The Wilmington Regional Office received the Stormwater Management Permit Application for Magnolia Greens on
October 10, 1997, with final information on September 22, 1998. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H.1000. We are forwarding Permit No. SW8 970104 Modification, dated September 30, 1998, for the construction of
the project, Magnolia Greens.
This permit shall be effective from the date of issuance until September 30, 2008, and shall be subject to the conditions
and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this
permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will
result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in
the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

construction, operation and maintenance of 3 detention ponds and a curb outlet system in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the approved
stormwater management plans and specifications and other supporting data as attached and on file with and
approved by the Division of Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until September 30, 2008 and shall be subject to the
following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on
page 3 of this permit, the Project Data Sheet. The subdivision is permitted for 364 lots. The built -upon
area for each lot has been restricted as follows: 288 lots @4,000 ftZ in Sections 1-9 and 76 lots @3,500
ft2 in Sections 10 and 11.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable
parts of the permit.

5. The uncollected portions of the low density subdivision are served by a Curb Outlet System. The swales
are generally located between lots, and must be maintained with a stable, vegetated 5:1 sideslope, be a
minimum of 100' long, have a longitudinal slope of 5% or less, and be able to carry the peak flow from a
10 year storm in a non -erosive manner.
6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the
allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised
without approval from the Division of Water Quality, and responsibility for meeting the built -upon area
limit is transferred to the individual property owner.
7. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
8. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall
submit a written time schedule to the Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and certification in writing to the Director that the
changes have been made.
II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and operational for its
intended use prior to the construction of any built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
3. The permittee grants permission to DENR Staff to enter the property for the purposes of inspecting the
project for compliance with the conditions of this permit.
4. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation
of this permitted facility, a certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
5. Decorative spray fountains will not be allowed in the ponds.
6. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not

limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
7. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
8. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to
the amount as shown on the Project Data Sheet, per Section I, Part 2. The recorded statements must
follow the form:
a. "The maximum built -upon area per lot in Sections 1-9 (288 lots) is 4,000 ft2 and in Sections 10
and 11, (76 lots), the built -upon area per lot is limited to 3,500 ft2 square feet, inclusive of that
portion of the right-of-way between the lot line and the edge of pavement, structures, pavement,
walkways of brick, stone, or slate, but not including open wood decking."
b. "The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State."
C. "Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the State."
d. "No one may pipe, fill in or alter the designated curb outlet swales."
"All runoff from the impervious surfaces of the clubhouse area, including parking lots, roads,
and building, must drain into Pond 43 of the permitted system. This may be accomplished
through providing roof drain gutters which drain to the street, grading the lot to drain toward the
pond, or grading perimeter swales and directing them into the pond or street."
9. This permit shall become voidable unless the facilities are constructed in accordance with the conditions
of this permit, the approved plans and specifications, and other supporting data.
10. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of
recording the plat. The recorded copy must be signed by the Permittee, dated, stamped with the deed
book number and page, and bear the stamp/signature of the Register of Deeds.
11. Prior to transfer of ownership, the pond must be inspected by DWQ personnel, and determined to be in
compliance with all permit conditions. Records of maintenance activities will be required.
12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of construction.
III. GENERAL CONDITIONS

1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or
there is a name change of the Permittee, a "Name/Ownership Change Form" must be submitted to the
Division of Water Quality accompanied by appropriate documentation from the parties involved, such as
a copy of the deed of trust. Other supporting materials, such as a signed Operation and Maintenance plan
in the case of engineered systems, will also be required. The project must be in good standing with
DWQ. The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and
federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement stormwater management systems.
5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
6. Permittee grants permission to staff of the DWQ to access the property for the purposes of inspecting the
stormwater facilities during normal business hours.

