All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter (permit) references DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office issued the subject project a permit on February 22, 2013 and recently discovered it contained an error. This permit correction is to specify that this project is a subdivision consisting of four lots and requires deed restrictions to be recorded. We understand that these restrictions have already been recorded (BK5845/PG2169- 2186), and so this is a formality. Please replace the previously issued permit with the enclosed corrected permit. This project is subject to the conditions and limitations as specified in the corrected permit. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, certification of the project, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until February 22, 2021, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This entire project is within 575ft of a saltwater outstanding resource water (ORW). Per 15A NCAC 2H .1007(2), the ORW Area of Environmental Concern (AEC) is delineated on the plans. The area inside the ORW AEC must maintain a 25% maximum impervious area. 2. This project is within a half mile of and draining to shellfish (SA) waters. Per SL2008-211, Section 2(b), (1)(c), stormwater discharges are prohibited. This project complies with this requirement by infiltrating the design storm. 3. Both infiltration trenches have been designed to infiltrate the 10yr24hr storm at half the infiltration rate reported in the soils report. Therefore the of line bypass and the vegetated filter strip are not required for either infiltration trench. 4. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 5. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 of this permit. The stormwater control has been designed to handle the runoff from 11,525 square feet of impervious area in drainage area 1 and 10,775 square feet of impervious area in drainage area 2. 6. The tract will be limited to the amount of built -upon area indicated in Section 1.10 of this permit, and as shown on the approved plans. The built -upon area for the future development is limited to 840 square feet in each drainage area. Page 2 of 8 State Stormwater Management Systems Permit No. SW8 130103 7. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 8. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. 9. The project shall provide a 50' wide vegetated buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of streams and rivers, and the mean high water line of tidal waters. 10. Classification of Water Body: SA; ORW *Pool decks must be constructed of wooden slatted decking such that no impervious area is created as shown on the permitted plans unless a permit modification or plan revision is approved prior to installation. "The stone base below each trench is required for structural integrily, and is not a part of the infiltration mechanism. Therefore, the trenches are 2ft above the seasonal high water table, but the stone base is within 2ft. The "bottom elevation" refers to the bottom of the trenches. *** Both trenches can infiltrate the 10yr24hr storm event at half the reported rate without discharge. Therefore no vegetated filter strip or bypass is required. Page 3 of 8 State Stormwater Management Systems Permit No. SW8 130103 11. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.10 of this permit. The subdivision is permitted for (4) four lots, each allowed a maximum amount of built -upon area as listed in Section 11.13 of this permit. II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2 During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, infiltration media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 5. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 7. Records of maintenance performance activities must be kept for each permitted BMP. The reports will indicate the date, activity, name of person performing the work and what actions were taken. 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. - b. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any areas noted as future development on the approved plans, prior to construction. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. Prior to the sale of any lot, the following deed restrictions must be recorded: g. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 130103 as issued by the Division under NCAC 2H.1000. h. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. i. These covenants are to run with the land and be binding on all persons and parties claiming under them. j. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. k. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. I. The maximum built upon area per lot is as specified below. This allotted amount includes any built - upon area constructed within the lot property boundaries, and that portion of the right of way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. Lot 1: 5,325 ft2 Lot 2: 4,350 ft2 Lot 3: 4,460 ft2 Lot 4: 4,050 ft2 m. All affected lots shall provide a 50-foot-wide buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers, and the mean high water line of tidal waters. n. Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations. o. All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. p. Built -upon area in excess of the permitted amount will require a permit modification. q. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. 14. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. III. GENERAL CONDITIONS Approved plans, application, supplement forms, Operation and Maintenance agreements, design calculations and specifications for this project are incorporated by reference and are enforceable parts of the permit. 