Secretary % Director, Division of Water Resources NORTH CAROLINA Environmental Quality April 18, 2022 Ms. Jessica Bednarcik, Senior Vice President EHS Duke Energy 526 S.Church Street Mail Code EC3XP Charlotte,NC 28202 Subject: Seep Management Amendment to Closure Plan Conditional Approval& Correction and Clarification of DEQ July 8,2021 Letter Duke Energy Progress, LLC—Mayo Steam Electric Plant NPDES Permit NC0038377 Person County Dear Ms. Bednarcik: In a July 8, 2021 letter,the Department of Environmental Quality(DEQ) issued its conditional approval of the Corrective Action Plan(CAP) Update for the Mayo Steam Electric Plant that had been submitted by Duke Energy on December 31,2019. The letter also referenced the Seep Management Plan Amendment submitted by Duke Energy to satisfy the terms of Section 2.d.of Special Order by Consent(SOC) S18-005, but mistakenly stated it was an amendment to the CAP when it was submitted as an amendment to the Mayo Steam Electric Plant's Closure Plan. To provide correction and clarification to issues associated with this matter,DEQ offers the following: • DEQ has conditionally approved the Seep Management Plan Amendment to the Closure Plan for the Mayo Steam Electric Plant submitted on May 10, 2021. • All conditions and requests for additional information stated in DEQ's July 8, 2021 conditional approval letter for the Mayo Steam Electric Plant CAP Update remain in effect. With particular regard to the subject of this letter, statements in the July 8,2021 letter regarding seep management, surface water quality evaluation and reporting, and the Surface Water Assessment Plan are equally applicable to this conditional approval of the Seep Management Amendment to the Closure Plan. As an interim measure,Duke Energy shall conduct monitoring and reporting of seeps as described in Section 3.5 of the Seep Management Plan until approval of the Surface Water Assessment Plan required in DEQ's conditional approval of the CAP Update. Reporting of the results of testing should continue to be submitted to DEQ via the email address used for the reporting of SOC data (desocdata@ncdenr.gov). Duke Energy should continue to work with the staff of DWR's Groundwater Resources Section in these areas. • The conditional approval provided in this letter activates the SOC termination provision for the Mayo Steam Electric Plant found in Section 2(b)(4) of SOC S 18-005.As a result, SOC requirements shall terminate on May 18,2022(30 days following the date of this letter)for this facility, and, paired with the termination of the SOC for the Roxboro Plant(affirmed October 8, 2021), SOC S18-005 shall terminate in its entirety on that date. We hope the points noted above provide clarity in this matter and will allow us to continue make progress toward final resolution of all matters associated with coal ash at the Mayo Steam Electric Plant.
