RHODES, AICP Assistant County Manager for Planning and Environment This is to advise you that the Pitt County Technical Review Committee conditionally approved the soil erosion and sedimentation control plan and construction plan for ARTHUR CHRISTIAN CHURCH on April 13, 2022, and hereby issue this Certificate of Approval. Conditions and requirements as a part of this approval are attached below. Copies of the draft minutes from the meeting will be available upon request prior to the next Technical Review Committee meeting. As stipulated on the financial responsibility form, you are responsible for ensuring compliance with all aspects of the approved plan and the Pitt County Soil Erosion and Sedimentation Control Ordinance. Your primary objectives include, but are not limited to, preventing offsite sedimentation, preventing sediment from entering watercourses, and establishing vegetation on all disturbed areas within 7-14 calendar days, following any completion of a phase of grading. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deq.nc.gov/NCG0l. Please direct questions about the NOI form to Annette Lucas at Annette.lucasCncdenngov or Paul Clark at Paul.clark(cyncdenngov. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. Please be aware that your project will be covered by requirements of the NPDES Construction Stormwater General Permit NCG010000. Please become familiar with all the requirements and conditions of this permit in order to achieve compliance. Upon discovery of noncompliance by our office, the following actions may be taken: 1. No further permits for building or other construction will be issued. 2. The authority to continue construction, other than for erosion control measures, will be terminated. 3. Penalties of up to $5000 per day may begin to accrue. Failure to immediately comply upon notice of noncompliance will result in injunctive and/or criminal action. Other Comments: 4. This erosion control plan shall expire three years following the date of approval if no land disturbing activity has been undertaken. 5. The Division of Water Quality may pursue legal action against you in order to enforce requirements of the NPDES, Phase II permit. 6. The Pitt County Soil Erosion and Sedimentation Control Ordinance authorizes County officials to inspect sites to ensure compliance with the Sedimentation Pollution Control Act. Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. Land disturbance shall not begin until a preconstruction meeting has taken place. No stormwater BMP's are required due to the nutrient loadings being below the maximum loading requirements for nitrogen and phosphorus and the attenuation calculations not showing more than a 10% increase in peak flow volumes from pre to post development. 2. The stormwater permit shall be valid for a period of two years from the date of issuance unless a valid building permit has been issued and maintained for the site or the stormwater permit has been revoked by Pitt County. If after two years the permitted activity has not begun nor a valid building permit secured, this permit shall expire. 3. All land purchases and transfers necessary to secure the property for development shall be completed prior to issuance of this permit. 4. The development of the tract shall proceed in conformity to all plans, design features, and restrictions submitted as part of the stormwater permit application and kept on file by the Pitt County Planning Department except that the Pitt County Stormwater Administrator may approve minor changes, consistent with the approved plan, as required by field conditions and in accordance with Section 15(G) of the Pitt County Stormwater Ordinance for Nutrient Control. 5. If any amendments are made to the approved plan, revised stormwater calculations must be submitted to the Pitt County Planning Department. 6. Show any stockpile/borrow locations. 7. Revise/Remove DEQ notes on C3 about disturbed acreage and contact info. 8. Additional silt fence may be required along the southern edge of the property if erosion occurs during construction. 9. Each lot will be evaluated in accordance with rules .1940 of the Laws and Rules for Sanitary Sewage Collection, Treatment, and Disposal (15A NCAC 18A .1900). 13. No fill material (including construction spoils) is allowed on any area to be used for a sewage disposal system or 100% repair area. Any amount of fill found on these areas will be grounds for disapproval of the proposed lot. 14. The location of any proposed berms must be shown on all subsequent maps. The final dimensions of the completed berm must be shown so that the Environmental Health staff can verify that no portion of any berms will interfere with the sewage system or 100% repair locations. 15. If underground electrical lines or natural gas lines cross the property at any point, they must be flagged by ULOCO before the site is evaluated by the Environmental Health staff. 16. The location of any existing or proposed drainage tile must be field located and shown of a surveyed map provided to Environmental Health staff. 17. A backhoe may be required for the site evaluations (15A NCAC 18A .1939(b)). 18. Any riparian buffers or floodways must be noted on subsequent maps. [General Comments] Soils located on site include Bb, Co, GoA, Ly, NrA, NrB, NrB2 and Ra per the Pitt County Soil Survey, Sheet 48. ■ Soils are prime farmland or have statewide importance for farming.
