Dear Mayor Medlin:
The Wilmington Regional Office received the modification to the Stormwater Management Permit Application for Kure
Dunes Phase II on April 15, 1997, with final information on October 8, 1998. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H.1000. We are forwarding Permit No. SW8 920807 Modification, dated October 8, 1998, for the construction of Kure
Dunes Phase II.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations
as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

construction of impervious areas to be treated in an off -site permitted stormwater facility, and for the construction of
impervious surfaces to be treated in underground infiltration trenches, in compliance with the provisions of 15A NCAC 2H
A 000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part
of this permit. The stormwater runoff from the site will be routed to a a detention pond operated and maintained by
Beachwalk Development, Inc. under the terms and conditions set forth in Permit No. SW8 960518.
This permit shall be effective from the date of issuance until October 8, 2008, and shall be subject to the following specified
conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. The stormwater system permitted under #SW8 960518 has been approved for the management of stormwater runoff
as described on page 3 of this permit, the Project Data Sheet. The built -upon area allotted to this development by
Stonnwater Management Permit 4SW8 960518 is 182,577 square feet. This project proposes a total of 29 single
family lots, each allowed a maximum of 70% of their lot area as built -upon area, per Kure Beach ordinance. In
addition, Lots 31, 32 and 33 drain to an underground trench system, and 4,960 square feet of entrance road drain to
an underground trench system, as shown on the approved plans. Page 4 of this permit describes the design
requirements for the infiltration trench systems, which will be operated and maintained by the Town of Kure Beach.
Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.

4. This subdivision is limited to the amount of built -upon area indicated in the supporting calculations and per
approved plans. The portion of the project that is treated in the detention pond must have a built -upon area less than
or equal to the amount permitted under Stormwater Permit #SW8 960518. Additional built -upon area will require
a modification to SW8 960518.The portion of the project treated in the infiltration system is limited to a total of
18,474 square feet.
The Town of Kure Beach is responsible for verifying that the proposed built -upon area per lot does not exceed the
allowable built -upon area, proposed as 70% of the total lot area, for every lot in the subdivision. Once the lot
transfer is complete, the built -upon area may not be revised without approval from the permittee and the DWQ,
and responsibility for meeting the built -upon area limit is transferred to the individual property owner.
The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Alteration of any drainage feature (piping, swales, etc.) shown on the approved plan.
The Director may determine that other revisions to the project should require a modification to the permit.
II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
Beachwalk Development, Inc. shall at all times provide the operation and maintenance necessary to assure the
permitted stormwater detention pond functions at optimum efficiency. The approved Operation and Maintenance
Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
The Town of Kure Beach is responsible for keeping the collection system in Phase II clear of debris, and for the
maintenance of the infiltration systems for Lots 31, 32 and 33, and the entrance road. Maintenance shall include
those same items as indicated in #3, page 5 above, except that two additional items will be required: 1-If the system
is not drawing down within 5 days, notify the Division of Water Quality; and 2- The system will be tested annually
for compliance with the volume and drawdown rate. The system will be restored or repaired to design condition
if a problem is found.

5. Beachwalk Development, Inc. and the Town of Kure Beach, must keep records of maintenance activities for their
respective systems, and make them available upon request to authorized personnel of DWQ. The records will
indicate the date, activity, name of person performing the work and what actions were taken.
6. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.
7. Beachwalk Development, Inc. has provided a certification from an appropriate designer for the system installed,
certifying that the permitted facility has been installed in accordance with Stormwater Permit #SW8 960518, the
approved plans and specifications, and other supporting documentation. The Town of Kure Beach is responsible
for providing a Certification from an appropriate designer for the infiltration trench system, certifying that the
system has been installed in accordance with the design conditions listed on Page 4 of this permit.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
9. All runoff from the lots permitted to drain into the offsite system must be directed into that system. Runoff from
the 3 lots and road to be treated in the infiltration systems must be directed into the appropriate system, as shown
on the approved plans.
10. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
Beachwalk Development, Inc. (for the detention pond) or the Town of Kure Beach (for the infiltation systems) as
appropriate, shall take immediate corrective action, including those as may be required by this Division, such as
the construction of additional or replacement stormwater management systems.
5. The permittee grants permission for DENR Staff to enter the property for the purpose of inspecting all components
of the permitted stormwater management facility.

6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

In response to your request for additional information dated August 7,1998, we
are sending to you the following:
The application form with Section III completed. The information shown
includes square footage for additional impervious area that would result from
the development of the existing pond area as four residential lots at some future
date. The Town of Kure Beach does not plan to develop these lots at this time.
However, we are requesting that this permit modification include approval for
this eventuality to prevent the Town of Kure Beach from having to revisit the
Kure Dunes Phase II Stormwater Permit again, in the future.

