Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2006-246. We are forwarding Permit No. SW3140901, dated September 30, 2014. This permit shall be effective from the date of issuance, shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 15013 of the North Carolina General Statutes. Per NCGS 143-215(e) the petition must be filed with the OAH within thirty (30) days of receipt of this permit. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. The overall tract built -upon area percentage for the project must be maintained below 24%, as required by Session Law 2006-246 of the stormwater rules. 3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 5. No piping is allowed except that minimum amount necessary to direct runoff beneath an impervious surface such as a road or to provide access. 6. All roof drains must terminate at least 30 foot from the mean high water mark. 7. The built -upon areas associated with this project shall be located at least 30 feet landward of all perennial and intermittent streams. 8. All swales that discharge into a wetland shall do so at a non -erosive velocity for the 10 year storm. Page 1 of 4 State Stormwater Permit Permit No.SW3140901 II. SCHEDULE OF COMPLIANCE The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 2. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 3. This project may not be sold or subdivided in whole or in part without first receiving a permit modification. 4. The following deed restrictions must be recorded with the Office of the Register of Deeds: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW3140901. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the State. f. This project may not be sold or subdivided, in whole or in part, without first receiving a permit modification from the Division. h. Construction of additional impervious areas such that low -density requirements are no longer met will require a permit modification prior to construction. An engineered system will be required to collect and treat the runoff from all built -upon area associated with the project, including that area permitted under the low density option. i. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this development, except for average driveway crossings, is strictly prohibited by any persons. j. The built -upon areas shall be located a minimum of 30 feet landward of all perennial and intermittent surface waters. 5. A copy of the recorded restrictions must be received in this Office within 30 days of the date of project completion. 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision, acquisition, or sale of the project area in whole or in part. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, altering or piping any vegetative conveyance shown on the Page 2 of 4 State Stormwater Permit Permit No.SW3140901 approved plan. 8. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 9. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. c. Mowing, and re -vegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 10. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. 11. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to, and approval by the Director. The Director may require modification or revocation and re -issuance of the permit to change the name and incorporate such other requirements as may be necessary. In the event of a name or ownership change, a completed Name/Ownership Change form, signed by both parties, must be submitted to the State accompanied by the supporting documentation as listed on page 2 of the form. The approval of this request will be considered on its merits, and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until the Director approves a transfer of ownership. Neither the sale of the project nor the transfer of common areas to a third party, such as a homeowner's association, constitutes an approved transfer of the stormwater permit. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Session Law 2006- 246, Title 15A of the North Carolina Administrative Code, Subchapter 21-1.1000; and North Carolina General Statute 143-215.1 et. al. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by the State, such as the construction of additional or replacement stormwater management systems. The permittee grants permission to DENR Staff to enter the property during normal business hours, for the purpose of inspecting all components of the stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The filing of a request for a permit modification, revocation and re -issuance, or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state and federal), which have jurisdiction. 11. REQUIRED ITEMS CHECKLIST' The following checklist outlines design requirements per the North Carolina Administrative Code Section 15A NCAC 2H .1000, NCDENR BMP Manual (2007), Session Law 2006-246, and Session Law 2008-211. Please indicate the page or plan sheet numbers where the supporting documentation can be found. An incomplete submittal package will result in a request for additional information. This will delay final review and approval of the project. Form SW401-Low Density-Rev.3-2/10/09 Page 3 of 4 V. SWALE SYSTEM MAINTENANCE REQUIREMENTS 1. Mowing will be accomplished as needed according to the season to maintain a healthy vegetative cover. Grass heights will not be mowed too close to the ground or "scalped". Vegetation will be maintained at a height of approximately six inches. 