At the indicated location, S&EC performed a soil profile description of morphological characteristics to 7' (84 inches) in depth. The purpose of the evaluation involved identification of seasonal high water table (SH WT). The SH WT determination will provide planners with information needed to design a proposed sand filter BMP. The following is a brief report of the methods utilized in this evaluation and results obtained. Our soil evaluation was performed by advancing a hand auger boring to a depth of 84 inches within the proposed stormwater location. The soil boring location was surveyed prior to our description work. The boring location is indicated on the attached map. Soil morphological conditions were described at the proposed location using standard techniques outlined in the "Field Book for Describing and Sampling Soils" published by the Natural Resources Conservation Service (NRCS, 2002). A detailed soil profile description is included in Attachment 1. Under current NC-DWQ regulations, SH WT must be at least 2' below the bottom of the proposed BMP. Based on our observations initial evidence of SHWT was identified at a depth of 10 inches from the ground surface (753.23'). Seasonal high water table determination was made by evidence of 2 chroma soil mottles via Munsell color chips. After 18 inches depth the soil matrix was predominantly 2 chroma colors. Reduced soil colors continued to a depth of 84 inches. Soil texture of the sample boring was predominantly sandy clay. NCDENR Stormwater Project No. SW3121102 In response to the Review Comments and Request for Additional Information provided on November 29, 2012, 1 offer the following information to support the revised documents being re -submitted for approval: 1. Please provide a narrative describing the stormwater treatment proposed. As we discussed on the phone yesterday, this should include an explanation of the future development plans for the whole property area. Please note that a plan revision and/or permit modification will be needed to show the future allotted BUA included for this phase, and all future phases. Isaacs Response: Reference revised Sheet C3.0 for Project Narrative. The future development of Phase 11 of this project is preliminary and subject to revisions of the proposed Built Upon Area and drainage limits, however we have utilized the master plan prepared to date to attempt accurate sizing of the BMP for future development. It is understood that we will need to submit detailed drawings and calculations for storm water review at the time of this Phase 11 future development to ensure the BMP sizing will accommodate the NCDENR requirements. Sheet C6.0 has been modified to further clarify the future build out assumptions used for over -sizing of the Phase I storm water measures. You will also note that we have revised the drainage areas and grading limits due to the relocation of the proposed entrance drive along Sudbury Road to accommodate additional site distance per NCDOT review comments. 2. Please provide a soils report that specifically determines what the SHWT elevation is within the footprint of the proposed sand filter. The geotech. report provided only states that no groundwater was encountered at that particular day. This is not the same as performing a boring within the BMP footprint, specifically to determine the SHWT elevation. Isaacs Response: Soils and Environmental Consultants prepared a SHWT anaIVsis and report — per attached. The results of their analysis required a re-desian of the BMP embankment and sand filter outlet to ensure minimum separation distances are being maintained. The bottom of the basin was raised and the 1,420 s.f sand filter media was relocated to be completely in proposed fill. S&EC determined there was evidence of SHWT beginning at 10" below grade (elevation = 753.23), however the soil characteristics exhibited stronger evidence of seasonal moisture levels beginning at 18" below grade. The lowest elevation of the 6" bottom drain at Point B (754.81) is approx. 1.6' above the shallowest evidence of seasonal high water noted in the S&EC report at an elevation of753.23. The bottom of the sand fiter media is at an elevation of 755.88 (757.38-1.5), which is 2.65' above the shallowest evidence of a SHWT. 3. The truck wash cannot discharge to the stormwater system. Vehicle wash water is a wastewater, not stormwater. Stormwater is defined in G.S. 143, Article 21 per 15A NCAC 02H .0103(31). $143-213(16a) states "stormwater" means the Flow of water which results from precipitation and which occurs immediately following rainfall or a snownl'elt. The water from the proposed truck wash is not a result of precipitation. It is therefore a wastewater. Wastewater cannot be discharged to surface waters without a permit per § 143-215.1, 15A NCAC 02H .0102 and .0105. As with all other commercial and industrial vehicle wash facilities, the truck wash water at this site will have to be connected to a sanitary sewer, pump and hauled, or possibly install a closed -loop recycle system. For additional information on the details of permitting wastewater please contact either Tom Belnick (919-807-6390) in the NPDES Permitting Unit or, for closed -loop systems, Jon Risgaard (919-807-6458) in the Aquifer Protection Section. Isaacs Response: The construction documents have been modified to include a covered truck wash with a recycled water closed loop system that is being designed by others. The effluent from the truck wash will be recycled and re -used and no longer is being shown as a surface discharge. 