2. This permit is not transferable to any person or entity except after notice to and approval by the Director. At least 30 days prior to a change of ownership, or a name change of the permittee or project, or a mailing address change, the permittee must submit a completed and signed Name/Ownership Change form to the Division of Energy, Mineral and Land Resources, accompanied by the appropriate documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. Page 5 of 8 State Stormwater Management Systems Permit No. SW8130103 3. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project area in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer request. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Energy, Mineral and Land Resources, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 7. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 8. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 9. Unless specified elsewhere, permanent seeding requirements for the stormwater controls must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2008-211, Title 15A NCAC 21-1.1000, and NCGS 143-215.1 et. al. 11. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. The bypass structure weir elevation is per the approved plan. 6. The bypass structure is located per the approved plans. 7. A Trash Rack is provided on the bypass structure. 8. All slopes are grassed with permanent vegetation. 9. Vegetated slopes are no steeper than 3:1. 10. The inlets are located per the approved plans and do not cause short-circuiting of the system. 11. The permitted amounts of surface area and/or volume have been provided. 12. All required design depths are provided. 13. All required parts of the system are provided. _14. Basically the stormwater permit allows the following: Total BUA = 22300 This permit includes 2 Drainage AREAS Drainage Areas : Total BUA = 11525 sq ft Drainage Area 2: Total BUA = 10775 sf ft The road BUA for the subdivision is separate from the Lot BUA allowance Lot 3 (located in Drainage area 2) is allocated, per the recorded deed, 4460 sq ft. THIS does NOT include the road for the development only the BUA on the lot. Because this is in a CAMA AEC, CAMA requires the dripline to be counted in the BUA allocation. That means that stormwater follows CAMA's requirement for BUA allocation. The only way to go beyond the 4460 sq ft allocation is to make a request to the permittee to mod the stormwater permit to allow permeable pavement. Let me know if you have any other questions. Got a phone call late yesterday evening from Kevin ref to Lots 3 and 4 and how the driveway cuts across lot with a driveway easement and how they were allowed a total of 22300 sq ft for all 4 lots per state storm water permit. Kevin also went over that the deed restriction shows 5323 sq ft for lot 1, 4250 sq ft lot 2, 4460 lot 3 and 4050 sq ft lot 4. 1 discussed that the "CAMA AEC was 575 ft" and that the amount of allowable impervious surface shall not exceed the 25 % of lot area within 575 ft of NHW. As you can see, the buildings, streets, parking, sidewalks, "other", and "future" impervious area drain to the infiltration trenches. I have also drafted a permit correction so that the permit is written as a subdivision and the impervious area per lot will now be in the permit text. The attached summary shows the specific breakdown of impervious data that is allowed per trench and per lot. It looks like for two of the lots (Lot 1 and Lot 2) the permittee recorded restrictions slightly below the amount that is allowed by the permit (2sf and 100sf, respectively.) A breakdown of that is provided as well. If you have a copy of the deed restrictions that we discussed this morning, I will leave those on file. PROJECT DESCRIPTION: The project site is located at 4616 Serenity Point, adjacent to the Channel Haven Subdivision and Masonboro Sound, in New Hanover County. To locate the property of interest from the Wilmington Regional Office (WiRO), travel southwest on Cardinal Drive Extension until you reach Eastwood Road. Turn left at Eastwood Road and travel east approximately 2.0 miles until you reach Military Cut -Off Road. Turn right on Military Cut -Off Road and continue onto Oleander Drive for approximately 3.3 miles until you reach Pine Grove Drive. Turn left onto Pine Grove Drive and travel south for approximately 2.0 miles until you reach Masonboro Loop Road. Turn right onto Masonboro Loop Road and travel south approximately 2.5 miles until you reach the Channel Haven Subdivision, which will be located on the left. Turn left onto Channel Haven Drive South and then turn left onto Channel Haven Drive North. Turn left onto Aqua Drive which turns onto Channel Haven Drive North. Continue heading east until you reach Serenity Point, which will be a gravel road located on the left. Continue down Serenity Point until it terminates to the property of interest. The property is adjacent to residential properties to the north and south. The site is also just north of the Channel Haven Subdivision community boat ramp located on the northwest side of the peninsula. The community boat ramp provides water access to the inland property owners of the adjacent Channel Haven Subdivision. The approximately 2.08 acre property has an average elevation of approximately 10' above normal high water (NHW) with approximately 480' of shoreline, which is currently stabilized by a timber bulkhead, which was authorized to the previous property owner under CAMA General Permit No. 6837-D on May 20, 