This office has reviewed the subject erosion and sedimentation control plan. We find the plan to
be acceptable with modifications and hereby issue this letter of Approval with Modifications. The
Modifications Required for Approval are listed on the attached page. This plan approval shall
expire three (3) years following the date of approval, if no land -disturbing activity has been
undertaken, as is required by Title 15A NCAC 4B .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the
NCG010000 Construction General Permit. After the form is reviewed and found to be complete,
you will receive a link with payment instructions for the $100 annual permit fee. After the fee is
received, you will receive the COC via email. You MUST obtain the COC prior to commencement
of any land disturbing activity. The eNOI form may be accessed at deq.nc.gov/NCGO1. Please

new responsible party is required to apply for his/her own COC.
Title 15A NCAC 4B .0118(a) and the NCGO1 permit require that the following documentation
be kept on file at the job site:
1. The approved E&SC plan as well as any approved deviation.
2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 12 months.
Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection
to ensure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance -oriented, requiring
protection of existing natural resources and adjoining properties. If, following the commencement
of this project, it is determined that the erosion and sedimentation control plan is inadequate to
meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General
Statute 113A-51 through 66), this office may require revisions to the plan and implementation of
the revisions to ensure compliance with the Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State
water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may
also apply to this land -disturbing activity. This approval does not supersede any other permit or
approval.
Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. This permit allows for a land -disturbance, as
called for on the application plan, not to exceed the approved acres. Exceeding the acreage will
be a violation of this permit and would require a revised plan and additional application fee. You
are requested to file an amended form if there is any change in the information included on the
form. In addition, it would be helpful if you notify this office of the proposed starting date for this
project. Please notify us if you plan to have a preconstruction conference.

DEED OF EASEMENT WITH SPECIAL WARRANTY FOR STREET RIGHT-OF-WAY AND
TEMPORARY CONSTRUCTION EASEMENT
THIS DEED OF EASEMENT (the "Agreement") is made and executed this 20th day of
July, 2021, by F7 West, LLC, a Georgia limited liability company, with a mailing address of 3455
Peachtree Rd NE, Ste 650, Atlanta, GA 30326, hereinafter referred to as the "Grantor", to the
City of Raleigh, hereinafter referred to as the "City", with a mailing address of 222 W. Hargett
Street, Raleigh, NC, 27601. The designation "Grantor" as used herein shall include the singular
and plural, as required, and the masculine and neuter gender, as appropriate.
WHEREAS, the Grantor is the owner of the land(s) described on Exhibit A, attached hereto
("Grantor's Property"), and has agreed to convey to the City, according to the terms set forth
below, the easements hereinafter;
WHEREAS, the City intends to construct Improvements (as hereinafter defined) in front
of and over a portion of Grantor's Property in the area depicted on Exhibit B and labeled as the
"Proposed Right of Way" (the "ROW Easement Area"); and
WHEREAS, in connection with the construction of the improvements in the ROW
Easement Area, the City requires a temporary construction easement over the portion of the
Grantor's Property depicted on Exhibit B and labeled as the "Temporary Construction Easement"
(the "Temporary Construction Easement Area"; and together with the ROW Easement Area,
the "Easement Areas").
Submitted electronically by The Citv of Raleigh in compliance with North Carolina statutes governing recordable documents and
the terms of the submitter agreement with the Wake County Register of Deeds.

