Again, I do apologize that I didn't respond earlier however, like I told you on the phone, the first email that I received from you was yesterday and then again today. I have always put the address of 1022 Grandiflora Drive Suite 100, Leland, NC 28451 on all of the previous stormwater permit renewal applications in the past because Magnolia Greens Master Association is managed out of that office. This is a satellite office to our Wilmington office which is located at 1628 Doctors Circle, Wilmington, NC 28401 which is also the address listed as the registered agent. The address that is listed on the permit renewal application is the correct address. Thank you for also confirming that this is all the information that is needed and that there will be no repercussions as a result of this delay. A response was not received by this date. On June 27, 2019, a follow-up email was sent to the provided email address requesting a status update regarding a response to the June 10, 2019 letter. Again, no response was received. A final follow-up email was sent on July 17, 2019 requesting a status update with a response due date of July 19, 2019. If a response is not received regarding the June 10, 2019 letter, the application will be returned as incomplete. If the application is returned, a new application must be submitted with all required items, including the application fee. Additionally, permit number SW8 000220 is expired. The operation of a stormwater treatment system without a valid and active permit is considered a violation of the permit and NCGS 143 Articie 21 and may result in appropriate enforcement action. The situation you described is that 3 lots, Lots 5-92, 5-93 and 5-94, as they are numbered on the approved stormwater plans, were combined and re -subdivided into 2 lots. The original 3 lots were each assigned a maximum Built -Upon Area (BUA) limit of 5,000 sf as per the existing stormwater permit. The plat showing the recombination and re -subdivision of these 3 Iuts was recorded on September 28, 2004 in Map Cabinet 31 at Page 106 and the 2 lots were renumbered as 56R and 58R. When Landmark recorded this new plat in 2004 to document the change from 3 lots to 2 lots, they made no provision to reallocate the leftover 5,000 sf to either of the resulting lots. As indicated on all the deeds of conveyance for Lot 58R since 2004, the lot was and still is treated as a single lot and is still subject to the Master Declaration of Protective Covenants for Magnolia Greens recorded in Deed Book 1191 at Page 991, and to that Amendment filed in Deed Book 1945 at Page 480 which annexed the Section 28 lots into Magnolia Greens. Based on those recorded documents, each lot is limited to a maximum of 5,000 sf of BUA. As we discussed, you must deal with the current permittee, Magnolia Greens HOA, to see if they will modify the permit to split up that leftover 5,000 sf of BUA between Lots 56R and 58R. DEMLR is only able to require the HOA to enforce the recorded BUA limit for each lot. DEMLR has no authority to force the HOA to accommodate your request for more BUA, or to force the HOA to disregard any established covenants governing how BUA is handled when 2 or more lots are combined. Please note that DEMLR has no objection to the HOA submitting a permit modification to provide more BUA for Lots 56R and 58R. I hope this addresses your concerns. A preliminary in-depth review of that information has determined that the application is not complete and that additional information is needed. To continue the review, please provide the following additional information: 1. 15A NCAC 02H.1045(3)(a)(ii): The address of the permitee, Magnolia Greens Master Association, in sections BA and 13.5 of the submitted permit renewal application is not consistent with the address on file with the NC Secretary of State. Please confirm the correct address is represented in the application and update section 13.4 and 13.5 appropriately. Please remember to confirm that any revised information is presented consistently throughout the application documents including calculations, supplements, narrative, and plans. Please also remember to provide two hard copies of any updated documents per 15A NCAC 02H.1042(2). The requested information should be received in this Office by June 25, 2019, or the application will be returned as incomplete. If the project is returned and you wish to re -submit later, you will need to resubmit all required items at that time, including the application fee. I cannot remember off -hand where this information is located withir the existing covenants and I cannot remember what the covenants specify as the maximum BUA limit for recombined lot. The only way to document the recombination of lots and to change the BUA limit ;s for the permit holder to submit an application to modify the permit. For this modification, I think that we'li need fie also deaf with the change in the lot numbers from what is shown in the current permit and can the approved master plan. These lots are numbered as Lcts 5-92, 5-93 and 5-94 in the permit and on the approved plans, but are shown on the recorded plat as Lots 56R and 58R. That can be very confusing for the HOA in terms of figuring out what the permitted BUA limit actually is, not to mentici confusing for the Division to determine compliance. Institute said she would call Corey Anen about speaking at our convention this summer. An issue has arisen at Magnolia Greens. I was hoping maybe you could help or refer me to someone that could. There are various SW permits at Magnolia Greens. The permit for Section 28 is SW8 000220 and allows 5,000 sq. feet of impervious coverage per lot. The Amendment to the Declaration annexing Section 28, Book 1945, Page 0480, recorded May 17, 2004, is attached. The original map for Section 28, Map Book 30, Page 210, also recorded May 17, 2004, showed lots 56, 57 and 58 (attached). On September 28, 2004, a revised map, Map Book 31, Page 106 was recorded, which combined lots 56, 57 and 58 into two lots, 56R and 58R (attached). The end result was that 3 lots became 2 lots. The owner of Lot 58R now wants to add a swimming pool. The problem is this would exceed the 5,000 square foot per lot impervious coverage limit. The owner believes that he should be allocated 7,500 sq. ft. as he owns essentially 1 1/2 lots. The HOA would like to work with him but only within the bounds of the permit. The pond is a series of water bodies interconnected with equalizer piping. The pond is designed to utilize irrigation as the sole means of drawing down the storage volume. 2/15/12 The Division forwards a compliant from a resident about the 000220 pond to the permittee, Landmark Developers. The complainant requested that the Division consider the occasional flooding at the intersection of Trail Pines Court and Morning View Way as a "nuisance condition" under the permit; that we investigate the adequacy of the equalizer pipes; that we ensure that the irrigation lines are in an easement so the HOA can maintain them; and to make sure that the irrigation pump is sized appropriately. Landmark is also looking at an alternative weir design to keep residents from removing boards in the flashboard riser to manipulate the water level. 3/16/12 Davis Fennell, P.E., files an engineering analysis report regarding the complaints filed on 2/15/12 above. The report concludes that the equalizer pipes are sufficiently sized to maintain flow between the pond sections for the 8" design storm without staging water too high in any one segment of the pond; the irrigation lines are located within recorded access easements and the pump is adequately sized. A new concrete weir is proposed to replace the flashboard structure. The Division determines that occasional flooding of the street is not a permit compliance issue. 5/13/13 The permit is transferred to the Magnolia Greens Master Association. 7/10/13 The Division receives a letter from Charles Meier (attorney for the HOA) with a request to amend the permit to allow the HOA to drawdown the pond before large storms as per the October 21, 2003 Flood Relief Policy. 12/3/15 The Division receives an email from Jody Bland, PE with Norris & Tunstall, requesting a meeting to discuss options for reducing the street flooding. A meeting is set for December 15, 2015. 12/14/15 The Division receives emailed questions from Jody Bland for discussion at the meeting. They want to discuss modifying the storage volume by lowering the weir elevation; converting the pond to a traditional pond with storage for 1.5" of rain and an orifice for drawdown and keep some water in reserve for irrigation; and options for lowering the weir elevation and/or widening the spillway. 12/15/15 DEMLR met with consultant about proposed changes to the pond. No application to modify the permit was.submitted. 