4. In IV.10. on form SWU-101: The impervious area shown does not add up correctly in the bottom part of the table. It appears that the proposed BUA shown is—113,256 sf, which only leaves —77,101 sf for future BUA to the sand filter. Please verify. Isaacs Response: Section IV (10) on Page three of the SWU-101 Form has been updated to be consistent with the construction documents and attached to this re -submittal. S. The sand filter detail on C5.1 shows the top of the sand at 753.2S', and stone up to 753.50'. If the bottom of the sand is at 752.00' as per the supplement form, then the minimum 18" of sand depth is not provided. Please revise accordingly. Isaacs Response: The construction documents and the Supplement Form have been modified to provide consistency. 6. There appears to be a "Floating" 773' contour shown on C3.0 at the access road stub -out. Please verify. Isaacs Response: The plans have been revised to eliminate this erroneous contour. The evaluated property occurs south of the intersection of Mooresville and Davidson Roads west of Kannapolis, NC. Surface waters on the property flow to the Rocky River (C waters). Figure 1 shows the approximate boundaries of the evaluated properties on the "Cornelius" USGS topographic quadrangle. One intermittent stream is depicted on the property as per the USGS map; however, other waters of the US were identified as a result of on] - evaluation. ExECUTIVF, SUMMARY We have determined wetlands and stream channels subject to Section 404 regulation by the US Army Corps of Engineers (USACE) exist on the evaluated property. S&EC delineated four streams averaging 2-3' in width. Five wetlands were delineated adjacent to streams on the property. Aquatic life was identified in the larger streams and will likely require mitigation depending on impact amounts. Two marginal streams were also identified during our fieldwork. We recommend having a meeting with the USACE to review these features. We recommend having a wetland survey of our flags prepared for approval by the USACE. Please refer to the sketch map and the results and recommendations section below for more detailed information. SCOPE OF WORK The wetland delineation consisted of pedestrian reconnaissance of the subject property in which the soils, vegetation, and hydrology were evaluated using procedures described in the Corps of Engineers Wetlands Delineation Manual (Januay 1987 — Final Report). When areas with positive indicators of hydric soils and evidence of wetland hydrology and hydrophytic vegetation are located wetlands are sketched onto a base map. Proof of wetland hydrology is found via the existence of hydric soils with oxidized root channels in the upper 12 inches of the "A" horizon, water borne deposits, drift lines, scour marks, drainage patterns, regional indicators of soil saturation, etc. Surface waters (streams) which are also subject to regulation by the US Army Corps of Engineers (USACE) as waters of the US were also identified. These surface waters may also be referred to as jurisdictional waters to indicate that they are within the jurisdiction of the USACE. It is important to note that wetlands are also classified as waters of the US and regulated by the USACE. RESUI:rs & RECOMMENDATIONS Wetlands and Jurisdictional Waters: We have determined that jurisdictional streams and wetlands occur on the property. Streams and wetlands were flagged using sequentially numbered pink S&EC logo tape. One stream was delineated in the southwestern portion of the property with flags 01-55. Flags 50-55 delineate a portion of the stream that has the potential to be isolated waters of the state. There exists a break in the channel between flags 49 and 50 (see map). A stream joined in confluence with the aforementioned stream at flag 27. This stream was delineated with flags 100-1 14. Another stream joined in confluence with the 0-55 series stream at flag 02 and was delineated with flags 200- 246. A small stream joined in confluence with the aforementioned stream at flag 229 and was delineated flags 300-303. Three wetlands were flagged adjacent to the 0-55 series stream with flags 4a-4b and 20a-20i and 22a/b. Two wetlands were delineated adjacent to the 100 series stream with flags 100a-107a and 10lb-105b. Two marginal streams were identified during our fieldwork (see map). We do not believe the two marginal streams meet