The Site Inspection on March 1, 2007 resulted in issuance of a Notice of Violation (NOV) on March 13, 2007. This office received your itemized response to the above referenced NOV together with the response from Quible & Associates, P.C. on April 17, 2007. Since most of the items from NOV are addressed satisfactorily this office will not entertain the Assessment of Civil Penalties option, however in order to continue with the renewal of Stormwater Permit the following additional information is needed. 1. One (1) complete set of signed and sealed as -built plans, with all required details; 2. Please provide one set of signed and sealed supporting documents that includes the following: Calculations to show total impervious area, provided storage volume and number of infiltration basins; C Basin bottom and overflow elevations; The above requested information must be received in this office prior to June 4, 2007 or your application will be returned as incomplete. The return of this project will necessitate resubmittal of all required items including the application fee. You should also be aware that the Stormwater Rules require that the permit be issued prior to any development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day. All other issues item 3 under"GENERAL QUESTIONS FILE REVIEW", item 9 under "SITE VISIT"; and items: 1, 3, and 6 under "CONDIMENTS", are addressed via written response directly to you from Mr. Eduardo J. Valdivieso, P.E., Vice -President, Quible Associates, P.C., the Museum's site engineers on this project. Items: 7, 12, and 15 under "SITE VISIT", and items 2, and 4 under"COMMENTS" deal specifically with: bank erosion, mowing, and vegetation/re-vegetation. As you are aware, the Museum is located on property belonging to the National Park Service (NPS), Cape Hatteras National Seashore. The Museum has a thirty (30) year Memorandum of Understanding (MOU) with the N'I S allowing the use of the land for the Museum. The NPS has been quite specific that we are not allowed to do any landscaping, planting, seeding, etc. and that all wetlands and native vegetation on the site be allowed to grow as they would in the natural environment of the seashore. We are allowed to mow and remove vegetation from the curb cuts to infiltration areas (around loose rocks), but all other areas must be left "natural". Some of the areas requiring re -vegetation are the result of construction activity, specifically the installation of parking lot and pathway lighting which was completed in January 2007. 1 am pleased to report that natural re -vegetation is occurring in these areas and should be complete by the end of summer. The fight front corner infiltration basin continues to be problematic in terms of bank erosion and re -vegetation. The area needs constant maintenance (at least once a month) and "natural beach vegetation is extremely slow to grow in this area (wind, blown sand, and erosion are factors �iratwY`rtl�rdic Ile Graveyard of the Atlantic Museum P.O. Under the terms of our MOU, all we can do is "let nature take her course" and sustain the area through constant maintenance. I am delighted to comply with any requirements of the NCDWC but, to be frank, we are on federal land, the NPS has told us what they require I am not in a position to dispute their instructions. Regarding "SITE VISIT", item 26, and "COMMENTS" item 5, pertaining to "Allainienaiice Records inusi be kepi of the O X, M cictiviiies cis require ui your permiP', I fully acknowledge the Museum's responsibility here and can only plead confusion. The May 12, 1997 cover letter from DEFINR Division of Water Quality notes we should "... pay special attention to the Operation and Maintenance requirements...". This was confused with the "WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT" which, unfortunately, does not mention the need for keeping maintenance records. As you can see from the report, all areas have been maintained to the fullest extent possible under the circumstances. Curb cuts and infiltration areas are inspected weekly to keep them clear of debris, sand, shells etc., and are thoroughly cleaned at least quarterly or more often as needed. Given the fact we are in a prime hurricane zone, the Museum takes this responsibility very seriously and we have been scrupulous in maintaining these areas (after Isabel, Museum grounds were the only place to land Helicopter support because we were "dry" and clear of debris). Needles to say, we are most embarrassed and have taken steps to rectify the situation. I am enclosing a copy of our recording format which will be kept in a separate, suitably marked binder and hope this will meet with your approval. " Response: From your perspective technically correct, however as evidenced by my October 2001 issuance of a "Designer's Certification" (copy attached) it was then and continues today to be my professional opinion that "construction was observed to be built within substantial compliance and intent of the approved plans and specifications." Please allow me to elaborate. Attached as Exhibit A find a copy of the "permitted" stormwater management plan dated 26 March 1997, entitled "Grading and Stormwater Management Plan; Graveyard of the Atlantic Museum" as prepared by Quible & Associates, PC. This plan was approved by DWQ on May 12, 1997. This plan authorized a built upon area of 2.3 acres with on -site mitigation of stormwater via multiple designated on -site infiltration areas with total treatment capacity (68,501 cf) well in excess of the 12,689 cf volume based on the 1.5" minimum required standard. In December 1999, the main parking lot configuration of the project was value engineered by Quible & Associates, P.C. to minimize the amount of import fill material, eliminate the costly network of drainage culverts, and linear interior traffic islands. Please consult Exhibit B. Note that the size of the western most infiltration basin was increased to compensate for the loss of the interior parking island infiltration areas. Built upon area did not increase and while the resultant on -site treatment capacity of the infiltration system in total was reduced to 46,954 cf, it was still