NOW, THEREFORE, for valuable consideration paid to the Grantor, receipt of which is
hereby acknowledged, the Grantor has bargained and sold, and does hereby grant, sell and
convey unto the City, its successors and assigns, those rights -of -way, privileges, and Easements
enumerated and described hereinbelow, and as more particularly identified and depicted in
Exhibit B, attached, as follows:
1. STREET RIGHT-OF-WAY
An easement over, across, under and through the ROW Easement Area (the "ROW Easement")
to construct, improve, reconstruct, replace, inspect, repair, maintain and use a public street,
including all related, customary uses of public street right-of-way such as sidewalk, bike path,
storm drainage, street lighting, sanitary sewer, water supply and distribution, electric power,
landscaping, cable television, gas, telephone, telecommunications, and other such purposes and
uses (collectively, the "Improvements"). In addition to the City's obligations pursuant to Section
2(a) hereof, the City will be responsible for damage to the Grantor's Property, to the extent
resulting from the gross negligence or willful misconduct of the City, or the City's employees or
contractors, in the performance of the City's obligations hereunder.
2. TEMPORARY CONSTRUCTION EASEMENT
A temporary easement over, across, under and through the Temporary Construction Easement
Area (the "Temporary Construction Easement") for purposes reasonably necessary and
incidental to the construction of public infrastructure improvements (such as streets, sidewalks,
slopes, greenway trail, water, sewer and storm drainage facilities), such temporary construction
purposes including the stockpiling of materials, the movement and storage of vehicles and
equipment, construction staging, the grading of soil and other like material, the repair,
reconstruction and reconnection of a private driveway or driveways onto adjacent public street
right-of-way, and similar purposes.
Further specific terms and conditions applicable to the Temporary Construction
Easement are as follows:
a) Following construction of the public infrastructure project (or earlier termination of
the Temporary Construction Easement if applicable), the City shall re -grade, mulch and re -seed,
or otherwise restore the temporary easement area substantially to its prior use and condition, in
accordance with generally accepted landscaping and engineering practices. The City will be
responsible for damage to the Grantor's Property, to the extent resulting from the gross
negligence or willful misconduct of the City, or the City's employees or contractors, in the
performance of the City's obligations hereunder;
b) The City's use of and activities within the Temporary Construction Easement Area
[including grading, stabilization, and restoration under subparagraph (a)] shall substantially
conform with official plans and specifications for the Blue Ridge Road Bike/Ped Improvements
Project, prepared by A. Morton Thomas and Associates, Inc., entitled "C-5604OF Blue Ridge
Road Bike/Ped Improvements Project", maintained in the offices of the City of Raleigh
Engineering Services Department;
c) The City shall not block or impede ingress or egress to and from the Grantor's
Property during normal business hours in any way that would materially affect Grantor's
operations on Grantor's Property without Grantor's prior written consent, which shall not be

unreasonably withheld or delayed. Such request for consent shall be sent to and obtained from
Grantor's property manager (Jennifer Nixon with Capital Associates) via email at the following
address: inixon ca italassociates.com (or to any address that Grantor may designate). If
Grantor's designee has not responded to the City's request within 48 hours following receipt of
the request, Grantor will be deemed to have provided consent; and
d) Upon the earlier to occur of (i) completion of construction of the Improvements, or
(ii) five (5) years after the date of this Agreement, the Temporary Construction Easement shall
automatically terminate and be of no further force or effect.
GRANTOR reserves the right to use the Easement Areas for all lawful purposes that do
not interfere with the City's use and enjoyment of the easements granted hereunder.
THE PROPERTY INTEREST HEREIN DESCRIBED AND CONVEYED does not include
a primary residence.
TO HAVE AND TO HOLD the above -described permanent easements, running with the
land, for the respective purposes enumerated above, unto the City of Raleigh, its successors and
assigns, in perpetuity.
TO HAVE AND TO HOLD the above -described temporary easements, while in effect,
unto the City, its successors and assigns.
The Grantor hereby, for itself, its heirs, successors, and assigns, hereby warrants and
covenants that Grantor is the owner of the property described in Exhibit A; that they have the right
to grant these easements; that the same are free from encumbrances except those set forth on
Exhibit C; that such encumbrances set forth on Exhibit C shall not impair or otherwise interfere
with the City's full use and enjoyment of the easements herein granted and that they will warrant
and defend the title to the same against lawful claims of all persons claiming by and through
Grantor.