"DECLARANT'), heretofore executed the Master Declaration of Protective Covenants for
Magnolia Greens, and caused the same to be recorded in Book 1191, Page 991, et seq. in the
Brunswick County Registry (herein the "Protective Covenants'); and
WHEREAS, in accordance with paragraph 17.2 of the Protective Covenants, the
DECLARANT has the right to amend the Protective Covenants; and
WHEREAS, the DECLARANT desires to amend paragraph 8.1 in order to correct
it and to amend paragraph 12.6 to include the built upon area including impervious surfaces for

Association and of the approval of the DECLARANT, as long as the DECLARANT owns any
property described in EXHIBITS A and B) by any authority having the power of
condemnation or eminent domain, each Owner shall be entitled to written notice. The award
made for such taking shall be payable to the Association and shall be used as set forth in C,()C.JLj_9

Brunswick County Registry (herein the "Protective Covenants"); and
WHEREAS, in accordance with paragraph 15.3 and paragraph 17.2 of the
Protective Covenants, the DECLARANT has the right to amend the Protective Covenants; and
WHEREAS, the DECLARANT has developed additional lots designated as
Section V Magnolia Greens all of which the DECLARANT desires to be made subject to the
Protective Covenants; and

As requested in your September 10, 1998 letter, please find enclosed the additional information
you requested for the above referenced stormwater submittal.

In addition to the enclosures we offer the following items to answer your questions and
comments.
1. Attached is a summary and a map indicating the impervious areas of pond 1 basin. The
summary indicates that the total impervious area of pond 1 basin is 1,277,877.66 sf, within
99.70% of the 1,281,710 sf you indicated
2. A Cul-de-sac detail of Rubra, Cherrywood, Chelsea and Waverly has been added to the
Stormwater Master Plan Drawing.
3. The area of roads within pond 3 basin has been revised to 1.95 acres. Drainage calculations
have also been revised to reflect the revised impervious areas and are enclosed for your
review.
4. The 0.20 acres of impervious shop area has been added to the enclosed drainage
calculations for pond 5.

1. I am still unable to duplicate your numbers for Pond 1. While the pond is adequately sized,
we must agree on the total built -upon area that is being treated by the pond prior to
permitting. Our discrepancies are in the road and lot totals. Please compare my figures to

Your calculations account for much more 22' pavement than mine do. Within the drainage
area of Pond 1, only Greymoss is noted as 22' wide, and it does not scale almost 3,000 feet
long. Also, from the point where Grandiflora Drive and Rubra Drive meet, to the lotline
between Lot 5-27 and Lot 5-29, scales 5,720 feet. The difference between your number and
mine cannot be accounted for as print stretch. Please check the linear feet of pavement for the
34' wide street and the 22' wide street. Where do you account for the eyebrow and cul-de-
sacs? Please make the necessary revisions to justify your numbers. I do not expect to match
up exactly, but I think that we must be in the ballpark.
2. The cul-de-sac detail is specific only to Cumbertre and Kobus Courts. What about the cul-de-
sacs on Rubra, Cherrywood, Chelsea, and Waverly? Please provide a detail for them, or
include them on the existing cul-de-sac detail.
3. It appears that you have well over -estimated the road impervious area for Pond 3, based on
the drainage area shown. Please compare numbers:

Specifically, we have addressed the following items from your request for additional
information:
The original pond calculations were based on the master plan drainage areas,
but have not been updated to reflect all of the lot revisions on the project. The
impervious inventories for the Ponds 3 and 5 have been revised. A new set of
calculations has been compiled and is attached for your review. Please
disregard previously submitted calculations for Ponds 3 and 5. The impervious
inventory for Pond 1 has been verified. The previously submitted calculations for
Pond 1 are correct and have not been revised.
2. The area that drains through FES 12A was not included in the calculations for
Pond No. 1 prior to the June 24, 1988 submittal. The drainage area for FES 12A
is comprised of 4.4 acres, including 1.69 acres of impervious surfaces (0.56 ac.
in roads, 0.13 acres in sidewalks, and 1.0 acres in lots). The drainage area for
FES 12A is included in the new calculations for Pond No. 1 and is attached for
your review.

