Division of Energy, Mineral & Land Resources Land Quality Section Washington Regional Office 943 Washington Square Mall Washington, NC 27889 APO 14 2016 �� IA0 0 RE: Request for State Stormwater Permit Name/Ownership Change for Stormwater Permit No. SW7130717 Barrier Island Station Combined Multiple Phases High Density Stormwater Project, Dare County and Request for State Stormwater Permit Name/Ownership Change and Permit Amendment Stormwater Low Density Permit (Unnumbered) Dated December 22, 1994 to Barrier Island Station Phase 1, Dare County Dear Bill: We recently discussed the status of the Beachwoods project in Kitty Hawk Woods, formerly known as Barrier Island Station, which currently has both a high density permit that covers the residential portions of the development (SW7130717) which was issued in December, 2013, and a low density permit which covers the non-residential portion of the development (Welcome Center and related construction) which was issued in December 1994. Ownership: Ownership of both portions of the development has changed twice since these permits were issued. Barrier Island Station, Inc. initially transferred title to Gold Key Resorts, LLC of Virginia Beach, VA and subsequently Gold Key has transferred title to Diamond Resorts GK Development, LLC. NC Department of Secretary of State information is included on all three of these entities. The desire is for the permits to be transferred from Barrier Island Station, Inc. directly to Diamond Resorts GK Development, LLC. Certifications of both the current and proposed permittees are included in the applications. Since Gold Key Resorts was title holder for a period of time, we have supplemented the standard certifications with an additional certification from Gold Key acknowledging their concurrence with the transfer of the permit to Diamond Resorts. High Density Permit SW7130717: On December 12, 2013, Stormwater Permit No. SW7130717 was issued which combined all of the then existing high density permits covering development in the residential portion of the PUD, most of which had received designer certifications at or prior to that time. Subsequent to the issuance of the permit, in 2014, several additional designer certifications were issued relative to several of the phases that had been completed. Copies of these certifications are included with this submittal. Phase IV has been partially constructed and will be certified upon its completion; Phase V has not yet been constructed. It is anticipated that development activities in Phases IV and V will resume in the coming months and appropriate certifications will be issued for these phases upon their completion. Plan ned"Commercial'Development:-A low density stormwater approval for Barrier Island 'Station Phase I, which-was'the-Planned "Commercial'Development portion of the property, was issued on December 22, 1994 to Barrier Island Station, covering a total project area of 24.47 acres, including a proposed lake of approximately 1.5 acres, and 2.84 acres, subsequently revised to 2.49 acres, of impervious area with a coverage of 12.3%, net of the lake area. Both the lake and the receiving wetlands were identified as having no outlet to the bay. It appears that the original developer made some modifications to the buildings and site after the permit was issued in 1994, but the changes were not previously documented. Some of those changes resulted in an increase in the built upon area covered by this permit. Recently, the new developer refurbished and modernized the original buildings. In order to document these changes, we have recently completed a `as-built"survey oof the modified development, a copy of which is included with this submittal'This s e documents the as -built changes and current conditions that were observed. In connection with the application:for-transfer-'ofthis:permit,-"we-are-also-requesting-approval"ofamin`o?modification . cto'the permit. The built upon area has increased fro lm 2:3% to 13.9% using what we believe to be the same methodology as that used in 1994. Barrier Island Station - Kitty Hawk, Phase II North (North) and (South) is construction complete in substantial conformity with permit SW7130717, Phase II North (North) revised Drawing C-122, Rev 6, copy attached, which exhibits revised (deleted) pavement regrading at the western and northwestern driveway and parking area with a (added) curb along the western edge of pavement, and Phase. II North (South) revised Drawing C-123, Rev 2, copy attached, which exhibits revised (deleted) Laundry Building gutters and downspouts. Laundry Building Gutters and Downspouts: The Laundry Building gutters and'downspouts were originally proposed and shown on Drawing C-123 because a very limited overland flow area is available to receive about 1/4 of the existing direct roof runoff, and about 3/4 of the existing roof runoff is directly to wetlands. The gutters and downspouts'are proposed to be deleted because the Laundry roof is observed to be clean and to not be a roosting area for birds, and the stormwater,runoff from the roof is anticipated to have no significant environmental impact on the approximately 50 acres of BIS wetlands and the hundreds of acres of surrounding wetlands with no surface water connection to Kitty Hawk Bay. The Laundry Building is a pre -fabricated metal building with no roof overhang, and the runoff from the roof flows down the exterior walls with no erosive effect on the receiving area. Further, reliable operation and maintenance of the gutters and downspouts would require that a half -dozen large (40' to 60' tall), indigenous trees be removed from the wetland maritime forest adjacent to the Laundry Building. Western Driveway and Parking Area Curb and Pavement Regrading: The western edge of pavement at the western and northwestern driveway and parking area has been. curbed to eliminate direct stormwater runoff discharge to wetlands adjacent to the pavement. Pavement slope modification was proposed and shown on Drawing C-122 to reduce the stormwater runoff discharge to infiltration basin