Mr. Riddle and Ms. Kucken: Thank you for your assistance yesterday at the Low & Bonar Inc. facility in Enka, NC (NCS000179). Below are the points we discussed: l . It was proposed during our discussion that no stormwater per se goes into the East Ditch; it is all wastewater (approximately 15,500 gallons per day) that is occasionally co -mingled with stormwater. Therefore, it may be appropriate to remove SDO-2 from stormwater permitting and sampling requirements. 2. Low & Bonar may be eligible for a 'non -exposure' exemption for the entire facility. No Low & Bonar raw materials or products are stored outside, thus none are in an 'uncovered' condition. Very little uncovered material is on the Low & Bonar site, one tenant - Wolseley Industries - has uncovered metal piping that is stored temporarily before being shipped to clients. This material could easily be covered or otherwise protected from precipitation. 3. If the 'non -exposure' classification is not applicable, the sites of SDO-2 (the East Side at Ditch) and SDO-i (West Side at Hominy Creek) should be moved to within the L&B property boundaries. 4. Currently, SDO-2 (East Ditch) sampling point is at the discharge into an un-named tributary to Hominy Creek and outside of the L&B property. We propose that the sampling point be moved about 50 feet upstream in the Flood Gate (see attached Exhibits 1-4). 5. Currently, SDO-i ( West Ditch) sampling point is at the discharge into Hominy Creek on the neighboring Fletcher Partners Property (see attached map). We propose that the sampling point be moved about 1,850 feet upstream to Manhole 17; which is about 120 feet upstream of the property boundary. 6. Samples collected on December 5 from all four locations will be sent to your office as soon as the laboratory report is available. This report will demonstrate how the current and proposed new locations for stormwater sampling are comparable, and will actually be a more accurate picture of L&B's actual stormwater discharges (with less influences from other properties). This sampling report is also the first semi-annual sampling report for 2018. 7. Enka Partners of Asheville, LLC (referred to as Fletcher Partners, Inc) (NOTE: Both are located at ioQ1 Hendersonville Road Asheville, NC 288og and are owned by the same entities) property is influencing Low & Bonar's SDO-1 stormwater discharge. It seems - without any empirical data - that abandoned stormwater piping on the Fletcher Partners property is transferring sediment from the surface or from damaged subterranean piping to the main stormwater discharge piping. We request that Fletcher Partners be issued a Construction Stormwater Permit (NCGol0000) as per NCGS 143-215.1. It is our opinion, based upon the approximately 150 piles of dirt that have been deposited upon the Fletcher Partners property, that construction has begun (see aerial image of the site with individual property owners noted). 8. American Recycling(http://www.amreUclingofvvnc.com/) property is influencing Low & Bonar's SDO-2 stormwater discharge. Recently, American Recycling had a hydraulic oil leak on pavement that discharged through the Flood Gate on the Low & Bonar property and hence to the un-named tributary to Hominy Creek. Low & Bonar staff responded to prevent the oil from reaching Hominy Creek and notified DEQ appropriately. We request that American Recycling be issued a Stormwater Permit with enforceable benchmark limits for discharges to the ditch due north of their property - not to Low & Bonar property. Ms. Kucken - We really appreciate your high quality work standard and professionalism. Despite your impending retirement you arranged for Mr. Riddle to become familiar with the Low & Bonar site AND you conducted a site survey on a very cold and windy day on a snow-covered site. Its been nice working with you, we will miss your input. Mr. Riddle - Thank you for making time to travel five hours to learn about our site and our stormwater issues. We have 12 general permits expiring this year, and our staff (still a little short-handed) has to focus on those until we get some more resources (coming soon). We have a new engineer joining us in early March, and we even hired Bradley as a temp (3 days a week) to help us out with other individual renewals! I could possibly do a site visit in March, but I don't know how soon after I'll be able to draft the permit. It might be a good visit for our new hire to go along on, though, so we'll keep that in mind. Mid -march is probably the better time for me to get out of the office. I've also copied Rick Riddle on the info about Low and Bonar. I'm not sure he's been able to pick that one up, either. Individual renewals have fallen pretty low in priority, especially since the general permit renewals happening along with all the electronic reporting and e-DMR prep. I'll let him give you a status. There may be loose ends that need to be tied up and/or acknowledged in their permit. 