well in excess of the aforementioned 12,689 minimum required volume. Exhibit C is an informative digital color aerial photography (circa 2003) plot of the Graveyard of the Atlantic site confirming as constructed layout. Mr. Al Hodge April 16, 2007 Page 3 of 3 In my professional judgement, these siting adjustments did not warrant a significant change to the intent of the original plans. In further support of this judgement call are the following affirmative findings recently itemized and made by your inspector on the respective 13 March 2007 State Stormwater Inspection Report: 1. Drainage area is consistent with the permit; 2. Built -upon area to drainage area is consistent with the permit; 3. All built -upon area (as permitted) is graded such that the runoff drains to the system. On behalf of the Graveyard of the Atlantic Museum, we respectfully request that the Washington Regional Office of the Division of Water Quality consider and accept the responses outlined above and subject to satisfactory review of forthcoming supplemental vegetation and maintenance related data directly from the Graveyard of the Atlantic, grant there request for renewal of permit SW7970407. It. OPERATION AND MAINTENANCE REQUIREMENTS: Dry detention ponds have moderate to high maintenance requirements, depending on the extent to which future maintenance needs are anticipated during the design stage. The owners, listed above, shall be responsible for both routine and non -routine maintenance tasks. If regular maintenance and inspections are not undertaken, the pond will not achieve its intended purpose. The basic elements of a dry extended detention pond maintenance program arc described below. Routine Maintenance lu'I1zVKCV7 The side -slopes, embankment and vegetative filter of a dry detention pond must be mowed at least once a month to discourage woody growth and control weeds. More frequent mowing may be required during the high growing season. The use of native or introduced grasses which are water -tolerant, hardy and slow - growing are rcconunended. See attached seeding schedule for representative species and fertilization rates. INSPECTION Ponds should be inspected on an annual basis to ensure that the structure operates in a manner originally intended. When possible, inspections should be conducted during wet weather to determine if the pond is meeting (lie targeted detention times. In particular, the overflow structure should be regularly inspected for evidence of clogging, or short circuiting. Other problems which should be checked for include: subsidence, erosion, cracking or tree growth on the embankment; erosion around the inlet and outlet structures; the adequacy of downstream vegetative filler; erosion of the pond's bed and banks; erosion of the downstream vegetative filler; and modifications to the pond or its contributing watershed that may influence pond performance. DEBRIS AND LITTER REMOVAL Debris and litter that accumulate near the inlet and outlet structures should be removed during regular mowing operations. The pond side -slopes, and embankment all may periodically suffer from slumping and erosion, although this should not occur often if the soils arc properly compacted during construction. Regrading and revegetalion may be required to correct the problems. Similarly, the riprap on the inlet and outlet structures may periodically need to be repaired. NUISANCE CONTROL Standing water or soggy conditions within the dry detention pond can create nuisance conditions for nearby residents. Odors, mosquitos, weeds and litter arc all occasionally perceived to be problems in dry ponds. Most of these problems arc generally a sign that regular inspections and maintenance are not being performed (e.g., mowing, debris removal, clearing the overflow structure. Non- Routine Maintenance STRUCTURAL REPAIRS AND REPLACEMENT Any structural damage in the inlet or outlet structures shall be made as soon as possible. SEDIMENT REMOVAL When properly designed, dry detention ponds will accumulate significant quantities of sediment over time. Sediment accumulation is a serious maintenance concern in dry detention ponds for several reasons. First, the sediment gradually reduces available stormwater management storage capacity within the pond. The best available estimate is that approximately 1% of the storage volume capacity associated with the two year design storm can be lost amorally. Thus, as much as 20% of a pond's total storage capacity can be lost within 20 years. Even more storage capacity can be lost if the pond receives large sediment input during the construction phase. Second, sediment accumulation can make dry extended detention ponds very unsightly. Third, and perhaps most importantly, sediment tends to accumulate around the control device of dry detention ponds. Sediment deposition gradually reduces storage capacity reserved for pollutant removal in the pond. For these reasons, accumulated sediment may need to be removed from the lower stage every 5 to 10 years in a dry detention pond. More frequent spot clean -outs may be needed. Sediment removal operations arc relatively simple if access for heavy equipment is provided. Front-end loaders or backhoes can be used to scrape off the bulk of the accumulated sediment, followed by manual removal of sediment deposited around the inlet and outlet structures. The disturbed area should be immediately stabilized with vegetation after removal operations are completed. I have been requested by our staff engineers to provide an assessment of the seasonal high water table at the 7 acre parcel of land designated by the National Park Service for construction of the Graveyard of the Atlantic Museum. The initial environmental assessment that our firm conducted on the property included delineation of the Section 404 wetlands. During that process I hand augured numerous soil borings on the site for the purpose of establishing water table. My findings indicate that the average existing elevations on the site range from +/- 7.5' to 4.5' with an average of approximately 5.5' and that the seasonal high water table in the area proposed for development is at an elevation of approximately 2.5'.