The Wilmington Regional Office received a Stormwater Management Permit Application for
Magnolia Greens on June 24, 1998. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
I had assumed that the original calculations for the ponds were based on the master plan
drainage areas, however, I am having difficulty matching up the roads and numbers of lots
that you say are within the drainage area of each pond with what the master plan shows. For
example, in Pond 1, the number of lots appears to be overestimated by 22 lots, and the road
is underestimated by about 30,000 square feet. For Pond 3, the plans show 4 full lots and 1/2
of 3 lots draining to the pond, not 1/2 of 8 lots, and the road has been underestimated by over
12,000 square feet. I think you forgot to include the sidewalks in the road totals for Ponds 3
and 5. For Pond 5, the total number of lots has been overestimated by 3, but the road has
been severely underestimated by over 59,000 square feet.
2. For Pond 1, the built -upon area indicates that an additional .68 acres is added due to adding
the area that drains through FES 12A. Isn't this already included in the road and lot totals
provided? If not, please specify exactly where this additional .68 acres comes from, ie., lots,
roads, etc.

Specifically, we have addressed the following items from your request for additional information:
1. Section III of the permit application has been revised to list the statistics for the engineered
ponds and the overall project individually.
2. Pond 3 calculations have been revised to indicate the correct impervious percentage and
SA/DA ratio.
3. The storage volume provided in Pond #1 is 3.75 acre-feet. The calculations have been
revised to reflect the actual storage volume. The orifice calculations have also been
revised.
4. The required storage volume for Pond #5 is 23,378 cubic feet. Pond #5 calculations have
been revised to reflect the required volume and to show adequate volume provided. The
calculations have also been revised to show that the 2" orifice will provide sufficient draw
down for the stored volume.
5. Pond details have been revised to reflect only the existing and proposed contours.
6. The forebay section detail with vegetated shelf information has been included on the pond
detail sheets.
7. Each street has been identified with a name. Street names are listed under the appropriate
road section detail.

The Wilmington Regional Office received the previously requested information for the Stormwater
Management Permit Application for Magnolia Greens Subdivision on April 24, 1998. A preliminary review
of that information has determined that the application is not complete. The following information is needed
to continue the stormwater review:
1. The first two pages of the original application were sent to you with the April 6, 1998 later.
Please revise Section III of the application to list the statistics for the 3 pond drainage basins
and the overall project individually.
2. Please don't round any numbers before reaching the final calculation, unless the rounding will
result in an excess design condition. For example, you rounded the percent impervious for
Pond 1 up to 25 % from 24 %, to calculate the SA/DA ratio which results in excess required
surface area. For Pond 3, you rounded the SA/DA ratio down, from 1.04 % to 1 %, resulting
in a loss of 254 square feet of required surface area. Fortunately, you incorrectly computed
the percent impervious as 27.2%, but it is actually 25.4%, so you came out OK. Please revise
your Pond 3 calculations to indicate the correct impervious percentage and SA/DA ratio.
3. Please report the surface areas provided at the storage elevations. For Pond 1, if the surface
area provided at elevation 18 is 83,975 square feet, and if the storage volume is 2.87 acre-feet
at 19.9 (125,017 cubic feet) then the surface area at 19.9 comes out to be 47,621 square feet,
which is impossible. Using a minimum surface area at 19.9 of 83,975, results in a minimum
storage volume of 159,552 cubic feet. Please revise your volume calculation, and recheck the
orifice calculation using the correct storage volume, or revise the surface areas to accurately
reflect the 2.87 acre-feet of storage.

