The entity did not change. Hendrix Brothers of Hoke is a special purpose entity, used solely for this one particular
project. We oversee the project and thus this project LLC.

We are reviewing the modification request to change the legally responsible individual
for this permit, NCC210160 (Blackhawk Landing).
Can you please verify two things?
1) Is David Vanoy also with Hendrix Brothers of Hoke, LLC? Or is he with another
organization? Is this a change of ownership of the project, or only a change to
the individual with Hendrix Brothers of Hoke, LLC who is responsible? This is
only a change of the individual who should be notified. Both D Ralph Huff III
and David Vannoy are managers of the LLC. Please let me know if you are in
need of a copy of the Operating Agreement.
2) The request was submitted by Kathryn Brown with RHH Land Investors, LLC,
which is not the original permitted organization. Is Kathryn Brown also affiliated
with Hendrix Brothers of Hoke, LLC, or with someone else? Modification
requests must be submitted by someone with the permitted entity
organization. Kathryn Brown works under me. I am the Vice President of RHH
Land Investors, LLC, Mr. Huff's Land Development company. As of October
2021, all of his land development projects, and associated LLCs are now under
my purview.

Thank you for the clarification. We cannot transfer NCG01 COCs to new owner entities
through a modification, so it is important to understand the request.
