This is to advise you that the Pitt County Technical Review Committee conditionally approved
the soil erosion and sedimentation control plan for East Ridge Section 2, Phases 1, 2, and 3 on
November 25, 2020. Conditions and requirements as a part of this approval are attached below.
Copies of the draft minutes from the meeting will be available upon request prior to the next
Technical Review Committee meeting.
As stipulated on the financial responsibility form, you are responsible for ensuring compliance
with all aspects of the approved plan and the Pitt County Soil Erosion and Sedimentation Control
Ordinance. Your primary objectives include, but are not limited to, preventing offsite
sedimentation, preventing sediment from entering watercourses, and establishing vegetation on
all disturbed areas within 7-14 calendar days, following any completion of a phase of grading.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the
NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to
the commencement of any land disturbing activity on the above named project. The NOI form
may be accessed at deq.ne.gov/NCGOI. Please direct questions about the NOI form to Annette
Lucas at Annette. lucas ancdenr. gov or Paul Clark at Paul.clark a,ncdenr. ov. After you submit a
complete and correct NOI Form, a COC will be emailed to you within three business days.
Please be aware that your project will be covered by requirements of the NPDES
Construction Stormwater General Permit NCG010000. Please become familiar with all the
requirements and conditions of this permit in order to achieve compliance.
Upon discovery of noncompliance by our office, the following actions may be taken:
1. No further permits for building or other construction will be issued.
2. The authority to continue construction, other than for erosion control measures,
will be terminated.
3. Penalties of up to $5000 per day may begin to accrue. Failure to immediately
comply upon notice of noncompliance will result in injunctive and/or criminal
action.
Other Comments:
4. This erosion control plan shall expire three years following the date of approval if
no land disturbing activity has been undertaken.
5. The Division of Water Quality may pursue legal action against you in order to
enforce requirements of the NPDES, Phase II permit.
6. The Pitt County Soil Erosion and Sedimentation Control Ordinance authorizes
County officials to inspect sites to ensure compliance with the Sedimentation
Pollution Control Act.
Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file
at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of
periodic inspection to insure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring
protection of existing natural resources and adjoining properties. If, following the
commencement of this project, the erosion and sedimentation control plan is inadequate to meet
the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General
Statute 113A-51 through 66), this office may require revisions to the plan and implementation of
the revisions to insure compliance with the Act. Acceptance and approval of this plan is
conditioned upon your compliance with Federal and State water quality laws, regulations, and
rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing
activity. This approval does not supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. You are requested to file an amended form
if there is any change in the information included on the form. Land disturbance shall not
begin until a preconstruction meeting has taken place.
A final Certificate of Occupancy will not be issued until the listed conditions have been
addressed.
Please provide a copy of the certificate of coverage prior to beginning any land disturbance.

CONDITIONS AND REQUIREMENTS

1. Obtain Certificate of Coverage from NCDEQ prior to beginning land disturbance.

2. Compliance with the Town's stormwater requirements is based on pervious surface
area that includes a large part of lots included in future construction phases (Lots 285,
286, and 287). The submitted construction plans are for an initial construction phases
that depend on the overall subdivision plan for stormwater compliance. Developer
should identify property in future construction phases on ultimate final plat (needed
before lots could be developed) to prevent potential for sale of portion of future
construction phases creating new parcels/properties that would create potential
violation of stormwater compliance. If the overall subdivision development is needed
for stormwater compliance, the total acreage should be included on any final plat.
3. Developer needs to proceed with annexation prior to beginning of any construction.
4. Future construction phase may impact a perineal stream. Soil maps/USGS maps
indicate the potential for a blue -line stream crossing a section of identified Lot 287.
Perineal stream should be identified or documentation provided that supports
declassification on the property.
[General Comments]
• Soils located on site include AgB, Bd, CrB2, ExA, GoA, GoB, Ly, NrB, OcB,
Pg, WaB, and possess the following characteristics:
■ Seasonal high-water table (Bd, Ra, CrB2, ExA, GoA, GoB, OcB, Pg, and
Ly)
■ Moderate Shrink -Swell potential (Bd, ExA)
■ High Shrink -Swell potential (CrB2)
■ Slow Permeability (Bd, CrB2)
■ Flooding or Ponding (Pg)
■ Low filtering action — possible contamination of groundwater (AgB)
■ Unstable for trenching 4 feet or more (AgB)
■ Swift Creek Watershed
■ Soils are prime farmland or have statewide importance for farming.
Development will remove the site from agricultural production.
■ The adjacent drainage laterals should be cleaned out to their original
bottom for improved drainage.
■ There is a record of sub -surface drain tile on site. Please see the attached
map.