4. The required volume for Pond 5 is 23,395 cubic feet ((.23 x 28 acres / 12) x 43560), but you
provide only 20,473 cubic feet, per your calculations. Please revise to provide a minimum of
23,395 cubic feet of volume. Check the orifice size to make sure 2" will still provide the
required drawdown for the increased storage.
5. The up -close details for Ponds 1 and 5 appear to have 2 sets of finished contour lines
superimposed on top of each other. Please show only one set of proposed contours.
6. The forebay section detail with the vegetated shelf information, as referenced on the details,
has not been included on the plan.
7. Please identify which street detail belongs to which road on the plans. You can name the
streets, or label them A, B, C, etc., and list each street under it's cooresponding detail.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to July 11, 1998, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee.

Specifically, we have addressed the following items from your request for additional information:
1. There is an existing ditch at the outlet of FES#17A that will be regraded such that it will
convey the discharge of FES#17A to the collection swale in the Pond #1 drainage area.
This information has also been added to the attached plan.
2. All water quality swales shown on the attached plan will be 100' in length. In areas where a
water quality swale receives piped drainage, piping will stop at the front building setback.
3. The proposed dry detention basin at FES#12A has been eliminated. The drainage from the
storm drain collection system has been re-routed to Pond#1 as shown on the attached plan.
Revised calculations for Pond#1 are attached demonstrating the pond's capacity to accept
this additional drainage.

5. The attached design plans have been sealed.
6. The pond maintenance agreement has been revised to show design depths for each
stormwater treatment pond. Landmark Developers, Inc. will be the party responsible for

to stabilize all water quality swales. Common Bermuda grass has an allowable velocity of
4 to 6 feet per second. The maximum calculated velocity for any swale (as shown in
previously submitted calculations) is 3.5 feet per second.

The Wilmington Regional Office received previously requested information for the Stormwater
Management Permit Application for Magnolia Greens Golf Course/Subdivision on February 18, 1998, and
March 13, 1998. A preliminary review of that information has determined that the application is not
complete. The following information is needed to continue the stormwater review:
1. How is the runoff from FES 17A treated? There is no curb outlet Swale noted, and it does not
appear to drain into Pond #1. FES 17A is shown within the drainage area of Pond 1, but it
is not clear how the runoff will get into Pond #1.
2. You have specified that all curb outlet treatment swales will be piped to the front building
setback. This is OK only as long as a minimum of 100 linear feet of 5:1 swale is provided.
If piping to the front building setback will result in less than 100 feet of swale, the piping
must be shortened to provide the 100' of swale.
3. The following design requirements for extended dry -detention have, not been provided:
a. A vegetation plan to be prepared by a licensed professional.
b. Demonstrate that the design storage provides for sediment storage equal to 20% of the
detention volume.
C. Inlet and outlet channel protection from scour during high flows from large storms.
d. Verification that the SHWT is at least l' below the proposed bottom elevation.
e. A forebay to minimize cleanout problems
f. An energy dissipation device at the inlet to prevent the resuspension of sediments.

4. Please either add the specific maintenance requirements for the dry detention basin to the
Pond Maintenance document, or provide a separate document. Maintenance includes:
a. All grassed areas mowed at least twice annually.
b. Frequent debris removal.
C. Annual inspections of the basin after a rain event to ensure proper operation.
d. Annual inspection items to include outlet/release rate, erosion, sediment removal,
emergency spillway condition, and removal of woody vegetation in the embankment.
5. Please seal the proposed design plans.
6. Specify the type of grass cover to be used in the swales. What is the permissible velocity for
the specified grass? Do all of the swales have velocities below this limit?
6. Please specify the design depth for each detention pond in the O & M in Item #3b. Please
revise the contact name in Item #5 to the Division of Water Quality. The Division of
Environmental Management was renamed in 1996, and no longer exists.
7. The detention pond O & M still specifies that the HOA is responsible for maintenance. Please
delete this reference until such time as the permit is transferred to the HOA.
8. On Attachment A, specify the total number of lots that will have 4,000 square feet of BUA
and the total number of lots that will have 3,500 square feet of BUA.
9. The calculations for Pond 3 indicate that a total volume of 18,235 cubic feet is provided in
the pond between elevations 26 and 28. If the surface area provided at the permanent pool of
26 is 11,000 square feet, then in order for the volume to equate to 18,235, the surface area
at 28 must be 7,235, which is impossible. Even with a vertical sided pond, the minimum
volume provided would be 22,000 cubic feet. Please revise the volume and orifice calculations
to accurately reflect the volume provided in the pond.

referenced stormwater submittal.

