Dear Jeanette:
We are submitting this letter in response to the email dated June 16, 2021, regarding MS4 Annual
Reporting guidance.
On May 5, 2021, the staff from the North Carolina Department of Environmental Quality (DEQ)
conducted a compliance audit of the Town of Haw River's NPDES Municipal Separate Storm Water
System (MS4) Permit. The following minimum control measures were evaluated:
• Program Implementation, Documentation & Assessment
• Public Education and Outreach
• Public Involvement and Participation
• Illicit Discharge Detection and Elimination
■ Post- Construction Site Runoff Controls
Pollution Prevention and Good Housekeeping for Municipal Operations
On May 21, 2021 (Notice received May 28, 2021), DEQ issued a Notice of Deficiency
(NOD-2021-PC-0367) to the Town of Haw River. The following actions were required:
1. Within 30 calendar days respond in writing to acknowledge these requirements and the intent
to comply. The Town submitted the letter to comply on June 24, 2021
2. Within 120 calendar days from the date of the receipt of this letter:
a. Conduct a self -audit which includes at a minimum an evaluation of compliance with the
permit conditions found in Section H.: Total Maximum Daily Loads utilizing the DEQ
standard MS4 audit Template.

b. Develop a Draft Stormwater Management Plan (SWMP)
These items are currently being reviewed and completed and are due on Sept 27, 2021
3. Submit an NPDES MS4 permit application within 30 days of receiving written DEQ concurrence
that the submitted Draft SWMP documents a compliant stormwater management program.
The MS4 Permit Application as required by DEQ was submitted on August 19, 2021.
4. Respond to public comment on the DRAFT SWMP and submit a Final SWMP for DEQ approval
and final permit issuance. This action will be completed when guidance is received.
This letter describes the follow-up items that are currently being completed, and as requested it is the
DEQ required annual report for the Town of Haw River for the 2021 annual reporting period.
