Purdy, owners of Unit 206 and 1/8 owners of the common area 3640 Dalrymple Road Chesapeake Beach, INC 20732 Ms. Marianne Coy, owner of Unit 208 and 1/8 owner of the common area 208 Waterway Lane Surf City, INC 284445 Subject: Stormwater Permit Exclusion — Redevelopment Lattier Landing Phase 1 Project Number SW8 121104 Pander County Dear Mr. Craig et al., Mr. and Mrs. Barth, Mr. and Mrs. Purdy., and Ms. Coy: On September 23, 2013, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources received a request to exclude the subject proposed redevelopment project from Stormwater Management Permit requirements with a complete package, including requested additional information, received on October 29, 2013. Staff review of the plans and supporting documentation has determined that the project proposes activities that are excluded from State Stormwater permitting requirements as set forth in Section 2.(d)(3) of Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC 2H.1000, as amended. Therefore, the director of the Division of Energy, Mineral and Land Resources is hereby providing confirmation that the subject project is excluded from State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as shown on the plans submitted to this Office; 2) The proposed built -upon area of 11,593 square feet does not and will not exceed the existing built - upon area of 11,607 square feet; and, 3) The proposed stormwater control, vegetated sheet flow, provides equal protection of surface waters as the existing stormwater control, which is vegetated sheet flow. If permeable pavement is proposed to keep the post -developed BUA amount equal to the existing BUA amount, then this exclusion is also conditioned on that amount of permeable pavement being installed and maintained per the approved plans, supplement and O&M agreement. This confirmation to exclude this project from the State Stormwater rules is not transferable to any person or entity except after notice to and approval by the Director. If a change in ownership is desired, then the effected parties shall submit a name/ownership change form, accompanied by the supporting documentation as listed on the form to the Davison at least 60 days prior to an ownership change including the sale or conveyance of the project area in whole or in part; the sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; bankruptcy; foreclosure; dissolution of the partnership or corporate entity; a name change of the current permittee; a name change of the project; or a mailing address change of the permittee. Therefore, any future development or changes to the proposed development, including, but not limited to, the relocation of built -upon area and the construction of additional built -upon area, may require approval or a Stormwater Management permit application and permit issuance from the Division of Energy, Mineral and Land Resources prior to any construction. Construction of the project prior to receipt of the required approval or permit or failure to maintain compliance with the exclusion conditions, are violations of Title 15A NCAC 2H.1000 and Session Law 2008-211, and may result in the initiation of appropriate enforcement action.