ELECTRIC UTILITY AND
TEMPORARY CONSTRUCTION EASEMENT
THIS DEED OF EASEMENT (the "A re_g ement") is made and executed this 20th day of
July, 2021, by F7 West, LLC, a Georgia limited liability company, with a mailing address of 3455
Peachtree Rd NE, Ste 650, Atlanta, GA 30326, hereinafter referred to as the "Grantor", to the
City of Raleigh, hereinafter referred to as the "City", with a mailing address of 222 W. Hargett
Street, Raleigh, NC, 27601. The designation "Grantor" as used herein shall include the singular
and plural, as required, and the masculine and neuter gender, as appropriate.
WHEREAS, the Grantor is the owner of the land(s) described on Exhibit A, attached hereto
("Grantor's Property"), and has agreed to convey to the City, according to the terms set forth
below, the easements hereinafter;
WHEREAS, the City intends to construct Improvements (as hereinafter defined) on a
portion of Grantor's Property in the area depicted on Exhibit B and labeled as the "Proposed Right
of Way" (the "ROW Easement Area");
WHEREAS, the City requires an electric utility easement (the "Electric Utility Easement")
in connection with the installation and use of the Improvements in the area depicted on Exhibit B
and labeled as the "Permanent Electrical Utility Easement" (the "Electric Utility Easement
Area"); and
Submitted electronically by The City of Raleigh in compliance with North Carolina statutes governing recordable documents and
the terms of the submitter agreement with the Wake County Register of Deeds.

WHEREAS, in connection with the construction of the Improvements in the ROW
Easement Area, the City requires a temporary construction easement over the portion of the
Grantor's Property depicted on Exhibit B and labeled as the "Temporary Construction Easement"
(the "Temporary Construction Easement Area"; and together with the ROW Easement Area
and the Electrical Utility Easement Area, the "Easement Areas").
NOW, THEREFORE, for valuable consideration paid to the Grantor, receipt of which is
hereby acknowledged, the Grantor has bargained and sold, and does hereby grant, sell and
convey unto the City, its successors and assigns, those rights -of -way, privileges, and Easements
enumerated and described hereinbelow, and as more particularly identified and depicted in
Exhibit B, attached, as follows:
1. STREET RIGHT-OF-WAY
An easement over, across, under and through the ROW Easement Area (the "ROW Easement")
to construct, improve, reconstruct, replace, inspect, repair, maintain and use a public street,
including all related, customary uses of public street right-of-way such as sidewalk, bike path,
storm drainage, street lighting, sanitary sewer, water supply and distribution, electric power,
landscaping, cable television, gas, telephone, telecommunications, and other such purposes and
uses (collectively, the "Improvements"). In addition to the City's obligations pursuant to
Sections 2(d) and 3(a) hereof, the City will be responsible for damage to the Grantor's Property,
to the extent resulting from the gross negligence or willful misconduct of the City, or the City's
employees or contractors, in the performance of the City's obligations hereunder.
2. ELECTRIC UTILITY EASEMENT
An easement to construct, install, improve, reconstruct, replace, inspect, repair, maintain and use,
both above and below ground, electric powerlines, poles, conduits, transformers, guy cables and
all other appurtenant facilities and equipment, and, in addition, the right to locate, affix, install,
inspect, repair, maintain and use telephone, cable television, and other telecommunications lines,
cables, and appurtenant equipment and facilities within the Electric Utility Easement Area.
Further specific terms and conditions applicable to the Electric Utility Easement are as follows:
a) The City is authorized to use up to an additional twenty (20) feet in each direction
beyond the Electric Utility Easement Area, as necessary for the placement of guy cables and
anchors; provided, such additional area shall not interfere with any improvements, utilities or
improvements located on the Grantor's Property as of the date hereof;
b) The City is authorized to remove and keep removed from the Electric Utility
Easement Area all trees, roots, limbs, shrubs, underbrush and part thereof, or other obstructions
as necessary to maintain, repair, or protect the power line and other lines and/or equipment
located therein. Further, the City shall have the right to trim limbs from, or cut down, any tree
outside the Electric Utility Easement Area which will likely endanger overhead electric cables or
other lines within the Electric Utility Easement Area;
c) The City shall be entitled to use the Electric Utility Easement Area for access onto
this and other public utility rights -of -way; provided nothing herein shall be construed to grant to
the City any right of access over other property of the Grantor except that described and conveyed
herein;

