All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that the updated permit or any updated pages to the permit will now reference DEMLR as the Division responsible for i8suance of the permit. State Stormwater Management Permit Modification: SW8 940226 The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for the subject project on November 1, 2017. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 effective January 1, 2017. We are forwarding modified Permit No. SW8 940226 dated December 1, 2017, for the construction, operation and maintenance of the built -upon areas and vegetated conveyance system associated with the subject project. Please replace the previously approved plan sheets with the attached modified and approved versions. 1. The following Attachments summarize the data permitted by this permit: a. Attachment A: Documentation of the overall 25% impervious area. b. Attachment B: Summary of all permits covered by the master permit, and their permitted impervious area. c. Attachment C: Summary of all permits covered by the master permit, and their respective permittees. d. Attachment D: Summary of the impervious area per lot allowed for all lots permitted under the 21 individual permits subject to this master permit, SW8 940226. e. Attachment E: Historical Summary and Future Plans 2. Tract 16: This tract was previously covered by SW8 940226, but it has been removed from the project area and will be covered by SW8 171201. Permit Correction: To Subject Permits There are 21 permits covered by this master permit that are cumulatively permitted to achieve 25% overall low density under this master permit, SW8 940226. Deed restrictions are recorded in BK2520/PG0127 and BK1941/PG764-765. As shown in Attachment A, these permits achieve that 25% with 117,647sf of impervious area available to allocate in the future. Some of these permits' impervious area inside these permits is constructed over the permitted amount as permitted under the 21 individual permits, and some are constructed below the permitted amount. Please also pay attention to the permit conditions that requires the recordation of deed restrictions and protective covenants, easements, and the maintenance agreement, which trust all be provided along with certification upon completion of the project. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). NC 28405 910}96 7215 State Stormwater Management Systems Permit No. SW8 940226 STATE OF NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAL QUALITY DIVISION OF ENERGY, MINERAL AND LAND RESOURCES STATE STORMWATER MANAGEMENT PERMIT LOW DENSITY DEVELOPMENT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules and Regulations PERMISSION IS HEREBY GRANTED TO Sunrise Corporate Development Limited. Sea Trail Plantation - Master Stormwater Plan Brunswick County FOR THE construction; operation and maintenance of a 25% low density subdivision in compliance with the provisions of 15A NCAC 2H .1000, effective September 1, 1995 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications, and other supporting data as attached and on file with and approved by the Division of Energy, Mineral and Land Resources (DEMLR) and considered a part of this permit for Sea Trail Plantation - Master Stormwater Plan. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS The following Attachments summarize the data permitted by this permit: a. Attachment A: Documentation of the overall 25% impervious area- b. Attachment B: Summary of all permits covered by the master permit, and their permitted impervious area. c. Attachment C: Summary of all permits covered by the master permit, and their respective permittees. d. Attachment D: Summary of the impervious area per lot allowed for all lots permitted under the 21 individual permits subject to this master permit, SW8 940226. e. Attachment E: Historical Summary and Future Plans 2. Each of the lots and future development tracts is limited to the maximum amount of built -upon area as shown on the application and as indicated on the approved Master Plan. 3. Individual low -density tracts within Sea Trail are permitted for a maximum of 40% built -upon area, as long as adequate sheet flow can be maintained. However, the overall built -upon area percentage for Sea Trail must be maintained at 25% or less, per the requirements of Section 1005 of the stormwater rules. Any individual tract proposing >40% built -upon area will require an engineered system to treat the runoff. 4. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. Page 3 of 11 State Stormwater Management Systems Permit No. SW8 940226 5 Projects covered by this permit will maintain a minimum 30-foot wide vegetative buffer between all impervious areas and surface waters. 6. The permitted impervious area is specified in Attachment A. Wetlands have not been delineated for this project. Prior to any future development; a wetlands delineation map must be submitted. The permitted built -upon area may be reduced if there is a significant amount of wetlands on the site; or certain areas may be considered as high density and required to provide an engineered system to treat the runoff. II. SCHEDULE OF COMPLIANCE Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 4. Per the covenants recorded in BK2520/PG0127 and BK1941/PG764-765, all dwelling units are subject to State Stormwater permitting. The allowable built upon area per Lot shall be restricted to a maximum number of square feet of built upon area, as provided in the Stormwater Permit applicable to said Lot. Impervious area per lot for all dwelling units is as documented in Attachment D. a. The allowable built -upon area per lot is as specified in Attachment D. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not include raised, open wood decking, or the water surface of swimming pools. b. The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the DEMLR. C. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons. d. Each lot will maintain a 30' wide vegetated buffer between all impervious areas and surface waters. e. Lots within the Coastal Area Management Act (CAMA) Area of Environmental Concern (AEC) may have the built upon area reduced due to CAMA's jurisdiction within the AEC. 5. The permittee shall submit a copy of the recorded deed restrictions that indicate the approved built -upon area per lot within 30 days of the date of recording. 6. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 7. No piping shall be allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road. b. That minimum amount needed under driveways to provide access to lots. C. That which is shown on the approved plans for the high -density areas. Page 4 of 11 State Stormwater Management Systems Permit No. SW8 940226 8. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allpwable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from the DEMLR, and responsibility for meeting the built -upon area limit is transferred to the individual property owner. 9. Within 30 days of completion of the project, the permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. 10. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 11 The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision, acquisition, or selling of the project area. f. Filling in, altering or piping any vegetative conveyance shown on the approved plan. g. The construction of permeable pavement for impervious area credit. 12_ The Director may determine that other revisions to the project should require a modification to the permit. 13. The permittee shall submit plans to the Division and receive approval for each low -density future development tract prior to construction. A permit application is required for each high -density future development prior to construction for an engineered system to treat the runoff. Due to the proximity of SA waters, engineered systems will be limited to infiltration systems that can store and infiltrate the runoff generated by 1.5" of rain, or alternative systems that do not discharge in response to the 1.5" design storm. 14. All streets that are curbed must provide either 100' curb outlet swales or 100' of vegetation at regular intervals to treat the road runoff. If the road runoff is collected, it must be permitted for treatment in an existing pond or a new infiltration system or alternative system that does not discharge in response to the 1.5" design storm. 15. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. 16. If the use of permeable pavement for BUA credit within the lot is desired, the permittee shall direct the lot owner to submit an application with all supporting documentation and the application fee to the Division and receive a permit prior to construction of the permeable pavement. III. GENERAL CONDITIONS Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the DEMLR, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. Page 5 of 11 State Stormwater Management Systems Permit No. SW8 940226 2 The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules; and regulations contained in Title 15A of the North Carolina Administrative Code; Subchapter 2H.1000, and North Carolina General Statute 143-215.1 et. al. 5. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; C. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121 e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-6- 07; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which have jurisdiction. If any of those permits result in revisions to the plans, a permit modification must be submitted. 7. The permittee grants permission to DEQ Staff to enter the property during business hours for the purposes of inspecting the stormwater control system and it's components. 8. The permittee shall notify the DEMLR of any name, ownership or mailing address changes within 30 days. 9. Any individual or entity found. to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 10. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. Then, you intend to modify one of those permits to be expanded to contain the other permits and simultaneously request to rescind the permits that are no longer needed. Rice Mill Phases II, III, and IV need to be covered by a State Stormwater permit. b. Future Actions: During the inspection, we discussed that Rice Mill Phases II, III, and IV may be incorporated into SW8 980122, SW8 911202 or SW8 940226. Or, you may obtain new permits for Phase 1I, Phase IIl, or Phase 1V. Or, you may combine these three phases into a single new permit. Please consider your business needs, and decide the best path forward. However, please be advised that Phases II, III, and IV can only be combined with a permit that is issued to an entity who owns the three phases' common areas. c. Pipes under the Swales Along Rice Mill Circle: I understand that there are pipes running underneath the swales along both sides of the road which drain to the south. Each pipe discharges to a pond (which are both believed to be amenity ponds). Please be advised that pipes are prohibited in low density projects. It is unclear why these pipes were installed originally, but they may be in place to help mitigate flooding uphill of the area. The area is stable, and no erosion is present. Flooding still exists uphill due to the overflow of an amenity pond. However, the flooding appears to be outside of the permit's jurisdiction because State Stormwater rules are environmental regulations which do not prohibit flooding. If it is necessary to leave the pipes in place, then please provide written justification in your permit application for doing so. For instance, the water that should be treated in a Swale may have equal or better treatment in the ponds that the pipes drain to. 3. SW8 931002 Sea Trail Barony Place: a. A drop inlet will be added to the plan at the western -most point of Barony Place Drive. No erosion was present. b. Erosion control rocks will be added to the entrance and exit of a pipe flowing under the eastern -most point of Barony Place Drive. No erosion was present. 4. SW8 040604 Sea Trail Eastwood Landing: This project is permitted to drain offsite to SW8 990825 for treatment in the pond. We inspected this project to decide about the pipe because at the time we thought it was a low -density project. But, since it is an offsite project there is no issue with the pipe. Please be advised that until you submit the required Name/Ownership Change Form to the Division and receive approval from the Division to transfer the permit, you are required to comply with the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the permitted stormwater system. On August 5, 2009, the Governor signed Session Law 2009- 406. This law impacts any development approval issued -by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. Permit SW8 990825 has been extended until June 19, 2015 and SW8 010911 has been extended until January 15, 2016. Four other permits, SW8 940405; SW8 960124; SW8 990237; and SW8 000709 have been previously issued extension letters. Copies of those letters are included with their respective permits. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH).