BAS7 and to redirect some of the pavement runoff to infiltration basin BAS8. Installation of the curb without pavement slope modification, however, has resulted in a surface runoff pattern that directs runoff primarily to.BAS8, and a small fraction of the runoff from the northwestern parking and drive area discharges to BAS7. The proposed plan modification maintains the existing pavement slopes and runoff, but with the curb installed. This will result in 400 cubic feet of runoff from a 2" rainfall to BASS which exceeds the theoretical capacity of BAS8, excluding infiltration during rainfall. Pavement grades between BAS8 and BAS6 are such that any runoff which is not accepted by BAS8 will bypass to BAS6, which has excess capacity of 146 cubic feet, again excluding infiltration during rainfall, and the total capacity of the 2 basins is the runoff from a 1.8" rainfall. In the event of rainfall runoff which exceeds the storage and infiltration capacity of the basins, runoff which is not'accepted by the basins will surface flow non- erosively into the approximately 50 acres of BIS wetlands and the hundreds of acres of surrounding wetlands with no surface water connection to Kitty Hawk Bay. Other minor field revisions depicted on Drawing C-122, Rev 6 include: 1. Revision of the fabrication and installation details of the drop inlet north of the 1600 Building (DI#1) and shift of the culvert alignment at BAS9 to allow the culvert discharge to miss a large tree and roots. 2. Addition of a drip -line Swale at the southern corner of the 1500 Building leading to infiltration basin BAS10. 3. Addition of a berm running northeast from the retaining wall south of the 1600 Building to provide separation between conveyed runoff and wetlands, and between infiltration basin BAS8 and wetlands, and addition of a berm running southeast from the retaining wall to provide separation between conveyed runoff and wetlands. The retaining wall at the northwestern corner of the Laundry Building was constructed with an impermeable facing and the western end of wall was extended west with a return to the south to allow the transfer swale from the pavement to infiltration basin BAS2 to be moved to immediately adjacent to the retaining wall, the nature trail to be shifted south, and the elevated walkway northwest of the building to be eliminated. 2. A stone apron was added at the drip edge of the shed roof at the south end of the Laundry Building to stabilize the drip area. 3. Stone slope protection and wheel stops were added along the BAS3 slope receiving pavement runoff or occasional vehicle wheel incursions to stabilize and protect the slope against erosion or rutting. 4. The swale, infiltration basin BAS4 and the wooden walkways were slightly reconfigured to accommodate the basketball court southern gate location. The letter of request and revised site plan dated June 27, 2016, indicated some dimensional changes to the project layout which resulted in an overall decrease in impervious area. There were no substantial changes in the drainage areas and stormwater treatment measures for this phase of the development. Based on the provided information and revised site plan, your request to handle these changes as a minor modification to the current stormwater permit is approved. The permit includes what was previously known as Phase IV of Barrier Island Station, which was partially developed previously and is now in the process of being completed. In connection with the completion, there have been some dimensional changes to the project layout, which has resulted in an overall decrease in built upon area that is being proposed for the phase. The drainage areas and, stormwater treatment are substantially the same as proposed previously. The approved built upon area was 1.64 acres (71,438 sq.ft.), while the revised built upon area will be 67,584 sq.ft. as shown on the updated Site Plan. The infiltration basins were originally permitted based on storing the runoff from a 2" rainfall. In the present configuration, the basins can handle a factor between 3 & 6 times the runoff anticipated from the 2" rainfall based on the new built upon areas, with no overflow off site. Based on the fact that the changes are relatively minor, the built upon area has been decreased, and the treatment process is substantially the same, with no stormwater outlet to surface waters, we propose to handle this as a minor modification to the existing permit. , Two copies of the revised Site Plan/Grading and Stormwater Management Plan are attached for your review. Dripline swales were modified slightly at the 2700 Building and the 2800 Building to better coordinate with existing site topography and stable local infiltration areas, with no significant change of runoff capture or local infiltration. 6. Infiltration basin BAS3 (formerly about half -way between the 2600 and 2800 Buildings) was deleted because of the presence of shallow underground electrical distribution lines and other utilities. The 423 sf tributary area and 71 cf runoff to BAS3 is now served by local infiltration in the same area or runoff to the drop inlet leading to BAS4, which has substantially greater capacity than the 11,000 sf and 2,425 cf runoff served. The schedule is revised accordingly. 7. The parkway curb along the eastern edge of the drive from the 2500 Building to southeast of the 2600 Building was replaced by a stabilized soil berm along the edge of pavement (observation of the as -built berm indicates satisfactory performance and no berm erosion). 8. The southern end of the retaining wall northwest of the 2800 Building was revised in the field from an approximately 90-degree return to an approximately 45-degree return to minimize transition grading (not shown on the drawing). 9. The southeastern corner of the parking lot pavement west of the 2800 Building was extended in the field slightly to the east, resulting in an inconsequential increase in pavement area and an inconsequential narrowing of the rock -lined transfer swale (which probably will never see any actual water flow).
