In that letter, it was explained that the subject project meets the requirements for obtaining a Stor mwater Management Permit prior to the construction of built -upon areas (buildings, pavement, gravel roads and parking areas, etc.). As of the date of this letter, our office has not received an application for the permit. Bc�advised that construction of any built -upon areas prior to issuance of the permit will be considered,a violation of Title15A)NCAC 02H .1003 and could result in the assessment of civil penalties of up to $25,000 per day, per violation. You should submit to this office your application package, or a schedule of construction if the project has not begun, within 15 calendar days from receipt of this letter. Based on the USGS quad sheet that was included with the classification request form, it has been determined that the project is within one mile of and draining to Hector Creek in the Cape Fear River Basin, which has a stream classification of WS-IV; HQW. Due to the classification of Hector Creek as High Quality Water, a Stormwater Management Permit is required for this project prior to the construction of any built -upon areas. To acquire the Stormwater Management Permit, please complete and submit to this office Form SWU-101, any and all applicable supplement forms and the appropriate fee of $420, which must be in the form of a check made out to the North Carolina Department of Environment and Natural Resources (NCDENR). Accompanying the DLR letter was a National Pollutant Discharge Elimination System (NPDES) General Stormwater Permit No. NCG010000. That permit authorizes you to discharge stormwater to the surface waters of North Carolina. Those point source discharges are associated with activities such as clearing, grading, and other land disturbing and construction activities. The purpose of this letter is to draw your attention to and to stress the importance of that NPDES General Stormwater Permit. The requirements contained in the stormwater permit coupled with the requirements called for by the Division of Land Resources are vitally important to the protection of the waters of the State. If you have not already done so, you are urged to immediately read and adhere to the stormwater permit requirements contained there in. Of particular importance are Parts I and II of the permit. Parts I and II set forth the minimum visual monitoring and reporting requirements for your stormwater discharge. In particular, Part 1, Section B describes the visual monitoring frequencies and locations, the requirement to maintain a rain gauge onsite, and the need to maintain a written record of all inspections.
