Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. This permit shall be effective from the date of issuance until October 25, 2021, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The total project site contains 5.62 acres. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The wet detention pond has been designed to handle the runoff from 73,363 square feet of impervious area. 3. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The built -upon areas associated with this project shall be located at least 50 feet landward of all perennial and intermittent surface waters. 6. The following design criteria have been provided for Drainage area # 1. The wet detention pond must be maintained at design condition: a. Drainage Area,ft2 115,211 b. Post development 1 year 24 hour: 1.07 cfs I. Controlling Orifice: 1.25 "0 m. Permitted Forebay Volume, ft3: 3,999 n. Receiving Stream/River Basin: Charles Creek/ Pasquotank o. Stream Index Number: 30-3-(11) P. Classification of Water Body: "C-Swp" In addition to the above, there is 31,967 sf of built -upon area in drainage area # 2 located along the eastern side of the property that does not flow into the wet detention pond. This results in a total of 105,330 sf of built -upon area allowed. II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and re -vegetation of slopes and the vegetated filter strip. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, level spreader, filter strip, catch basins and piping. g. Access to the outlet structure must be available at all times. Records of maintenance activities must be kept for each permitted BMP. The records will indicate the date, activity, name of person performing the work and what actions were taken. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form, to the Division of Energy, Mineral, and Land Resources, signed by both parties, and accompanied by supporting documentation as listed on page 2 of the form. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Energy, Mineral, and Land Resources, in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DEQ Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 11. The permittee shall notify the Division of any name, ownership or mailing address changes at least 30 days prior to making such changes. 12. This.permit shall be effective from the date of issuance until October 25, 2021. We designed the pond to accept runoff from a 2.64 acre drainage area with a total coverage of 73,363 sf. Included in that coverage total was 14,080 sf of future coverage. The enclosed plans show a parking lot expansion that will add 13,486 sf to the site. Runoff from this coverage is directed to the existing detention pond. Specifically, the permit states "the stormwater control has been designed to handle the runoff from 73,363 square feet of impervious area." in 1.2. and in 1.6. states a total impervious area of 73,363 square feet; however, the permit application item III.10 states 72,712 sq.ft for Drainage Area 1 and 34,371 sq. ft. for Drainage Area 2. The permit application total impervious area is 107,114 sq.ft. Elizabeth City currently has a site plan application to allow an additional parking lot at the site, which will bring the total impervious coverage to 104,607 sq.ft. As the state permit states 73,363 sq.ft and the proposed plan states 104,607 sq.ft. we have a conflict. Will you please check your files and confirm the issued permit is incorrect in the 73,363 sq.ft limitation? If so, then an administrative permit modification seems appropriate. 1 will call soon to discuss. Stormwater Controls: Permit Number SW7961115 dated 10/25/2013 was provided as a supplement to the submittal package. This permit states the stormwater control is designed to handle the runoff from 73,633 square feet of impervious area. These plans indicate 104,067 square feet of impervious area. It also appears the existing site may be in non-conformance with the existing permit due to the prior addition of impervious area without permit modification. Please explain the discrepancy. The permit was for the additional impervious coverage beyond what existed at the time of the 2013 plans and specifically for the Drainage Area indicated on the plans (See Sheet C300). The existing impervious areas outside of that drainage area are excluded from the permit modification. 2. SW Permit Number SW 7961115 Condition 11.9, requires that the permittee shall submit to the Director of DEMLR and have received approval prior to construction for any modification of the approved plans, including "addition to the approved amount of built -upon area". Provide documentation from DEMLR that approval has been granted for this Parking Lot Expansion Phase 2. See response in note #1 above. The proposed impervious improvements are included in the aforementioned permit. 3. Provide stamped and sealed plans. As has been an accepted policy with City submittals in the past, we will provide signed & sealed plans upon receipt and confirmation that all comments from City Staff have been addressed. 4. It appears that wastewater from the carwash pad is running off the pad and onto the ground and potentially into stormwater. Please provide a plan amendment to ensure all carwash water is discharged to the sanitary sewer system. Please refer to the previously approved plans (SP 05-13). These plans show the grading of that area in addition to the improvements installed at that time. The stormwater runoff is directed to the basin in the center of the pad and directed to the wastewater system. 5. The outfall from the stormwater detention pond could not be inspected due to brush. Please have brush cut so that outfall and discharge pipe may be inspected as part of the stormwater operation and maintenance plan. Given the City StaWs recent policy on another proposed ditch cleaning just upstream of this site, will it be allowed by all City Staff? If there is a concurrence from Public Works and Planning on this item, we can include the recommendation as a part of this plan. 6. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans; including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form, to the Division of Energy, Mineral, and Land Resources, signed by both parties, and accompanied by supporting documentation as listed on page 2 of the form. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Energy, Mineral, and Land Resources, in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. The following criteria are approved as meeting 'the stormwater rules for this project: a. The total area for this project is 5.6 acres. b. Total impervious area for this project site is 0.74 acres. C. Total -number of lots is one. d. Allowable built -upon area must be consistent with plans and application submitted by permittee. 2. The overall tract built -upon area percentage or lot sizes for the project must be maintained at levels at least as stringent as the low density levels specified in the stormwater rules. 3. The development must demonstrate that no areas within the project site are of such high density that stormwater runoff threatens water quality. 4.. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 5. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) or curb outlet systems as defined in the stormwater rules and approved by the Division. 6. No piping shall be allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road b. That minimum amount needed under driveways to provide access to lots. 7. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 8. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 9. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of Register of Deeds. A copy of the recorded restrictions must be received by this Office within 30 days of the date of recording. Recorded deed restrictions must include, as a minimum, the following statements related to stormwater management: a. A statement of the allowable built -upon area per lot in the following form: "The allowable built -upon area shall not exceed 0.74 acres, inclusive of that portion of the right- of-way between the front lot line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, not including wood decking." 4 b. Items related to stormwater management must remain in the deed restriction, and this is to be indicated by including the following: "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. To assure that vegetated conveyances are not piped (in accordance with item 5) deed restrictions must indicate that: "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons." 10. The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. 11. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size b. Project name change C. Transfer of ownership d. Redesign or addition to the approved amount of built -upon area e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee shall comply with the following schedule for construction and maintenance of the Low Density Option stormwater systems: Q a. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 2. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et.al. 6 5. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for those revisions under any of the following conditions: a. Any additions, deletions or redesign of the previously permitted amount of built -upon area proposed regardless of the size of the modification. b. Further subdivision of the project area. 6. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary.