1 I have spoken with Darlene briefly about this site and I told her I will get with her when she returns in two weeks. Also, I believe, based on Susan Wilsons inspection, (way back when 2008) the site was noncompliant. It is a very complex site, old old industrial site. I cannot, nor can the new site manager understand the circumstances that lead to this decision. I have to believe that it was a total misunderstanding of what the permit was. It could have been it was associated with the old Waste Water Treatment Plant that served this site many years ago. Low & Bonar is not the same company that existed in 2013. There was a complete regime change that occurred in 2014 starting with a new CEO (London) in August 2014. The changes also affected Asheville's on -site personnel. None of the Bonar personnel that were part of the inspection and request for the Waste Water Permit to be rescinded (Including the President/Site Manager) are still employed by the company. To explain how we have come full circle back to the point of interest, The Waste Water Permit, Low & Bonar has mandated a program entitled "Project Planet" where Business Sustainability and Corporate Responsibility are a must for all its manufacturing facilities globally. Part of this initiative is ISO 14001. As you may know ISO 14001 goes beyond compliance and is the catalyst for continual improvement to processes and procedures to reduce pollution and improve efficiencies. I received funding for the ISO 14001 initiative in December 2016. This enabled me to hire outside consultants to conduct an independent analysis/audit of our environmental compliance obligations to fulfill § 6.1.3 of ISO 14001:2015 requirements. This process was the gateway to a facility -wide environmental evaluation. Ultimately, we have conducted a re-evaluation the basis of need, the monitoring, recordkeeping, and reporting requirements for all of our environmental permits. The Compliance Obligations audit process consumed the first four months of 2017. As we began realizing that we had storm water issues, I reached out to Alison Davidson as she was with NCDEQ DEACS in February. I knew she could place us in contact with the correct personnel to help us resolve our problems. It is unfortunate that I did not realize that storm water was broken into two entities now. In a previous job I just dealt with one person, Michael Parker, out of the Mooresville office. 301'1 0) O' 'q NcJ -aol-1 J- v114$ Upon completion of the Compliance Obligations Audit, we realized we had three areas that needed attention. 1) stormwater (which with the revelation that waste water discharge was different, we added the third category.) 2) POTW sewerage wastewater, and 3) surface wastewater areas. Low and Bonar chose to address those deficiencies in that order. To date, we have completed NC DEQ stormwater inspection by Darlene Kucken, and the Metropolitan Sewerage District (MSD) wastewater permit renewal. We are now reaching out to you to address or readdress our surface wastewater issues with your office. The following points address questions in your email. 1. Water Conduits Low and Bonar conducted four recent studies of wastewater and stormwater sources to determine volumes and pollutant concentrations. Those studies are described below. ISO 14001-- Compliance Obligations This clause required us to look at all our activities including effluent management. During this process, Low & Bonar initial engineering estimates were that 28,848 to 54,781 gallons of wastewater from various processes are discharged to the East Ditch conveyance to Hominy Creek. Table 1 lists those preliminary estimates of effluent sources and volumes. This was our first concrete indication that something was amiss from data in our files. The ISO study revealed that cooling tower blowdowns are co -mingled with stormwater discharges to the East Ditch, see Figure 1. b. ISO 14001— On -site Audit The extension office of Georgia Tech conducted an ISO 14001 preliminary audit of Low & Bonar in May 2017. That audit reinforced the water issues and concerns described by our consultant. c. Metropolitan Sewerage District (MSD) Wastewater Permit Renewal Low & Bonar completed its wastewater discharge permit