1990. The existing timber bulkhead currently ties into an existing bulkhead located on the adjacent property to the south. The applicant currently remains as a vacant lot; however there was a previous single-family residence on this property, which has been demolished. Upland vegetation consists primarily of wild grasses and Live Oak trees. Located on the northern end of the property the vegetation transitions which exhibits §404 type wetlands, consisting primarily of Common Reed (Phragmites australis), Grounsel-bush (Baccharus halimifolia), Marsh -elder (Iva frutescens), Wax Myrtle (Myrica cerifera) and Yaupon (Ilex vomitoria) shrubs. A narrow border of Sea Oxeye (Borrichia frutescens) and high coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), and Salt Meadow Grass (Spartina patens) transitions to an area of Smooth Cordgrass (Spartina alterniora) approximately 25' in width to the open water area of Masonboro Sound. Existing NEW was delineated by New Hanover County Inspections Department and existing §404 wetlands were delineated and verified by the U.S. Army Corps of Engineers (USACE) (See Jurisdictional Determination (JD), C1 Sheet 1 of 3 and Project Narrative). The Wilmington/New Hanover County Land Use Plan 2006 update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of Masonboro Sound are Classified as Outstanding Resource Water (SA-ORW) by the NC Division of Water Resources and are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The area of Masonboro Sound is OPEN to the harvesting of shellfish. PROPOSED PROJECT: The applicant proposes a four (4) lot subdivision and an associated community docking facility in Masonboro Sound. The application states the approximately 2.08 acre tract would be subdivided into four (4), approximately 0.52 units per acre lots, averaging approximately 15, 000 sq. ft. The lots would be accessed via a 20' access easement and would include a 30' concrete driveways and stormwater infiltration system. The applicant proposes to provide a 6' wide pedestrian elevated walkway to the community dock within a 10' wide access easement along the most southern side of Lot 4 for the proposed four -lot subdivision. The entire site is located within the 575' ORW Area of Environmental Concern (AEC). No dwellings are proposed at this time, only proposed footprint. The property owners would be required to obtain individual permits from the local level. The applicant has received a State Stormwater Permit from the N.C. Division of Water Resources on February 22, 2013 (SW8130103) and a Sedimentation and Erosion Control Plan from the New Hanover County Engineering Department (GP 34-12) (See Sheet Cl Sheet 1 of 3 dated July 10, 2013). The pier would terminate to a new partially covered platform, measuring approximately 36' in length by 12' in width, which would be located entirely over open water and oriented towards the north creating an "L-shaped" configuration. A fixed platform would continue a distance approximately 72' in length by 6' in width towards the north. Waterward of the proposed platforms would be four (4) access ramps, which would lead onto four (4) new floating docks, each measuring approximately 16' in length by 6' in width, running perpendicular to the channel and shoreline. These floating docks would be spaced -approximately 30' apart to allow for the construction of eight (8) boatlifts, each measuring approximately 13' in length by 14' in width to be located within this configuration. The application states that the proposed configuration would accommodate up to eight (8) vessels, specifically for the four lot owners of the Serenity Point Subdivision. Based on the provided hydrographic survey that was conducted in this area of Masonboro Sound, the application states that the proposed docking structures would be located in water depths of approximately -2.4' relative to mean low water (MLW); further, based on this survey the proposed docking facility would extend to the established pier length south ofthe project site, which includes two (2) private docking facilities and the Channel Haven Subdivision peninsula, aforementioned (See Sheets 1 and 2 of 2 For Proposed Pier dated July 12, 2013 and Project Narrative). 10. ANTICIPATED IMPACTS The proposed upland development would disturb approximately 65,340 sq. ft. (1.5 acres) of highground within the Estuarine Shoreline area. According to the site drawings, the four lots, portions of the 20' access easement, 30' concrete driveways and stormwater infiltration system are entirely located within the 575' AEC. It is assumed that these four lots would be developed, however there should be no long term impacts associated with the development of these lots. The applicant has indicated that approximately 25.0 % of the SA-ORW shoreline would be covered by built upon area. The proposed structures would incorporate approximately 4,384 sq. ft. of Public Trust Area and Estuarine Waters. The structures would not encroach into the 15' riparian corridor setback requirement of the adjacent riparian properties. Based on the provided survey and drawings, the proposed structures would not encroach into the 80' setback from the AIWW federal channel. The proposed structures would extend approximately 315' into a waterbody, which measures approximately 970' across. This distance appears to not conform to the 1/4 width rule; however, it appears to extend to the 1/3 distance and the established pier length, aforementioned. The proposed structures would accommodate up to eight (8) vessels at this location within current water depths of approximately -2.4' relative to ML W.