d) Following completion of any public utility improvements within the easement area,
any disturbed lands will be restored in accordance with generally accepted engineering and
landscape practices; and
e) The City may also use the Electric Utility Easement Area, on a temporary basis, for
construction purposes and activities in accordance with Section 3 of this Agreement.
3. TEMPORARY CONSTRUCTION EASEMENT
A temporary easement over, across, under and through the Temporary Construction Easement
Area together with the Electric Utility Easement Area (collectively, the "Temporary Construction
Easement") for purposes reasonably necessary and incidental to the construction of public
infrastructure improvements (such as streets, sidewalks, slopes, greenway trail, water, sewer and
storm drainage facilities), such temporary construction purposes including the stockpiling of
materials, the movement and storage of vehicles and equipment, construction staging, the
grading of soil and other like material, the repair, reconstruction and reconnection of a private
driveway or driveways onto adjacent public street right-of-way, and similar purposes.
Further specific terms and conditions applicable to the Temporary Construction
Easement are as follows:
a) Following construction of the public infrastructure project (or earlier termination of
the Temporary Construction Easement if applicable), the City shall re -grade, mulch and re -seed,
or otherwise restore the temporary easement area substantially to its prior use and condition, in
accordance with generally accepted landscaping and engineering practices. The City will be
responsible for damage to the Grantor's Property, to the extent resulting from the gross
negligence or willful misconduct of the City, or the City's employees or contractors, in the
performance of the City's obligations hereunder;
b) The City's use of and activities within the Temporary Construction Easement Area
[including grading, stabilization, and restoration under subparagraph (a)] shall substantially
conform with official plans and specifications for the Blue Ridge Road Bike/Ped Improvements
Project, prepared by A. Morton Thomas and Associates, Inc., entitled "C-5604OF Blue Ridge
Road Bike/Ped Improvements Project", maintained in the offices of the City of Raleigh
Engineering Services Department;
c) The City shall not block or impede ingress or egress to and from the Grantor's
Property during normal business hours in any way that would materially affect Grantor's
operations on Grantor's Property without Grantor's prior written consent, which shall not be
unreasonably withheld or delayed. Such request for consent shall be sent to and obtained from
Grantor's property manager (Jennifer Nixon with Capital Associates) via email at the following
address: (or to any address that Grantor may designate). If
Grantor's designee has not responded to the City's request within 48 hours following receipt of
the request, Grantor will be deemed to have provided consent; and
d) Upon the earlier to occur of (i) completion of construction of the Improvements, or
(ii) five (5) years after the date of this Agreement, the Temporary Construction Easement shall
automatically terminate and be of no further force or effect.
GRANTOR reserves the right to use the Easement Areas for all lawful purposes that do
not interfere with the City's use and enjoyment of the easements granted hereunder.

a primary residence.
TO HAVE AND TO HOLD the above -described permanent easements, running with the
land, for the respective purposes enumerated above, unto the City of Raleigh, its successors and
assigns, in perpetuity.
TO HAVE AND TO HOLD the above -described temporary easements, while in effect,
unto the City, its successors and assigns.
The Grantor hereby, for itself, its heirs, successors, and assigns, hereby warrants and
covenants that Grantor is the owner of the property described in Exhibit A; that they have the right
to grant these easements; that the same are free from encumbrances except those set forth on

with the City's full use and enjoyment of the easements herein granted and that they will warrant

THIS DEED OF EASEMENT is made and executed this o'lD day of
20oZi , by North Carolina Museum of Art Foundation, Inc., a North Carolina non-profit
corporation, with a mailing address of 2110 Blue Ridge Rd, Raleigh, NC 27607, hereinafter
referred to as the "Grantors", to the City of Raleigh, hereinafter referred to as the "City", with a
mailing address of 222 W. Hargett Street, Raleigh, NC, 27601.
WHEREAS, the Grantors are the Owners of the land(s) hereinafter described, and have
agreed to convey to the City, according to the terms set forth below, the easement(s) hereinafter
described;
The designation "Grantors" as used herein shall include the singular and plural, as
required, and the masculine and neuter gender, as appropriate.
NOW, THEREFORE, for valuable consideration paid to the Grantors, receipt of which is
hereby acknowledged, the Grantors have bargained and sold, and do hereby grant, sell and
convey unto the City, its successors and assigns, those rights -of -way, privileges, and
Easements enumerated and described hereinbelow, and as more particularly identified and
described in Exhibit A, attached, as follows:
1 STREET RIGHT-OF-WAY
An easement to construct, improve, reconstruct, replace, inspect, repair, maintain and
use a public street, including all related, customary uses of public street right-of-way such as
sidewalk, bike path, storm drainage, street lighting, sanitary sewer, water supply and
distribution, electric power, landscaping, cable television, gas, telephone, telecommunications,
and other such purposes and uses.
Submitted electronically by The City of Raleigh in compliance with North Carolina statutes governing recordable documents and
the terms of the submitter agreement with the Wake County Register of Deeds.

