Salisbury Street, 6th Floor 1612 Mail Service Center OENR 1,AND QUALITY Raleigh,NC 27699-1612 'STORMWATER PERMITTING Re: Town of Stallings 2021 Annual Report(NCS00411141 Dear Jeanette: We are writing this letter in response to the emails we received from you on April 7, 2021 and August 18, 2021 regarding the Town of Stallings Annual Reporting Instructions. On August 6,2020, staff from the North Carolina Department of Environmental Quality(NCDEQ) conducted a compliance audit of the Town of Stallings National Pollutant Discharge Elimination System (NPDES)Municipal Separate Storm Sewer System(MS4)Permit(Permit No.NCS000454). On September 15,2020,NCDEQ issued a Notice of Violation(NOV-2020-PC-0364)to the Town of Stallings. The following actions were required: 1. Respond in writing within thirty(30)calendar days from the date of receipt of the notice to acknowledge these requirements and the intent to comply. On October 10,2020,the Town of Stallings Engineer(Christopher Easterly,P.E.)provided a letter acknowledging the NOV requirements and the intent to comply. 2. Adopt a Council Resolution within sixty(60)calendar days from the date of receipt of the notice. The resolution must declare support for a compliant stormwater management program. On November 9,2020,the Town of Stallings Town Council adopted a resolution declaring support for development and implementation of a compliant NPDES MS4 Stormwater Program. 3. Submit documentation for review and comment within one hundred and twenty(120)calendar days from the date of receipt of the NOV letter: a. Conduct a self-audit which includes,at a minimum,an evaluation of compliance with the permit conditions found in Part II Section F: Post-Construction Site Runoff Controls and Section H: Total Maximum Daily Loads. The self-audit must be documented utilizing the NCDEQ standard MS4 Permit Compliance Audit Report Template. On April 20,2021,the Town of Stallings provided a self-audit to NCDEQ. The self-audit was prepared utilizing the NCDEQ standard MS4 Permit Compliance Audit Report Template. b. Develop a Draft Stormwater Management Plan(SWMP)which details specific actions, measurable goals,and implementation timelines to bring the stormwater management program Telephone 704-821-8557 • Fax 704-821-6841 • www.stallingsnc.org e 1 NPDES MS4 Annual Report Page 2 of 2 into compliance with NPDES MS4 requirements over the new 5-year permit term. The SWMP must be documented utilizing the NCDEQ Phase II MS4 SWMP Template. The SWMP must address all known compliance deficiencies including,at a minimum,the items detailed in the NCDEQ MS4 Program Audit Report and the Town of Stallings self-audit. The Draft SWMP was provided to NCDEQ by Christopher Easterly,P.E. and is currently under review. 4. Submit an NPDES MS4 permit application within thirty(30)days of receiving written NCDEQ concurrence that the submitted Draft SWMP documents a compliant stormwater management program. A new 5-year MPDES MS4 permit will be public noticed along with the submitted SWMP. The Town will submit a new NPDES MS4 permit application within thirty(30)days of received written NCDEQ concurrence that the submitted SWMP documents a compliant stormwater management program. 5. Respond to public comments on the Draft SWMP and submit a Final SWMP for NCDEQ approval and final permit issuance. The final NCDEQ-approved SWMP shall become an enforceable component of the NPDES MS4 permit. The Town will respond to public comments on the Draft SWMP and will submit a Final SWMP for NCDEQ approval upon receiving comments from the public noticing period.
