Since the application was filed in July 2021, the Greensboro -Randolph Megasite Foundation (GRMF) has coordinated closely with the North Carolina Division of Water Resources (NCDWR) to provide additional details and answer questions regarding the application. With the public announcement of the end user of the site in December 2021, GRMF has been able to develop final plans for the site layout and wetland and stream impacts of the project. Accordingly, we believe that the following information, coupled with the original application and the information submitted in September, October and December is sufficient to enable the NCDWR to process and issue the requested permit. Below you will find responses to comments received by email on January 21, 2022. The site plan and additional detail regarding schedule will be provided in a separate file marked as confidential. DWR comments are shown below in normal text, and the applicant's respective response to each respective comment are shown immediately below that comment in italics. • While the Division recognizes that continued efforts have been made to further the avoidance and minimization efforts for the project, we have concerns that until final site design, layout and grading plans are completed and that information is reviewed, that issuance of a 401 authorization will be premature. Any future changes to the proposed site design or layout after issuance of the 401 will require formal application for modification of the 401. The Division wishes to avoid multiple iterations of a 401 application review and approval given that the site layout, grading and design continue to be under development. The end user of the site was publicly announced in December 2021. GRMF has worked closely with the end user to update the site layout, grading and design plans for the site. The plans submitted and pending before NCDWR are the final plans. No further changes affecting the area of development or the expected impacts to aquatic resources are expected. Accordingly, NCDWR now has sufficient information to evaluate the application and issue the 401 Water Quality Certification. 555 Fayetteville Street, Suites 900 & 210, Raleigh, NC 27601-3034 (919) 232-6600 •• PROTECTED r411 t5'4,:6 • The recent responses identified several instances of additional avoidance and minimization, including the removal of a proposed waste treatment and solar facility. Information provided also includes additional impacts associated with a new access road. You have provided new impact maps, however these are insufficient to adequately show the changes made to the proposed site layout. Please provide a new site layout map for the project that clearly shows and labels all components of the site, and clearly includes the location of the new access road in its entirety. Please also ensure that the site layout clearly shows the areas to be connected by the proposed new access road. Please see the attached Confidential Site Plan. • Provide a detailed engineering plan and profile for the culvert proposed under the new access road to document that it will maintain natural stream function above and below the culvert as well as provide for aquatic passage while in use. The design of the culvert takes into account burial of the pipe 1-foot to maintain aquatic passage and natural stream function. See the attached plans and calculations. • You state that this access road is necessary to provide safe travel between the site grading and field offices. Please clarify if this access road will remain upon completion of grading/development of the site. If the road will not be necessary upon completion of construction and removal of field offices/grading activities, provide a restoration plan to be followed upon removal of the culvert proposed under the new access road. The end user requires this access remain in place for the life of the facility. Accordingly, the access road impact has been illustrated as a permanent impact. • The updated impact sheets show the original locations for stormwater ponds. Please update the impact sheets to show the revised locations of all features, including stormwater ponds and the locations for any ancillary features that have been removed from the proposed site pad but are still proposed to be located on the property (solar facility, waste treatment facility, etc.) Please label these items clearly. Please also review and identify whether any additional access roads or utility lines will be necessary for the proposed new locations of these ancillary features. The site plan is provided and marked as confidential. The updated impact sheets are being provided to illustrate impacts for the items noted above. The solar facility has been postponed at this time on the site. A separate pretreatment wastewater facility was also not needed at this time due to pretreatment processes being internal to the building. • The plan sheet that shows the location of the edge of fill impact and the location of the proposed outlet of Wet Pond B2 indicate that there will be a portion of the stream channel between the limit of impact/fill and outlet of the wet pond which is likely to experience a significant reduction in hydrology. Please determine this length of stream channel and update the application and impact tales to include this length as indirect impacts. The area referred to in this comment is a portion of S1, as shown on the impact sheets. The impact sheets provided in the avoidance and