2 SLOPING EASEMENT
An easement for slopes of cuts and fills adjacent to public street right-of-way, which shall
specifically include the right to use the area, in accordance with generally accepted engineering
practices, for excavating, sloping, cutting, filling, the construction of retaining walls, the
installation of stormwater drain pipes or other drainage facilities, and including grading or
otherwise changing the natural contours of the land in order to support and accommodate the
adjacent roadway.
Further specific terms and conditions applicable to the Sloping Easement are as follows:
a) Upon completion of construction of the adjacent street and/or sidewalk, the area
subject to this easement will be graded, stabilized, and restored, using
conventional engineering and landscaping methods.
b) The City may also use the Sloping Easement area, on a temporary basis, for
construction purposes and activities which are incidental to the Blue Ridge Road
Bike/Ped Improvements Project, such purposes and activities including, but not
limited to, clearing, grading, landscaping, erosion control, temporary
impoundment of drainage flows, movement and storage of supplies and
equipment, construction staging, and the repair and re -connection of a private
driveway or driveways onto the adjacent public roadway, the right to engage in
such Project -related temporary uses to terminate upon final completion of the
Blue Ridge Road Bike/Ped Improvements Project. Any land -disturbing temporary
construction uses shall be restored in accord with sub -paragraph (a) above.
c) In addition, and at its option, the City may plant and maintain trees, shrubs and
other landscaping materials within the easement area. Routine maintenance of
the trees, shrubs, or other landscape material, such as watering, minor pruning,
and weeding will be the responsibility of the Grantors. Major maintenance
determined to be necessary by the City of Raleigh's Urban Forester will be
performed by the City; and the Grantors may not injure, remove, or otherwise
destroy the landscape material planted within the easement area without the
written consent of the City.
d) The City's use of and activities within the above -described easement area
[including grading, stabilization, and restoration under subparagraph (a)] shall
substantially conform with official plans and specifications for the Blue Ridge
Road Bike/Ped Improvements Project, prepared by A. Morton Thomas and
Associates, Inc., entitled "C-5604OF Blue Ridge Road Bike/Ped Improvements
Project," maintained in the offices of the City of Raleigh Engineering Services
Department.
e) The Grantors shall in all other respects remain the fee owners of the property
and area subject to these easements, and may make all lawful uses of the
property not inconsistent with this easement and its terms and conditions;
provided, there be no damage to the lateral and subjacent support of the public
street and/or sidewalk or to any stormwater drainage facilities.
3 ELECTRIC UTILITY EASEMENT
An easement to construct, install, improve, reconstruct, replace, inspect, repair, maintain
and use, both above and below ground, electric powerlines, poles, conduits, transformers, guy

cables and all other appurtenant facilities and equipment, and, in addition, the right to locate,
affix, install, inspect, repair, maintain and use telephone, cable television, and other
telecommunications lines, cables, and appurtenant equipment and facilities within the
easement.
Further specific terms and conditions applicable to the Electric Utility Easement are as
follows:
a) The City is authorized to use such other, additional area outside the above -
referenced easement, as necessary for the placement of guy cables and
anchors.
b) The City is authorized to remove and keep removed from the easement all trees,
roots, limbs, shrubs, underbrush and part thereof, or other obstructions as
necessary to maintain, repair, or protect the power line and other lines and/or
equipment located therein. Further, the City shall have the right to trim limbs
from, or cut down, any tree outside the easement area which will likely endanger
overhead electric cables or other lines within the easement.
c) The City shall be entitled to use the easement area for access onto this and other
public utility rights -of -way; provided nothing herein shall be construed to grant to
the City any right of access over other property of the Grantors except that
described and conveyed herein.
d) Following completion of any public utility improvements within the easement
area, any disturbed lands will be restored in accordance with generally accepted
engineering and landscape practices.
e) The City may also use the Electric Utility Easement area, on a temporary basis,
for construction purposes and activities which are related to the Blue Ridge Road
Bike/Ped Improvements Project, such purposes and activities including, but not
limited to, clearing, grading, landscaping, erosion control, temporary
impoundment of drainage flows, movement and storage of supplies and
equipment, construction staging, and the repair and re -connection of a private
driveway or driveways onto the adjacent public roadway, the right to engage in
such Project -related temporary uses to terminate upon final completion of the

