This letter is to inform you of certain conditions of your stormwater permit that have
not been met. Permit SW7110303 was issued on March 15, 2011 for a wet detention pond
to serve a family amusement park located at 7430 U.S. Hwy 70 near New Bern, NC. A
Division of Energy, Mineral, and Land, Resources file review confirms that a certification of
completion has not been submitted. Permit condition number ll. 8 states "Upon completion
of construction and prior to operation of this permitted facility, a certification must be
received from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation..."
Please provide a copy of the certification or a statement that the project has not
been constructed to this Office at the letterhead address within 30 days of receipt of this

This project proposes the construction of a family amusement park consisting of small
amusement rides, miniature golf, a go kart track and an arcade building.
The project will have a wet detention pond for stonmwater treatment. The pond is sized
for 90% TSS removal and will detain the treatment volume associated with the 1.5 inch
rainfall event. The project area is established as a total of 4.157 acres in size. The
project built -upon area is 44.6%. 3.9 acres of the site will be disturbed by this project in
order to construct the site improvements.
The wet pond is sized using the average pond depth method and comes out to an average
depth of 4.09 feet. The forebay is sized to be 20.4% of the pond volume excluding the
one foot sediment storage zone. The provided permanent pool surface area of 7,282 SF
exceeds the required 7,007 SF of permanent pool surface area. The detention pond will
be used as a temporary sedimentation trap during construction and will be cleaned of any
accumulated sediment after construction.
"rhe soils on the site are classified as rains by the Craven County Soil Survey. Rains is
described as a fine sandy loam and a sandy clay loam at the depths to be disturbed by this
project. The depth to the seasonal high water table at the boring location was determined
to be 24 inches. This depth corresponds to an elevation of 24.5 feet_ The pond
permanent pool elevation is set at an elevation of 24.5.
']'he property is owned by Mr. Jeffery Wynne and is being developed by Mr. Donald
Palmer. There have been no previous permits issued for the work area. The stormwater
detention pond is being constructed on adjoining property belonging to a family member
of Mr. Jeffery Wynne. A legal easement has been obtained for the use of this property.
There is no off -site pervious or impervious area draining into the site.
The sewer system for the property will be a septic system and pressure drain field which
is permitted through the NCDENR and Craven County. There will be no other new
utilities constructed by this project. There are no known historic sites on the property.
There are not any NCDENR non-compliance issues associated with the site.
The site drains to Tucker Creek, a tributary of the Neuse River. "fucker Creek is
classified as SC;Sw,NSW, index #27-1 12-6. There are not any Coastal wetlands on the
site. 404 wetlands are located at the rear of the site but are outside of the work area. A
NCLIse riparian buffer exists at the rear of the site. Grading and managed vegetation will
occur in the outer 20 feet of the buffer. Zone I of the buffer will remain undisturbed.
The detention pond oulfall occurs above the riparian buffer, This project, including the
detention pond oulfall, does not impact any wetlands. The wetlands were delineated by
Joseph C. Avolis, PE, president Avolis Engineering, PA.
This project requires post development runoff rate control which is accomplished by the
wet pond to pre -development conditions for the I -year, 24-11our storm.
Since a new ditch oulfall is occurring to the adjacent riparian buffer, 30% reduction of
nutrients is provided. This reduction is accomplished by a combination of a 5:1 side
slope grass swale segment and the wet detention pond.

Enclosed please find our erosion and stormwater submittal for the above -referenced
project incorporating the review comments from our recent meeting.
I have included a swale supplement and swale calculations to show nutrient reduction to
the 30% level. This single swale is designated as swale 41. I adjusted the drainage
pattern in order to get enough flow into the swale for treatment to get the project to the
necessary reduction level.