2. Swales will be frequently inspected for the first few months after construction or until the site is stabilized to ensure vegetative cover is establishing well. After the site is stabilized, swales will be inspected at least quarterly for sediment build-up, erosion, and trash accumulation. 3. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded following sediment removal. 4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a timely manner based on the periodic inspections. Side slopes must be maintained at the permitted slope. 5. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected at least quarterly. Trash and debris will be cleared away from grates, curb cuts, velocity reduction devices and piping. 6. Swales will not be altered, piped, or filled in without approval from NCDENR Division of Energy, Mineral and Land Resources. Pleasant Substation in Cabarrus County. Per the County's Conditional Use Permit Approval and Zoning Compliance review, the following revisions have been made to the site development plans... 1. Relocate the temporary silt fence (in the southeast corner of the lot parcel) outside the 75' side yard setback and, 2. Increase the water body buffer zone (in the south central portion of the lot) to include the previous farm pond area (which has now been drained). The referenced temporary silt fence (southeast corner of lot parcel) was to provide sediment control for potential excess spoil, and was not really site specific. It has simply been moved northward outside the 75' side yard buffer. The inclusion of the former pond area (approx. 0.072, 3,150 sq. ft.) in the water body buffer zone was required since the US Corps of Engineers and/or NC DENR did not formally review the site after the pond was drained. Both USACE and DENR reviewed the site initially, and indicated the pond was non -jurisdictional and could be drained. The increase in the buffer zone had no effect on the proposed/submitted plans. Per the CUP/Zoning Review, the above listed modifications have been made to the Mt. Pleasant Site Plan and Grading Plan. Project plans were not formally re -submitted to your office because we felt the changes were minor and had no effect on proposed stormwater control plans for the project. However, because the plans have been modified since initial approval by NC DENR, Cabarrus County needs verification of project approval from your office. If you would, please review the attached plans and proposed changes, and indicate a final approval for the project. The initial plans (as submitted to your office) were dated 09/23/14. The revised plans are dated 10/21/14. Changes are "clouded" in red. Since the changes are minor, we would very much appreciate email verification of project approval in the essence of time, as the project has been in review with Cabarrus County for the past several weeks. Also, to help insure you have the most current copy of all plans and drawings, we will send you two complete sets (hard copy) of the plans and drawings ... as there have been minor note revisions in some supporting drawings. All areas of gravel on compacted subgrade should be included in this calculation. Please revise the documentation to include all impervious areas, and verify this will meet the Low Density requirements based on the corrected areas. 2. Access easements to a public right of way are required for all stormwater BMPs. Easements must be of sufficient width to access and maintain the BMP. Please show the easements on the Site Plan with sufficient dimensions to provide an accurate description. 3. FED 10 2015 Storm Water Management Narrative for the Mt Pleasant Substation AND NATURAL RESOURCES Union Power Cooperative plans to construct a 100,000 volt (100 kV) substation to increase electrical capacity and reliability in the eastern portion of Cabarrus County. Union Power is committed to protecting the health, safety, and welfare of the area, which includes the environment and water resources. Storm water runoff will be controlled per the regulations of the Cabarrus County Phase II — Post Construction Storm Water Management program. The 12.52-acre parcel of land is typical of rural piedmont areas and is characterized by silt loam soils on 2-8 and 8-15 percent slopes, land cover consisting of oak -hickory with scattered pine forests, and low -density rural development. Two drainage areas run through the site and converge into a perennial stream on the southern boundary of the site that is a tributary to Dutch Buffalo Creek which runs approximately 0.76 miles east of the site. The unnamed tributary is not located on current USGS quadrangle maps, but was delineated by biological consultants Environmental Resources of the Carolinas, Inc. and verified by the US Corps of Engineers during due diligence studies. In addition, Cabarrus County requires surface waters buffers, which have been applied. Site development will include a limited amount of "Built -upon", or impervious area. The substation pad will covered in uniformly -graded, washed stone. The access drive will be covered in 8" of compacted crusher-run/"ABC" gravel, while an approximate 60' x 24' asphalt surface will cover the access drive entrance from Mt Pleasant Rd S. In total, "Built -upon" areas will be limited to 1.41 acres, or 11.3% of the total property. Therefore, the Mt Pleasant Substation qualifies as a low -density