Specifically, we have addressed the following items from your request for additional information:
1. Each 100' Water Quality Swale has been identified with a number. Corresponding velocity
calculations for each swale are attached.
2. Storm drain discharging to a water quality swale has been revised such that piping will end
Q? at the first setback line of adjacent lots (30' back of the right-of-way).
3. Storm drain outlets to treatment ponds have been revised to eliminate short-circuiting.
4. The proposed outlet for Pond #5 has been located on the Master Plan and section and plan
details are also attached. Pond #6 will not function as a treatment pond.
5. The 916.5 acre site area does include 92.8 acres of wetlands, yielding an overall impervious
coverage of 23.0 %. Deduction of the 92.8 acres of wetlands from the overall project site
increases the percentage of impervious coverage to 25.6%.
6. Future development may impact water quality devices (such as the 100' water quality
swales) and necessitate modification of such devices. Should this occur, any proposed
modification will require permit modification.
7. Calculations for Stormwater Treatment Pond #3 are attached. These calculations include
the clubhouse area and all amenities (current and future).

8. The drainage area delineations and outlets for lots 9-25 through 9-30 have been more
clearly illustrated on the attached plan.
9. Portions of tract N will drain to Pond 6 as shown on the attached plan. Pond 6 will not be a
water quality device and all drainage from tract N will be treated via. a 100' water quality
swale prior to entering Pond 6. Tracts E and O will not drain to Pond 6.
10. The Golf Maintenance Facility does not drain to Pond 5. The delineated drainage area to
Pond 5 has been revised for clearer illustration.
11. The outlet from Pond 3 will not discharge to a water quality swale. All water quality swales
are to be stand alone devices.
12. Collection swales conveying piped drainage to treatment ponds shall be graded at 3H:1V
side slopes.
13. The future development of tracks P and Q shall require individual engineered systems for
treatment of runoff.
14. All multi -family and commercial development tracts shall require individual engineered
systems for treatment of runoff.
15. A dry detention basin and a collection swale are specified for the outlet FES#12A. The
receiving pond is not to provide treatment. The discharge from FES#12A shall be treated
prior to entering the pond by way of the dry detention basin.
16.. To scale plan and section details are attached for all storm water treatment ponds proposed
for permitting.
17. Drawdown and orifice sizing calculations have been provided for all storm water treatment
ponds proposed for permitting.
18. Pond 6 shall not function as a water quality device and is no longer proposed for permitting.
19. All ponds proposed for permitting have been designed for 90% TSS removal eliminating the
need for a vegetated filter at the pond outlet.
20. The required volume has been included in sizing calculations for each pond proposed for
permitting.

As requested, please find enclosed the additional information you requested for the above
referenced stormwater submittal.
e (3) copies of the stormwater master plan,
• (3) copies of the application with operation and maintenance agreements, deed
restrictions, and impervious breakdowns.
Specifically, we have addressed the following concerns raised in your request for additional
information:
1. The Built -Upon Area (BUA) tracking tables have been combined on the Master Plan and in
the application. The total BUA is 211.15 AC.
2. The breakdown section of the application has been completed. Estimates of future BUA are
included in the breakdown section of the application and listed individually in the tracking
table of the Master Plan.
3. An estimated BUA of 3.96 AC for the clubhouse site has been included in the Phase I
tracking tables. Upon final design, specific BUA will be submitted.
4. Wetlands areas are clearly identified on the Master Plan. Landmark's environmental
consultant has assessed pond areas 1, 5, and 6, the piped collection system, and swale
discharge points. The wetlands do not contravene the stormwater plan.
5. A note has been added to the Master Plan reading, "Treatment ponds 1, 5, and 6 are
located in access/drainage easements measuring 10 ft. from top of bank."
6. All curb outlets and water quality swales serving drainage areas not served by treatment
ponds have been located and labeled on the Master Plan.
7. All drainage areas served by treatment devices have been more clearly identified on the
Master Plan.

