Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 970104 Modification, dated September 30, 1998, for the construction of the project, Magnolia Greens. This permit shall be effective from the date of issuance until September 30, 2008, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The subdivision is permitted for 364 lots. The built -upon area for each lot has been restricted as follows: 288 lots @4,000 ftZ in Sections 1-9 and 76 lots @3,500 ft2 in Sections 10 and 11. 3. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. Side) Q State Stormwater Management Systems Permit No. SW8 970104 Modification 5. The uncollected portions of the low density subdivision are served by a Curb Outlet System. The swales are generally located between lots, and must be maintained with a stable, vegetated 5:1 sideslope, be a minimum of 100' long, have a longitudinal slope of 5% or less, and be able to carry the peak flow from a 10 year storm in a non -erosive manner. 6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from the Division of Water Quality, and responsibility for meeting the built -upon area limit is transferred to the individual property owner. 7. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 8. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee grants permission to DENR Staff to enter the property for the purposes of inspecting the project for compliance with the conditions of this permit. 4. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 5. Decorative spray fountains will not be allowed in the ponds. 6. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not 4 State Stormwater Management Systems Permit No. SW8 970104 Modification limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 7. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 8. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on the Project Data Sheet, per Section I, Part 2. The recorded statements must follow the form: a. "The maximum built -upon area per lot in Sections 1-9 (288 lots) is 4,000 ft2 and in Sections 10 and 11, (76 lots), the built -upon area per lot is limited to 3,500 ft2 square feet, inclusive of that portion of the right-of-way between the lot line and the edge of pavement, structures, pavement, walkways of brick, stone, or slate, but not including open wood decking." b. "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. "Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State." d. "No one may pipe, fill in or alter the designated curb outlet swales." "All runoff from the impervious surfaces of the clubhouse area, including parking lots, roads, and building, must drain into Pond 43 of the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the pond, or grading perimeter swales and directing them into the pond or street." 9. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 10. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat. The recorded copy must be signed by the Permittee, dated, stamped with the deed book number and page, and bear the stamp/signature of the Register of Deeds. 11. Prior to transfer of ownership, the pond must be inspected by DWQ personnel, and determined to be in compliance with all permit conditions. Records of maintenance activities will be required. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. III. GENERAL CONDITIONS S State Stormwater Management Systems Permit No. SW8 970104 Modification 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a "Name/Ownership Change Form" must be submitted to the Division of Water Quality accompanied by appropriate documentation from the parties involved, such as a copy of the deed of trust. Other supporting materials, such as a signed Operation and Maintenance plan in the case of engineered systems, will also be required. The project must be in good standing with DWQ. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 6. Permittee grants permission to staff of the DWQ to access the property for the purposes of inspecting the stormwater facilities during normal business hours. Within the drainage area of Pond 1, only Greymoss is noted as 22' wide, and it does not scale almost 3,000 feet long. Also, from the point where Grandiflora Drive and Rubra Drive meet, to the lotline between Lot 5-27 and Lot 5-29, scales 5,720 feet. The difference between your number and mine cannot be accounted for as print stretch. Please check the linear feet of pavement for the 34' wide street and the 22' wide street. Where do you account for the eyebrow and cul-de- sacs? Please make the necessary revisions to justify your numbers. I do not expect to match up exactly, but I think that we must be in the ballpark. 2. The cul-de-sac detail is specific only to Cumbertre and Kobus Courts. What about the cul-de- sacs on Rubra, Cherrywood, Chelsea, and Waverly? Please provide a detail for them, or include them on the existing cul-de-sac detail. 3. It appears that you have well over -estimated the road impervious area for Pond 3, based on the drainage area shown. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: I had assumed that the original calculations for the ponds were based on the master plan drainage areas, however, I am having difficulty matching up the roads and numbers of lots that you say are within the drainage area of each pond with what the master plan shows. For example, in Pond 1, the number of lots appears to be overestimated by 22 lots, and the road is underestimated by about 30,000 square feet. For Pond 3, the plans show 4 full lots and 1/2 of 3 lots draining to the pond, not 1/2 of 8 lots, and the road has been underestimated by over 12,000 square feet. I think you forgot to include the sidewalks in the road totals for Ponds 3 and 5. For Pond 5, the total number of lots has been overestimated by 3, but the road has been severely underestimated by over 59,000 square feet. 2. For Pond 1, the built -upon area indicates that an additional .68 acres is added due to adding the area that drains through FES 12A. Isn't this already included in the road and lot totals provided? A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The first two pages of the original application were sent to you with the April 6, 1998 later. Please revise Section III of the application to list the statistics for the 3 pond drainage basins and the overall project individually. 2. Please don't round any numbers before reaching the final calculation, unless the rounding will result in an excess design condition. For example, you rounded the percent impervious for Pond 1 up to 25 % from 24 %, to calculate the SA/DA ratio which results in excess required surface area. For Pond 3, you rounded the SA/DA ratio down, from 1.04 % to 1 %, resulting in a loss of 254 square feet of required surface area. Fortunately, you incorrectly computed the percent impervious as 27.2%, but it is actually 25.4%, so you came out OK. Please revise your Pond 3 calculations to indicate the correct impervious percentage and SA/DA ratio. 3. Please report the surface areas provided at the storage elevations. For Pond 1, if the surface area provided at elevation 18 is 83,975 square feet, and if the storage volume is 2.87 acre-feet at 19.9 (125,017 cubic feet) then the surface area at 19.9 comes out to be 47,621 square feet, which is impossible. Using a minimum surface area at 19.9 of 83,975, results in a minimum storage volume of 159,552 cubic feet. How is the runoff from FES 17A treated? There is no curb outlet Swale noted, and it does not appear to drain into Pond #1. FES 17A is shown within the drainage area of Pond 1, but it is not clear how the runoff will get into Pond #1. 2. You have specified that all curb outlet treatment swales will be piped to the front building setback. This is OK only as long as a minimum of 100 linear feet of 5:1 swale is provided. If piping to the front building setback will result in less than 100 feet of swale, the piping must be shortened to provide the 100' of swale. 3. The following design requirements for extended dry -detention have, not been provided: a. A vegetation plan to be prepared by a licensed professional. b. Demonstrate that the design storage provides for sediment storage equal to 20% of the detention volume. C. Inlet and outlet channel protection from scour during high flows from large storms. d. Verification that the SHWT is at least l' below the proposed bottom elevation. e. A forebay to minimize cleanout problems f. On Attachment A, specify the total number of lots that will have 4,000 square feet of BUA and the total number of lots that will have 3,500 square feet of BUA. 9. The calculations for Pond 3 indicate that a total volume of 18,235 cubic feet is provided in the pond between elevations 26 and 28. If the surface area provided at the permanent pool of 26 is 11,000 square feet, then in order for the volume to equate to 18,235, the surface area at 28 must be 7,235, which is impossible. Even with a vertical sided pond, the minimum volume provided would be 22,000 cubic feet. Please revise the volume and orifice calculations to accurately reflect the volume provided in the pond. Each 100' Water Quality Swale has been identified with a number. Corresponding velocity calculations for each swale are attached. 2. Storm drain discharging to a water quality swale has been revised such that piping will end Q? at the first setback line of adjacent lots (30' back of the right-of-way). 3. Storm drain outlets to treatment ponds have been revised to eliminate short-circuiting. 4. The proposed outlet for Pond #5 has been located on the Master Plan and section and plan details are also attached. Pond #6 will not function as a treatment pond. 5. The 916.5 acre site area does include 92.8 acres of wetlands, yielding an overall impervious coverage of 23.0 %. Deduction of the 92.8 acres of wetlands from the overall project site increases the percentage of impervious coverage to 25.6%. 6. Future development may impact water quality devices (such as the 100' water quality swales) and necessitate modification of such devices. Should this occur, any proposed modification will require permit modification. 7. Calculations for Stormwater Treatment Pond #3 are attached. The drainage area delineations and outlets for lots 9-25 through 9-30 have been more clearly illustrated on the attached plan. 9. Portions of tract N will drain to Pond 6 as shown on the attached plan. Pond 6 will not be a water quality device and all drainage from tract N will be treated via. a 100' water quality swale prior to entering Pond 6. Tracts E and O will not drain to Pond 6. 