City of Raleigh Engineering Services Department.
f) The Grantors shall in all other respects remain the fee owner of the property and
area subject to these easements, and may make all lawful uses of the property
not inconsistent with this easement and its terms and conditions.

4 TEMPORARY CONSTRUCTION EASEMENT
A temporary easement for purposes reasonably necessary and incidental to the
construction of public infrastructure improvements (such as streets, sidewalks, slopes,
greenway trail, water, sewer and storm drainage facilities), such temporary construction
purposes including the stockpiling of materials, the movement and storage of vehicles and
equipment, construction staging, the grading of soil and other like material, the repair,
reconstruction and reconnection of a private driveway or driveways onto adjacent public street
right-of-way, and similar purposes.
Further specific terms and conditions applicable to the Temporary Construction
Easement are as follows:
a) Following construction of the public infrastructure project, the City shall re -grade,
mulch, and re -seed, or otherwise restore, the temporary easement area
substantially to its prior use and condition, in accordance with generally accepted
landscaping and engineering practices.
b) The City's use of and activities within the above -described easement area
[including grading, stabilization, and restoration under subparagraph (a)] shall
substantially conform with official plans and specifications for the Blue Ridge
Road Bike/Ped Improvements Project, prepared by A. Morton Thomas and
Associates, Inc., entitled "C-5604OF Blue Ridge Road Bike/Ped Improvements
Project," maintained in the offices of the City of Raleigh Engineering Services
Department.
c) This easement shall terminate upon final completion of the project referenced
above, Thereafter, the Grantors may make and enjoy all lawful uses of their
property.
THE PROPERTY INTEREST HEREIN DESCRIBED AND CONVEYED does not include
a primary residence.
TO HAVE AND TO HOLD the above -described permanent easements, running with the
land, for the respective purposes enumerated above, unto the City of Raleigh, its successors
and assigns, in perpetuity.
TO HAVE AND TO HOLD the above -described temporary easements, while in effect,
unto the City, its successors and assigns.
The Grantor covenants with the City that Grantor has done nothing to impair such title to
the property described in Exhibit A as Grantor received, and Grantor will warrant and defend the
title to the property described in Exhibit A against the lawful claims of all persons claiming by,
under or through Grantor, subject to ad valorem taxes for the year 2021 and subsequent years;
easements, rights -of -way, restrictions and any other matters of record; and all applicable zoning
and land use ordinances, statutes, building codes and regulations.

notary acknowledgment below, by and between the STATE OF NORTH CAROLINA, a body
politic and corporate, hereinafter referred to as GRANTOR, and the CITY OF RALEIGH,
hereinafter referred to as GRANTEE:
WITNESSETH:
THAT, WHEREAS, the Department of Agriculture and Consumer Services, has
authorized and approved the execution of this Easement for the purposes herein expressed; and,
WHEREAS, the execution of this Easement for and on behalf of the State of North
Carolina has been duly approved by the Council of State by resolution adopted at a meeting held
in the City of Raleigh, North Carolina, on the 3Td day of August 2021; and,
WHEREAS, Grantor owns certain parcels or tracts of land situated in the City of
Raleigh, Meredith Township, Wake County, North Carolina, PIN No. 0784664216, as further
described herein, and
WHEREAS, Grantee desires an easement over and upon a portion of the Property for the
purpose of improvements to the bike and pedestrian facilities along Blue Ridge Road including a
pedestrian bridge over Wake Avenue, a multi -use path, new sidewalks, and a protected
intersection at Reedy Creek Road; and,
WHEREAS, Grantor, subject to the terms and conditions set forth herein, has consented

to grant and convey a non-exclusive easement to Grantee over and upon a portion of the Property
for the purpose of constructing and maintaining certain drainage improvements and access

