The project was placed on public notice on September 27, 2021 and the comment period for the notice ended October 28, 2021. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Your application states that "cofferdams and a pump around will be used" during of the construction of the road crossing in Impact A. (See Section E: Impact Justification and Mitigation, 1b) However, no temporary stream impacts are requested in Section D of the application. Please provide more details or an exhibit on the cofferdams and a pump around design and clarify if there are temporary impacts associated with it. [15A NCAC 02H .0502(c)] 2. Your application states that "Impact A2- Buffer Mitigation for Zone 1 only may be required." (Section D: Proposed Impact Inventory, 6i). Please clarify how this impact is categorized in the Table of Uses in 15A NCAC 02B .0714(11). Further please clarify the boundaries of Impact A2 on the impact maps and provide the width of the permanent maintenance corridor. [15A NCAC 02H .0502(c) and 15A NCAC 02B .0611(b)(2)] 3. On the impact map for Impact A, the proposed new sewer line turns north to connect with the existing sewer line to the north of the proposed road crossing. Please provide more details as to why the tie in was designed this way. [15A NCAC 02H .0502(c)] 4. On the impact map for Impact B, there is a label for "New Waterline" but no corresponding water line on the map. Please clarify the label and if a "New Waterline" is being proposed and if it has any buffer or stream impacts. [15A NCAC 02H .0502(c)] 5. On the Overall Site Plan, Sheet Number CD-2.0, there appears to be an outlet for a proposed stormwater wetland that goes through the buffer for Stream E on the west side of the project and another outlet for a proposed stormwater wetland that goes through the buffer for Stream A on the northeast side of the property. Please provide additional details on these outfalls and how they meet dispersed flow as defined in 15A NCAC 02H .1002 Further please clarify why these discharge points are proposed to be armored through the buffer all the way to the stream banks. [15A NCAC 02B .0714(9)] 6. Please provide a copy of the Stormwater Management Plan for this project. [15A NCAC 02H .0506(b)(1)] 7. Public Hearing - The Director has determined that it is in the public's interest to hold a public hearing to received comment and additional information on the proposed project. This hearing must be held prior to taking final action on your application. The Division is in the process of scheduling the public hearing and will forward the details by separate letter. [15A NCAC 02H .0503(f)]. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deq.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Section 401 of the Clean Water Act or the Neuse River Buffer Protection Rules for this activity and any work done within waters of the state of the regulated riparian buffers may be a violation of North Carolina General Statutes and Administrative Code.