10. The Golf Maintenance Facility does not drain to Pond 5. The delineated drainage area to Pond 5 has been revised for clearer illustration. 11. The outlet from Pond 3 will not discharge to a water quality swale. All water quality swales are to be stand alone devices. 12. Collection swales conveying piped drainage to treatment ponds shall be graded at 3H:1V side slopes. 13. The future development of tracks P and Q shall require individual engineered systems for treatment of runoff. 14. All multi -family and commercial development tracts shall require individual engineered systems for treatment of runoff. 15. A dry detention basin and a collection swale are specified for the outlet FES#12A. The receiving pond is not to provide treatment. The discharge from FES#12A shall be treated prior to entering the pond by way of the dry detention basin. 16.. To scale plan and section details are attached for all storm water treatment ponds proposed for permitting. 17. Drawdown and orifice sizing calculations have been provided for all storm water treatment ponds proposed for permitting. 18. Pond 6 shall not function as a water quality device and is no longer proposed for permitting. 19. All ponds proposed for permitting have been designed for 90% TSS removal eliminating the need for a vegetated filter at the pond outlet. 20. Is the 92.8 acres of wetlands included in the 916.5 acre site area? 6. What happens to the WQ swales that are located inside the tract boundaries of future development? It appears that the Golf Maintenance Facility could easily drain into Pond 5, but again, the drainage area delineation does not support this. 11. The WQ swales must stand alone; no additional upstream drainage can be routed through them. It appears that the oulet of Pond 3 will drain through the WQ swale opposite Lot 5-28, and that upstream ditch flow from the CP&L right-of-way will drain through the WQ swale behind Lots 1-1 and 1-2. 12. The 100' WQ swales are not required for those areas that are included in a pond to be permitted by DWQ, ie., Ponds 1, 5 and 6. There are several WQ swales within the drainage area to Pond 6 that have WQ swales noted. This is not required. Those collection swales may have a 3:1 side slope. 13. It appears from the proposed plans that the more dense development of multi -family, Tracts P and Q, will be located closest to the receiving stream. These tracts will be identified in the master plan permit as being required to provide individual engineered systems for their runoff. 14. For permitting purposes, all multi -family and commercial development tracts will be required to provide engineered systems. 15. At FES #12A, between Lots 4-6 and 4-8, no WQ swale is specified. If the one acre Pond will be the treatment, please provide the State calculations for it. If not, please specify a WQ swale at that location. 16. Provide a to scale detail of the grading in each pond proposed for permitting, which indicates the overall pond dimensions. Label and delineate the permanent pool and design pool contours. Provide a detail of the outlet structure and orifice size for each pond. Permitted ponds must provide an outlet. 17. Provide drawdown and orifice sizing calculations for the ponds. The runoff must drawdown in 2-5 days. 18. The bottom and forebay elevations for Pond 6 in the table do not appear correct. The use of two columns on the application is only necessary when the classifications differ and result in a different allowable built -upon area, ie., one drains to SA waters @25 % BUA, and the other drains to SC waters 030 %. In this case, the classifications for both Jackey's Creek and Sturgeon Creek result in 30 % BUA. As a result, you may combine the tracking tables you show on the plan. 2. The breakdown section of the application must be completed, regardless of the phasing of the development. In the end, there will be a total BUA. If you want us to issue a permit to the Magnolia Greens POA, you must supply proof that it is the landowner of record. If you can't supply this, please have Mr. Stephens sign the application as President of Landmark Developers, and revise the "Owner's Name" to Landmark Developers. At some point in time, after the deed restrictions are recorded and the curb outlet swales and ponds are determined to be in compliance with the permit, then a transfer of ownership to the POA will be considered. Phased transfers will be considered due to the fact that this project will be phased, and not all construction will be completed and ready for transfer at the same time. 10. Please identify the future single family and multi -family tracts with letters or numbers and list these in the table, along with the expected maximum number of lots and BUA. Any single family tracts exceeding 40 % BUA or any multi -family tracts exceeding 30 % BUA must submit an engineered system for approval. 11. The plans show a solid, heavy line, but it is not identified as to what it represents. The dashed areas supposedly delineating the drainage areas are not very clear as where thay start and stop. 12.