renewal to MSD in May 2017. This renewal provided a sharper focus on all wastewater effluents by differentiating between wastewater treatment plant effluents and surface water discharges. The MSD permit renewal estimates wastewater to range from 18,850 to 21,370 gallons per day. Table 2 lists those updated effluent sources and volumes. Note, those values are in part engineering judgements; they are not data from flow measuring devices. d. Stormwater Inspection NC DEQstormwater staff conducted an inspection in May 2017. Our evaluations show that Low & Bonar does discharge to Hominy Creek the following: a. Non -Contact Cooling Waters b. Atmospheric Cooling Systems Condensates C. Blowdown Wastewaters d. Exempt Stormwaters e. Similar wastewaters 2. Wastewater Piping Video I do not have any videos of our discharges. 3. Site/Process Map of Wastewater Discharge Sources Figure 1 is a Site Map of Wastewater Discharge Sources. This is a recent upgrade of an older figure of stormwater collection systems. Figure 1 shows individual sources and provides discharge destinations and volumes. Table 3 lists those wastewater sources and volumes ranging from 24,368 to 34,581 gallons per day. Table 3 is not complete; our facility engineering department has provided estimates of most of the wastewater discharges to the East Ditch and then to Hominy Creek. However, these are estimates; they are not the definitive measurements that flow measuring devices would provide. Tables 1, 2, and 3 do provide some continuity; internally, we continue to discuss the actual disposition of some wastewater streams. 4. Stormwater Sampling/Discharge Data Stormwater Discharge Monitoring Reports for 2015 and 2016 are included in Attachment A. These reports show that comingled stormwater and wastewater steams in the East Ditch conveyance to Hominy Creek comply with all stormwater effluents limits and with the Stormwater Permit (NCS000179) effluent limits for Chemical Oxygen Demand (COD) and pH. S. Annual Stormwater Certification Statement Attached with the Monitoring reports is a certification statement table ... Bart Austin was the President and Site Manager during this time. After the full scope regime change, I was uncertain to the validity of what had been presented to me regarding non process discharges. I therefore elected to not certify the discharges after August 6, 2014 until I could have a comprehensive evaluation done of our storm water situation. My first year here, I took at face value what I had been told by Bonar personnel ... the ones who ask you for the recession. Please contact me to request any other data necessary prior to your site inspection. We are ready to accommodate your schedule for this inspection. The ISO 14001 certification process has been very instructive and illuminating for Low & Bonar staff. We have found that'the process does indeed go beyond compliance and is the catalyst for continual improvement to processes and procedures to reduce pollution and improve efficiencies. Low & Bonar intends to comply with all State and Federal discharge limitations. Ultimately, we believe that an individual NPDES wastewater permit is appropriate for our site. I inspected the Enka site in 2013 when Jeremy Nauert was the Environmental Manager. Dan March was acting consultant at that time. The Enka site has come to my attention again, primarily concerning wastewater questions but also stormwater questions. These questions relate to the complexity of this site and the conduits of water; stormwater (SW), wastewater (WW), comingled (SW/WW), waterbodies, etc. At my inspection on September 4, 2013, I was informed by Mr. March and Bonar personnel that it had been determined all conduits of water carrying any type of wastewater flowed to the lift station and were discharged to Metropolitan Sewage District (MSD). The WW permit (NCG500608) rescission request followed and then was granted based on this information. Furthermore, an ongoing annual Certification as required by your Stormwater Permit (permit #NCS000179, Part II, Section A 1. e.) remains in effect. Please submit to me the final study report that determined the conduits of water at the Enka facility, including any video recording of those conduits and an up to date map delineating all conduits of water. Also submit the last two years of sampling data from the Enka site and most recent signed Certification as required under SW permit (NCS000179; Sampling - Part II Section B, Certification - Part II, Section A 1. e.). Once I have received these documents we can arrange an onsite meeting to further discuss.
