April 8, 2015 Carsten Jenson. 4536 Technology Drive Wilmington, NC 28405 Subject: Notice of Inspection - Not Compliant Lots 54, 55, 56 & 57R Technology Drive State Stormwater Management Permit No. SW8 020516 New Hanover County Dear Mr. Jenson: Donald van der Vaart Secretary On March 20, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) inspected Lots 54, 55, 56 & 57R Technology Drive, located in the North Chase Industrial Park at 4540 Technology Drive in New Hanover County to determine the status of compliance with the State Stormwater'Management Permit Number SW8 020516 issued on October 5, 2006. DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. The required Designer's Certification for the wet pond system constructed for Lot 57R has not been submitted. The Division sent you a letter on April 11, 2014, which requested that you submit the required certification. However, no response to that letter has been received to date. The runoff from the remainder of the site is treated in the offsite wet detention pond permitted under SW8 961004 under the purview of the Technology Court Owner's Association. 2. The permit must be modified to account for the retaining wall which has been added in the pond. 3. The orifice may be clogged. The water level in the pond was close to going over the weir, but no flow was observed from the orifice. 4. The relative elevation difference between the temporary pool elevation and the permanent pool elevation did not appear to be 1.3 feet, as permitted. 5. The premises appeared vacant. If you have transferred ownership of this property to a new owner, please download, complete and submit the below -referenced Name/Ownership Change form from our website. Please inform this Office in writing before May 8, 2015, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by May 8, 2015, then DEMLR staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Please be advised that you are required to comply with the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including operation and maintenance of the permitted stormwater system. Violations of your Stormwater Management Permit may be subject to the assessment of civil penalties of up to $25,000 per day per violation. A retaining wall has been added to the pond slopes which are closest to the building and along the short side of the pond closest to Technology Drive. This retaining wall is not shown on the approved plan or pond details. 3. The orifice may be clogged. The orifice was not running and the water level in the pond was close to the overflow weir 4. The permanent pool and temporary pool elevations need to be verified, as well as the pond depth and surface area. The inspector observed that the required difference between the permanent pool and the temporary pool elevations may not be 1.3 feet, as required. 5. Ownership of the property needs to be verified. A retaining wall has been added to the side of the Lot 57R wet pond nearest the building which curls around the short side of the pond adiacent Technology Drive. This retaining wall is not shown on the approved pond details. 3. The offsite facility permitted under SW8 961004, which serves Lots 54 55 and 56 was not inspected. The Lot 57R wet pond slooes oarallelina and closest to Enterorise Drive are nicely maintained 5. The orifice was not running and appeared to be clogged. The water level in the Lot 57R pond appeared close to the overflow elevation. 6. The permitted distance between the orifice invert and the overflow elevation is 1.3 feet or just shy of 16". It was not clear to the inspector that this distance has been provided. The consultant should verity this as part of the designer certification. The premises appear to be vacant County tax records from 2014 suggest that Mr. Jensen is still the owner of record. page: 3