8. All lots have been numbered by section. For example, lot 12 in section 5 is identified as 5-
12.
9. The application has been revised to show Landmark Developers as the owner of record and
the responsible party in all Operation and Maintenance Agreements.
10. Future development has been designated on the Master Plan by capital letters identifying
each tract. Phase 1, amenities, and the clubhouse are shown in their respective locations.
Future Single Family tracts are lettered B through E and future Multi -Family tracts are
lettered K through Q. The commercial area is simply listed as such. Breakdown
information corresponding to each tract has also been included in the BUA tracking table on
the Master Plan.
11. The solid, heavy line on the Master Plan designates the Magnolia Greens project boundary
and has been more clearly identified on the plan.

The Wilmington Regional Office received previously requested information for the Stormwater
Management Permit Application for Magnolia Greens Golf Course and Subdivision on December 12, 1997.
A preliminary review of that information has determined that the application is not complete. The following
information is needed to continue the stormwater review:
1. Please number each of the 100' WQ swales and correspond them to velocity calculations.
Provide velocity calculations for each swale.
2. Several areas show lot lines that are completely piped to a WQ swale. Please delete this piping
and show it stopping at the right-of-way.
3. Inlets into the pond must be situated such that they do not cause short-circuiting of the pond,
such as is occurring in Pond 1. Ideally, inlets are located opposite the outlet, with the flow
path along the longest pond axis.
4. Please locate the proposed outlets for Ponds 5 and 6 on the plans.
5. Is the 92.8 acres of wetlands included in the 916.5 acre site area?
6. What happens to the WQ swales that are located inside the tract boundaries of future
development? Will future development cause relocation?
7. Please provide the State calculations for the detention pond for the runoff from the clubhouse
tract. Large expanses of parking lot preclude meeting low density.
8. The drainage area delineations for Lots 9-25 through 9-30, and at the entrance road make no
sense. It appears that small drainage areas have no swales and no outlets. Please check.

9. It appears that Tracts E, N and O will eventually drain into Pond 6, but the area delineation
does not support this.
10. It appears that the Golf Maintenance Facility could easily drain into Pond 5, but again, the
drainage area delineation does not support this.
11. The WQ swales must stand alone; no additional upstream drainage can be routed through
them. It appears that the oulet of Pond 3 will drain through the WQ swale opposite Lot 5-28,
and that upstream ditch flow from the CP&L right-of-way will drain through the WQ swale
behind Lots 1-1 and 1-2.
12. The 100' WQ swales are not required for those areas that are included in a pond to be
permitted by DWQ, ie., Ponds 1, 5 and 6. There are several WQ swales within the drainage
area to Pond 6 that have WQ swales noted. This is not required. Those collection swales may
have a 3:1 side slope.
13. It appears from the proposed plans that the more dense development of multi -family, Tracts
P and Q, will be located closest to the receiving stream. These tracts will be identified in the
master plan permit as being required to provide individual engineered systems for their
runoff.
14. For permitting purposes, all multi -family and commercial development tracts will be required
to provide engineered systems.
15. At FES #12A, between Lots 4-6 and 4-8, no WQ swale is specified. If the one acre Pond will
be the treatment, please provide the State calculations for it. If not, please specify a WQ swale
at that location.
16. Provide a to scale detail of the grading in each pond proposed for permitting, which indicates
the overall pond dimensions. Label and delineate the permanent pool and design pool
contours. Provide a detail of the outlet structure and orifice size for each pond. Permitted
ponds must provide an outlet.
17. Provide drawdown and orifice sizing calculations for the ponds. The runoff must drawdown
in 2-5 days.
18. The bottom and forebay elevations for Pond 6 in the table do not appear correct.

