This law impacts any development approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. As a result, 120 USMC Camp Lejeune permits are impacted. Of the 120 permits, 45 permits have previously been issued extensions and 75 permits have been extended effective today. This is summarized in Attachment A. The state has given us permission to plant shrubs along the pond slopes to reduce line of sight for the geese. In order for us to do this we had to submit 0&M addendums, which I dropped off to you this afternoon. The state has already approved the 0&Ms and has requested that Carl sign the documents for their files. There are a couple of reasons that planting vegetation at the water's edge help to make ponds less appealing to geese. The biggest factor is line of sight. This is their primary protection against predators. Also, geese prefer to walk from water to an easy, adjacent feeding area. By eliminating an easy path, the pond is less attractive because they don't want to walk through high vegetation in fear of predation. We've tried other methods such as chemical repellents and fake alligators but nothing seems to do the trick. Even the real alligators in our ponds don't keep these birds away. I'm not sure if you have ever seen what a bird can do to an aircraft, but it is pretty devastating. Let me know if you need some pictures.
