Henson WIM North Carolina Department of Environment and Natural Resources Division of Water Quality 225 Green Street — Suite 714 Fayetteville, North Carolina 28301-5043 Dear Ms. Henson: This letter is in response to the Notice of Violations, NOV-2009-OP-0049 & NOV-2009-OP-0050, issued by your office on July 20, 2009 for failure to apply and secure a Stormwater Management Permit according to North Carolina General Statute (G.S.) 143-214.7. The Notice of Violations were issued for the Special Operation Force (SOF) Rowe Training Complex Phase III and the SOF Rowe Training Complex Phase IV. Construction began on the SOF Rowe Training Complex Phase III project on September I, 2005. The project scope involved the construction of four 12,011 square feet ready -state isolation facilities (totaling 48,044 SF), utility upgrades, the relocation of a C-130 mock-up site and the demolition of four existing ready -slate buildings, an instructor building, and a repelling tower. Fort Bragg's Directorate of Public Work's (DPW) stormwater management directive for the project was for post -construction storm water runoff to not exceed pre- devclopmcnt storm water runoff and be designed for the 25-year, 24-110111- storm event. This requirement was achieved by designing and constructing grass -lined channels and biorctcntion areas to the specifications outlined in the North Carolina Division of Water Quality Stormwater BMP Manual. . Construction began on the SOF Rowe Training Complex Phase IV project on September 28, 2006. The project scope involved the construction of one five bay single story post -selection ready -state (isolation unit) building that would occupy approximately 12,050 square feet and a two-story 12,480 sq ft ready -state building. As for Rowe Phase IV, the stormwater management directive for the project was for post -construction storm water runoff to not exceed pre -development storm water runoff and be designed for the 25-year, 24-110ur storm event. This requirement was achieved by designing and constructing grass -lined channels and an infiltration basin. Stormwater Management Plans for both the SOF Rowe Training Complex Phase III and the SOF Rowe Training Complex Phase IV were mandated in the initial scoping package by the Fort Bragg DPW/Water Management Branch. The projects were required to meet the in-house DPW installation policy of post - construction storm water runoff not to exceed pre -development storm water runoff for the 25-year, V .(. -2- 24-hour storm event (modeled per NC DWQ requirements for High Quality Water Zones). The projects were reviewed, evaluated, and fulfilled this requirement. However, the stormwatcr management plans were never submitted to the NC DWQ to obtain the necessary permits for construction projects that take place in a designated High Quality Water Zone. The primary reason for this error can be attributed to the early planning stages of the two projects. Although stormwatcr management was required for the projects, it was not accurately conveyed and documented in either the planning charrette or the request for proposal that a permit from the NC DWQ would have to be obtained before construction. The omission of the requirement at this critical juncture allowed the project to proceed into design and ultimately into construction without any knowledge to the development teams (design firms, construction contractors, project managers, etc.) that a problem existed. When the notifications for the necessary permits were received (2006, 2007) from NC DWQ, the respective projects were complete or nearing completion. By this time, contracts with the development teams had been fulfilled and the permit package preparation and permit fees required the existing contracts to be modified and negotiated. The required permit application has been prepared and will be submitted to your office for your review. The events that have resulted in this situation have been evaluated and our processes have been revised. All of the construction projects in this sensitive area, since this incident, have sufficiently identified the requirement in the planning stage and acquired the necessary permit. On May 28, 2009, Mike Lawyer of the Fayetteville Regional Office observed thee completion of the subject development project known as SOF Rowe Training Complex Phase IV located on Special Forces Way at Camp iMacKall, Richmond County, North Carolina. A review of DWQ files has confirmed that letters were sent via Certified Mail dated July 6, 2006 and May 9, 2007 regarding the location of the subject project being within the one -mile watershed of I-ligh Quality Waters and the requirement to obtain a Stormwater Management Permit prior to the construction of built -upon areas. Copies of these letters as well as the Certified Mail Return Receipts are enclosed for your reference. As of the date of this Notice, a Stormwater Management Permit has not been issued for the subject project prior to construction of impervious surfaces as described above. As a result of the site insPection and file review, the following violation is noted: Failure to Obtain a State Stormwater Management Permit Title 15A NCAC 2H .1003, in accordance with G.S. 143-214.7, requires a State Stormwater Management Permit for development activities that require a Sedimentation/Erosion Control Plan and are within one mile of and draining to High Quality Waters (HQW). The inspection and DWQ file review confirms that a State Stormwater Management Permit was not obtained prior to construction of impervious surfaces at the subject site as described above. Required Response This Office requests that you respond to this letter, in writing, within 30 calendar days of receipt of this Notice. On May 28, 2009, Mike Lawyer of the Fayetteville Regional Office observed the completion of the subject development project known as SOF Rowe Training Complex Phase III located on Special Forces Way at Camp MacKall, Richmond County, North Carolina. A review of DWQ Files has confirmed that letters were sent via Certified Mail dated June 21, 2006 and May 9, 2007 regarding the location of the subject project being within the one -mile watershed of High Quality Waters and the requirement to obtain a Stomtwater Management Permit prior to the construction Of built -upon areas. Copies of these letters as well as the Certified Mail Return Receipts are enclosed for your reference. As of the date of this Notice, a Stormwater Management Permit has not been issued for the subject project prior to construction of impervious surfaces as described above.
