A f6llow-up inspection of this project on May 14, 2009, indicated that some of the violations outlined in the Notice have still not been corrected. The violation being continued is: Failure to conduct a land -disturbing activity in accordance with the approved erosion and sedimentation control plan. G.S. I I3A-57(5). In addition to the violation outlined in our Notice dated March 24, 2009, this inspection also revealed the following violations The additional violations found are: a. Failure to file an acceptable, revised plan after being notified of the need to do so. G.S. 113A-54.1 (b) and 15A NCAC 4B .0118 (a). Michael Morton, Member/Manager May 19, 2009 Page 2 A check of our files revealed that a revised erosion and sedimentation control plan was submitted to this office but disapproved. b. Failure'i"within�2i"calendar days of completion of any phase of grading, to plant or otherwise provide exposed graded slopes or fills with temporary or permanent ground cover, devices, or structures sufficient to restrain erosion. G.S. 113A-57(2). The inspection revealed that graded slopes and fills throughout the site have not been provided with a groundcover sufficient to restrain erosion within 21 calendar days. To correct these violations, you must, WITHIN 10 DAYS OF RECEIPT OF THIS NOTICE OF CONTINUING AND ADDITIONAL VIOLATIONS: 1. Submit a revised plan along with the appropriate plan review fee, showing all planned or completed development activity not indicated on the erosion and sedimentation control plan approved by this office on October 13, 2008. 2. Provide a groundcover sufficient to restrain erosion on all exposed slopes/areas. Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover" or of "ground cover sufficient to restrain erosion." These requirements are not satisfied until an adequate cover of grass or other ground cover (such as properly applied and secured, mulched seeding or appropriate rip -rap) is established. which is, in fact, sufficient to restrain accelerated or man-made erosion. The violations cited herein may be referred to the Director of the Division of Land Resources (Director) for appropriate enforcement action, including civil penalty assessments for an initial one -day violation and/or a continuing violation. The Division of Land Resources is not required to provide a time period for compliance before assessing a penalty for the new violations cited herein. The penalty for an initial one -day violation may be assessed in an amount not to exceed $5,000.00. Please be advised that a civil penalty may be assessed for the new violations regardless of whether the violations are corrected within the time period specified above. In addition, if the new violations cited herein are not corrected WITHIN 10 DAYS OF RECEIPT OF THIS NOTICE OF ADDITIONAL VIOLATIONS, this office may request that the Director take appropriate legal action against you for continuing these violations pursuant to NCGS 113A-61.1 and 113A-64. A penalty may be assessed from the date of the violation, pursuant to NCGS 113A-64(a)(1), and for each day of a continuing violation in an amount not to exceed $5,000.00 per day. This matter is being referred to the Director, Division of Land Resources, for enforcement because the violations reported in our original Notice, dated Marph 24, 2009, were not corrected on or before the deadline for compliance, which was Aptil 9, 2009. It should be noted that each day of noncompliance constitutes a separate violation of the Sedimentation Pollution Control Act of 1973. Please be advised that if compliance is not immediately undertaken, other appropriate action may be requested. Please be advised that any new land -disturbing activity associated with this project should not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so that work can be inspected. You should not assume that the property is in compliance with the Act until we have notified you. After installation, all erosion control measures must be maintained in proper working order until the site is completely stabilized. Asphalt surfaced parking will be provided for the site. The property is 2.72 acres in size. 2.75 acres, which includes the driveway connections, will be disturbed and developed by this project. The property is owned by Jerry A. Jackson, LLC of Havelock, NC but is being purchased and will be developed by Morton-Crayton Ventures, LLC. The property is being subdivided from a portion of tax parcel 46-039-003. There have been no previous permits issued for the site. There is no pre-1988 built -upon area on the site. There are no existing permits for the site. The project will be built on a continuous basis. The stormwater treatment BMP serving the site will be constructed prior to the building and associated parking areas. The project will be served by the City of Havelock water supply and public sewer. There are no known historic sites on the property. There is no public funding associated with this project. There are not any known DENR non-compliance issues associated with the site. The site is not in a CAMA area. The site drains to an unnamed tributary of Cedar Creek which is a tributary of the Neuse River. Cedar Creek is classified as SC;Sw,NSW, index #27-112-3. The site is not within any Neuse Riparian Buffer setback areas. The site is currently undeveloped and exists as a grassed field. The site is planned as one overall high density stormwater drainage area. The stormwater runoff will be treated by one wet detention pond. All of the building roof runoff will be pretreated in a bio-retention area in order to achieve compliance with the City of Havelock's nutrient reduction requirements. This treated runoff also discharges to the wet pond. The NPDES Phase Il stormwater rules do not apply to the project area. The majority of the stormwater collection is by piping and drop inlets. The proposed built -upon area is 64.7% over a drainage area of 2.75 acres. A wet detention pond is proposed in order to treat the runoff associated with the one -inch rainfall event. The wet pond is sized to provide 90% TSS removal. Stormwater Narrative Sound of Freedom Shoppes Havelock, NC Runoff into the pond is delivered primarily via collection piping. A single forebay area is provided at the head of the pond. The stormwater runoff from all of the developed areas will be collected for treatment. There is no off site runoff coming into this project. A perimeter planted vegetative shelf is provided with one-half of the shelf below the permanent pool level and one-half above the permanent pool level for the detention pond. The outlet structure for the pond is sized to draw down the temporary pool in 72 hours. The pond provides attenuation of the one -ten-year storm to predevelopment conditions. The soils on the site are a combination of a clay structure and a loam at the depths to be disturbed by this project. The depth to the seasonally high water table at the detention pond area is thirty inches (elevation 48.0'). Two soil borings were made at the proposed wet pond and bio-retention area locations for the Sound of Freedom Shoppes. The soil borings were completed on July 11, 2008 with a hand auger by Joseph C. Avolis, PE. The borings were located near each other and yielded the same data at each location. The Craven County Soil Survey maps the soil at the site as the Rains type. Rains is described as a fine sandy loam in the upper 16 inches and a sandy clay loam down to a depth of 80 inches. At the depth to be disturbed by this project, the Rains soil type is listed as having a permeability ranging from 0.6 to 2.0 inches/hour. The on site soil boring indicated soil characteristics similar to the general soil description for the Rains type. The following soil characteristics were observed: Depth Elevation Description 0'-0.5' 50.5' Gravel 0.5'-1' 50.0' Black Top Soil P-2' 49.5' Grey clay with tan mottles 2'-3' 48.5' Light grey clay, no mottles 3'-4' 47.5' Grey clay, few rhizospheres/mottles 4'-5' 46.5' Grey clay, few mottles 5'-5.5' 45.5' Wet silty grey clay 5.5'-6' 45.0' Light grey silty sand, wet 6'-7' 44.5' Brownish white sand, wet The depth to standing water in the borehole was 60", elevation 45.5' (assumed datum). The depth to the seasonal high groundwater at the boring location was 30 inches. This depth corresponds to an elevation of 48.0 feet. The site is suitable for the construction of a wet detention pond. However, the pond surface water elevation is limited to an elevation of 48.5 feet due to the available outlet elevation.