8/18/17 The Division receives an email from Shirley Lawler, a candidate for Leland Town Council, who is lodging a complaint on behalf of Gary Ostby, who lives adjacent one of the permitted ponds (#8) in Parkview at Brunswick Forest #SW8 061007. Mr. Ostby believes that the pipes under Leesburg Drive leading into the pond are "undersized". The Division explains that sizing the collection system is not the purview of the Division and recommends that Mr. Ostby contact either the NCDOT (if the roads are public) or the Town of Leland. 9/21/17 Pond #8 under SW8 061007 (Parkview at Brunswick Forest) is inspected for compliance and found to be OK. 10/2017 Town of Leland issues a draft report of their commissioned flooding investigation, prepared by Cape Fear Engineering. 2/20/18 The Division receives an email from Dennis Deasy (HOA Pond Committee) asking for Division comments to the October Flooding Report. 2/21/18 The Division emails comments to the HOA regarding certain interpretations made in the report. DEMLR explains what the design criteria are for the pond; surface area; volume; permanent pool and temporary pool; and drawdown via irrigation. DEMLR does not have jurisdiction over flooding, and that a modification is needed to change any of the permitted parameters, including drawdown by irrigation. 8/14/18 A copy of the Division's February 21, 2018 email is forwarded to Angie Barker with CEPCO, who manages the HOA, and to David Hollis, Leland Town Manager. Mr. Hollis was meeting with the HOA that evening and needed to be sure of certain things regarding this permit. We agreed that if irrigation was no longer able to achieve drawdown within 5 days, then that would be a compliance issue that could be addressed via submission of a modification to add an orifice. 8/17/18 The Division receives an email from David Hollis with an allegation that the water level in the Magnolia Greens pond has not been at elevation 21 in "a decade". The Division replies that the October 2017 Flooding Report commissioned by the Town shows that there is a declining demand to irrigate the golf course, most likely due to the return of normal to above -normal rainfall for our area. The Division again indicates that if irrigation is not achieving the necessary drawdown, the permittee should consider other options for drawdown and submit the necessary permit modification. 10/15/18 Letters from the Mayor of the Town of Leland are sent to Jim Gregson regarding flooding issues at the Lakes at Magnolia Greens, Parkview in Brunswick Forest, Wedgewood, and Lanvale Trace. For the Lakes at Magnolia Greens, the letters allege that there are weir elevation discrepancies and that the system is only able to draw down to elevation 21.76. 12/3/18 Creighton Brown (DEMLR Sediment Program) inspects SW8 970104. Mr. Brown met with Terry Miller, a homeowner in Magnolia Greens who lives adjacent a curb outlet Swale. The lot backs up to wetlands and Jackey's Creek. The owner complains about standing water in the crawl space under his home due to Jackey's Creek flooding; and the unvegetated condition of the swale; and indicates that it is the inspector's "moral obligation" to remove an uprooted tree in the wetlands because it poses an imminent danger to his grandchildren who might fall into the hole while playing. The Division requires the swale to be vegetated, but can do nothing about the flooding, the standing water or the uprooted tree. 12/6/18 Jim Gregson forwards an email to Danny Smith with the October 15, 2018 letters attached. Danny Smith forwards the email and attachments to Annette Lucas. Mr. Smith requests that the Division investigate and report the findings back to him. 12/20/18 Annette Lucas forwards the 12/6/18 email to Dan Sams, who forwards it to Stormwater Program staff. 12/21/18 Kelly Johnson pulls the files and provides a summary of the situation with each project. 1/7/19 Linda Lewis returns from vacation and opens the 12/20/18 email from Dan Sams and reads the attached letters from the Town to Jim_ Gregson and provides emailed comments to the allegations made in the letters. 1/11/19 Creighton Brown (DEMLR Sediment Program) inspects all of the projects referenced in the letters. Other than routine maintenance issues, no permit violations are found. Based on photographs, it appears that the water level in the pond on that day was at the top of the concrete weir, which is supposedly set at the temporary pool elevation of 23.5. From January 6 to January 11, 2019, the National Weather Service indicated that no rain had fallen in this area. The pond level should have been drawn down to elevation 21, some 2.5 feet below the weir. Since it was not, the Division suspects that irrigation is not being utilized for drawdown.