19. Use of 85 % TSS SA/DA ratio requires a vegetated filter at the outlet of the pond. This
vegetated filter is NOT A DITCH, as has been assumed for many years by the engineering
community. Please provide a detail of the filter on the plans, and locate the filters on the
plans.
20. The required pond volume is based on the entire drainage area, not just the impervious area.
Please revise as necessary to provide the required volume in each pond.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to March 16, 1998, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee.

As requested, please find enclosed the additional information you requested for the
above referenced stormwater submittal.
• (3) copies of the stormwater master plan,
• (3) copies of the application with operation and maintenance agreements,
deed restrictions, and impervious breakdowns.
Specifically, we have addressed the following concerns raised in your request for
additional information:
1. The Built -Upon Area (BUA) tracking tables have been combined on the Master
Plan and in the application. The total BUA is 210.77 AC.
2. The breakdown section of the application has been completed. Estimates of
future BUA are included in the breakdown section of the application and listed
individually in the tracking table of the Master Plan.
3. An estimated BUA of 3.96 AC for the clubhouse site has been included in the
Phase I tracking tables. Upon final design, specific BUA will be submitted.
4. Wetlands areas are clearly identified on the Master Plan. Landmark's
environmental consultant has assessed pond areas 1, 5, and 6, the piped
collection system, and swale discharge points. The wetlands do not contravene

7. All drainage areas served by treatment devices have been more clearly
identified on the Master Plan.
8. All lots have been numbered by section. For example, lot 12 in section 5 is
identified as 5-12.
9. The application has been revised to show Landmark Developers as the owner
of record and the responsible party in all Operation and Maintenance
Agreements.
10. Future development has been designated on the Master Plan by capital letters
identifying each tract. Phase 1, amenities, and the clubhouse are shown in their
respective locations. Future Single Family tracts are lettered A through E and
future Multi -Family tracts are lettered K through Q. The commercial area is
simply listed as such. Breakdown information corresponding to each tract has
also been included in the BUA tracking table on the Master Plan.
11. The solid, heavy line on the Master Plan designates the Magnolia Greens
project boundary and has been more clearly identified on the plan.
12. If requested, additional information regarding treatment pond designs will be
submitted.

The Wilmington Regional Office received a modification to the Stormwater Management Permit Application
for Magnolia Greens Golfcourse and Subdivision Master Plan on October 10, 1997. A preliminary review of that
information has determined that the application is not complete. The following information is needed to continue the
stormwater review:
It is not necessary to break up the project between Jackey's Creek and Sturgeon. The use of two
columns on the application is only necessary when the classifications differ and result in a different
allowable built -upon area, ie., one drains to SA waters @25 % BUA, and the other drains to SC waters
030 %. In this case, the classifications for both Jackey's Creek and Sturgeon Creek result in 30 %
BUA. As a result, you may combine the tracking tables you show on the plan.
2. The breakdown section of the application must be completed, regardless of the phasing of the
development. In the end, there will be a total BUA. Please make an educated guess about the BUA
for the unknown development.
3. Please include an estimate of the BUA for the clubhouse in order to approve the Master Plan. At the
time the design in final, you can resubmit with all the specifics.
3. Please note that DEM no longer exists. It was replaced last year by the Division of Water Quality.
Please make the appropriate changes to your documentation.
4. Delineate all wetlands on site, or note on the plans that none exist. I see places where the word
wetlands is noted, but there is no other indication of the extent of the wetland.
5. Locate the ponds it recorded access/drainage easements.
6. Please locate and label the 100' grassed swales for the curb outlet systems for those Drainage Areas
not served by a detention pond to be permitted by DWQ.