minimization package and the ones attached have been revised with the final grading plans. The area in question includes direct impacts to S1, but there shouldn't be any indirect impacts to S1. • The Division recognizes the efforts to reduce impacts to Streams S17 and S18 and wetlands adjacent to these streams through continued avoidance and minimization measures. In order for the Division to re-evaluate the concerns we have had for the •• PROTECTED r411 t5'4:6 potential of indirect impacts from reduced hydrology in these channels please provide an impact plan sheet that shows the area encompassed by impact sheets 18, 19, 22, and 23 with the existing topography shown. See attached combined version of the mapping with existing topography. • In response to previous questions about the proposed phasing schedule of the project you indicated that "There will be no phases of construction of the contiguous pad — site grading and construction of the pad will be continuous". The response does not answer the question posed by the Division. While we acknowledge preference to construct the pad in a continuous fashion, public announcements of the proposed Toyota battery manufacturing facility indicated that the Toyota facility may be developed and operational in phases. Please provide a detailed schedule of the proposed operation of the proposed Toyota facility. Please see the attached Confidential Site Plan that provides the detail requested regarding schedule. • You have stated that the placement of fill would reduce the storage volume of Dodson's Lake and therefore trigger requirements to modify the dam. Please provide detailed information related to this statement including, but not limited to, an engineering report or other technical evaluation documenting the need for modifications to the dam; a reference to regulations that require Dodson's lake to provide "storage capacity"; a reference to regulations that would trigger modifications to the dam. You have stated that the cost of dam modifications or reconstruction would be cost prohibitive. Provide a specific analysis of this statement. The cost analysis must include cost savings in any reduction of stream and/or wetland mitigation from the preferred on -site alternative. The applicant is proposing Option 1, which does not impact Dodson's Lake. As reflected in the attached alternatives analysis, the alternatives that would impact Dodson's Lake would have greater impacts on wetlands and streams, and thus were not selected. In addition to having greater impacts, there are constraints with construction within the lake area due to the poor soils, undercutting, and settlement issues. In accordance with the CWA 404(b)(1) guidelines, Option 1 was selected because it is the least damaging/has the least impact on aquatic resources. • Please clarify if it is your intention to propose Permittee Responsible Mitigation for any portion of the mitigation requirement for the proposed project. Review of a Permittee Responsible Mitigation proposal will take significant time and effort by staff. The Division is concerned that you have indicated an extreme need that the 401 be issued as soon as possible in order to meet your construction schedule, however issuance of a 401 authorization would be premature if there will be modifications to the proposed mitigation plan. Please note that upon issuance of the 401, impacts may not occur until the mitigation plan has been finalized. (e.g., payment in full to the mitigation provider.) The applicant will not be proposing onsite Permittee-Responsible Mitigation (PRM) as mitigation for the proposed project. •• PROTECTED r411 t5'46 The Applicant looks forward to issuance of the 401 Water Quality Certification for the GRMS project. License Number: F-0116 •• PROTECTED %i1t5is;n 4.3.3 Level 3 Analysis A Level 3 Analysis was performed to assess alternative layouts for the Proposed Project in terms of accessibility, efficiency, and environmental impacts. Each design utilized an identical site area (1,015-acre construction pad including rail and other infrastructure necessary for the overall project purpose), but with different layouts. The facility layout must be designed to support efficient battery manufacturing processes, deliveries, shipping, and access from a logistical perspective. Layout options 1 through 5, detailed below, represent a variety of Proposed Project configurations. 4.3.3.1 Option 1 locates the battery manufacturing, production, and assembly facility along the middle and upper portions of the site but angles the southern boundary of the pad to avoid impacts to Dodsons Lake and minimize stream and wetland impacts just north of Dodsons Lake and to the stream on the eastern side of the site (Figure 2). This option avoids impacts to the western most stream reaches on the site. This option provides access to rail and transportation upgrades and provides the largest buffer along the eastern, western, and southern perimeter of the pad where the highest density of residential properties abut the site. Option 1 provides suitable configuration and access to the necessary facilities while minimizing impacts to certain jurisdictional features and avoiding impacts to Dodsons Lake. The proposed site layout as shown would impact approximately 8.69 acres of wetlands, 21.54 acres of open water, 33,567 linear feet of stream and has 30.55 acres of FEMA AE Zone within the boundary. Alternative Impacts Map — Proposed Layout Onsite Option 1 •• PROTECTED %i1t5is;n 4.3.3.2 Layout Onsite Option 2 Option 2 locates the battery manufacturing, production, and assembly facility in the middle portion of the site similar to Option 1 but retains a portion of the drainage to the west and also minimizes direct impacts between the rail alignment and the pad area (Figure 3). This option is very similar to Option 1; however, it results in a reduced buffer along the southeastern boundary, impacts Dodsons Lake, and the area between the rail and pad boundary could be considered indirect impacts due to location. Option 2 has the most wetland impacts, impacts Dodsons Lake, and reduces the site buffer along the southeastern edge of the site. The site layout as shown would impact approximately 14.7 acres of wetlands, 23.5 acres of open water (73.8 if Dodsons Lake had to be drained), 33,867 linear feet of stream, and 52.5 acres of FEMA Zone AE. Alternative Impacts Map — Layout Onsite Option 2 •• PROTECTED %i1t5is;n 4.3.3.3 Layout Onsite Option 3 Option 3 shifts the location of the battery manufacturing, production, and assembly facility slightly east and increases avoidance of stream drainages to the west of the site; however, this configuration impacts the upper portion of Dodsons Lake (Figure 4). This option provides no buffer on the southern boundary which is a concern for residents along perimeter of the site and with respect to setback requirements. Option 3 would require transportation upgrades to extend further east to tie into the pad (-622 linear feet of impact). This option would involve undercutting poor soils on the lake bottom and substantial filling of the area to reach final pad elevation. Development of the lake area, undercutting the soft and sediment laden soils in the lakebed, would present a high risk of settlement issues which is a great concern to the end user as the machinery in the facility has little tolerance for settlement issues. Because of these settlement issues, the developed former lake areas may not be able to be developed and used as needed to meet the applicant's purpose and need for the project. Option 3 also provides space for future development to the west. In summary, Option 3 has similar impacts to Option 1; however, the layout impacts a portion of Dodsons Lake and leaves no buffer on the southern boundary, and there will likely be soil settlement issues in the former lake area that may prevent this area from being used as needed and therefor this option may not meet the applicant's purpose and need for the project. The site layout as shown would impact approximately 11.5 acres of wetlands, 34.4 acres of open water (71.8 if Dodsons Lake had to be drained), 33,580 linear feet of stream, and 67.3 acres of FEMA Zone AE. This option also impacts non -jurisdictional Pond B (PB) (1.06 acres) and Wetland HDR WD (0.02 acres) which are not included in the jurisdictional impact totals. This option provides the potential for future development to the south (Figure 5). Although Option 4 provides a similar site layout to Option 1 and avoids impacts to Dodsons Lake, the layout would impact every stream drainage on the site resulting in the highest stream impacts of all the options. The site layout would impact approximately 9.4 acres of wetlands, 21.8 acres of open water, and 36,256 linear feet of stream, and 27.0 acres of FEMA Zone AE. Development of the lake area, undercutting the soft and sediment laden soils in the lakebed, would present a high risk of settlement issues which is a great concern to the end user as the machinery in the facility has little tolerance for settlement issues. This alternative would require additional track to be built, has greater impacts than other alternatives, and impacts Dodsons Lake. The site layout would impact approximately 12.1 acres of wetlands, 34.1 acres of open water (76.2 acres if Dodsons Lake had to be drained), and 35,993 linear feet of stream, and 58.3 acres of FEMA Zone AE. Alternative Impacts Map — Layout Onsite Option 5 OPTION 5 IMPACTS MAP 4.3.3.6 Layout Onsite Option 6 (Deemed Infeasible) An option to fill Dodsons Lake entirely was not deemed feasible. The site boundary forms a spur around the lake that is narrow compared to the rest of the site. Measured east to west, the widest part of this area is approximately 2,200 feet across. The width narrows to approximately 1,100 feet at the southern tip of the site. The required fill slopes in this area to achieve pad elevation would significantly reduce the buildable area. The southern entrance to the site follows the eastern edge of this area reducing developable area while creating accessibility issues due to the required grade of the fill slope. This option would involve draining Dodsons Lake, undercutting poor soils on the lake bottom, and substantial filling of the area to reach final pad elevation. Development of the lake area, without undercutting the soft soils in the lakebed, would present a high risk of settlement issues which is a great concern to the end user as the •• PROTECTED %i1t5is;n machinery in the facility has little tolerance for settlement issues. This option would have considerably higher impacts to FEMA Zone AE than all other options. 4.3.4 Identification of the Onsite LEDPA GRMF evaluated a number of layout options as described in Sections 4.3.3.1 through 4.3.3.5. The GRMF proposes Option 1 of the Level 3 Analysis on the GRMS as the Onsite LEDPA. See below for the impact matrix for the five onsite options analyzed. Table 1.