& EASEMENT AGREEMENT
THIS PROFIT A PRENDRE AND EASEMENT AGREEMENT made this
Dav of- 201 , by and between William Dennis Wynne and
wife, Michele Tnpp nne, heremafter "Wynne", and Donald Palmer, hereinafter
"Palmer".
***WITNESSETH***
PROFIT A PRENDRE: Wynne, for and in consideration of the sum of Ten and
00/100 Dollars ( $ 10.00) and other valuable consideration as set forth and described in
("License") attached hereto and incorporated herein by reference, to it paid by Palmer, the
receipt of which is hereby acknowledged, has bargained and sold, and by these presents
does hereby grant, bargain, sell and convey to Palmer, his heirs or successors and assigns,
the perpetual, non-exclusive right of use of the detention pond, located on said property
owned by Wymie ("Tract 2") as set forth in that real property described in Schedule ("A")
attached hereto and incorporated herein by reference. This profit also includes the use of
the real property described in Schedule ("A") by Palmer for inlet and outlet drainage for
the detention pond for storm water runoff and utility type service that's required for the
fountain in the detention pond. This use shall run with the land. The purpose of this profit
and easement is for the development of an Amusement Park on the adjacent property
('Tract 1 ") owned at this time by Jeffery Ashford Wynne. The exact location of the
detention pond and drainage on said property owned by Wynne (`Tract 2") as set forth in
that real property described in ('Exhibit C") attached hereto and incorporated herein by
reference.
The full and actual size of the detention pond and drainage, will be determined by Avolis
Engineering, P.A. of New Bern, NC. This profit and easement use located on said
property owned by Wynne (`Tract 2") as set forth in that real properly described in
(`Exhibit B") limited to 1/4-1/2acre attached hereto and incorporated herein by reference.
The perpetual, non-exclusive right, restricted for, and use by, an Amusement Park on the
adjacent property, for so long as it is fully operational and open to the public.

EASEMENT: Wynne, for and inconsideration of the shm of Ten and 00/100
Dollars ($10.00) and other valuable consideration as set forth and described in
("License") to it paid by Palmer, the receipt of which is hereby acknowledged, has
bargained and sold, and by these presents does hereby grant, bargain, sell and convey to
Palmer, his heirs, successors and assigns, the perpetual, non-exclusive right of easement
of ingress, egress and regress on the real property set out in Schedule ("A") and described
in ("Exhibit B") and it shall run with the land for the above stated purposes..
Right of way is granted for limited use with prior notification, to Palmer, his heirs,
successors, and assigns, to use driveway, and walk across property owned by Wynne
("Tract 2"), to access the profit and easement, for maintaining, inspection of detention
pond, and drainage for storm water runoff.
The Profit and Easement shall be cleaned up after construction of the detention
pond, drainage and utility installation and any debris removed by Palmer. The profit and
easement shall be maintained by Palmer, his heirs, successors and assigns and shall be
responsible for all cost associated with the construction of profit, easement and
maintenance, any future liabilities, penalties, tines, legal fees and any increase in property
taxes, solely due to and for this profit and easement, that Wynne would not other wise
incur. Palmer, his heirs, successors and assigns shall not permit structures to be
constructed or maintained on said profit and easement, there shall be no other rights,
privileges, or use, with exception to what is conveyed and written in this agreement,
misuse of Wynne property by Palmer, his heirs, successors and assigns, or non payment
as described in ("License") attached hereto and incorporated herein of this agreement, in
excess of NINETY ("90") DAYS alter due date will be considered a breach of the terms
of this agreement and Wynne shall have the right to seek relief and damages.

TO HAVE and to hold said profits and easements and all privileges and
appurtenances thereunto belonging or in any appertaining to said respective parties, their
heirs, successors and assigns forever, for so as long as the Amusement Park on the
adjacent property ("Tract I") is fully operational and open to the public, if and when the
following conditions occur, ("Permanent Closing and dissolvent of the Amusement
Park"), Palmer releases and surrenders in writing to Wynne, all Profits and Easements on
all property owned by Wynne, thus freeing Wynne of all burdens and obligations in this
Profit and Easement Agreement.
IT BEING fully understood and agreed that any pronoun or other word used herein
shall be construed as singular or plural, and of the masculine, feminine or neuter gender,
as the context may indicate or require.

Soil Boring Report
Kid's World
U.S. Highway 70
Craven County
February 15, 2011
A single soil boring was made at the proposed stormwater pond area location for the
Kid's World Amusement Park. The soil boring was completed on February 15, 2011
with a hand auger by Joseph C. Avolis, PG. The boring was located within the proposed
13MP area.
The Craven County Soil Survey maps the soils on the site as Rains. Rains is described as
a line sandy loam and a sandy clay loam at the depths to be disturbed by the BMP
construction. Rains soil type is listed as having a permeability of 0.6 —2.0 inches/hour at
the bottom elevation of the BMP.
The on site soil boring indicated soil characteristics similar to the general soil description
for the two soil types. The following soil characteristics were observed:
Depth Elevation Description
0'-0.5' 26.57 'fop soil
0.5'-1.5' 26.0' "fan sandy loam
1.5'4.0' 25.0' Sandy clay loam
The depth to the seasonal high water table was 24 inches, elevation = 24.5 feet.
The site is suitable for the construction of a stormwater wet detention pond. The BMP
will be constructed at the seasonal high water table elevation.