The design capacity for the existing Kure Dunes Phase II pond is 33, 050 c.f. If
the existing pond is removed and eventually developed as four additional lots,
the following additional quantity of run-off could be expected:

Remaining Undeveloped Area of Lots: 32,718 s.f. x .3 x .20 = 1,963 s.f.

remain as originally stated. The Town of Kure Beach will continue to be responsible
for maintenance of the entire original stormwater system for Kure Dunes Phase II,
including any necessary maintenance on the piping associated with the existing pond
removal.

information.
Request for original application submitted to DWQ — Wilmington on July 1, 1998.
The original application was not returned with your correspondence dated July 1,
1998. We have enclosed three (3) copies each of our file copy of the original
application.
2. Request for additional information dated May 2, 1997, requesting revised plan for
Kure Dunes Phase II Subdivision showing new lot lines.
The Town of Kure Beach owns the property where the existing pond is to be filled.
The Town does plan to create four (4) lots on the location of the filled pond in the
future (see Detention Pond Removal Plan dated August 6, 1998). The Kure Dunes
Development Lot Layout will remain the same as originally approved. We have
enclosed a copy of the original Drainage Plan.
3. Request for Operation and Maintenance Plan for Kure Dunes, Stormwater System.
The Town will be responsible for maintenance of the proposed piping relating to the
filling of the detention pond (see attached letter dated July 29, 1998 from the Town of
Kure Beach, NC).

It needs to be shown on the plans and listed on the application as a separate drainage area. Is
the Town aware of this infiltration system? Will they maintain it as well?
Who will be responsible for maintaining the piped collection system in Kure Dunes, not just
that small portion that is new which connects into Beachwalk? The letter from the Town only
says it is responsible for the "piping necessary for filling of the pond". What does that mean?

The Wilmington Regional Office received a modification to the Stormwater Management Permit

submitted on July 22, 1998, and reviewed today indicates that the application is not complete. The following
information is needed to continue the stormwater review:
1. The original application which was submitted on July 1 and returned to you. It has been
determined that a 1998 version of the application is not necessary.
2. The additional information letter of May 2, 1997, requested that a revised plan be submitted
that showed the overall subdivision with the pond deleted, and showing the new lot lines. If
new lots will not be created in the area of the closed pond, please indicate this on the plans.
The plans submitted on July 22, 1998, only show the revised piping in the area of the closed
pond. The new plans will replace those previously approved, and must show all lots, streets,
etc., as were originally approved, with the current revision.
3. A signed Operation andMmaintenance plan for the maintenance of the stormwater collection
system only (NO POND MAINTENANCE) in Kure Dunes, unless the Town of Kure Beach
will be responsible for this, too.

In follow up to my memo dated February 22, 1995, I am
responding as to my findings concerning the accusations by Bill
Hanna which were without merit.
Going back to our phone conversation of February 22, 1995, I
have a copy of your hand written notes dated October 26, 1992,
wherein it appears there were notes taken by you concerning Lots
51-53 and Lots 31, 32 and 33 draining to pipe along 421. It
appears to me that these notes have absolutely nothing to do with
the detention pond in question; therefore, the last sentence in
your second paragraph of your letter dated February 7, 1995,
addressed to Bill Hanna, is in error if it pertains to the
detention pond.
As I told you on the phone, Mr. Hanna in my opinion, has
some animosity or ill will towards Carl Farmer as Mr. Hanna so
advised this writer and Mayor Medlin on Monday, February 13,
1995, at approximately 11:00 a.m. Mr. Hanna without any expert
advice, assumed that the detention pond was constructed in
wetlands and proceeded to call Charlie Hollis, the consultant.
From our conversation, it became apparent that Mr. Hollis
speculated based upon the erroneous information obtained from Mr.
Hanna and gave his opinion that the location based upon Hanna's
information appeared suspect and he advised that today a permit
probably would not issue.
Armed with the above erroneous and/or hearsay statements,
Bill Hanna had his conversation with you which led to the
correspondence mentioned hereinabove.

As I told you on the phone, the detention pond area was
examined by John P. Ryder who not only examined the site of the
detention pond, but took several borings to view the soil profile
and also looked for the presence of groundwater sufficient to
meet the wetland hydrology criteria for regulated wetlands. I am
enclosing a copy of John Ryder's letter for your information. If
you wish to review this matter further, I have a complete file of
correspondence on this project.
The best I can make of this situation is that Bill Hanna,
even though he thought he was doing the right thing, he
overstepped his bounds by (1) not being an expert, (2) not
seeking expert advice, (3) relied on hearsay, (4) passed on
erroneous information, and (5) refuses to admit he was in error.
I will assure you that the Town of Kure Beach wishes to
comply with your regulations as evidenced by the fact we took the
enforcement out of the county's hands and placed it in yours so
that we would know the law is followed.
Based upon my reviewing of the files and based upon my
research and investigation, I feel this matter is resolved. If
you should have some information or other evidence to the
contrary, I would be most receptive to your expertise and
knowledge.
Should you have any questions, please do not hesitate to