NOW, THEREFORE, in consideration of the sum of SEVENTEEN THOUSAND
FOUR HUNDRED SEVENTY-FIVE DOLLARS AND NO/100 ($17,475.00), paid to
Grantor, receipt of which is hereby acknowledged, Grantor does hereby grant, sell and convey
unto Grantee, its successors and assigns, the right, privilege, and easement for ingress and
egress, together with the right to construct, install, maintain, inspect and repair storm water
drainage improvements within and upon the Easement Area, as hereinafter described;
1. Permanent slope easement of 150 square feet or (+/-0.003 acre) more or less, and more
particularly described on Exhibit A, attached and,
2. Temporary construction easement of 762 square feet or (+/-0.017 acre) more or less, and
more particularly described on Exhibit A attached and,
3. Stormwater drainage easement of 439 square feet or (+/-0.01 acre) more or less and,
more particularly described on Exhibit A attached.
IT IS UNDERSTOOD AND AGREED BETWEEN GRANTOR AND GRANTEE:
1. Grantee shall have the right to go in and upon the Easement Area for the purpose
of constructing, installing, maintaining, inspecting and repairing drainage improvements and for
no other purpose.
2. Grantee shall repair damage to the Property or shall pay Grantor for damage done
to the Property as a result of the exercise of the easement rights granted herein.
3. This Easement is granted subject to all existing rights of way and easements
within the Easement Area.
4. Grantor reserves the right to utilize the area within the Easement Area for all
purposes not inconsistent with the easement rights herein conveyed.
5. It is understood and agreed that this Easement is granted subject to the condition
that Grantee shall properly obtain all necessary permits required by State and federal law.
Failure to obtain such permits in a timely manner shall be deemed an abandonment of this
Easement.
TO HAVE AND TO HOLD the aforesaid rights, privileges and easements unto
Grantee, its successors and assigns, for so long as Grantee maintains its drainage improvements
within the Easement Area and no longer.

THIS EASEMENT ("Easement"), made and entered into as of the date set forth in the
notary acknowledgment below, by and between the STATE OF NORTH CAROLINA, a body
politic and corporate, hereinafter referred to as GRANTOR, and the CITY OF RALEIGH,
hereinafter referred to as GRANTEE:
WITNESSETH:
THAT, WHEREAS, the North Carolina Department of Agriculture and Consumer
Services, have authorized and approved the execution of this Easement for the purposes herein
expressed; and,
WHEREAS, the execution of this Easement for and on behalf of the State of North
Carolina has been duly approved by the Council of State by resolution adopted at a meeting held
in the City of Raleigh, North Carolina, on the 3Td day of August, 2021; and
WHEREAS, Grantor owns those certain parcels or tracts of land located on Trinity Road
in Raleigh, Wake County, North Carolina and being more particularly described in Book of Maps
1985, Page 1399, 2100 Blue Ridge Road, of the Wake County Registry (the "Property"); and
WHEREAS, it is the intent of Grantee to construct and maintain certain road
improvements to the bike and pedestrian facilities upon a portion of the Property and Blue Ridge
Road from just North of Trinity Road to Reedy Creels Road, Meredith Township, Wake County,
North Carolina, plans for the improvement include a pedestrian bridge over Wake Avenue, a