7. Clearly delineate and label the Drainage Areas to each curb outlet swale and for each pond to be used
as a treatment device. Ponds that only accumulate drainage from low density portions of the project
or from curb outlet swales are not subject to this requirement. The drainage areas delineated on the
Master Plan are confusing.
Are the lots shown along the main road single family? Have they been included in the totals? Please
number each lot.
9. If you want us to issue a permit to the Magnolia Greens POA, you must supply proof that it is the
landowner of record. If you can't supply this, please have Mr. Stephens sign the application as
President of Landmark Developers, and revise the "Owner's Name" to Landmark Developers. At
some point in time, after the deed restrictions are recorded and the curb outlet swales and ponds are
determined to be in compliance with the permit, then a transfer of ownership to the POA will be
considered. Phased transfers will be considered due to the fact that this project will be phased, and
not all construction will be completed and ready for transfer at the same time.
10. Please identify the future single family and multi -family tracts with letters or numbers and list these
in the table, along with the expected maximum number of lots and BUA. Any single family tracts
exceeding 40 % BUA or any multi -family tracts exceeding 30 % BUA must submit an engineered
system for approval.
11. The plans show a solid, heavy line, but it is not identified as to what it represents. The dashed areas
supposedly delineating the drainage areas are not very clear as where thay start and stop.
12. I cannot review the pond data until the Drainage Areas are more clearly marked and the lots are
numbered. Additional information may be requested later.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received by this Office prior to December 17, 1997, or the application will be returned as
incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee.

determined that the application is not complete. The following information is needed to continue the
stormwater review:
1. The clubhouse project will be required to provide an engineered control because it is
considered a pocket of high density, and it proposes a collection system. Please submit
engineering calculations and revised plans which include pond contours, section details, and
outlet structure details. Please remember that all impervious area associated with the
development of the clubhouse must be collected. None may bypass.
2. A signed Operation and Maintenance plan.
3. In order to determine the percent impervious of the site, please use the disturbed area from
the SEC plan application, or the drainage area to the pond, or delineate a property line. If
using the drainage area to teh pond, be sure to account for the potential build -out within the
drainage area, such as subdivision lots, roads and parking. Due to this revision, the permit
application will need to be revised as well.
4. Delineate all wetlands on site, or note on the plans that none exist.

10. The fee for an engineered project is $385.00. Since $225.00 has already been submitted, only
$160.00 remains to be submitted.

Please find enclosed the stormwater submittal for the above mentioned project. We
have delivered to you the following:

This project is a low density submittal. Stormwater will be treated throughout the
project with grass lined swales and sheet flow over grass and natural ground cover;
However, we have included design for ponds #1,#5 and #6 which will be used for
treatment prior to discharge to the appropriate drainage basin. The purpose in
these ponds are due to long collection pipe runs and/or discharging into an existing
drainage ditch which receives upstream flow.
The clubhouse site has been included in the impervious calculations , but at this
time will not be considered in this submittal. The clubhouse site constitutes a high
density pocket and stormwater will be treated in a nearby detention pond . At this
time the clubhouse site is in the final stage of design, and should be ready for your
review within the next week.

This office has received a soil erosion and sedimentation control plan for the project listed below
which was submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-
57).
Please be advised that this Act requires that all persons disturbing an area of one or more acrE��,
land must obtain approval of a soil erosion control plan prior to the commencement of said land disturl
activity (NCGS 113A-54(d)(4)). The act further states that this plan must be filed a minimum of 30 r
prior to the activity and the approving authority must approve or disapprove the submitted plan within
days of receipt. 'Failure of the approving authority to approve or disapprove the submitted plan with'
30 day period.will be deemed approval of the plan. Commencement or continuation of a land-dist��
activity under the jurisdiction of this Act prior to the approval of an erosion and sediment control ply
violation of the Act.
This land disturbing activity described in this plan is also subject to the Environmental Manager:.
Commission's review of their regulations to implement stormwater controls in coastal counties (15 NC;;

ensure this activity is in conformance with their rules.