Wetlands Investigation
On April 2, 1992 the +0.75-acre site currently occupied by a
stormwater detention pond at Kure Dunes was investigated for the
presence of wetlands. During the site visit the site was
traversed on approximately 25-foot intervals. Numerous soil
borings were made to view the soil profile and to look for the
presence of groundwater sufficient to meet the wetland hydrology
criteria for a regulated wetland. The majority of these borings
were to a depth of 30 inches with several extending to a depth of
50 inches. At no time during the site visit was any groundwater
observed. while seasonal and even yearly rainfall patterns af-
fect the location of the groundwater, the fact that the site was
visited in early spring should have resulted in the groundwater
being at a higher level. This is typical of this region due to
our increased rainfall averages during the spring of the year.
Many of the soil profiles extracted during the boring opera-
tions did not appear to have typical coloration and stratifica-
tion that one would expect from a Leon or Lynnhaven soil profile.
This site was marked by the soil survey of New Hanover County as
having Lynnhaven series soils. Lynnhaven soil series is con-
sidered a hydric soil.
Prior to development of the site as a detention pond the
site was dissected by a 6-foot deep drainage ditch. Ap-
proximately 2 inches of flowing water was observed in the bottom
of this ditch.
A visual inspection of the soil profile exposed along the
ditch bank appeared to show an area approximately 2 to 3 feet
deep of fill material above what appeared to be the historic
natural ground plane. This same profile was found in most of the
borings performed during the site visit.
The pond site is located adjacent to the old bromine extrac-
tion plant that operated in Kure Beach during World War II. It
was concluded that fill material had most likely been placed on
the proposed pond site during the construction or operation of
this facility.

In conclusion, it was the opinion of the wetlands delineator
that this site had been sufficiently disturbed and drained to
render it a non -wetland area. This site did not appear to meet
the hydrology criteria necessary for the requirements of the
USCOE definition for a regulated wetland.
It is also worth noting that the current stormwater reten-
tion pond has worked as designed since its construction. This
fact would also tend to support the assumption that the area of
the pond is not a wetland and that sufficient storage area exist
in the pond above the existing groundwater level to meet
stormwater storage needs. The average groundwater level in the
pond is well below the elevation required to meet the wetlands
hydrology criteria.

Dear Mr. Hanna:
I have reviewed the file of this project and the question concerning whether the pond was built
in wetlands, and whether the project's wetland delineation and status were misrepresented to this Office
in order to obtain the Certification of Compliance.
The file contains a letter from Mr. Carl Farmer, P.E., Century/von Oesen Engineers, and written
notes from a meeting between myself and Mr. Farmer. The letter, dated October 22, 1992 states that
the majority of the property affected by Phase II was filled with 2' of material before WWII began during
construction of the Dow Chemical facility. Any wetlands remaining on the site would be centered around
the outlet ditch west of "N" Avenue and Fourth Street, and would be less than '/a of an acre. The notes,
dated October 26, 1992, state that Mr. Farmer indicated that no wetlands existed on site. Copies of both
documents are attached.
I will be in touch with the Attorney General's Office concerning any possible action on the part
of the State, but since the Certification was issued to the Town of Kure Beach, any enforcement will be
directed to the Certification holder, not the original developer. Any problems between the Town and the
developer must be worked out privately. If it is determined that the amount of wetlands on this project
was misrepresented, the Town may want to consider suing the developer for fraud, have the maintenance
agreement voided, and refuse to issue building permits for the project until the situation is revisited by
the Town Council.

The Wilmington Regional received a revised Stormwater submittal for Kure Dunes Phase II on
November 19, 1993. Based on our review of the revised project plans and information, we have
determined that the revision complies with the Stormwater regulations set forth in Title 15A NCAC
2H.1003. This Certification is a revision of the one issued on December 2, 1992. All conditions and
terms of that previously issued Certification remain in effect except as herein provided:
1. The swale location along the rear property lines of Lots 32 and 33 has been shifted closer
to Sandman Drive. The lot owners will sod the swale upon completion of their homes.

Dear Mr. Shiver:
For the record I would like for your department to know that I
did not authorize or enter any agreement with the owner of Lot 33,
Kure Dunes to modify or change the approved storm water drainage
system. The first knowledge that I had of any problem was when the
Kure Beach Building Inspector, Mr. Bill Hanna called and asked me to
meet him on Lot 33, because one of the neighbors had complained of
water running down Spotters Court. When I arrived, we discovered
that the Berm had been flattened and the water was running down
Spotters Court.
Mr. Hanna asked me to contact the owner of Lot 33, which I did
and the owner (Mr. Larry Greene) informed me that the rain had
stopped his landscaper from working and he was going to reconstruct
the berm and put down sod, makeing sure that no water ran off of his
property. I relayed this information to Mr. Hanna. Friday of last
week, Mr. Greene called and left a message for me to look at the
berm over the weekend and let him know if everything was ok. Monday
morning (11-28-94) I called Mr. Hanna for him to inspect it but was
told he was on vacation. Today I received your notice.
Mr. Greene is a very nice gentlemen and I
violation notice, and after receiving my fax,
say he would be down to Kure Beach on Friday
this matter. Even though the drainage system
am willing to help Mr. Greene re-establish the