the criteria for jurisdictional status. Aquatic life was observed in the two larger streams. Therefore, these two streams are likely to be considered miligable by the USACE. Mitigation will likely be required if impacts exceed 150 linear feet. We recommend as site meeting with the USACE to review marginal features and approve our delineation. Afler that meeting we recommend preparing a wetland delineation survey for USACE approval. All S&EC flags comprising the wetland and jurisdictional waters delineation should be surveyed and a Wetland Delineation Map generated if USACE approval is desired. The Wetland Delineation Map should include all of the information listed on the attached `Requirements for Wetland Delineation Maps'. S&EC delineation flag numbers should be shown on the wetland survey. Please complete the attached agent authorization form if you would like S&EC to act on their behalf for requesting approval of the wetland delineation. This form is also used in preparing a permit application for impacts to wetlands or surface waters. S&EC cannot conduct correspondence with the USACE unless we have agent authorization (see attached Agent Authorization). This authorization form must be filled out in its entirety by the current landowner and sent to S&EC (a faxed copy is acceptable). i REGULATIONS Regulations that apply to jurisdictional wetlands and waters present on the site are discussed below. Local Ordinances: We recommend consulting with your project planner/engineer with questions regarding any potential stream buffer ordinances in Cabarrns County. Wetland Permitting: Wetland impact permits are issued on a per -project basis as delerniined by the USACE. The USACE has determined that impacts on parcels sub -divided from larger tracts are sometimes considered to be cumulative to existing impacts for the large tract. If this is the case, then thresholds as discussed below may not apply and impacts to wetlands must be considered in light of existing permits. Impacts above nationwide permit thresholds of 1/2 acre of jurisdictional wetlands or waters of the US and/or 300 linear feet of important (perennial) stream channel require an Individual Permit (IP). Individual Permits require an analysis to determine that the proposed impact is the least environmentally damaging practical alternative, typically require compensatory mitigation, notification to adjacent property owners, and public notice. For projects with no previous permits, pre -construction notification to the USACE is not required for impacts less than 1/10 acre. Pre -construction notification and approval by the USACE is required for wetland impacts that exceed 1/10 of an acre and /or any stream channel impacts. Preconstruction notification to the NC Division of Water Quality (DWQ) is required for wetland impacts greater than 1/10 acre and/or 150 linear feet of stream channel impact. If notification to the DWQ is required and the project impervious area is 30% or more, then stormwater treatment to meet the pollutant removal design standard of 85% removal of total suspended solids (i.e., wet detention basins, stormwater wetlands, sand filters, bioretention areas, etc.) will likely be required by the DWQ. If impacts are proposed for any of the areas we can discuss the ramifications with you. Nationwide Permit 39 (Residential, Commercial, and Institutional Developments) limits above - grade fills within 100-year floodplains specifically prohibiting above -grade fill within the floodway. Therefore impacts such as filling wetlands in the floodway of the 100-year lloodplain outside of utility and road crossings are not allowable without an 1P. Additionally, Nationwide Pen -nit 39 limits stream channelization and relocation to streams with an average annual flow of less than lcfs and placement of storm water management facilities (wet ponds) on wetlands or perennial streams. Impacts to vegetated wetlands in excess of 1 acre of wetlands or 150 linear feet of stream channels containing "significant aquatic function" may require mitigation by the DWQ. The USACE may require mitigation for any wetland/jurisdictional waters impacts. Wetland mitigation is a complex process that requires planning and monitoring. Channel mitigation is typically intended to replace lost signi ficant aquatic functions and values. Relocating channels is considered to be an adverse impact and typically results in mitigation within the new channel. S&EC will discuss mitigation issues with you if we believe your project may require mitigation. A complete DWQ 401 Water Quality Certification application has a maximum 60-day processing period while Individual Permit applications submitted to the USACE have no maximum processing periods. The USACE require that all impacts to wetlands or Waters of the US, less than 1/10 acre, be reported to the USACE within 30 days of the completion of construction. A complete USACE Nationwide Permit application has a 45-day processing period.