project under the post -construction storm water management model. Stormwater from Mt Pleasant Road will be conveyed under the site entrance via Culvert #5, a 15" reinforced concrete pipe (RCP). The existing ditch along Mt Pleasant Road will be excavated to only the extent necessary to allow for positive drainage. The majority of storm water runoff entering the site will drain from the north and will be conveyed through Culvert # 1, a 36" RCP that allows water to naturally drain under the access road and through the property. Temporarily, the water conveyed through Culvert #1 will be intercepted by a temporary skimmer sediment basin. This basin will be removed once the site is completely stabilized and the area will be graded into a permanent vegetated swa le. Storm water from the washed gravel substation pad will be diverted into one of four storm water conveyance systems. The substation pad will generally shed water in all directions from its highest point in the center. 1. Oil Containment System: Water that falls in the center of the substation pad will be collected by the underground oil containment system, which is designed to hold water volumes from a 25-year storm and oil volumes from the largest single vessel. Water from this system will outfall on the southern end of the substation pad and onto a dissipater pad, then given the opportunity to sheet flow over planted and naturalized vegetation before reaching the stream outlet. 2. Storm water that falls on the southern portion of the substation pad will be allowed to sheet flow over to existing grade and through planted and naturalized vegetation before reaching the stream outlet. 3. Swale # 1 will collect the majority of water from the substation pad and cut slope. Gently set at a 2% slope, Swale # 1 will be matted, seeded, and will convey water to Culvert # 1. Once site stabilization is complete and the temporary skimmer sediment basin is removed, water will be allowed to drain over Swale #2 before reaching the stream outlet. Storm water uphill from the cut slope will be permanently conveyed to Culvert # 1 using a cut slope diversion swale. 4. Catch Basin # 1 will collect storm water from eastern portion of the substation pad and release it onto a dissipater pad. Again, this water will be allowed to drain over Swale #2 before reaching the stream. BMP Swale #'s 1&2 will be permanently deeded as drainage easements. In addition, a 20' access easement will provide necessary access from public rights -of -way to the drainage swales to permit routine maintenance and inspection. Sediment and Erosion Control As previously mentioned, the Mt Pleasant Substation project will disturb approximately 5.91 acres of land, therefore an erosion and sedimentation control plan must be submitted to the regional NCDENR office at least 30 days before any land disturbance begins. Appropriate sediment and erosion control measures have been planned to minimize and control the transportation of sediment. During construction, minimizing the dislocation of sediment is the first priority. All disturbed slopes 2:1 or greater, 10 feet or more feet of vertical change, or drainage swales are planned to be covered in erosion control matting. Disturbed slopes will be seeded within 21 days following completion of any phase of grading. If sedimentation does occur, Union Power's next priority is to control the translocation of sediment and prevent offsite disturbance. Union Power will implement 5 techniques to control sedimentation, including: 1. Permanent Diversion Swale: A permanent diversion swale (detail 3) will be utilized uphill of the substation cut slope, which will serve to redirect storm water away from the substation pad and through culvert # 1 and into the temporary skimmer sediment basin. 2. Temporary Diversion Swale: A temporary diversion swale (TD) will be utilized on the southern end of the substation pad to redirect storm water into the temporary skimmer sediment basin. The TO will be maintained daily with clearing operations and remain in place during fill operations. In addition, the TO will be appropriately raised and lengthened (daily if necessary) as the grade of substation pad is built up. 3. Temporary Slope Drains: Two temporary slope drains (TSD) will collect and transport water into the temporary skimmer sediment basin from the substation pad. One TSD will collect water from the temporary diversion swale while the second will collect water from the center of the substation pad. 4. Temporary Skimmer Sediment Basin: The temporary skimmer sediment basin (sediment basin) will serve as the primary sedimentation collection facility on site. Located in a natural drainage channel, the sediment basin has been sized appropriately to account for all on site and off site drainage within the proposed watershed. Following the regulations set by NCDENR, the sediment basin will be periodically inspected and maintained. After all disturbed slopes have been stabilized, the sediment basin will be removed and land will be graded into a vegetated swale. At this time, disturbed soils will be appropriately matted and seeded to minimize erosion. 5. Silt Fences: Silt fences (in some instances with rock outlets) will be used where sediment - laden water cannot be diverted into the sediment basin. These primarily include fill slopes on the southern end of the substation pad and sediment basin embankment.
