee simple.
AND Grantor hereby covenants with Grantee, and its successors in interest, that Grantor is
seized of the premises in fee simple, has the right to convey the same in fee simple, that title is
marketable and free and clear of all encumbrances, and that Grantor will warrant and defend the
title against the lawful claims of all persons whomsoever, except for those matters which are
Permitted Exceptions, but against no others.
GRANTEE, ITS SUCCESSORS AND ASSIGNS AND INCLUDING ANY TENANT OR
OPERATOR OF THE PROPERTY, WILL NOT, AND WILL NOT PERMIT ANY THIRD PARTY,
for a period of four (4) years from and after the date of this Deed, without Grantor's prior written
consent, produce at, and/or sell bagged feeds from, the Property. FURTHERMORE, the Property
may not be sold to a competitor of Grantor for a period of two (2) years following the date of this
Deed. The term "competitor" as used herein shall mean any person or entity that produces and/or
sells bulk or bagged animal feeds.