improvements constructed in accordance with said Project Plan are sometimes referred to herein
as the "Project" ).
NOW, THEREFORE, in consideration of the sum of EIGHT THOUSAND ONE
HUNDRED SEVENTY-FIVE AND NO/100 DOLLARS ($8,175.00), paid to Grantor, receipt
of which is hereby acknowledged, Grantor does hereby grant, sell and convey unto Grantee, and
its successors, the right, privilege, right of way and easement for ingress and egress, together with
the right to construct, improve, reconstruct, repair, replace, inspect, maintain and use for highway
right of way purposes, permanent rights of way, drainage, utility, sedimentation control and
necessary cut and/or fill slopes within and upon the Easement Area, as hereinafter described, and
the area adjacent to the Project and being located in the City of Raleigh, Wake County, North
Carolina, upon and along Trinity Road, and being more particularly described as follows:
1. Permanent Slope Easement of +/-212 square feet or (+/-0.005 acre) more or less, and
more particularly described on Exhibit A; and
2. Temporary Construction Easement of +/-542 square feet or (+/-0.012 acre) more or less,
and more particularly described on Exhibit B.
Permanent Drainage Easement, and Temporary Construction Easement areas, reference to which
is hereby made for a more particular description (the "Easement Area").
IT IS UNDERSTOOD AND AGREED BETWEEN GRANTOR AND GRANTEE:
1. The purpose of this Easement is to allow Grantee to construct the Trinity Road
Underpass project in Raleigh, Wake County, North Carolina in accordance with the Project Plan.
2. This Easement shall cover that portion of Trinity Road between Youth Center
Drive and Blue Ridge Road on or adjacent to the Property, as shown on the Project Plan.
Permission is also granted to Grantee to exceed the Easement Area, for the purpose of cut and fill
slopes that are needed for the construction of the Project. Grantee shall have the right to perform
such work as is reasonably necessary in order to accomplish construction of the Project, together
with the right to maintain and repair the Project for so long as necessary to maintain those areas
described herein, as part of the State maintained road system.
3. Grantee agrees that it will utilize the Easement Area for no purpose other than the
construction of the Project as shown on the Project Plan and for the maintenance of same
thereafter. Grantee further agrees that it will not permit anyone to encroach upon nor grant to
anyone encroachment rights within the Easement Area. The temporary construction easements
will terminate at the completion of construction of the project.
4. This Easement is granted subject to all existing rights of way and easements
within the Easement Area.

5. Grantor reserves the right to utilize the area within the Easement Area for all
purposes not inconsistent with the easement rights herein conveyed.
6. Pursuant to the delegation of authority, under G.S. § 113A-56(b), to administer its
own sedimentation and erosion control program, Grantee agrees to construct the Project
consistent with the mandatory requirements of G.S. § 113A-57 and the Regulations promulgated
thereunder in 15A North Carolina Administrative Code, Chapter 4. Likewise, Grantee agrees
that it will, to the extent practical, return the Easement Area and any other areas of the Property
affected by the construction of the Project, to preconstruction condition, including if necessary,
replacing any trees which may be destroyed during construction.
7. It is understood and agreed that Grantee shall have the right to construct and
maintain the cut and/or fill slopes in the Easement Area until such time that the property owners
alter the adjacent lands in such a manner that the lateral support of the cut and/or fill slope is no
longer needed. Any additional construction areas lying beyond the cut and/or fill slopes and
extending beyond the right of way limits will terminate upon completion of the Project.
8. It is understood and agreed that Grantee will correct any drainage problems on the
Property related to the construction of the Project in a timely manner and to Grantor's
satisfaction.
TO HAVE AND TO HOLD the aforesaid rights, privileges and easements unto Grantee,
its successors and assigns in perpetuity.

to grant and convey a non-exclusive easement to Grantee over and upon a portion of the Property
for the purpose of constructing and maintaining certain improvements and access thereto.
NOW, THEREFORE, in consideration of the sum of ONE HUNDRED TWENTY-
EIGHT THOUSAND FOUR HUNDRED SEVENTY- FIVE DOLLARS AND NO/100

IT IS UNDERSTOOD AND AGREED BETWEEN GRANTOR AND GRANTEE:
1. Grantee shall have the right to go in and upon the Easement Area for the purpose
of constructing, installing, maintaining, inspecting and repairing improvements and for no other
purpose.
2. Grantee shall repair damage to the Property or shall pay Grantor for damage done
to the Property as a result of the exercise of the easement rights granted herein.
3. This Easement is granted subject to all existing rights of way and easements
within the Easement Area.
4. Grantor reserves the right to utilize the area within the Easement Area for all
purposes not inconsistent with the easement rights herein conveyed.
5. It is understood and agreed that this Easement is granted subject to the condition
that Grantee shall properly obtain all necessary permits required by State and federal law. Failure
to obtain such permits in a timely manner shall be deemed an abandonment of this Easement.
TO HAVE AND TO HOLD the aforesaid rights, privileges and easements unto Grantee,
